Before leasing space in a data center that advertises hydrogen or other green fuels, verify how power reaches your equipment, what fuel is actually used, how the site performs when a supply fails, and who pays or bears the risk if promised service or fuel attributes fall short. A “hydrogen-powered” label alone does not establish that hydrogen serves all of your load, that the hydrogen is renewable, or that the facility can keep operating through a grid outage.
What should I ask before leasing space in a data center? Ask for evidence about the entire power chain and the lease terms that apply to outages, fuel changes, permits, costs, and reporting—not just a sustainability statement or a generator specification.

Start by mapping the facility’s power system
A data center can combine utility electricity, contracted renewable electricity, onsite generation, batteries, and backup generators. Fuel cells may supply some or all of the site’s power at some times, but a fuel-cell installation does not by itself explain how the facility runs during grid disruption or a fuel interruption.

- What contracted capacity is available to your tenancy, at what voltage and delivery point, and when is it firm and usable?
- Is the facility grid-connected, islanded, or capable of both modes? Identify each utility feed, interconnection or tariff, onsite generator, battery, and transfer path.
- What share of your load comes from each source in normal operation and during grid events? Ask for interval or hourly data supporting any time-matched renewable claim.
- Is the generation dedicated to the facility or shared with other loads? Who controls dispatch, and which loads receive power first when supply is scarce?
- What equipment or supply arrangements are shared between tenants, and where are the common-mode failure points?
Ask for a one-line electrical diagram, a description of operating modes, and a clear definition of the contracted delivery point. If the operator cannot connect its source-level claims to the path supplying your contracted capacity, treat the claim as unverified for your lease decision.
Is the data center’s hydrogen actually renewable?
Ask what fuel is used in practice—not only what fuel the equipment could use. The answer might be hydrogen, biogas or biomethane, renewable natural gas, synthetic methane, a blend, or a conventional fuel. For hydrogen, ask whether it is made by electrolysis or from fossil feedstock, whether carbon capture is used, who supplies it, and what lifecycle boundary and emissions factors support the operator’s claim. The accounting should explain how upstream electricity, production, processing, and transport are treated.
Request evidence for the fuel attribute
- Which certificates, registry entries, chain-of-custody records, supplier statements, or independent assurance support the claimed fuel attributes?
- Do the records identify the quantity, production period, source or pathway, and facility to which the attributes are assigned?
- Can you audit the records and the emissions calculation, and does the lease require the operator to retain them?
- What happens if the supplier changes, the fuel is unavailable, or the fuel no longer qualifies under the standard named in the lease?
Apply EU criteria only where they govern or are contractually claimed
Under the European Commission’s summary of the EU renewable-hydrogen framework published in 2023, qualifying renewable hydrogen must meet a greenhouse-gas savings threshold of at least 70% and criteria that include additionality and temporal and geographic correlation. The Commission describes power purchase agreements with new and unsupported renewable electricity generation capacity as part of the criteria, alongside a transitional allowance involving existing renewable installations until 1 January 2028. These are EU-specific requirements, not a global definition of renewable hydrogen. If an operator relies on this framework, ask which methodology and operative legal requirements it applies to the particular supplier and production period; do not assume the EU classification governs a site elsewhere.
A useful answer identifies the claimed standard, the calculation boundary, the evidence supporting each criterion, and the party responsible for keeping the claim current. A marketing label without those details is not enough to establish the fuel’s provenance or emissions intensity.
Test reliability across the whole chain
Reliability is not a property of the fuel cell alone. It depends on utility feeds, switchgear, generation, fuel inventory, delivery arrangements, batteries or UPS, cooling, controls, maintenance, and the transfer logic connecting them. Ask for the system design and operating evidence at the contracted load, not merely the maximum rating of one component.

- PCI & HIPPA and EIA/ECA-310-E compliant
- What redundancy exists from the utility connection through switchgear, onsite generation, UPS, cooling, and fuel storage? Are the paths independently operable end to end?
- What runtime has been tested at the load level covered by your contract for batteries and onsite generation? What fuel inventory and resupply arrangements support that runtime?
- How does the site transfer load between grid and onsite sources, and what interruption or capacity restriction can occur during a transfer?
- What are the historical outage, generator-test, maintenance, and SLA-performance records? Request the period covered and the method used to calculate uptime.
- What supplier delivery obligations, backup supply, storage capacity, and interruption rights apply to the fuel? What is the contingency if deliveries stop?
The EU’s Commission Delegated Regulation (EU) 2024/1364 defines data-centre redundancy as “the duplication of certain sets of components or functions of a data centre in such a way that if one set fails or needs to be taken down for maintenance, the other set or sets can take over.” Ask the operator which duplicated components or functions meet that description, and whether a single utility connection, fuel source, storage system, control system, or maintenance dependency can defeat the apparent redundancy.
Read the SLA against actual failure scenarios
Check whether the service-level agreement addresses utility interruption, onsite-power failure, fuel unavailability, planned maintenance, and curtailment. Identify required notice, service credits, outage remedies, termination rights, and any exclusions. A generic uptime commitment may not tell you what happens when the fuel or operating mode central to the sustainability claim is unavailable.
Check permits, water, emissions, and local constraints
Permits and operating limits depend on location and system configuration. Ask which entity holds permits for generation, fuel storage, air emissions, water withdrawal and discharge, noise, and land use. Request copies, compliance history, and the status of any pending approvals. Establish the applicable limits on generator hours, testing, emissions, fuel storage, and emergency operation, and what happens if a permit is delayed, appealed, modified, or revoked.
Jurisdiction-specific examples illustrate why a general “permitted” assurance is insufficient. The California Energy Commission describes state review pathways, including Small Power Plant Exemption and certification pathways, for some thermal plants associated with data centers; backup generators also require permits, and other approvals may apply. In a July 27, 2026 announcement, the U.S. Environmental Protection Agency described guidance that the Acid Rain Program does not apply to certain non-grid-connected islanded generation facilities. That is a specific interpretation, not a finding that islanded plants are exempt from other federal, state, or local air, water, or land-use requirements. Pennsylvania’s 2026 GRID Requirements apply to qualifying proposals in that state and include provisions addressing energy, water, backup generation, and emissions; they are not a national standard.
For water, request the source, cooling approach, annual consumption, maximum-day demand, discharge information, drought restrictions, and any recycling or closed-loop plans. For air and climate impacts, request emissions for normal operation, testing, and emergency events, with the facility boundary, methodology, and verification status stated. Ask whether reports cover the whole facility or only a particular generator or tenant allocation.

Require auditable data with clear boundaries
Agree on the metrics, boundaries, intervals, and evidence you will receive before signing. EU Delegated Regulation 2024/1364 is one example of a defined facility-level approach: it includes fuels and other energy sources in total facility energy measurement and requires backup-generator energy to be measured separately. It specifies measurement at primary and secondary supplies and at additional supplies such as backup generation. Those rules have their own legal scope, but their measurement boundaries are useful questions for any site: where is each number measured, what equipment does it include, and how is it distinguished from tenant load?

- Facility energy by source, with the measurement boundary and interval stated.
- Backup-generator energy and runtime, reported separately from other supply where possible.
- Fuel consumption, supplier and pathway information, and evidence for renewable attributes.
- Water use, including annual totals and peak-day demand, plus source and discharge details.
- Emissions methodology, factors, boundary, and independent assurance status.
- Changes to fuel suppliers or pathways, certificates, emissions factors, onsite generation, utility arrangements, and permits.
State how records are retained, how quickly material changes must be reported, and what access you have to supporting documents. Pennsylvania’s 2026 GRID requirements and EU reporting rules provide examples of jurisdiction-specific measurement and logging provisions; confirm whether either applies to the site rather than treating its requirements as universal.
Allocate power, fuel, and regulatory risk in the lease
Translate operational promises into contract terms. The lease and related service agreements should say what is being supplied, how the operator substantiates any fuel attribute, and what remedy applies if capacity, reliability, reporting, or legal operation falls short.
- Define contracted capacity, delivery point, supply priority during scarcity, and any curtailment rights.
- Specify representations about power capacity, fuel attributes, permits, reporting, and compliance, together with recordkeeping and audit rights.
- Require notice and, where appropriate, consent or a remedy for changes to fuel source, production pathway, emissions factors, generation, utility arrangements, or permits.
- Set responsibility for grid upgrades, fuel-price changes, balancing, backup, taxes, and infrastructure costs. Examine pass-through definitions, caps, supporting records, and audit rights.
- Define outage credits, cure periods, relocation or termination rights, and the treatment of fuel interruption or loss of a claimed qualification.
- Allocate change-in-law risk and explain what happens if an approval is delayed, altered, challenged, or withdrawn.
Enforceability depends on the governing law and the transaction. Have local counsel align the lease, SLA, power arrangements, and any sustainability representations so one document does not promise what another allows the operator to change.
Compare sites without collapsing the trade-offs into one “green” score
Use the same questions and evidence requirements for every candidate. A site with lower claimed emissions may still have higher price volatility, weaker fuel security, limited transparency, or different outage and water risks. Record the source and date of each answer, and distinguish a measured or audited result from a forecast or marketing claim.
| Comparison area | What to compare across sites |
|---|---|
| Delivered cost | Contracted energy and infrastructure charges, pass-through exposure, fuel-price volatility, and audit or cap protections. |
| Emissions and fuel claims | Lifecycle boundary, emissions factors, fuel pathway, renewable-attribute evidence, and assurance quality. |
| Supply security | Grid dependence, dispatchability, fuel availability, onsite storage, resupply, and shared supply obligations. |
| Outage resilience | Tested performance at contracted load, end-to-end redundancy, common failure points, maintenance history, and SLA remedies. |
| Water and local impacts | Water source and demand, cooling and discharge, local pollutants, generator limits, and permit status. |
| Transparency and risk allocation | Reporting boundaries and intervals, document access, change notices, pass-through controls, and remedies for shortfall or regulatory change. |
Choose according to the requirements that matter to your operation, and keep the evidence trail alongside the comparison. A label cannot substitute for verified supply, measurable performance, and enforceable remedies.
