What to Ask Local Officials Before Approving a Data Center

Before approving a data center, local officials should require a site-specific record showing what will be built, who will use it, how much electricity and water it will need, who pays for new infrastructure, what neighbors will experience, and which promises are legally enforceable. Start with the application, load and water studies, draft permit conditions, fiscal analysis, and a clear map of which local, state, and utility authorities make each decision.

Data centers vary dramatically in size, purpose, cooling technology, power demand, and operating profile. A small enterprise facility and a multi-building campus cannot be reviewed with the same assumptions. The questions below give a practical hearing, staff-review, and negotiation checklist while preserving the distinction between local land-use powers and state or utility regulation.

1. Define the proposal before debating its benefits

Ask the applicant to submit one consistent project description and identify every assumption. Pennsylvania’s Department of Community & Economic Development municipal toolkit treats review as a process that runs from the initial inquiry through zoning, permitting, and long-term planning; it highlights infrastructure, fiscal impacts, legal issues, and community priorities. Use that broad frame instead of deciding on a zoning label alone.

Identity, users, and commitments

  • What is the legal name of the developer and its parent company? Provide ownership, contact, and financial-responsibility information for the applicant and any operating entity.
  • Is an end user or anchor tenant identified? Ask for an executed lease, service agreement, or other evidence supporting the claimed demand. Separate signed commitments from marketing projections.
  • Will the facility serve one customer, several customers, public cloud workloads, artificial-intelligence workloads, cryptocurrency activity, or another use? Different workloads can change power density, cooling, noise, and staffing.
  • Are there parallel site, interconnection, or utility requests elsewhere that could change the scale or timing of this proposal? Maryland’s Executive Order 01.01.2026.16 specifically calls for checking whether stated loads are supported by an identified end user or executed agreements and whether parallel requests exist.

Scale, phasing, and approvals

  • What is the gross building area, equipment yard area, number of buildings, rack or cabinet capacity, and maximum design load?
  • What is the projected peak electrical demand in megawatts, and how does it change by phase? Require a year-by-year schedule rather than one lifetime estimate.
  • What construction phases, expansion triggers, construction hours, and expected operational life are proposed?
  • Which approvals are requested now, and which will follow: rezoning, conditional use, site plan, building permits, utility interconnection, environmental permits, water withdrawals, wastewater, stormwater, air emissions, wetlands, or road work?
  • Which statements are binding commitments and which are estimates subject to change? Put the distinction in the record.

2. Establish who has authority to decide each issue

Do not promise that a local vote can settle matters assigned to another regulator. Michigan’s guidance describes a common division: local governments address land use and community impacts, while state agencies and utility regulators may control electricity, water withdrawals, air emissions, wastewater, wetlands, construction, and related permits. The exact allocation differs by state and utility territory.

Build an authority matrix

Issue Questions for officials Record to request
Land use Does the comprehensive plan support the location? Which zoning district, conditional-use standards, setbacks, buffers, and hearing procedures apply? Current plan, zoning map, code provisions, staff report, and proposed findings.
Utilities Which electric, water, sewer, and telecommunications entities serve the site? What approvals and cost-allocation rules govern them? Utility capacity letters, interconnection studies, tariffs, and regulator filings.
Environmental permits Which state or federal permits cover withdrawals, wastewater, air emissions, wetlands, stormwater, or habitat? Permit applications, technical studies, agency comments, and final conditions.
Enforcement Which body can inspect, compel reports, impose penalties, suspend operations, or revoke a permit? Code-enforcement provisions, draft conditions, appeal routes, and responsible contacts.

Have municipal counsel explain procedural requirements, discretionary standards, and preemption risks. Maryland’s order operates subject to applicable statutes and regulations; it is a state-specific review framework, not a nationwide rule. A local government should publish the jurisdictional map so residents know where to direct questions and objections.

3. Test the electricity plan and ratepayer exposure

Power review must address both physical capacity and cost. A developer’s projected consumption does not show whether the grid can serve it, whether upgrades are needed, or who will pay when the project changes schedule or never reaches full build-out.

Questions about load and reliability

  • What is the full incremental load, including cooling, pumps, lighting, security, offices, battery systems, and future phases?
  • Has the utility received accurate load, ramp-up, power-quality, and timing information? Ask for the assumptions used in the interconnection study.
  • What generation, transmission, substation, feeder, or distribution improvements are required, and on what schedule?
  • What happens if the project’s load arrives earlier, later, or at a different magnitude than forecast?
  • Will backup generators, batteries, or on-site generation operate only during outages, or also for testing, peak shaving, or market participation?

Questions about who pays

  • Which costs are paid directly by the developer, recovered through utility rates, funded by public money, or shared with other customers?
  • Are there security deposits, minimum-demand charges, termination payments, or construction milestones that protect existing ratepayers if a phase is canceled?
  • Could the project defer or accelerate grid work needed by homes and businesses? Require an analysis of reliability and queue effects.
  • What additional clean-energy supply is proposed, and is it matched to the facility over time rather than counted as an unconnected annual purchase?

Maryland’s 2026 executive order identifies load support, infrastructure costs, reliability, and additional clean-energy supply as review considerations. The utility and regulator process in another jurisdiction may use different tests, so officials should name the controlling tariff and agency rather than presenting Maryland’s approach as universal.

4. Determine whether water resources and wastewater systems can handle the facility

Ask for withdrawals and consumption by source and season, not a single annual average. Cooling design can make the difference between a manageable industrial use and a serious stress on a water system or aquifer.

Water-supply questions

  • What are maximum daily, monthly, and seasonal withdrawals and consumptive losses? Identify municipal potable water, groundwater, surface water, reclaimed water, and other sources separately.
  • Does the local water supplier have to approve the demand, and what capacity, allocation, or service-extension rules apply?
  • How could demand affect existing users, drought reserves, water quality, aquifers, surface waters, or sensitive resources? Require analysis of low-flow and drought conditions.
  • What water-quality treatment, storage, redundancy, metering, leak detection, and public reporting will be required?

Cooling alternatives

  • Why was the proposed cooling system selected? Compare closed-loop, air-cooled, reclaimed-water, and other non-potable options on water use, energy use, noise, emissions, and reliability.
  • What operating conditions cause the highest consumption, and can the facility reduce demand during drought or declared emergencies?
  • Are evaporative systems, cooling towers, humidification, or blowdown discharges included in the calculations?

Wastewater and stormwater

  • What wastewater streams will be produced, including cooling-tower blowdown, treatment residuals, sanitary flow, and chemical cleaning water?
  • Can the sewer plant accept the flow and pollutant load during all phases? Who pays for capacity upgrades?
  • What stormwater volume, heat, chemical, and flood risks arise from roofs, parking, equipment yards, and fuel storage?
  • Which drought, water-quality, wastewater, and public-disclosure conditions will appear in permits?

St. Louis used one local permit to require a closed-loop system and air-cooled chillers. That demonstrates an available local approach, not a requirement that automatically applies elsewhere. Officials should rely on their own water utility, permitting record, and applicable law.

5. Specify what neighbors will experience

Require baseline measurements and operating scenarios before approval. Generic statements that equipment will be quiet or generators will run rarely are not enforceable performance standards.

  • What heat, noise, and vibration buffers are proposed? Are setbacks measured from residences, schools, hospitals, or property lines?
  • Can fire, medical, hazardous-materials, and law-enforcement services reach the site? What equipment, training, staffing, and cost reimbursement are needed?

Monitoring and complaints

  • Which baseline data will be public before construction, and which post-opening measurements will be published?
  • Who receives complaints, how quickly must the operator respond, and what independent verification is available?
  • Do permit conditions require corrective action, fines, operating limits, or suspension when standards are exceeded?

6. Calculate net fiscal and employment effects

Headline investment and tax numbers can obscure public costs. Request a transparent estimate that subtracts tax incentives, infrastructure work, new service demands, emergency preparedness, and any subsidy.

Fiscal questions

  • What property, sales, utility, or other tax revenue is expected each year, by taxing body?
  • Which abatements, credits, exemptions, grants, discounted land, or infrastructure contributions reduce that revenue?
  • What will the locality spend on roads, water, sewer, fire protection, police, inspections, planning, and long-term maintenance?
  • What is the net fiscal impact under low, expected, and delayed build-out scenarios?

Employment questions

  • Separate temporary construction jobs from permanent operations, maintenance, security, and administrative positions.
  • State expected wages, benefits, local hiring, apprenticeship places, workforce training, and contractor standards.
  • Set measurable targets, deadlines, reporting intervals, and remedies for missed commitments.

One St. Louis community-benefit term sheet projected 200 full-time jobs for the broader development, first-year tax revenue of $27.4 million for the City and $33.4 million for St. Louis Public Schools, a contribution of $30 per square foot, and an estimated $15 million city fund. Those figures describe that particular project and should not be treated as a general data-center benchmark.

7. Turn community benefits into enforceable obligations

Ask whether benefits will be conditions of approval, a development agreement, a community benefits agreement, or merely a public statement. The document should bind successors and remain effective through expansion, sale, refinancing, and decommissioning.

Terms that belong in the agreement

  • Exact dollar amounts or in-kind deliverables, payment dates, eligible uses, and inflation or escalation rules.
  • Responsible parties, reporting format, independent audit rights, annual publication, and public meeting requirements.
  • Expansion triggers that reopen benefits, infrastructure, water, power, and neighborhood-impact analysis.
  • Successor obligations that bind a purchaser or new operator.
  • Remedies for missed payments, inaccurate reports, permit violations, and failure to correct impacts.
  • Decommissioning, equipment removal, site restoration, financial assurance, and abandoned-phase obligations.

Maryland’s framework emphasizes reporting, successor obligations, remedies, and periodic review. St. Louis states that specified permit conditions can support permit revocation if uncorrected and that the city may seek legal recourse on agreement terms. Officials should have counsel confirm what remedies their own law permits.

8. Compare proposals and locations on one record

When evaluating alternatives, require the same data fields and scenarios for every site. There is no universal weighting formula, so publish the assumptions and let elected officials explain the trade-offs.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
Comparison axis Evidence to compare
Land use Zoning fit, comprehensive-plan consistency, distance from homes and sensitive uses, buffers, and expansion area.
Electricity Peak demand, phase timing, grid upgrades, reliability effects, clean-energy matching, and cost allocation.
Water Source, seasonal availability, cooling method, consumptive use, drought performance, wastewater, and aquifer or surface-water effects.
Community impacts Noise, generator emissions, traffic, lighting, heat, visual screening, emergency services, and monitoring.
Public finances Net revenue after incentives and service costs, infrastructure obligations, and sensitivity to delayed or partial build-out.
Enforceability Specific benefits, deadlines, reporting, remedies, successor obligations, expansion review, and decommissioning security.

9. Use a public-review checklist before the vote

  1. Publish a plain-language project description, ownership chart, site plan, phase schedule, peak-load forecast, water budget, and list of requested approvals.
  2. Obtain independent or regulator-reviewed electricity, water, wastewater, traffic, noise, air, fiscal, and emergency-service analyses where local staff lack the expertise.
  3. Map each decision to the responsible local, state, federal, utility, or regulatory body and identify appeal and comment deadlines.
  4. Hold a hearing after technical studies are available, not only after a development agreement has been negotiated.
  5. Write measurable conditions into the permit and agreement, including monitoring, reporting, remedies, expansion triggers, successor duties, and decommissioning.
  6. Publish a compliance calendar and designate the official responsible for receiving reports and complaints.
  7. Review performance periodically against actual power, water, employment, fiscal, noise, traffic, and emissions data.

10. Questions residents can ask at a hearing

  • What is the maximum—not average—electricity and water demand, and during which seasons or operating conditions does it occur?
  • Which upgrades are needed, what will they cost, and what prevents those costs from shifting to existing customers?
  • What evidence shows that the claimed load and jobs are backed by an identified user and binding commitments?
  • What happens to water service and aquifers during drought or a low-flow year?
  • What noise, generator, traffic, lighting, heat, and emergency-service limits will be enforceable on day one?
  • Who can inspect, order corrections, impose penalties, or revoke approval if conditions are violated?
  • What obligations survive a sale, expansion, bankruptcy, or shutdown?

Mayor Cara Spencer summarized the policy choice in St. Louis’s April 21, 2026 announcement: “We want St. Louis to be open for business, but business on our terms; that means we’re only going to allow the development of data centers if the community benefits.” The practical test is whether those terms are specific, funded, monitored, and enforceable for the actual site.

11. Keep the legal and geographic limits clear

The Pennsylvania toolkit is a state resource for Pennsylvania municipalities; Michigan’s authority discussion describes Michigan; Maryland Executive Order 01.01.2026.16 applies to Maryland; and St. Louis conditions belong to one local permit. None creates a nationwide legal requirement. Confirm current zoning, state permits, utility rules, water law, and counsel’s advice for the proposal in front of you. A bill or policy discussed elsewhere should not be described as current law until its enactment and effective date are verified.
