There is no single, universally binding set of rules for every sea voyage carrying animals. The governing law depends on the route, the departure, transit and destination jurisdictions, the species, the type of journey and the legislation in force when the voyage takes place.
At international level, the World Organisation for Animal Health (WOAH) Terrestrial Animal Health Code, Chapter 7.2, provides standards and recommendations for transport by sea. For journeys covered by European Union law, Council Regulation (EC) No 1/2005 is the central welfare instrument, supplemented for livestock vessels by Commission Implementing Regulation (EU) 2023/372. These EU instruments are not universal maritime law, so a route-specific legal check is essential.

Start with the route, not the vessel
A ship’s flag or the fact that animals cross the sea does not, by itself, identify the complete legal regime. A voyage can involve rules at the place of departure, requirements in transit jurisdictions, controls at the destination and, where applicable, regional legislation such as the EU framework. The first legal question is therefore which countries and regional systems are connected to the journey.

Whether a particular export, import, transit movement or voyage falls within a provision depends on its route and the applicable legal text. WOAH standards provide an international reference point, but they do not automatically replace domestic legislation.

A practical jurisdiction map
- Identify the country and port where the animals are loaded and the country and port where they are unloaded.
- List every jurisdiction the animals or vessel will enter during the journey, including any transit movement relevant to the animals.
- Confirm the species, number of animals, commercial status and whether the animals are being moved between EU Member States, into the EU or out of it.
- Check the current legislation and guidance of each competent authority. A general description of EU or WOAH standards cannot answer every country-specific certification, customs or veterinary question.
What EU Regulation 1/2005 requires
For journeys within the regulation’s scope, Article 3 supplies the basic welfare rule: “No person shall transport animals or cause animals to be transported in a way likely to cause injury or undue suffering to them.” The same article turns that principle into operational duties for everyone arranging or carrying out the journey.
Planning and journey organization
The journey must be planned in advance to minimize its length and meet the animals’ needs. That includes choosing suitable transport, loading and unloading facilities, arranging competent or properly trained handlers, and ensuring that transport is carried out promptly. Welfare checks must be made regularly rather than treating loading as the end of the organiser’s responsibility.
The regulation also requires adequate floor area and height for the animals concerned. Water, feed and rest must be provided at suitable intervals. “Suitable” is not a universal time period for every animal: the annexes contain species-specific provisions and exceptions, so a compliance plan has to match the animals and journey rather than rely on a single rule of thumb.
Fitness to travel
Animals must be fit for the proposed journey. The assessment should be made before loading and must account for the expected conditions, duration, handling and unloading. An animal that cannot withstand the journey without likely injury or undue suffering should not be loaded under the general duty in Article 3. Annex I contains the detailed fitness-to-travel requirements and exceptions.
Documentation
Required journey information includes the animals’ origin and ownership, the place of departure, the date and time of departure, the intended destination and the expected journey duration. Transporters and journey organisers have defined responsibilities for arranging and retaining the information needed to demonstrate how the journey was planned.

Approval of certain livestock vessels
Article 7(2) sets a specific approval trigger. For specified domestic equidae, cattle, sheep, goats and pigs, a livestock vessel must be inspected and approved before transporting the animals by sea for more than 10 nautical miles from a Community port. This is not a blanket approval threshold for every animal, every vessel or every sea movement; the listed species and the geographic trigger matter.
Technical requirements in Annex I
Annex I adds technical rules covering fitness, vessel and container design, air quality, access for inspection and care, adequate space and water-supply arrangements. It also contains species-specific provisions and exceptions. A vessel may therefore meet a general description of being suitable yet still require additional measures for the particular species, container arrangement or journey.
Additional EU controls for livestock vessels
Commission Implementing Regulation (EU) 2023/372 supplements the general framework rather than replacing it. EUR-Lex lists the instrument as in force, with partial application from 1 January 2024.
Official-control records
The regulation sets out how competent authorities record, store and share written records of official controls on livestock vessels. Those records create an official trail showing what was checked and what findings were made, rather than leaving vessel oversight solely to private contracts.
Contingency plans and vessel approval
It specifies requirements for emergency contingency plans and addresses matters connected with vessel approval. A responsible operator should be able to explain what happens if loading is delayed, a vessel loses a critical system, severe weather changes the voyage or animals require urgent care. The contingency plan is part of preparedness, not merely a document produced after an incident.

Exit-point infrastructure
The instrument also sets minimum requirements for designated exit points. Welfare obligations therefore extend beyond the ship itself: the port facilities and official control arrangements used to move animals out of the EU can be part of compliance.
What WOAH Chapter 7.2 adds
WOAH’s Terrestrial Animal Health Code, Chapter 7.2, is titled “Transport of animals by sea.” It is an international standard and recommendation framework. Its provisions are especially useful where several parties and jurisdictions must coordinate, but the chapter is not a substitute for legislation that is directly applicable in a particular country.
Shared responsibility across the chain
WOAH states: “Exporters, importers, owners of animals, business or buying/selling agents, shipping companies, masters of vessels and managers of facilities are jointly responsible for the general health of the animals and their fitness for the journey, and for their overall welfare during the journey, regardless of whether duties are subcontracted to other parties during transport.”
This approach prevents a party from assuming that a contract transfers all welfare responsibility away. A shipper, owner, agent, carrier and facility manager can each have a role in checking fitness, communicating the plan, providing resources and responding when conditions change.
Operational subjects covered
Chapter 7.2 addresses journey planning, selection of an appropriate vessel, competent handlers, current contingency plans, loading, food, water, ventilation, protection from weather, regular inspection and responses to problems. These subjects align with the practical questions a voyage plan must answer:

- Is the vessel appropriate for the species, number of animals, route and anticipated weather?
- Are handlers competent to load, inspect and care for the animals?
- Can animals reach water and feed, and can staff inspect them safely?
- Will ventilation and protection from weather remain adequate throughout the voyage?
- What immediate actions, veterinary support and communications are available when an animal becomes ill or a system fails?
WOAH’s January 2026 implementation message
In January 2026, WOAH emphasized implementation and enforcement of standards, clearly allocated shared responsibilities, trained veterinary services and staff, adequate infrastructure and monitoring, and better communication and coordination. That statement is a policy emphasis; it does not itself create a new, universally enforceable maritime code.
How the main instruments differ
| Comparison point | EU Regulation 1/2005 | EU Regulation 2023/372 | WOAH Chapter 7.2 |
|---|---|---|---|
| Geographic reach | Applies to journeys within the EU framework, including transport between EU Member States and checks on animals entering or leaving the EU, subject to the route and legal scope. | Operates within the EU official-control and livestock-vessel framework. | International standards and recommendations; domestic law determines direct legal force. |
| Main focus | General welfare duties for planning, fitness, facilities, handlers, monitoring, basic needs and documentation. | Official-control records, emergency contingency plans, vessel-approval matters and minimum exit-point requirements. | Coordinated welfare responsibilities and practical standards for sea transport. |
| Vessel approval | For specified domestic equidae, cattle, sheep, goats and pigs, approval is required for sea transport over 10 nautical miles from a Community port. | Provides additional rules about vessel-approval processes and controls. | Calls for appropriate vessel selection and preparedness, without replacing a country’s approval law. |
| Onboard conditions | Annex I covers design, air quality, access, space, water and species-specific requirements. | Supports official oversight of livestock-vessel arrangements. | Covers food, water, ventilation, weather protection, inspection and response to problems. |
| Responsibility | Places duties on transporters and journey organisers and requires specified journey information. | Defines how competent authorities document and share control results. | Names exporters, importers, owners, agents, shipping companies, masters and facility managers as jointly responsible. |
A compliance workflow for a planned sea journey
- Define the movement. Record the species, number, ownership, commercial purpose, departure port, destination port, planned route, expected duration and every relevant jurisdiction.
- Determine the legal instruments. Establish whether EU Regulation 1/2005 applies, whether the voyage involves an EU entry or exit point and which domestic rules apply at departure, transit and destination.
- Screen fitness before booking. Assess each animal against the applicable fitness requirements and exclude animals that are likely to suffer injury or undue suffering during the planned journey.
- Plan the shortest practicable journey. Build the schedule around animal needs, including loading, sea time, unloading, water, feed, rest and welfare checks. Account for foreseeable delays rather than assuming the timetable will be perfect.
- Verify the vessel and facilities. Check the approval status where the 10-nautical-mile EU trigger applies, confirm species-appropriate space and height, and review ventilation, air quality, access, containers, water systems and loading or unloading facilities.
- Assign competent people. Identify the exporter, owner, journey organiser, transporter, master, handlers, facility managers and veterinary contacts. Define who performs each check and who can make an urgent welfare decision.
- Prepare documents and contingency plans. Keep the required origin, ownership, departure, destination, timing and duration information. Set out actions for delays, severe weather, equipment failure, illness, injury and access to care.
- Monitor and record during the voyage. Carry out regular inspections, provide required food and water, maintain ventilation and weather protection, and record significant findings and corrective actions.
- Review the official-control trail. For EU livestock-vessel movements, ensure that competent-authority checks, vessel approvals, contingency arrangements and exit-point requirements are addressed under the additional EU controls.
What welfare protection looks like onboard
Space, height and movement
Animals need adequate floor area and height under Regulation 1/2005, with the applicable detail depending on species and arrangement. Crowding decisions should therefore be tied to the relevant annex provisions, container design and the animals’ ability to remain safe and be inspected.
Air, weather and ship systems
Annex I addresses air quality, while WOAH addresses ventilation and protection from weather. A voyage plan should consider how the systems perform in changing conditions, not only how they operate at departure. Staff need safe access to inspect animals and identify deteriorating conditions.
Water, feed and rest
Water, feed and rest must be supplied at suitable intervals under the EU general duty, with species-specific rules and exceptions in the annexes. WOAH likewise treats food and water as core voyage-planning subjects. The schedule should show how supplies are delivered and how staff will confirm that animals can use them.
Recommended Free Tools
Inspection and intervention
Regular welfare checks are required under the EU framework, and WOAH calls for regular inspection and action when problems arise. An inspection system is useful only if it leads to intervention: isolate an injured animal when appropriate, obtain veterinary help, correct environmental conditions and document the decision.
Best Value
Who may be accountable when something goes wrong?
Responsibility is distributed rather than concentrated in the captain or the company that owns the vessel. Depending on the journey, the relevant parties include:
- Exporters and owners: provide accurate animal information and ensure animals are fit for the intended journey.
- Importers and agents: coordinate the destination, communicate requirements and ensure the receiving facilities can handle the animals.
- Journey organisers and transporters: plan timing, route, facilities, staffing, documents and welfare checks.
- Shipping companies and masters: operate the vessel, maintain onboard systems and ensure that the crew can inspect and care for the animals.
- Handlers and facility managers: load, unload, inspect and care for animals using suitable facilities and competent methods.
- Competent authorities: perform official checks, maintain records and apply the relevant approval and control requirements.
Subcontracting a task does not erase the shared responsibility described by WOAH. Contracts can allocate work, but the welfare duty still has to be managed across the chain.
Limits, exceptions and common mistakes
- Calling EU law universal maritime law: Regulation 1/2005 applies within its stated EU scope; it is not a rule for every sea journey worldwide.
- Applying the 10-nautical-mile threshold to every shipment: Article 7(2) names specified domestic species and a Community-port trigger.
- Using a generic checklist: Annex I includes species-specific provisions and exceptions for fitness, space, equipment and care.
- Treating WOAH standards as automatically enforceable: Chapter 7.2 guides international practice, while domestic legislation determines legal compulsion.
- Focusing only on shipboard conditions: EU livestock-vessel controls also cover official records, contingency plans, vessel approval and exit-point infrastructure.
- Ignoring current law: the European Commission has reported work on a wider revision of EU animal-welfare legislation, including transport. Proposed or amended rules can change the answer for a future voyage.
What to verify before relying on an answer
A reliable legal answer for an individual voyage should identify the route, species, commercial status, dates and applicable edition of the law. Check the current consolidated EU text and the competent authorities’ instructions before loading, especially when a voyage involves an EU exit or entry point, a livestock vessel, a species-specific exception or a proposed legislative change.

Bottom line
Sea-transport welfare is governed by overlapping layers: route-specific national or regional law, the EU’s Regulation 1/2005 and livestock-vessel controls in Regulation 2023/372 where applicable, and WOAH’s international standards. The decisive compliance tasks are to establish jurisdiction, verify fitness, use an appropriate and approved vessel when the EU trigger applies, provide space, air, water, feed, rest and inspection, keep the required records, maintain contingency plans and allocate responsibility across every party involved.
