The U.S. Department of Justice (DOJ) Civil Rights Division enforces federal civil-rights and anti-discrimination laws. Its work includes civil investigations and lawsuits, criminal prosecutions, enforcement coordination with other federal agencies, and technical assistance. The Division does not handle every rights complaint itself: the applicable statute, the conduct, the covered person or organization, and the required proof determine which DOJ section or another agency has authority.

DOJ describes the mission this way: “Our mandate at the Civil Rights Division is protecting the civil and constitutional rights of all Americans. We do this by enforcing federal anti-discrimination laws and civil rights laws.”

What the Civil Rights Division is responsible for

The Civil Rights Division (CRT) is a litigating and enforcement component of DOJ. It protects rights created by the Constitution and federal statutes rather than acting as a general-purpose legal representative for individuals. Depending on the law and facts, CRT may:

  • Investigate alleged discrimination or other civil-rights violations.
  • Bring civil lawsuits or negotiate settlements when a statute authorizes DOJ to do so.
  • Prosecute federal criminal civil-rights violations.
  • Coordinate enforcement by federal agencies that distribute federal funds or regulate particular industries.
  • Give agencies, institutions and the public technical assistance about their legal obligations.

The Division is organized into specialized sections covering areas such as criminal justice, disability rights, education, employment, federal coordination, fair housing, immigration-related employment, institutionalized persons, religious liberty and voting. DOJ’s current statutes-enforced index is the most reliable way to connect a particular law with the section and case type responsible for it.

CRT’s mission is broad, but its authority is not unlimited. A complaint must fit a law that DOJ can enforce, involve a covered actor or setting, and contain facts that could satisfy that law’s elements. Contacting DOJ does not establish that a violation occurred, create an attorney-client relationship, or guarantee an investigation, prosecution or lawsuit.

Civil enforcement and criminal prosecution are different routes

Civil investigations and litigation

Civil sections can review complaints, request information, conduct investigations and seek a remedy through a negotiated settlement or litigation. Remedies depend on the statute. They may include policy changes, accessibility improvements, compensation or other relief authorized by Congress. DOJ may also coordinate with another federal agency that has primary responsibility for a program or funding stream.

A civil investigation is not a finding that the accused party violated the law. DOJ must evaluate jurisdiction, evidence, statutory coverage and the appropriate remedy before filing a case or entering a settlement.

Criminal investigations and prosecutions

Criminal civil-rights matters can involve complaint review, investigation, grand-jury proceedings, indictment and trial. The Criminal Section explains that not every complaint becomes an investigation and not every investigation results in charges. Prosecutors must establish each element of a federal offense beyond a reasonable doubt.

Some criminal laws connected with civil rights are assigned to DOJ’s Criminal Division rather than CRT. The Assistant Attorney General for Civil Rights has authority to enforce federal civil-rights statutes, with exceptions for certain criminal laws involving specified aspects of voting rights, civil unrest, fraud and abortion that are enforced by the Criminal Division. That allocation means a subject may be associated with civil rights while a different DOJ component handles the case.

Representative laws and subject areas

The statute index is extensive. The examples below explain the main types of authority without suggesting that they are a complete list.

Area Representative authority Who or what it covers Typical DOJ role
Criminal deprivation of rights 18 U.S.C. § 241 and § 242 Conspiracies against federally protected rights; deprivation of rights under color of law Criminal investigation and prosecution when the evidence meets federal criminal standards
Employment discrimination Title VII of the Civil Rights Act Covered employment decisions and conduct based on race, color, religion, sex or national origin; retaliation and other prohibited conduct Civil enforcement and litigation in matters within DOJ authority, with other employment enforcement handled by the appropriate federal agency
Pregnancy-related workplace accommodation Pregnant Workers Fairness Act Covered employers and qualified workers with known limitations related to pregnancy, childbirth or related medical conditions Enforcement under the statute’s coverage, standards and procedures
Voting rights Voting Rights Act and related federal voting laws Specified discriminatory voting practices and other protections defined by the applicable provision Civil enforcement or referral; the responsible DOJ component depends on the conduct and legal theory
Federal-funding discrimination Title VI and related authorities Recipients of federal financial assistance and programs they operate Federal Coordination and Compliance Section coordination, oversight and enforcement support across agencies
Disability rights Federal disability-rights statutes Covered public entities, businesses, programs and institutions, depending on the statute Investigation, technical assistance, settlement or litigation as authorized
Housing and public accommodations Federal fair-housing and public-accommodations authorities Covered housing providers, public entities and places of public accommodation Civil investigations, pattern-or-practice cases and litigation where statutory requirements are met
Institutionalized persons Federal protections for people in certain institutions Covered jails, prisons, juvenile facilities and other institutions, subject to statutory definitions Investigations and remedies addressing systemic conditions
Religious liberty, immigrant and employee rights, and servicemembers Several federal statutes administered by specialized sections Rights and duties vary by statute, actor and setting Section-specific investigation, enforcement, coordination or technical assistance

18 U.S.C. § 241 and § 242

Section 241 addresses conspiracies against the exercise of federally protected rights. Section 242 addresses deprivation of a federally protected right under color of law. DOJ’s description of § 242 is important: the deprivation must be willful, it must occur under color of law, and the offense does not require racial or other discriminatory animus. The evidence must still satisfy all criminal elements, and prosecutors decide whether the facts support federal charges.

Title VII

Title VII bars covered employment discrimination because of race, color, religion, sex or national origin. It also addresses retaliation and other prohibited conduct. Coverage, administrative prerequisites, filing deadlines and the division of responsibility between DOJ and other federal agencies vary by employer and claim. A worker should identify the specific employment action, the employer, the protected basis and any retaliation before choosing a federal filing route.

Pregnant Workers Fairness Act

The Pregnant Workers Fairness Act requires covered employers to provide reasonable accommodations for a qualified worker’s known limitations related to pregnancy, childbirth or related medical conditions, subject to the statute’s standards and limitations. Whether an employer is covered, an accommodation is reasonable, or an exception applies requires a fact-specific analysis; the law is not a blanket guarantee of every requested adjustment.

Voting Rights Act and election complaints

The Voting Rights Act protects against specified discriminatory voting practices and provides other protections described in its individual provisions. Responsibility can shift within DOJ depending on the alleged conduct. DOJ’s voting FAQ directs voter-fraud reports to the FBI, a U.S. Attorney’s Office or the Criminal Division’s Public Integrity Section. Therefore, an election-related complaint is not automatically a Civil Rights Division matter. A claim about discriminatory access, language assistance or another protected voting right must be distinguished from an allegation of fraud or election administration misconduct.

Title VI and federal-funding coordination

The Federal Coordination and Compliance Section implements Title VI and related authorities concerning recipients of federal funds. Its role includes coordination and oversight across federal agencies, not simply direct lawsuits against every organization that receives federal money. The precise program, funding relationship, discriminatory conduct and agency procedure matter. DOJ’s Title VI materials also note that policy and guidance can change, so current agency guidance should be checked before relying on an older interpretation.

How DOJ decides which section or agency acts

Start with five questions:

  1. What right is allegedly violated? Identify the protected activity, characteristic, constitutional right or statutory entitlement.
  2. What setting is involved? Employment, housing, education, voting, policing, incarceration, a public accommodation and a federally funded program are governed by different authorities.
  3. Who is the covered actor? The relevant actor may be an employer, public entity, federal-funding recipient, housing provider, institution or person acting under color of law.
  4. What proof does the law require? Civil and criminal standards differ. Some statutes require intent; others focus on discriminatory effects, denial of access, retaliation or failure to accommodate.
  5. What procedure applies? The route may be a DOJ complaint, referral to another agency, an administrative process, investigation, settlement or litigation.

Use DOJ’s current statutes-enforced index to locate the responsible section, then read the dedicated page for that law. The index is broad because it organizes authorities by section and case type; a short list of familiar statutes cannot replace it.

What happens after someone contacts DOJ

1. Initial review

DOJ reviews the allegations for jurisdiction, statutory coverage, urgency and available evidence. It may seek additional information or determine that another DOJ component or federal agency is better placed to respond.

2. Referral or investigation

If another authority has primary responsibility, DOJ may refer the matter. If CRT has authority and the facts warrant further action, investigators may request documents, interview witnesses or examine policies and practices. A referral is not a decision on the merits.

3. Civil resolution

A civil matter may end with no further action, voluntary compliance, a settlement or a lawsuit. Settlements generally specify the obligations the covered entity must meet; they are not automatically proof that every allegation was established in court.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

4. Criminal path

For a potential criminal offense, investigators may develop evidence for prosecutors and a grand jury. Prosecutors can seek an indictment and proceed to trial, or decline charges when the evidence, jurisdiction or federal interests do not support prosecution. The Criminal Section specifically cautions that a complaint alone does not guarantee investigation or prosecution.

Limits readers should understand

  • DOJ is not a private lawyer. The Division generally enforces federal law in the public interest; it does not promise to represent an individual or recover every personal loss.
  • Not every unfair act is a federal civil-rights violation. The conduct must fall within a statute or constitutional authority that applies to the actor and setting.
  • State and local remedies may matter. A federal referral does not eliminate deadlines or procedures under state law, agency rules or private civil actions.
  • Criminal jurisdiction is allocated among DOJ components. A matter involving voting, fraud, civil unrest or another specialized offense may belong to the Criminal Division rather than CRT.
  • Evidence and timing matter. Preserve notices, messages, policies, witness information and dates. Filing deadlines and administrative prerequisites differ by statute.

How to frame a useful complaint or referral

A clear submission helps the receiving office identify jurisdiction quickly. Organize it around:

  • The names and roles of the people or organizations involved.
  • The date, location and sequence of events.
  • The specific decision, denial, threat, condition or policy being challenged.
  • The right or protected characteristic you believe is implicated.
  • Documents, communications, photographs, records and witness contact information.
  • Any prior complaint, response, retaliation or pending deadline.

Do not label an allegation only with a broad term such as “civil rights violation.” Explain the covered setting and the facts that could satisfy the relevant statute. For voting matters, distinguish discriminatory voting practices from suspected voter fraud so the report can reach the appropriate DOJ component or federal law-enforcement office.

Finding the controlling law

Because CRT enforces a large and changing body of authority, use the current DOJ statutes-enforced index as the starting point rather than relying on an old summary. Then confirm:

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  • The statute’s definitions and coverage.
  • The responsible DOJ section or other agency.
  • Any notice, exhaustion or filing requirement.
  • The required proof, including intent or knowledge standards.
  • Available remedies and applicable deadlines.

This approach prevents a common error: assuming that a familiar law covers every similar dispute. Title VII, the Pregnant Workers Fairness Act, Title VI, voting provisions and criminal civil-rights statutes protect different interests through different procedures. The correct route depends on the facts, not simply on the phrase “civil rights.”
