AI involvement alone does not create one worldwide right to appeal. Your options depend on your jurisdiction, the type of decision, the data used, the system’s role and whether a person meaningfully reviewed the result. In the European Union, the key protection covers decisions based solely on automated processing that have legal or similarly significant effects. Colorado has enacted separate rights for covered automated decisions beginning January 1, 2027. UK rules are changing and must be checked against the current legislation and commencement dates.
Start with four questions that determine your rights
Before asking for an explanation or human review, establish the legal setting. The same algorithmic score can be regulated differently depending on where the organization operates, where you are located, and whether the decision concerns credit, employment, housing, insurance, education, public benefits, security or another sector.

- Which jurisdiction applies? Identify the country, state or other authority governing the organization and transaction.
- What happened? Record the decision, date, practical consequence and any notice or explanation you received.
- How did the system participate? Was it merely an analytical tool for a decision-maker, or did its output determine the result without meaningful human control?
- How serious is the effect? Legal consequences and effects comparable in significance to a legal consequence generally receive stronger protection than routine personalization or low-impact recommendations.
Also identify the personal data or profile involved. A system may infer attributes from your data without making a final decision, or a person may use an automated recommendation and genuinely change the outcome. Those distinctions often determine whether a specific right is triggered.

| Jurisdiction | Core trigger | Potential rights | Timing and qualifications |
|---|---|---|---|
| EU GDPR | A decision based solely on automated processing that produces legal effects or similarly significant effects | Generally, a right not to be subject to the qualifying decision; where an exception permits it, safeguards can include human intervention, expressing a view and contesting the decision | Exceptions include contractual necessity, explicit consent or authorization in EU or national law with suitable safeguards. The facts and sector law matter. |
| Colorado SB26-189 | A covered automated-decision technology produces a covered consequential decision with an adverse outcome | Request personal data used, correct factually incorrect data, and request meaningful human review and reconsideration | Enacted law takes effect January 1, 2027. Implementing rules were proposed in 2026, so details and compliance procedures are time-sensitive. |
| United Kingdom | UK GDPR rules on significant automated decisions, as amended by the Data (Use and Access) Act 2025 | Rights and safeguards differ from the EU text; the amended framework includes a definition based on absence of meaningful human involvement and changes concerning special-category data | Check the current UK legislation and commencement status for the date of your case rather than assuming EU wording applies. |
EU GDPR: when Article 22 protection applies
“Solely automated” means more than using an AI tool
The European Commission describes a solely automated decision as one taken by technological means without human involvement. The European Data Protection Board adds a practical test: did a person exercise significant control, and could that person change or reverse the outcome? A nominal sign-off that simply accepts the system’s output may not amount to meaningful involvement.

That means an employer’s recruiter, lender or insurer cannot avoid the issue merely by placing a human somewhere in the workflow. The person’s role, authority, information and ability to depart from the recommendation all matter. Conversely, an AI-assisted decision with genuine, informed human assessment may fall outside the “solely automated” category even though AI materially influenced the analysis.
The effect must be legally or similarly significant
Article 22 concerns decisions that produce legal effects or affect a person in a similarly significant way. The Commission gives refusal of an online credit application as an example of a potentially significant effect. A tailored advertisement or an ordinary content recommendation normally will not meet that threshold. Whether a particular outcome qualifies depends on its real-world consequences and the applicable law.
The Commission states the protection this way:
“The data protection law establishes that you have the right not to be subject to a decision based solely on automated means, if the decision produces legal effects concerning you or significantly affects you in a similar way.”

Profiling is related, but not identical
Profiling is automated processing of personal data to evaluate personal aspects, such as reliability, behavior, interests or economic circumstances. It can occur without a decision being made. An organization may profile you for marketing, risk analysis or eligibility assessment, then have a person make the final decision. Profiling can therefore be relevant evidence without automatically creating an Article 22 right.
The EDPB explains these distinctions in its guidance on respecting individuals’ rights.
EU exceptions and the safeguards that follow
The GDPR sets a general protection against qualifying solely automated decisions, but it is not an unconditional ban. A solely automated decision may be permitted when it is:
- necessary to enter into or perform a contract with you;
- authorized by EU or national law that also provides suitable safeguards; or
- based on your explicit consent.
When one of those exceptions applies, the organization must provide the safeguards required by the GDPR. Depending on the circumstances, these can include the ability to obtain human intervention, express your point of view and contest the decision. Special-category personal data, such as certain health, biometric or political information, is subject to additional restrictions and conditions.

Do not treat an exception as permission to ignore you. Ask which exception the controller relies on, what safeguards are available and how to use them. The Commission’s guidance for organizations, Dealing with requests from individuals, describes request handling and response obligations.
How to challenge a potentially automated EU decision
- Identify the controller. Find the company, public authority or other organization that made or implemented the decision, not merely the software supplier.
- Preserve the record. Save the decision notice, date, account or application number, stated reason, score or classification (if disclosed), and the practical harm.
- Ask directly about automation. Request confirmation of whether automated processing or profiling contributed, whether the decision was based solely on it, and what meaningful human involvement occurred.
- Request relevant data and correction. Ask what personal data and inferred information were used, and identify factual errors with supporting documents. Use the access and rectification routes that apply to your situation.
- Invoke the available safeguard. Where an Article 22 exception applies, request human intervention, state your view and contest the outcome. Ask for the exact review channel and deadline.
- Explain the real-world impact. Describe lost access to credit, work, housing, services or another significant opportunity rather than simply saying that an algorithm was used.
- Escalate if necessary. If the controller does not respond or the response is inadequate, consult the data-protection authority, an ombudsman, a discrimination body or legal-aid service competent for your country and sector.
Keep copies of every request and response. A clear chronology helps a regulator distinguish a factual-data dispute, an unlawful solely automated decision and a separate discrimination or sector-law issue.
The EU AI Act does not replace data-protection rights
The AI Act and the GDPR address different legal questions. Recital 10 of the AI Act confirms that people continue to have rights and guarantees under EU data-protection law, including protections concerning solely automated individual decision-making. The AI Act therefore should not be presented as one universal appeal mechanism for every AI-supported outcome. Read Recital 10 alongside the GDPR rules that apply to your case.
There is also a narrow safeguard in Recital 42: in the specified criminal-offence risk context, natural persons should not be assessed solely through AI-based profiling or personality characteristics without objective, verifiable facts and human assessment. That provision is tied to that criminal-risk context; it is not a general rule covering every commercial or administrative risk score. The text is available in Recital 42.

Colorado: rights under SB26-189 from January 1, 2027
Colorado’s SB26-189, signed in 2026, repeals and reenacts state provisions on automated decision-making technology. Its enacted summary describes rights for consumers affected by covered consequential decisions with adverse outcomes. Those rights include:
- requesting the personal data used by the covered technology;
- correcting data that is factually incorrect; and
- requesting meaningful human review and reconsideration of the adverse decision.
The law’s effective date is January 1, 2027. It is not a statement that all Colorado algorithmic decisions already carry these rights in 2026. The enacted bill and its scope are set out by the Colorado General Assembly.
Implementation is still moving. The Colorado Attorney General reported filing proposed rules on August 11, 2026, with rulemaking comments scheduled through October 26, 2026. Definitions, notices, procedures and covered entities may therefore depend on the final rules. Check the Attorney General’s Colorado Anti-Discrimination in AI Law rulemaking page for the current status when making a request.

If you are preparing a Colorado request, preserve the adverse decision and ask the organization which covered technology and personal data were involved, how to submit a correction, and how to obtain meaningful human reconsideration once the applicable process is available.

The UK is a separate and changing framework
Do not copy an EU GDPR answer into a UK complaint without checking the current UK text. The Data (Use and Access) Act 2025 amended the UK GDPR, including the rules on significant automated decisions, special-category data and the concept of meaningful human involvement. The official EU adequacy decision records those amendments, while the current UK GDPR text is published in Chapter III of the UK legislation.
Whether an amendment applies to your event can depend on commencement provisions and the date of the decision. Confirm the operative wording and any regulator guidance for your date, sector and location. A UK complaint may still involve access, correction, fairness, discrimination or sector-specific rights even where the automated-decision provision does not apply.
When a human “reviews” the result
The decisive issue is not the job title of the reviewer but what the reviewer actually did. Useful questions include:
Quick wins for a faster PC:
Clear out junk files and repair common Windows errorsFree Scan →Fix the driver behind crashes, sound loss and screen glitchesFind Drivers →Repair Windows errors before they cause bigger problemsFix Now →- Did the reviewer see the relevant facts, or only a system-generated yes/no result?
- Could the reviewer obtain additional information and investigate an error?
- Did the reviewer have authority to depart from, reverse or delay the system’s recommendation?
- Was there enough time and expertise to exercise independent judgment?
Ask the organization to describe this process in concrete terms. A statement that “a human is in the loop” does not by itself establish meaningful control.
A practical checklist for any jurisdiction
- Write down the organization, decision, date, effect and jurisdiction.
- Collect notices, emails, application records and evidence of factual errors.
- Ask whether an automated system or profile contributed and whether a person could alter or reverse the result.
- Request the personal data used and the correction, review or contest process available under local law.
- State the specific facts that are wrong and attach concise supporting proof.
- Request reconsideration or human review where the relevant law provides it.
- If the organization fails to respond, identify the competent regulator, ombudsman, discrimination agency or legal-aid route for that jurisdiction and sector.
There is no single worldwide complaint form. The correct escalation path depends on the law governing the organization and the type of harm you experienced.
Quick Recap
What to remember
- AI use by itself does not establish an EU GDPR Article 22 claim; sole automation and a legal or similarly significant effect are central.
- Profiling and automated decision-making overlap but are not the same legal concept.
- EU safeguards can include human intervention, expressing a view and contesting a decision, subject to exceptions and conditions.
- The EU AI Act preserves relevant data-protection rights rather than creating one universal appeal right.
- Colorado’s enacted rights for covered decisions begin January 1, 2027, with rulemaking details still time-sensitive in 2026.
- UK rules have changed separately, so verify the current text and commencement status.
