What the Supreme Court Can Decide on an Emergency Application—and What It Cannot

The Supreme Court can grant, deny, modify, or refer an emergency application, but only within the relief requested and the procedural posture presented. Most applications seek temporary action—especially a stay that pauses a lower-court order while an appeal or possible Supreme Court review continues. Granting a stay generally preserves the status quo; it does not automatically decide who ultimately wins the case.

The controlling language is the Court’s actual order. It may limit relief to one injunction, specify an end date or terminating event, and expressly reserve broader legal or factual questions. Read the order, the cited lower-court rulings, and the current docket together.

What an emergency application is

The Supreme Court’s Public Information Office defines an application as “a request for emergency action addressed to an individual Justice.” Unlike a petition for certiorari, which asks the Court to accept a case for full review, an emergency application asks for immediate action while ordinary appellate proceedings continue or before the Court decides whether to hear the case.

A stay is the most familiar request. A stay temporarily prevents a judgment or injunction from taking effect, or pauses enforcement of an order already in effect. Other applications can seek an injunction, an extension of time, release from a procedural requirement, or another form of relief authorized by law. The Court can act only on the relief actually requested and on the record presented; an emergency application is not a vehicle for deciding every issue in the underlying dispute.

What the Court can do

Grant the requested relief

The Court may grant a stay or other emergency remedy in whole or in part. A partial order can pause only a specific provision, geographic area, agency action, or deadline. The text controls: “stayed” does not necessarily mean that every consequence of a lower-court judgment is suspended.

Deny the application

A denial leaves the challenged lower-court order in effect unless another court changes it. A denial of emergency relief is not necessarily a ruling that the lower court was correct on the merits. It may reflect the applicant’s failure to satisfy the demanding requirements for interim relief, an inadequate record, a procedural defect, or the availability of relief elsewhere.

Modify or condition relief

An order can impose narrower terms than the applicant requested, preserve only part of the status quo, or attach a duration and terminating event. The operative paragraphs—not headlines, commentary, or a party’s description—determine what is enforceable.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Refer the application to the full Court

An application is ordinarily addressed to the Justice assigned to the federal circuit where the case arose. Under Rule 22, a Justice who receives a stay application may refer it to the full Court. The full Court can then grant, deny, or otherwise dispose of the request.

Allow renewal in limited circumstances

A Justice who denies an application may permit renewal before another Justice in circumstances described by Rule 22. Renewed applications are not favored, so a party should not assume that filing the same request again will produce a second opportunity.

What the Court generally cannot decide on that application

Questions outside the requested emergency relief

The Court does not automatically decide every constitutional, statutory, factual, or policy question implicated by the broader lawsuit. If the application asks only to pause a preliminary injunction, the emergency order may address whether that pause is justified—not the ultimate legality of the challenged program.

A final merits judgment merely by granting a stay

A stay is provisional. It preserves conditions while appellate review proceeds and may be issued without a full merits record or oral argument. Even when the Court gives reasons, those reasons should not be read as a final holding unless the order unmistakably resolves the legal question.

Relief that was not first sought below, absent extraordinary circumstances

Rule 23 requires an applicant to explain specifically why relief is unavailable from another court or judge. Except in the most extraordinary circumstances, the Supreme Court will not entertain a stay request unless the applicant first sought relief in the lower courts. The emergency docket is not a routine substitute for asking the district court or court of appeals to act.

Facts or claims not in the record

Emergency decisions are commonly made on written submissions. The Court cannot reliably adjudicate factual disputes that were never developed below, and an application cannot expand the record simply by asserting new evidence. The scope of review depends on the orders, opinions, filings, and other materials submitted under the Rules.

How an application reaches a Justice or the full Court

Rule 22: filing and assignment

The Supreme Court Rules adopted February 17, 2026, and effective March 16, 2026, are the current rules identified by the Court’s Rules and Guidance page. Rule 22 provides that an application addressed to an individual Justice is filed with the Clerk. If that Justice has authority to grant the requested relief, the Clerk promptly transmits the application.

The application is generally addressed to the Justice assigned to the circuit in which the case arises. The receiving Justice can act alone, deny the request, permit a renewal in the situations covered by the Rule, or refer a stay application to the full Court.

Rule 23: requirements for a stay

Rule 23 permits a party to a judgment sought to be reviewed to apply for a stay of enforcement. The application should identify the judgment, append the relevant order and opinion, include the lower-court denial, and give particular reasons why a stay is justified and why relief is unavailable elsewhere.

The Rule’s lower-court-first requirement has a practical consequence: an applicant should create a clear record of what was requested in the district court and court of appeals, what those courts did, and why immediate Supreme Court intervention is necessary. Skipping that sequence risks summary rejection unless the circumstances are truly extraordinary.

The factors normally considered for a stay

The Supreme Court Public Information Office’s reporter guide summarizes four general criteria drawn from the Court’s case law. They are guideposts, not a guarantee that any application will succeed:

  • Probability of review: a reasonable probability that four Justices will vote to grant review of the underlying case.
  • Prospect of error: a fair prospect that a majority will conclude the decision below is erroneous.
  • Irreparable harm: a showing that denying interim relief would cause harm that cannot be repaired adequately later.
  • Balance and public interest: in a close case, comparison of the harms to each side and consideration of the public interest.

The first two factors concern the eventual appellate path, while the latter two address the immediate consequences of allowing the lower-court order to operate. The Court may weigh the factors together rather than treat any one as dispositive.

Who decides and what vote is needed

Decision point What the official guide says Practical meaning
Individual Justice An application is addressed to the Justice assigned to the circuit; a stay request may be referred to the full Court. The first decision maker may act alone or send the matter to all Justices.
Granting certiorari Four Justices are described as sufficient to grant review. This is the threshold for accepting the underlying case, not a finding that emergency relief should issue.
Granting a stay by the full Court Five Justices must agree when the full Court acts on an application. The vote requirement concerns the interim stay, not the final merits judgment.

Not every emergency application produces a detailed opinion or a recorded vote. The Court’s guide says applications are typically handled “on paper,” meaning there are normally no hearings or oral arguments. The Court also reports that the vast majority of filed cases are disposed of summarily by unsigned orders.

A practical step-by-step path

  1. Identify the exact order to be paused or changed. State the court, date, case number, operative command, and the date the order will take effect.
  2. Seek relief below first. Ask the issuing court or the next appellate court for a stay or comparable relief, unless extraordinary circumstances make that route unavailable.
  3. Build the required appendix. Include the judgment or order, the relevant opinion, the lower-court ruling on emergency relief, and the other materials required by the Rules.
  4. Explain the four stay considerations. Connect the asserted irreparable harm and public interest to concrete consequences, and explain why the lower-court decision is likely wrong and review is reasonably probable.
  5. Address jurisdiction and circuit assignment. Direct the application to the Justice assigned to the circuit where the case arose and explain why that Justice has authority to grant the requested relief.
  6. File with the Clerk and monitor transmission. Electronic submission alone does not cause the Clerk’s Office to review an emergency application. The Court’s filing FAQ instructs parties whose applications require prompt action in unique circumstances to contact the Clerk’s Office by telephone.
  7. Read the resulting order word for word. Determine what is stayed, what remains in force, whether the order is referred to the full Court, and what event ends the relief.

Duration matters as much as the word “stay”

An emergency order can last until a specified date, until a lower-court appeal is resolved, until the Court acts on a timely certiorari petition, or until another event stated in the order. It may terminate automatically rather than require a second filing.

For that reason, a party should calendar every trigger in the order and distinguish the stay’s duration from the underlying case’s duration. A stay can expire while the merits appeal continues, or it can continue through a certiorari decision without resolving the legal dispute.

Example: Trump v. American Federation of Government Employees

In docket 24A1174, the government sought emergency relief after lower courts enjoined implementation of an executive order and related memorandum. On July 8, 2025, the Supreme Court stayed the district court’s preliminary injunction while the Ninth Circuit appeal proceeded and while the Court could consider any timely certiorari petition.

The order specified two endpoints: the stay would terminate automatically if certiorari were denied, or when the Court sent down its judgment if certiorari were granted. Those clauses show why an emergency order must be read for its procedural triggers rather than summarized simply as “the Court sided with” one party.

The order also stated that the agency plans themselves were not before the Court and that the Court expressed no view on their legality. The practical effect was temporary relief from the injunction, not a final ruling approving or invalidating those plans. Any later merits decision would require the appropriate appellate process and a record addressing the plans directly.

How to tell a temporary order from a merits decision

  • Look at the relief verb. “Stay,” “temporarily enjoin,” or “pending” signals interim action; “affirm,” “reverse,” or a judgment resolving the legal question signals merits disposition.
  • Check the pending proceedings. References to a circuit appeal, a possible certiorari petition, or the Court’s future judgment indicate that review remains open.
  • Find express reservations. If the order says an issue is not before the Court or that no view is expressed on legality, that reservation limits what the order decides.
  • Read the endpoint. Automatic termination clauses often reveal that the order is designed to preserve the status quo only until a defined procedural event.

Where to verify the current order

Use the Supreme Court docket for the specific case and the Court’s Orders of the Court page for miscellaneous and scheduled orders. Confirm the docket number, filing date, and operative language rather than relying on a news report or a party’s description.

The Court warns that electronic orders can contain computer-generated errors or other deviations. If an electronic version conflicts with the later official printed version, the printed version controls. That warning is especially important when a deadline, geographic limitation, or termination clause determines what parties may do.

Common mistakes and how to avoid them

Calling every emergency filing an “appeal”

An application is a request for immediate relief; it does not itself place the entire case on the Court’s merits docket. The underlying appeal and any petition for certiorari remain separate procedural steps.

Assuming a denial validates the lower court

The Court can deny interim relief without deciding that the lower court’s reasoning is correct. The denial means the requested emergency remedy was not granted on that application.

Ignoring the lower-court record

Failure to show what relief was sought below, or why it was unavailable, conflicts with Rule 23’s requirements and can make emergency intervention unlikely.

Stopping after the first electronic filing

Electronic delivery does not itself trigger Clerk’s Office review. When timing is critical, follow the filing FAQ’s direction to contact the Clerk’s Office by telephone in unique circumstances requiring prompt action.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Reporting a stay as a final policy ruling

Use the order’s own limits. If it pauses an injunction and reserves the legality of an agency plan, describe it as a pause—not as approval, invalidation, or a final interpretation of the plan.

Bottom line for readers

The Supreme Court’s emergency power is real but bounded. It can provide immediate, often temporary relief, route an application to the full Court, or refuse to intervene. Rule 23’s lower-court-first requirement, the stay factors, the assigned Justice’s authority, and the exact duration written into the order all constrain that power. A stay preserves the status quo while review continues; only a decision that actually reaches the merits resolves the underlying legal question.
