Before an MSME claims a free-trade-agreement (FTA) preference, it must verify five things for the specific shipment: the trade lane and agreement are in force, the product has the correct HS classification, the product passes that agreement’s product-specific origin rule, the required evidence is available, and the importer can make the preference claim with the prescribed proof. An FTA does not automatically make goods duty-free, and manufacturing or dispatching a product from a participating country alone does not establish originating status.
The importer commonly claims the reduced or zero rate when the goods enter its market, using origin information supplied by the exporter. Because rules differ by agreement, product and destination, this checklist is a decision framework rather than an eligibility determination for any particular shipment.

1. Define the exact trade lane before checking eligibility
Write down the exporting country, importing country, product, buyer, expected shipment date and every FTA or other preference arrangement that might apply. Confirm that the agreement is in force between those parties on the relevant date. Some agreements phase in tariff concessions, exclude particular products or apply different procedures during transition periods.
An agreement being available is not enough. Compare the preferential rate for the correctly classified product with the rate that would otherwise apply in the destination market. If the difference is negligible, the compliance work may not be commercially useful; if it is significant, the preference may justify the evidence and coordination required.

Compare candidate agreements on the same shipment
When more than one arrangement could cover a sale, compare them using the same five questions:
- What preferential tariff would apply, and what is the otherwise applicable rate?
- What product-specific origin test must the goods pass?
- How much supplier, production and costing evidence is required?
- Who may issue or provide the proof of origin, and in what format?
- Can the buyer, broker and carrier operationally use that proof at entry?
Do not assume that qualifying under one FTA automatically qualifies the same product under another. Each agreement has its own definitions, exceptions and documentary rules.
2. Classify the finished product correctly
The HS classification is the key input for both the destination tariff and the origin rule. Start with a precise description of the finished good: its materials, function, degree of completion, packaging and any components that affect classification. Determine the Harmonized System heading and the destination tariff nomenclature, which may require more digits than the international HS level.

Why classification errors are expensive
Origin schedules are commonly organized by tariff heading or subheading and may require a rule at a specified digit level. A wrong classification can therefore produce the wrong tariff, the wrong origin test and an invalid preference claim even when the manufacturing facts are unchanged. A product described only as “equipment,” “garment” or “food item” is not sufficiently specific for this purpose.
Resolve uncertainty before certification
If two classifications appear plausible, or if a component changes the heading, ask the competent customs authority about its classification process or consult an experienced customs professional. Keep the product description, technical specifications, photographs, composition data and any ruling or written advice with the export file. Do not wait until the goods are at the border: a preference declaration based on an unresolved classification can create duty, penalty and delay exposure.

3. Apply the agreement’s product-specific rule of origin
Read the origin chapter and the product-specific rule for the exact HS code in the exact agreement. Do not infer origin from the seller’s address, the country of dispatch or the fact that some processing occurred locally. The rule may require one test or a combination of tests.
Common origin tests
- Wholly obtained: The goods, such as certain agricultural, mineral or animal products, must be obtained entirely in an eligible country or territory under the agreement’s definition.
- Exclusive use of originating materials: Every material or ingredient must already qualify as originating under that agreement.
- Tariff shift: Non-originating inputs may be used, but processing must change their tariff classification in the way the product-specific rule specifies.
- Regional value content: The product must meet a minimum share of value calculated with the agreement’s prescribed method, definitions and records.
- Combination rule: The product may have to satisfy a tariff shift plus a value threshold, or a particular processing requirement in addition to one of those tests.
A product can contain imported or otherwise non-originating inputs and still qualify in some agreements. That is possible only when the applicable rule expressly permits those inputs and the product meets every associated calculation, process and exception.
Read definitions and exceptions, not just the headline rule
Terms such as “originating material,” “value,” “production,” “packing,” “fungible goods,” “accessories” and “indirect materials” have agreement-specific meanings. Separate provisions may allow tolerance for small amounts of non-originating material, prescribe special treatment for sets or mixtures, or exclude packaging from a calculation. Apply the definitions and method in the agreement itself; do not substitute a formula from another FTA or from a general customs guide.
Document the calculation
For a tariff-shift test, map each non-originating input to its classification and show the processing that produced the finished good. For a value-content test, retain the cost or value data, currency and date used, the treatment of freight and other permitted additions, and the calculation method required by the agreement. If the rule offers alternatives, record which alternative was selected and why the evidence supports it.
4. Build the evidence file before making a claim
Collect proof while the product is being sourced and made, not after the buyer requests it. The exporter or producer may have to explain the basis for origin, and customs authorities can verify an origin claim after importation.

Core records to assemble
- Finished-product description, technical specifications and confirmed HS classification.
- Bills of materials showing each input, supplier and country of origin.
- Supplier origin statements or other declarations for materials claimed as originating.
- Purchase orders, invoices, import records and inventory or lot-traceability records.
- Production descriptions, manufacturing routes, work orders and records of qualifying processing.
- Cost, value and quantity records supporting any regional-value-content calculation.
- The version of the agreement, tariff schedule and rule used for the shipment date.
- A signed internal worksheet linking each factual record to the chosen origin test.
Evidence should be detailed enough that another trained person can reproduce the classification and origin result. Keep records for the retention period required by the relevant agreement and customs law; that period is jurisdiction-specific and should be confirmed before shipping.
5. Use the correct proof of origin
Origin proof varies. Depending on the arrangement, it may be an exporter declaration, a producer or exporter certificate, a government-issued certificate, or information held by the importer. Some agreements do not require a fixed certificate form, but they still require specific data elements, wording, signatory details or shipment coverage.
Coordinate the data with the importer
Ask the buyer and customs broker which proof they will use at entry and when they need it. Confirm:
- the exact origin statement or fields required;
- whether the proof covers one invoice, a defined period or multiple shipments;
- the language, electronic format, signature and date requirements;
- whether the exporter, producer or importer must issue or possess the document;
- how corrections, replacements and post-entry claims are handled.
Give the importer enough supporting information to make a defensible claim, but certify only goods that qualify under the named agreement. A buyer’s request for a preference statement is not evidence that the rule has been met.
Do not confuse preference proof with a generic certificate
A certificate of origin used for commercial, banking or non-preferential customs purposes may have different issuance rules and does not necessarily establish entitlement to an FTA rate. Conversely, an FTA declaration does not replace the commercial invoice, packing list, transport document or other documents required for export and import.

6. Check the rest of the export and import file
FTA origin is only one part of a compliant shipment. The destination may impose separate requirements for product safety, labeling, technical standards, sanitary or phytosanitary controls, licensing, packaging, valuation, marking, buyer documentation and payment terms. Ask the buyer and logistics provider for their document checklist and verify product requirements with official destination-country customs and regulatory sources.
Keep documents consistent
Descriptions, quantities, weights, HS codes, invoice values, manufacturer names and country statements should agree across the invoice, packing list, transport records and origin proof. A mismatch can cause a customs query even when the goods genuinely qualify. If a third party prepares the declaration, review it against the underlying records before signing or transmitting it.
7. Use reliable tools, then verify the result
The International Trade Centre’s Rules of Origin Facilitator can be used to screen agreement-specific origin rules, tariff information and origin procedures by product and market. ITC’s Market Access Map and its broader Market Analysis Tools portal provide additional market-access information. These are useful starting points for an MSME comparing trade lanes, but they are not a substitute for the current agreement text or competent customs guidance for the actual shipment.
The Rules of Origin Facilitator was launched by ITC and the World Customs Organization in 2018; the World Trade Organization announced collaboration with the initiative in 2019. In that announcement, WTO Deputy Director-General Yi Xiaozhun described it as a platform intended to bring reliable, up-to-date rules of origin information together in one place. That historical description does not guarantee current coverage or accuracy for every product and market, so verify the result before certifying.

- Use a tariff and origin tool to identify candidate agreements and the apparent rule for the product.
- Open the current agreement text, annexes, tariff schedule and origin procedures for the shipment date.
- Confirm the HS classification and destination-specific tariff with customs sources.
- Match the product’s materials and processing to every element of the product-specific rule.

8. Escalate difficult cases before shipping
Seek qualified customs or trade advice when the product has many imported inputs, the classification is disputed, the value calculation is close to a threshold, or several agreements offer different tests. A professional can also review destination entry requirements that are outside the FTA itself.

If the interpretation remains uncertain, check whether the destination authority offers an advance ruling on classification or origin under the relevant agreement. Availability, application requirements, timing and legal effect differ by jurisdiction. Obtain the ruling before relying on the preference, and retain the application and decision with the records.
Decision checklist for an MSME
| Check | Evidence or action | Stop-and-resolve trigger |
|---|---|---|
| Trade lane and agreement | Exporting country, importing country, product, shipment date and agreement in force | No confirmed agreement or no useful tariff difference |
| HS classification | Detailed product description, tariff code and destination digits | Competing classifications or missing technical data |
| Origin rule | Exact product-specific test, definitions, exceptions and chosen method | Rule cannot be matched to the production facts |
| Materials and processing | Supplier statements, bills of materials and production records | Unverified supplier origin or undocumented processing |
| Value or tariff-shift calculation | Reproducible worksheet using the agreement’s method | Missing costs, classifications or threshold margin |
| Proof method | Correct declaration or certificate, fields, signature and coverage | Importer and exporter disagree on required format |
| Other documents | Invoice, packing, transport, regulatory and destination records | Inconsistent descriptions or missing permits |
| Retention and review | Saved source text, records, calculation and internal approval | No person responsible for post-entry verification |
Common mistakes and how to prevent them
Assuming local dispatch equals local origin
Shipping from an FTA country or performing a minor finishing operation there does not by itself satisfy an origin rule. Trace the inputs and apply the exact test.
Using the wrong agreement’s formula
Regional-value-content methods, tariff-shift requirements and tolerance provisions are not interchangeable. Label every worksheet with the agreement and version used.
Recommended Free Tools
Certifying before the file is complete
If supplier statements or production records arrive after the declaration, the exporter may be unable to substantiate the claim. Make evidence collection a purchasing and production requirement.
Treating a generic certificate as an FTA claim
Confirm the legal purpose of every certificate and declaration. Ask the importer whether the document is intended to claim preferential treatment at entry.
Ignoring the importer’s operational process
A theoretically valid declaration can fail if it arrives late, lacks a required field or cannot be entered in the broker’s system. Agree on the workflow before the goods depart.
What the MSME should be able to answer before shipment
Do not ship on an FTA preference assumption until you can answer, in writing: Which agreement and tariff line apply? What is the otherwise applicable rate? Which product-specific origin rule is being used? Which inputs are non-originating? How does the calculation or tariff shift satisfy the rule? Where is each fact supported? Which proof will the importer present, and are all other destination documents ready?
If any answer is unknown, treat the preference as unconfirmed. The business can still export and pay the ordinary duty where appropriate, but it should not make an unsupported preferential claim.
