What Restaurants Should Disclose When They Use AI-Generated Food Images: EU Rules and Practical Guidance for 2026

For a restaurant serving customers in the European Union, two separate questions determine what to disclose about an AI-generated food image. First, the image may fall within the EU AI Act’s transparency rules for qualifying deepfakes. Second, whether or not an AI label is required, EU food-information rules prohibit a menu, delivery listing or advertisement from misleading people about the dish. A notice can explain that an image is synthetic; it cannot make an inaccurate depiction acceptable.

Article 50 transparency obligations apply from 2 August 2026. The European Commission’s summaries describe a deployer disclosure duty for image, audio or video content that qualifies as a deepfake. They do not establish that every AI-generated photograph of a meal must carry a label. Restaurants should assess the image, the changes made to it and the context in which diners see it, then use a plain-language notice whenever the synthetic or materially altered presentation could affect a reasonable customer’s understanding.

What the EU AI Act actually requires

The EU AI Act uses a narrower concept than “anything made with AI.” The European Commission describes a deepfake as image, audio or video content generated or manipulated by AI that resembles existing persons, objects, places, entities or events and would falsely appear to be authentic or truthful. Article 50 includes transparency duties for qualifying content, with obligations applying from 2 August 2026.

That wording matters for restaurant marketing. A fully generated image of a bowl of pasta is not automatically a deepfake merely because software created it. The question is whether the particular image and its presentation could be taken as an authentic depiction of an existing dish, place, event or other subject. A photorealistic image presented as the restaurant’s actual meal deserves more scrutiny than an obviously stylized illustration used as decoration.

The Act also distinguishes between providers and deployers. A provider makes or supplies an AI system; a deployer uses the system or its output. A restaurant that commissions, edits or publishes an image should identify which duties apply to its arrangement, including whether it is acting as a deployer. A supplier’s technical marking does not remove the restaurant’s responsibility to present food information accurately.

The European Commission’s Code of Practice on Transparency of AI-Generated Content is voluntary. The Article 50 obligations it explains are legal. Treat the Code as practical guidance rather than as a substitute for the regulation or for advice about a particular national enforcement situation.

Food-information law is a separate duty

Even when an image does not meet the AI Act’s deepfake threshold, EU food rules still apply to how the meal is advertised and pictured. The European Commission’s summary of Regulation (EU) No 1169/2011 states that food information must not mislead consumers about characteristics such as the food’s nature, identity, composition or quantity. The rule covers advertising and presentation, including pictorial representations.

The rules specifically address images that suggest an ingredient or food is present when it has been substituted or is absent. A generated burger showing a thick slice of a particular cheese, a garnish, or a filling that the restaurant does not provide can therefore create a problem independently of whether the picture is labelled as AI. The same concern applies to a portion that looks materially larger, a preparation method that is not used, or a finished appearance customers cannot receive.

Disclosure and accuracy solve different problems. A label tells people something about how the picture was made. It does not correct a false impression about ingredients, size, quantity or preparation. If the image remains materially misleading after a notice is added, the safer remedy is to change the image, change the dish, or use a clear textual qualification that accurately describes what customers will receive.

Classify the image before deciding on a notice

Record what was done to the image rather than using a single “AI” category. The following framework is a practical editorial risk assessment; it is not a statutory test that replaces legal advice.

Image treatment Questions to ask Practical action
Fully generated food image Is it presented as the restaurant’s real dish? Does it depict an existing location, event or other subject as if photographed? Does it show ingredients, size or preparation that customers may expect? Use a nearby plain-language notice when the synthetic status could affect understanding. Do not use it to promote a dish whose real characteristics differ materially.
Real photograph with limited AI editing Were color, lighting, background or minor blemishes changed, or were ingredients, portions and shape changed? Minor corrections may call for an internal record and a context-based decision. Disclose or replace the image when edits alter a meaningful food characteristic or make the plate appear more authentic than it is.
Composite or generated background Could a diner reasonably believe the setting, event or restaurant location is real? Does the background change the meaning of the food presentation? Consider disclosure if the setting is material to the claim. Keep the dish itself accurate and avoid implying a real event or location that did not occur.
Stylized illustration Would an ordinary viewer recognize it as an illustration rather than a photograph of the meal? A conspicuous illustration style may reduce confusion, but a short notice is still prudent when the image appears in a menu or listing where customers normally expect a true depiction.

Material changes are the warning sign

Focus on changes a diner could use to decide whether to order. Ingredients, substitutions, portion size, number of pieces, cooking method, texture cues and expected appearance are all material candidates. Adding steam for atmosphere is different from adding a seafood ingredient. Brightening a photograph is different from turning a small serving into a platter.

Context determines the risk

The same image can communicate different things in different places. A clearly labelled concept image in a blog post may be understood as illustrative. The identical image beside a dish name and price in a delivery marketplace is more likely to be read as a representation of the meal that will arrive. Examine the image’s caption, surrounding text, menu claims, ordering flow and audience, not just the file itself.

Where a disclosure should appear

When disclosure is warranted, put it next to the image or in the same immediately visible panel. A diner should not have to open a general terms page, follow a separate “AI policy” link or infer the image’s status from an icon. On a menu, place the notice below the picture or beside its caption. In a delivery listing, keep it in the listing’s visible description. In an advertisement, include it in the creative or adjacent copy wherever the platform permits.

The reviewed European sources do not prescribe one universal phrase or one mandatory placement for every restaurant image. A concise statement such as “AI-generated illustration; actual dish may differ” communicates the image’s status and sets an expectation about variation. Where the image has been substantially edited rather than wholly generated, say so plainly: “Image digitally altered; see description for the dish served.” Do not call an image a photograph if it is not one, and do not use vague wording such as “artist’s impression” if customers could reasonably read it as a real serving.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Make the notice specific enough to matter. If the image does not show the actual portion, say that. If a garnish or arrangement is decorative and not included, identify it in the dish description as well as in the image treatment notice. The notice should not imply that every difference is harmless when an ingredient or quantity has changed.

A publication workflow for restaurant teams

  1. Set the jurisdiction. Identify where the restaurant, ordering service and intended audience are located. The evidence summarized here supports EU-focused advice. Do not assume the same Article 50 analysis applies outside the EU; check the law and platform policy for each other market.
  2. Inventory the source and edits. Keep the original prompt or photograph, the editing steps and the final file. Note whether software generated the entire plate, replaced an ingredient, expanded the portion, changed the background or altered only lighting and color.
  3. Compare the picture with the dish served. Use the current recipe, portion specification and plating guide. Check every visible ingredient, side, topping, vessel, piece count and preparation cue. A manager should approve any difference that could affect an ordering decision.
  4. Assess the AI Act category. Ask whether the content could be a qualifying deepfake that would falsely appear authentic or truthful, and identify the restaurant’s role in using or publishing it. If the answer is uncertain, treat uncertainty as a reason for a clear notice and obtain jurisdiction-specific legal advice rather than claiming that no label is needed.
  5. Assess food-law risk separately. Regardless of the AI result, remove or correct any depiction that misleads about nature, identity, composition, quantity or a substituted or absent ingredient. A disclosure is not a waiver.
  6. Choose the least confusing presentation. Prefer a real photograph when the image is intended to show the exact meal. If an illustrative image is useful, make its status visible where the customer sees it and align the text description with the dish actually supplied.
  7. Document the decision. Save the approved image, notice wording, date, market, responsible reviewer and recipe version. Recheck the asset when ingredients, portions, suppliers, menu names or platform layouts change.

Common scenarios and safer fixes

A generated image shows an ingredient that is not in the recipe

Suppose a plant-based sandwich image contains a glossy slice that resembles dairy cheese, while the sold version uses a different topping or no cheese. The picture can mislead about composition even if a caption says it was AI-generated. Replace the image or make the difference unmistakable in the image and the written dish information. Do not rely on the AI notice alone.

The picture shows a substantially larger serving

A small bowl digitally enlarged into a generous serving can mislead about quantity. A phrase such as “serving suggestion” may not cure the impression if the menu presents the picture as the meal being sold. Use a photograph or illustration that matches the specified portion, and state any genuine serving limitation in the ordering information.

A realistic scene implies a real restaurant event

A generated image may place the dish on a terrace, at a festival or in a recognizable setting where the restaurant has never served it. If the setting is material to the advertising claim, disclose that it is synthetic and remove wording that implies the event or location actually occurred. The deepfake analysis is separate from the food-accuracy analysis, so check both.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

A real photo is retouched for color and cleanliness

Routine exposure, white-balance and dust corrections do not necessarily change what food is offered. The risk rises when editing adds ingredients, removes an unappealing component, changes the amount or creates a texture the kitchen cannot reproduce. Keep a simple edit log so staff can explain what was changed and why.

Managing third-party tools and platforms

Restaurants often receive images from agencies, photographers, menu systems or delivery platforms. Contract language should identify who generated the asset, who edited it, who approves factual claims and where disclosure text will appear. Ask for the original file and an edit history rather than accepting a vendor’s statement that an image is “compliant.”

Platform interfaces may add their own AI labels, but the research reviewed here does not establish consistent behavior across services. A platform badge may be hidden on another device, omitted from a print menu or removed when the asset is downloaded. Place the restaurant’s own plain-language notice where customers encounter the image, and verify the result on mobile, desktop and printed versions when those channels are used.

What is and is not established outside the EU

The strongest evidence available for this question concerns the European Union. It does not establish equivalent disclosure requirements in the United States, the United Kingdom or other jurisdictions, nor does it establish country-specific enforcement outcomes or a universal platform-labeling practice. Restaurants operating across borders should map the rules for each target market and keep claims about legal duties geographically qualified.

The IAB AI Transparency & Disclosure Framework V2, dated 18 August 2026, recommends a risk-based, materiality-driven approach for consumer-facing marketing, including imagery. It is an industry framework, not legislation. It can help a marketing team ask whether an AI use could change a consumer’s interpretation, but it cannot replace the EU AI Act or food-information requirements.

Internal checklist before an image goes live

  • Is the image a real photograph, an edited photograph, a composite or fully generated artwork?
  • Could a reasonable diner mistake it for a photograph of the actual serving?
  • Does it accurately show ingredients, substitutions, portion, piece count, preparation and expected appearance?
  • Could the image qualify as AI-generated or manipulated content that would falsely appear authentic or truthful under the Article 50 deepfake concept?
  • Is the notice visible beside the image in every channel where it appears?
  • Does the written menu description correct any detail the picture cannot show?
  • Has the asset been checked for every jurisdiction and platform in which it will run?
  • Is there a named reviewer and a record of the image, edits, notice and approval date?

The practical standard is simple: show customers what they will receive, identify synthetic or materially altered imagery when that information affects their understanding, and never treat a disclosure as permission to exaggerate the dish. For EU-facing restaurants, that approach addresses the AI Act’s qualified transparency duty while meeting the separate requirement that food information and presentation remain accurate and non-misleading.
