What Taxes and Fees Apply When Investing in Indian Real Estate? (2026 Guide)

There is no single all-India property tax on an investment purchase. Your total cost can include state stamp duty and registration, GST on certain construction supplies, buyer-side TDS, recurring municipal property tax and ownership expenses, tax on rental income, and capital-gains tax when you sell. The amount and even whether a charge applies depend on the state and city, property and project status, transaction value, seller residency, holding period, transfer date and your own tax profile.

Use this as a national framework, then obtain the current state registration schedule and a transaction-specific tax computation before signing or paying. State and municipal rules can change independently of central tax provisions.

The cost layers to budget for

Separate the investment into four cash-flow stages rather than treating every charge as part of the quoted property price.

Stage Possible charges What determines the amount
Purchase and transfer Stamp duty, registration and, in some cases, GST State or territory schedule, city, property type, project status, valuation basis and transaction date
Payment to the seller Tax deducted at source (TDS) Seller residency, buyer category, threshold conditions, consideration and stamp-duty value
Ownership and letting Municipal property tax, maintenance, insurance, utilities and tax on rent Local valuation rules, lease terms, expenses, financing, ownership and tax regime
Sale Capital-gains tax and sale-side compliance Holding period, transfer date, cost evidence, exemptions, residency, surcharge and cess

Compare properties on the same basis. An advertised price that excludes transfer charges is not comparable with an offer that includes them. Model the initial cash requirement, the timing of any withholding credit, annual net rent and the after-tax sale proceeds over your expected holding period.

Stamp duty and registration: state charges at purchase

Stamp duty and registration fees are imposed under state or territory law, not at one uniform national rate. The schedule can vary by state, city or local authority, property value, property type, buyer category and date. Some jurisdictions use different treatment for apartments, plots, commercial units, agricultural land, gifts or family transfers.

Confirm the valuation base

Ask the conveyancer which amount is used for each charge. Depending on the jurisdiction, the calculation may refer to the agreement value, a government circle or guidance value, the stamp valuation, or the higher of two values. A low negotiated price therefore does not necessarily produce a proportionately low duty.

Obtain the current official schedule

  1. Identify the exact state, district, municipal area and property classification.
  2. Check the state registration or inspector-general-of-registration schedule in force on the date you will execute the instrument.
  3. Confirm whether the quoted percentage is stamp duty, registration, or a combined estimate, and whether surcharges or local levies are added.
  4. Have the draft agreement reviewed so that the parties, consideration, co-ownership shares and description of the property match the filing data.

Because no location was specified, a defensible nationwide percentage cannot be supplied. Treat this lookup as a pre-contract condition, not an amount to estimate from an online calculator.

GST: only when the transaction is a taxable construction supply

GST does not automatically apply to every purchase of land or a completed home. The Central Board of Indirect Taxes and Customs rate schedule contains conditional entries for specified residential-apartment construction services, including reduced-rate treatments subject to project and notification requirements. The legal result depends on what is being supplied and when the supply is treated as occurring.

Classify the transaction before calculating

  • Under-construction apartment: determine whether the builder is supplying construction service under an eligible residential-project entry.
  • Completed property: establish whether the transaction is a sale of an immovable property after completion rather than a taxable construction service.
  • Other structures: plots, commercial premises, redevelopment arrangements, development rights and composite contracts can fall under different provisions.

Request the builder’s tax invoice, the project classification and the notification entry relied upon. Do not assume that a rate quoted for one residential project applies to another, and do not add GST merely because a property is new. The applicable notification and project facts should be checked for the payment and agreement dates.

Buyer TDS when the seller is resident

For a resident seller, the Income Tax Department’s current guidance describes a 1% deduction when the section’s ₹50 lakh threshold conditions are met. The deduction is calculated on the higher of the sale consideration or the stamp-duty value. The buyer deducts and remits the amount; it is a credit against the seller’s tax position, not an additional 1% final tax on top of the seller’s capital-gains liability.

Checks before the payment

  • Verify that the seller is resident for the relevant tax rules and obtain the correct permanent account details.
  • Test the threshold using the transaction’s required aggregation rules, including all co-buyers and co-sellers where applicable.
  • Compare both the contractual consideration and the stamp-duty value; use the higher figure if the section requires it.
  • Confirm the applicable section, challan, certificate and filing steps for the actual payment date. The department’s guidance has been amended by Finance Act 2026, so older forms or instructions may be obsolete.

Keep proof of deduction and remittance with the purchase file. The withheld amount reduces the cash paid to the seller but does not reduce the contractual property price; the seller claims the credit in the seller’s tax return.

When the seller is non-resident: do not use the resident shortcut

A non-resident seller changes the withholding and reporting workflow. From 1 October 2026, the Income Tax Department says Form 141, Schedule E applies to a resident individual or Hindu undivided family buying from a non-resident seller where section 393(2) requires deduction. The department’s guide states that, for specified transactions from that date, the earlier TAN/Form 144 process was replaced by this process.

The correct withholding amount can depend on the seller’s taxable gain and the law applicable to the transaction; the 1% resident-seller rule is not a safe substitute. Establish the seller’s residency with documentary support, obtain professional advice on the estimated tax and lower or nil deduction options if relevant, and complete the form and remittance workflow before releasing funds. A closing timetable should allow for the reporting steps rather than treating them as an afterthought.

Recurring ownership costs and municipal property tax

Municipal property tax is determined locally. Cities use their own valuation methods, classifications, billing cycles, rebates and penalties, so no national percentage or annual amount can be stated for an unspecified address. Ask the municipal authority for the property’s assessment number, outstanding balance and next due date before completion.

Build an annual carrying-cost schedule

  • Municipal property tax and any local cess.
  • Society or association maintenance, sinking-fund contributions and major-repair levies.
  • Building insurance, utilities and security that the owner must bear.
  • Loan interest, processing costs and other finance charges.
  • Vacancy periods, brokerage, repairs and compliance costs if the property is let.

Obtain a written no-dues statement where available and specify in the agreement who pays arrears, taxes and maintenance up to the handover date. These are cash expenses even when a tax return permits a deduction.

Tax on rental income

Rental taxation cannot be reduced to a single national rate. The computation depends on gross rent, municipal taxes actually paid, statutory deductions, financing, ownership shares and the tax regime chosen by the taxpayer. A lease may also allocate maintenance or utilities differently from the tax treatment.

Information to collect each year

  • Rent received or receivable, security deposits and the vacancy period.
  • Municipal taxes paid by the owner, with receipts and the relevant billing year.
  • Loan-interest certificates and ownership documents.
  • Co-owner percentages and any rent-sharing agreement.
  • Evidence of repairs, brokerage and other costs, while distinguishing accounting expenses from deductions permitted by the applicable law.

Have the annual computation prepared under the tax regime you actually use. Do not infer the result from the property’s gross yield: two owners with identical rent can have different taxable income because their financing, ownership and deductions differ.

Capital-gains tax when you sell

For land and buildings, the Income Tax Department identifies 24 months as the long-term holding period. Count the period under the applicable transfer rules, retain acquisition and improvement evidence, and use the transfer date—not merely the date negotiations began—to select the rate framework.

Transfers on or after 23 July 2024

The department’s current guide describes a 12.5% long-term capital-gains rate without indexation for transfers on or after 23 July 2024. The taxable gain still requires a transaction computation, and surcharge, health and education cess, exemptions, residency and other provisions can change the final liability.

Protection for certain earlier acquisitions

An eligible resident individual or Hindu undivided family selling qualifying land or a building acquired before 23 July 2024 may compare the legacy 20% method with indexation where the statutory protection applies and use the lower-liability treatment. Eligibility is not automatic: establish the acquisition date, taxpayer category, asset qualification and transfer details, then calculate both methods using documentary costs.

Records that affect the gain

  • Registered purchase deed and the payment trail.
  • Brokerage, transfer expenses and qualifying improvement invoices.
  • Past depreciation or business-use records where relevant.
  • Stamp valuation and sale agreement used for the transfer.
  • Details of any earlier exemption or reinvestment claim.

A capital-gains figure based only on the sale price is unreliable. The computation must reconcile these records with the applicable valuation and rate rules.

Section 54 reinvestment relief for a residential house

Section 54 may allow an eligible individual or Hindu undivided family to defer qualifying long-term gain from a residential house when another residential house in India is purchased or constructed, subject to the statutory conditions and limits.

The Income Tax Department’s statutory wording says the taxpayer must have “within a period of one year before or two years after the date on which the transfer took place purchased, or has within a period of three years after that date constructed, one residential house in India.” Those windows do not, by themselves, guarantee relief.

Plan the claim

  1. Confirm that the asset sold, taxpayer and gain meet section 54’s eligibility rules.
  2. Choose purchase or construction and document the relevant transfer and completion dates.
  3. Track the statutory limits, ownership requirements and any restrictions on additional houses or subsequent transfer.
  4. If the gain is not used by the return-filing deadline, examine whether the Capital Gains Account Scheme is required and follow its deposit and withdrawal rules.
  5. Retain agreements, payment proofs and construction bills with the return records.

Section 54 is a conditional exemption, not an automatic tax-free rollover. A missed deadline or failed eligibility condition can make the deferred gain taxable.

How to compare two investment properties

Use one worksheet and hold the assumptions constant. Compare each property on the same price basis and the same planned holding period.

Comparison line Questions to answer
Upfront cash What are the state stamp and registration amounts, and is GST included or extra?
Withholding Is the seller resident or non-resident, and what form and timing apply?
Annual cash flow What remains after municipal tax, maintenance, vacancy, financing and income tax?
Exit proceeds What is the expected gain after selling costs and the applicable capital-gains computation?
Risk and eligibility Are title, project status, valuation, reinvestment plans and co-ownership structured consistently?

Under-construction versus completed status, location, title and transfer structure can matter as much as the quoted base price. A route that appears cheaper may simply move GST, duty or financing costs to a different stage.

Closing checklist

  1. Identify the state, city, property type, project status and all buyers and sellers.
  2. Obtain the official stamp-duty and registration calculation using the correct valuation base.
  3. Confirm GST treatment with the builder or seller’s tax invoice and the applicable notification.
  4. Determine seller residency and complete the correct TDS workflow before payment.
  5. Check municipal arrears, association dues and handover adjustments.
  6. Model rent, annual carrying costs and the tax regime for each owner.
  7. Record the acquisition date and preserve every cost document for a future capital-gains computation.
  8. If planning section 54, calendar the purchase, construction and Capital Gains Account Scheme deadlines immediately after transfer.
  9. Have a local property lawyer or conveyancer and a tax professional review the documents before signing.
