An H-1B is a temporary U.S. employment classification for a specific specialty-occupation job. The employer—not the worker acting alone—normally starts the case by obtaining a Department of Labor (DOL) Labor Condition Application (LCA) and filing Form I-129 with U.S. Citizenship and Immigration Services (USCIS). A worker outside the United States may then need a separate visa application through the Department of State (DOS). An approved petition, a visa stamp and admission to the United States are different steps.
This guide explains who qualifies, how the employer-led process works, the annual numerical limits, worker protections and the reported September 2025 proclamation. Immigration rules can change quickly, so confirm the current instructions for your case with USCIS, DOS and DOL before filing or traveling.

What is an H-1B visa?
In everyday conversation, “H-1B visa” often means the entire route to temporary employment in the United States. Legally, the H-1B is a nonimmigrant employment classification. It lets a qualifying U.S. employer employ a foreign worker in a particular specialty-occupation position under the terms approved by USCIS.

A degree in any subject does not automatically make any position H-1B-eligible.

The classification is tied to the petitioning employer, the job and the stated employment conditions. It is not an open work permit that a person can obtain independently and then use for any employer. Changing employers, work locations or material job duties can require a new or amended filing.
Who applies for an H-1B: the employer or the worker?
The employer generally leads the process. The worker supplies education, experience and identity information, but the employer must establish that it has a qualifying job and must accept the legal obligations attached to H-1B employment.
- Employer: Defines the position, determines the required qualifications, obtains the LCA and files Form I-129 with USCIS.
- Worker: Provides passports, degrees, transcripts, credential evaluations when needed, résumé and immigration-history details, and follows the visa or status instructions that apply.
- DOL: Reviews the LCA, which contains the employer’s attestations about wages and working conditions.
- USCIS: Decides the employer’s petition and the requested classification or change of status.
- DOS: Handles visa issuance at a U.S. consulate or embassy when a worker outside the United States needs a visa to seek admission.
A petition approval does not itself place a visa stamp in a passport. Likewise, a visa allows a traveler to request admission; U.S. Customs and Border Protection makes the admission decision at the port of entry.
How does the H-1B process work?
The sequence below is the ordinary employer-sponsored route. The exact filing package differs for a first petition, an extension, a transfer, a change of employer, a change of status or a consular case.
1. The employer and worker match a qualifying job
The employer identifies a real position, its duties, worksite or worksites, required degree field and offered salary. The role must call for highly specialized knowledge and normally at least a bachelor’s degree or equivalent. USCIS evaluates the position and the worker’s credentials together; a job title alone does not establish eligibility.
2. The employer files a Labor Condition Application
Before submitting the H-1B petition, the employer files Form ETA-9035/9035E, the LCA, with DOL. The DOL H-1B program explanation says the employer must attest to required program conditions, including paying the required wage and maintaining the stated working conditions.

The required wage is generally the higher of two figures: the actual wage the employer pays similarly qualified employees in the job, or the prevailing wage for the occupation and area. DOL summarizes this as “whichever is greater.” The certified LCA is included with the later USCIS petition.

3. The employer files Form I-129 with USCIS
After the LCA is certified, the employer submits it with Form I-129 and supporting evidence to USCIS. The filing identifies the employer, position, worksite, wage, requested dates and the worker’s qualifications. USCIS reviews whether the petition requirements are met and may request additional evidence. A filing receipt is not an approval, and an approval is not yet a visa or admission.
4. The worker follows the path for their location
The next step depends primarily on where the worker is and what immigration status the worker holds.
| Worker’s situation | What usually follows petition approval | Important distinction |
|---|---|---|
| Outside the United States | Apply for an H-1B visa through DOS procedures, attend any required interview and seek admission at a U.S. port of entry. | A visa application and border admission are separate decisions from USCIS petition approval. |
| Already in the United States in a qualifying status | The employer may request a change of status or extension through the USCIS petition, if the facts support it. | A person may have valid status without needing a new visa stamp until traveling abroad; travel can create a separate visa requirement. |
| Changing H-1B employers | The new employer generally files its own petition and must meet the LCA and specialty-occupation requirements. | Do not assume approval for one employer automatically authorizes work for another. |
The DOL elaws H-1B Advisor explains the broad distinction between the employer petition and the later visa or status process. Because travel history, maintenance of status and the requested classification affect the correct route, use the current USCIS and DOS instructions for the individual case.

|---|---|---|
| Regular cap | 65,000 | The statutory regular numerical limit reported by DOL for each year. |
| U.S. advanced-degree exemption | 20,000 additional places | Additional places for qualifying beneficiaries with a U.S. master’s degree or higher, subject to the applicable rules. |
These figures are limits, not a promise that a particular worker will be selected, approved or admitted. Cap-subject registration and selection procedures, exemption rules and filing instructions are administered under current USCIS guidance. Some employers and petitions can fall outside the cap, but the exact exemption must be confirmed from the facts and the current agency instructions; do not treat every nonprofit, research or higher-education job as automatically exempt.
What happens after an H-1B petition is approved?
Worker outside the United States
The worker normally uses the USCIS approval information to begin the DOS visa process at the appropriate U.S. embassy or consulate. DOS may require a completed visa application, an interview and supporting documents. If the visa is issued, the worker may travel and request admission. The visa does not guarantee entry; admission is decided at the port of entry, and the authorized stay is reflected in the admission record.
Worker already in the United States
If the petition includes an approved change of status or extension, the worker follows the validity dates and conditions stated in the USCIS decision. A visa stamp is generally a travel document, not the same thing as maintaining status inside the country. Leaving the United States can require consular visa processing before the worker returns.
When the petition, visa and admission do not line up
An approved petition can expire, be revoked or cover different dates from a visa. A visa can remain unexpired while the underlying petition or employment has changed. Check the approval notice, passport visa, admission record and employer details together before starting work or traveling.
What does the September 2025 H-1B proclamation mean?
DOS reports that a Presidential Proclamation dated September 19, 2025 restricts visa issuance and entry for certain H-1B cases based on petitions filed after September 21, 2025, at 12:01 a.m. Eastern Daylight Time. DOL’s current H-1B program page describes covered issuance as restricted except where the petition is accompanied or supplemented by a $100,000 payment.

This is a narrowly dated and fact-dependent policy. The agency descriptions do not establish that every H-1B worker, every petition or every existing visa is covered. Exceptions, implementation details, litigation and later guidance can change the practical result. Before filing, scheduling a visa appointment or traveling, read the current DOS proclamation notice and the DOL H-1B program update, and check current USCIS instructions. Do not assume that paying the stated amount resolves every eligibility or admission issue.
Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone. What wages and workplace protections apply?
H-1B status comes with enforceable labor protections. According to DOL’s H-1B worker guidance, the worker is entitled to the applicable required wage, comparable working conditions and fringe benefits on the same basis as U.S. employees in the relevant situation.
- The employer must pay at least the required wage—the greater of the actual wage or prevailing wage stated through the LCA process.
- The employer may not shift certain petition filing fees or employer business expenses to the worker.
- An employer generally may not impose a financial penalty on the worker for leaving employment early when the penalty would violate the applicable rules.
- The worker should receive information about the LCA and retain a copy when available.
- Keep personal records of hours, pay, worksite, job duties and employer communications.
A suspected underpayment, impermissible fee or retaliation issue should be raised with DOL or qualified immigration counsel. The correct remedy depends on the facts; a worker should not stop reporting to work or travel on the assumption that a complaint automatically changes immigration status.

What documents and facts should applicants prepare?
The exact evidence list depends on the petition type, but organizing the following early helps the employer and counsel identify gaps:
- Passport biographical page and current immigration documents.
- Diploma, transcripts and evidence of degree equivalency when the degree was earned abroad.
- Résumé, employment letters, licenses and records supporting specialized skills.
- A detailed job description showing duties, required degree field and the connection between the role and the worker’s education.
- Worksite, client-site or itinerary information when services will be performed away from the employer’s main office.
- Prior approval notices, I-94 admission records and a complete history of U.S. entries, exits and status changes for extensions or changes of status.
Inconsistent job duties, an unexplained worksite, a wage below the applicable requirement or a degree that does not relate to the position can lead to questions or a request for evidence. Never alter documents or omit a prior immigration event to make the case appear simpler.

Common mistakes to avoid
Confusing a visa with an approved petition
A petition is the employer’s request for classification. A visa is issued by DOS for travel. Admission is decided at the border. Treating these as interchangeable can cause unlawful work or travel plans.
Assuming any bachelor’s degree is enough
The degree must be relevant to the specialty occupation or otherwise satisfy the equivalent-qualification rules. The position itself must also require specialized knowledge.

Relying on old policy information

Assuming an exemption without checking
The 65,000 and 20,000 figures describe cap limits, while cap-exempt treatment depends on the employer and petition facts. Obtain a current determination before planning around an exemption.
Quick Recap
A practical decision checklist
- Confirm that the employer, job duties and worksite are real and clearly documented.
- Map the required degree or equivalent qualification to the specialty occupation.
- Ask the employer how it will determine the actual and prevailing wages.
- Determine whether the case is cap-subject or potentially exempt under current USCIS rules.
- Identify whether the worker is abroad, maintaining U.S. status, changing status or changing employers.
- Check the petition filing date against any current proclamation or other travel restriction.
- Keep copies of the LCA, petition receipt, approval notice, visa, admission record and pay statements.
- Verify the latest USCIS, DOL and DOS instructions immediately before filing or travel.
Bottom line
H-1B is an employer-sponsored, temporary classification for a qualifying specialty-occupation job. The normal chain is DOL LCA, USCIS Form I-129 petition, then—when the worker is abroad—DOS visa processing and a separate admission decision. The annual limits are 65,000 regular places plus 20,000 advanced-degree exemption places, but those numbers do not guarantee selection or approval. Wage protections apply, and the reported September 2025 proclamation makes the petition filing date and individual facts especially important. Treat the official agency guidance as the controlling source before taking action.
