For ordinary job placement in the United States, a legitimate recruiter or placement firm typically gets paid by the hiring company—not by the candidate. The Federal Trade Commission (FTC) advises job seekers to walk away when a placement firm asks them to pay a fee, particularly in advance. A separately chosen service, such as resume writing, is a different purchase; it should not be presented as payment for an interview, placement, or guaranteed job.
Should you pay a recruiter to apply, interview, or get hired?
Usually, no. In the ordinary U.S. placement model, the employer pays the placement firm to find qualified candidates. The FTC says honest placement firms do not typically charge job candidates and advises: “If a placement firm asks you for a fee — especially one you have to pay in advance — walk away.”

That is practical consumer guidance, not a universal statement of the law in every state or country. State employment-agency rules and protections for particular worker categories can differ.

A firm may sell a separate career service that you choose to buy, rather than charge you for access to a job. The FTC has described services such as executive counseling, resume writing, or job listings as distinct from placement; its examples include historical guidance and do not establish that any particular current offer is trustworthy. FTC historical guidance also does not validate a promise of employment.

Before agreeing to pay for any optional service, get the details in writing. Make sure the contract identifies the specific service or deliverable, total price, due date, refund terms, and any promises. A fee described as buying an interview, referral, placement, or guaranteed job is not merely a separate career service.

- Who pays? Is the hiring company paying for placement, or is the candidate being asked to pay to access the opportunity?
- What does the payment buy? Is there a clearly described service you independently want, or is payment tied to an interview, job offer, or promise of employment?
- When is it due? An advance fee demanded as a condition of getting a job is a significant warning sign. The legal timing may also depend on state rules.
- What does the contract say? Check that the service, price, payment timing, refund policy, and any guarantee match what you were told. North Carolina’s Department of Justice advises consumers to review contracts and refund terms and be wary of upfront fees and guarantees. Its page is consumer advice, not a fee rule for every state.

Payment for a job or a guarantee
Do not pay for a job or for a promise of employment. The FTC’s guidance is direct: “Don’t pay for a job or the promise of employment.” A firm that charges for supposed services while advertising fake or outdated openings is another reason to stop and verify.

An unexpected recruiter or unfamiliar employer
Verify the role and recruiter independently. Look up the employer’s official contact information yourself and ask whether the opening and recruiter are real; do not rely only on contact details supplied by the person who contacted you. The FTC also warns that fake onboarding portals can be used to collect Social Security numbers or bank details. Be cautious about providing sensitive information before you have verified the employer and job. FTC guidance on employment scams

A request involving recruitment abroad or a covered temporary labor program
Do not apply the ordinary consumer summary without checking the specific program. The U.S. Department of Labor says recruitment fees are illegal in the covered temporary labor certification context described on its recruitment page. It says a worker may be entitled to recover fees paid in their home country and that the employer must reimburse the entirety in the first paycheck. The rule’s application depends on the job and program; contact the Wage and Hour Division at 1-866-487-9243 or the relevant country’s embassy or consulate for help.

If you are facing a real dispute, check the employment-agency regulator or labor agency for the relevant state. For a job involving a federal work program, confirm the applicable requirements with the federal agency administering it.
