Sections 73, 74 and 74A of India’s Central Goods and Services Tax Act, 2017 deal with the same core problem: determining GST that was not paid or was short paid, refunds issued by mistake, or input tax credit wrongly availed or utilised. The section that applies depends first on the financial year and, for periods up to FY 2023-24, on whether the department alleges fraud-related conduct.
Sections 73 and 74 apply to periods up to FY 2023-24. Section 73 is the route where the stated reason is not fraud, wilful misstatement or suppression of facts to evade tax. Section 74 is the route where one or more of those grounds are alleged. Section 74A applies to matters pertaining to FY 2024-25 onward, whether or not the case is fraud-related; its penalty rules retain different treatment for fraud and non-fraud cases.

The short answer: which section applies?
| Provision | Financial-year scope | Statutory basis | What it does |
|---|---|---|---|
| Section 73 | Periods up to FY 2023-24 | Reasons other than fraud, wilful misstatement, or suppression of facts to evade tax | Determines specified unpaid or short-paid tax, erroneous refunds, or wrongly availed or utilised input tax credit. |
| Section 74 | Periods up to FY 2023-24 | Fraud, wilful misstatement, or suppression of facts to evade tax | Determines the same broad categories where those fraud-related grounds are alleged. |
| Section 74A | FY 2024-25 onward | Any reason; penalty treatment changes according to whether fraud-related grounds apply | Provides a unified determination framework, including notice, response, determination and penalty rules. |
The amendment introducing section 74A took effect on 1 November 2024, according to the commencement notes in the consolidated Act. The financial-year boundary remains the key way to classify a matter: sections 73 and 74 concern periods through FY 2023-24, while section 74A concerns FY 2024-25 and later.
What all three provisions cover
These sections are tax-determination provisions. They are not a general procedure for every GST disagreement. Their common subject matter is:
#1 Best Overall

- [Deep Bass with Clear Vocals] High-performance drivers produce punchy bass while keeping vocals clean and detailed for everyday listening.
- GST that was not paid or was paid short;
- GST refunded erroneously; and
- input tax credit that was wrongly availed or utilised.
A notice under one of these provisions therefore concerns an alleged tax liability or credit issue for a defined period. The section does not, by itself, decide whether the department’s factual allegation is correct. The taxpayer’s records, returns, invoices, credit eligibility, correspondence, notice wording and applicable rules remain relevant.
Section 73: the non-fraud route for periods up to FY 2023-24
When section 73 is used
Section 73 applies to the specified tax, refund and input-tax-credit issues pertaining to periods up to FY 2023-24 when the stated reason is something other than fraud, wilful misstatement or suppression of facts to evade tax. In practical terms, it is the statutory route for a non-fraud determination for those financial years.
The classification is based on the statutory ground stated in the proceedings, not merely on the size of the proposed demand. A large demand can still be a section 73 matter if the alleged reason is non-fraudulent. Conversely, a small amount does not automatically make section 74 inapplicable if the notice alleges the specified fraud-related conduct.
What a taxpayer should read in a section 73 notice
Check the financial year, the tax period or transactions identified, the category of alleged short payment or credit error, and the explanation given for invoking section 73. Compare the allegation with returns, payment records, invoices, credit ledgers and any earlier departmental communication. If the notice uses fraud-related language while invoking section 73, or invokes section 73 for a period outside its stated year range, that mismatch should be raised in the written response and reviewed against the law applicable to the notice.
Section 74: fraud-related grounds for periods up to FY 2023-24
The grounds that distinguish section 74
Section 74 covers the same broad categories of unpaid or short-paid tax, erroneous refunds and wrongly availed or utilised input tax credit, but for periods up to FY 2023-24 where the reason alleged is fraud, wilful misstatement or suppression of facts to evade tax.

Those words matter. Section 74 is not simply a higher-rate version of section 73. It is the provision selected when the department relies on one or more of those specified grounds. The notice should identify the conduct relied upon and connect it to the tax, refund or credit amount in dispute. A taxpayer assessing a section 74 notice should therefore separate two questions: whether the tax or credit calculation is correct, and whether the evidence supports the fraud-related ground used to classify the case.
Why the section number changes the analysis
The section affects the legal framework under which the department seeks to determine the amount and penalty. It can also affect limitation and response strategy, but those consequences cannot be determined from the section number alone. The exact notice date, service record, annual-return due date, amendments, rules, notifications and judicial decisions may all matter. A general explanation of section 74 is not a determination of whether a particular notice is valid or timely.
Section 74A: the framework from FY 2024-25 onward
When section 74A applies
Section 74A applies to the specified tax, refund and input-tax-credit issues pertaining to FY 2024-25 onward. Unlike sections 73 and 74, it is not divided into separate provisions according to whether the underlying reason is fraudulent. The same section covers either type of case, while its penalty provisions distinguish fraud-related cases from other cases.
The section’s heading describes determination of tax not paid or short paid, erroneously refunded, or input tax credit wrongly availed or utilised for any reason pertaining to FY 2024-25 onward. The commencement notes state that the statutory transition took effect on 1 November 2024. Because the financial-year scope and commencement date answer different questions, both should be recorded when analysing a notice.
What the notice must seek
Section 74A’s opening provision contemplates a show-cause notice asking why the specified tax, interest under section 50, and a penalty leviable under the Act or rules should not be paid. No notice is to be issued where the amount for a financial year is below ₹1,000, as stated in the consolidated Act.

The ₹1,000 figure is a statutory threshold for issuing a section 74A notice for the financial year; it is not a general statement that every GST liability below ₹1,000 disappears. The calculation, aggregation and facts behind the amount should be checked in the notice and the records supporting it.

Notice timing: the 42-month period
Section 74A provides that the notice is to be issued within 42 months from the due date for furnishing the annual return for the relevant financial year, or within 42 months from the date of an erroneous refund, as applicable. The correct starting point depends on which type of allegation is made and which statutory date applies to the facts.
Do not calculate the period by counting 42 months from the tax invoice date or from the date on which a return was filed unless the provision and the facts make that the relevant event. Preserve the annual-return due-date record, refund date, notice date and service evidence. A limitation conclusion requires those dates together with the version of the law and any applicable extension or transitional rule.
Statements covering additional periods
Where a notice covers one period, section 74A permits a statement to address other periods on the same grounds, subject to the conditions stated in the section. A taxpayer should therefore read beyond the first period named in a communication and identify every financial year, tax head, credit entry and refund included in any accompanying statement.
Representation and the determination order
The proper officer must consider the taxpayer’s representation and then determine the tax, interest and penalty by issuing an order. Section 74A states a 12-month period from issuance of the notice for this determination, subject to the extension mechanism provided in the provision.

The 12-month figure is an order-period rule, not a substitute for checking the notice date, the date of service, any statutory extension and the contents of the order. A response should address the calculation and the legal classification separately so that the officer can deal with each disputed element.
Section 74A penalties
| Case category under section 74A | Penalty stated in the provision | How to read it |
|---|---|---|
| Reason other than fraud, wilful misstatement or suppression to evade tax | 10% of tax due or ₹10,000, whichever is higher | The comparison is made against the tax due; the higher statutory amount applies. |
| Fraud, wilful misstatement or suppression to evade tax | An amount equal to the tax due | The section retains a separate, tax-equal penalty for the fraud-related category. |
These are figures stated in section 74A, not independently measured statistics. The tax amount, the applicable category and the evidence supporting that category must be established in the individual proceeding.

- Identify the financial year. Write down the year to which the unpaid tax, refund or input-tax-credit issue pertains. A period up to FY 2023-24 points to section 73 or 74; FY 2024-25 onward points to section 74A.
- Classify the alleged reason. For a pre-FY 2024-25 period, check whether the notice alleges fraud, wilful misstatement or suppression of facts to evade tax. Non-fraud wording points to section 73; those specified grounds point to section 74.
- Separate the underlying issue. Confirm whether the allegation concerns unpaid or short-paid tax, an erroneous refund, or wrongly availed or utilised input tax credit. Note the tax period, return, invoice or credit entry used to calculate it.
- Check the notice’s dates. For section 74A, compare the notice date with the relevant annual-return due date or erroneous-refund date and the 42-month period stated in the provision.
- Reconcile the money figures. Recalculate tax, section 50 interest and penalty independently. For section 74A, check the ₹1,000 no-notice threshold and the applicable 10%-or-₹10,000 or tax-equal penalty rule.
- Prepare the representation. Respond to the facts, calculation, section invoked, financial year, dates and penalty category. Attach records that directly support each disputed point and retain proof of submission.
Worked classification examples
Example: FY 2022-23 credit dispute without a fraud allegation
A notice alleges that input tax credit was wrongly availed in FY 2022-23 and describes the issue as an eligibility or reconciliation error, without alleging fraud, wilful misstatement or suppression to evade tax. The year falls within the pre-FY 2024-25 range and the stated ground is non-fraud, so section 73 is the relevant classification on the information given.
Example: FY 2023-24 short payment with an evasion allegation
A notice concerns short-paid tax for FY 2023-24 and alleges deliberate suppression of facts to evade tax. The year still falls within the section 73/74 range, but the stated fraud-related ground points to section 74.

An erroneous refund relates to FY 2024-25. The year places the determination under section 74A. The notice and evidence must then establish whether the case belongs to the non-fraud or fraud-related penalty category; the fact that section 74A applies does not itself prove either category.

Common mistakes when reading these provisions
- Using the notice date to choose the financial-year section. The decisive question is the period to which the underlying tax, refund or credit issue pertains.
- Treating section 74A as a fraud-only provision. It covers FY 2024-25 onward for either type of reason; fraud changes the penalty category.
- Assuming section 73 means no penalty. The section classification does not eliminate the need to read the applicable penalty provisions and the notice’s demand.
- Ignoring the distinction between availed and utilised credit. The statutory subject includes input tax credit wrongly availed or utilised; the notice should be checked to see which conduct and amount are actually alleged.
- Applying the 42-month period without identifying its starting event. Section 74A uses the annual-return due date or erroneous-refund date, as applicable.
- Relying on a headline amount without checking the year. The ₹1,000 threshold, 10% or ₹10,000 minimum comparison, 42-month period and 12-month order period are section 74A figures and should not be transferred automatically to sections 73 or 74.
- Assuming the amendment date answers every transitional question. The 1 November 2024 commencement date and the FY 2024-25 scope must be read with the particular notice, amendment text and applicable rules.
Documents and dates to assemble before responding
A clear file makes it easier to test both the amount and the statutory route. Assemble:
- the show-cause notice, annexures and proof of service;
- the financial year, tax period and annual-return due date;
- returns, payment challans and electronic liability or credit ledgers;
- tax invoices, debit or credit notes, refund applications and sanction records;
- reconciliation schedules explaining differences between returns and books;
- earlier replies, audit communications and orders concerning the same transactions; and
- a calculation separating tax, section 50 interest and each proposed penalty.
For a section 74A matter, add a written calculation of the 42-month date, the amount tested against the ₹1,000 threshold and the facts relied on for the non-fraud or fraud-related penalty category.
What this overview cannot decide
The provisions set the statutory framework, but a general summary cannot decide whether an individual notice is within time, whether suppression or wilful misstatement is proved, whether a credit was legally available, or how an amendment, rule, notification or court decision affects the case. Those questions require the complete notice and record for the relevant period.
