Short answer: A landlord’s permission to enter your rented unit is not automatically permission for immigration officers to enter it. Under the National Immigration Law Center’s (NILC) national guidance current as of February 17, 2026, officers generally need your consent, a judicial warrant signed by a judge or magistrate, or a recognized emergency exception to enter a private home. An immigration-agency administrative warrant, by itself, generally does not authorize entry into a home.
Landlord-entry rules are a separate question controlled by your lease and state or local housing law. If officers come to your door, keep it closed, ask to see the document, clearly decline consent, remain silent, and request a lawyer. Do not lie, hide someone, obstruct officers, or physically resist if they force entry.

Why two different legal questions are often confused
Renters commonly ask whether a landlord can “let ICE in.” That wording combines two separate issues:
- Landlord access: when the property owner or manager may enter your unit for repairs, inspection, emergencies, showings, or another lease-related purpose.
- Government access: what legal authority immigration officers need to enter a private dwelling, search it, or arrest someone inside.
A landlord’s right to enter for a repair does not automatically give government agents authority to enter. Conversely, a landlord’s refusal to open the door does not necessarily stop officers who have valid judicial authority or an applicable exception. Analyze the lease, state and local law, the officers’ document, and the circumstances separately.

Can immigration officers enter a rented home?
NILC’s February 17, 2026 national FAQ says immigration officers generally cannot enter a home without permission unless they have a warrant signed by a judge or a recognized exigent circumstance applies. NILC also explains that a leaked May 2025 Immigration and Customs Enforcement (ICE) memo claimed broader authority in some removal-order situations. NILC’s position is that an agency memo does not change constitutional and statutory rules; in its words, “ICE cannot change them by writing a memo.” That is an advocacy organization’s explanation of the law, not a court holding, and litigation or policy can change the practical landscape.
For a renter at the door, the key distinction is whether the paper is a judicial warrant or an administrative immigration warrant. Consent and emergency exceptions can change the analysis, and a document’s label alone does not resolve every issue.
Judicial warrant
A judicial warrant is normally issued by a court and signed by a judge or magistrate. NILC says an immigration judge is not the judicial officer meant by this distinction. A document should be checked for the court heading, the judge’s or magistrate’s signature, the person or address identified, and the scope of the authority granted. A judicial warrant may authorize an arrest, a search, or both; read what it actually says rather than assuming that every warrant permits a general search.

Administrative immigration warrant
An administrative warrant is issued by an immigration agency and signed by an immigration officer. Forms commonly identified in NILC guidance include Form I-200 and Form I-205. They may carry Department of Homeland Security or ICE branding, but branding does not make them judicial warrants. Under NILC’s current national guidance, an administrative warrant alone does not authorize officers to enter a private home without consent.

Exigent circumstances and other exceptions
Warrant rules have exceptions. A genuine emergency, such as an immediate threat to safety or a risk that evidence will be destroyed, may affect whether officers can enter without first obtaining a judicial warrant. The exact standard is fact-specific. Do not assume that an officer’s assertion of an emergency automatically settles the matter, but do not physically interfere with an entry either.
What to do when officers come to your door
NILC’s “Know Your Rights: Warrants,” published December 22, 2025, recommends a calm, non-confrontational sequence. These steps protect your ability to challenge an entry later without asking you to obstruct officers.
- Keep the door closed. You can speak through the door, a window, or an intercom. Opening the door can be treated as consent to entry in circumstances where officers otherwise would need permission.
- Ask who they are and why they are there. Request names, agency identification, and the purpose of the visit. Do not rely on uniforms alone to determine what authority they have.
- Ask to see any warrant. Request that officers hold it to a window or slide it under the door. You can inspect the issuing court, signature, name or address, date, and scope without opening the door.
- State that you do not consent. NILC’s suggested wording is: “I do not consent to you entering my house.” Say it clearly and avoid arguments about immigration status or the facts of a case.
- Remain silent and ask for counsel. NILC also suggests: “I am using my right to remain silent. I want to speak with a lawyer right away.” You generally do not have to answer investigative questions, although different rules can apply to requests for identity documents or during an arrest.
- Do not lie, hide someone, or obstruct. NILC cautions that knowingly denying a named person is inside while refusing entry could create concealment risk. Do not provide a false name, destroy evidence, physically block an officer, or direct another person to hide.
- Do not physically resist. If officers force entry, step aside, keep your hands visible, and repeat that you do not consent. Physical resistance can create additional danger and charges. Contact a lawyer as soon as it is safe.
What if officers show a document that looks official?
Official-looking paper is not the same as judicial authority. Compare the issuing authority and signature, not just the logo. Check whether the document names your address, identifies a person, states what officers may do, and has a current date. A complicated warrant may require legal review; a renter is not expected to conclusively authenticate it during a stressful doorstep encounter.
How landlord entry rules work
Landlord access is governed primarily by the lease and the law where the property is located. States and cities differ on notice periods, permitted purposes, entry hours, emergency access, and remedies for unlawful entry. Some jurisdictions require written notice for ordinary inspections or repairs; others set a reasonable-notice standard. Emergency provisions can allow immediate entry to address fire, flooding, a gas leak, or another urgent threat.

Read the lease for the practical baseline
Look for clauses covering:
- How much advance notice the landlord must give and how notice must be delivered.
- Permitted reasons for entry, such as repairs, inspections, pest treatment, or showing the unit to prospective tenants or buyers.
- Hours when entry may occur.
- Emergency definitions and after-hours contacts.
- Whether a manager, contractor, or law-enforcement officer may be accompanied by the landlord.
A lease cannot necessarily waive protections supplied by state or local law. If the lease conflicts with a mandatory housing rule, a tenant-rights organization or local attorney can explain which provision controls.
Landlord presence is not government consent
If a landlord lawfully enters to repair a sink, that does not automatically authorize immigration officers to follow inside and search. Officers still need a legal basis for government entry. Similarly, a landlord may choose to open a building’s common entrance while lacking authority to consent to entry into a tenant’s private unit. The facts of the building, the lease, and the officers’ stated purpose matter.
Landlord records, subpoenas, and warrants are different
Immigration authorities may seek information from a landlord without asking to enter a unit. A demand for tenant files is not the same thing as a warrant authorizing physical entry or a search of a home.

What a records demand may look like
A subpoena can request leases, rent ledgers, contact details, or other records. The Associated Press reported on July 15, 2025, that immigration authorities sought landlord-held tenant files with subpoenas. The report quoted a housing-law professor warning against automatic overcompliance, while federal officials defended the subpoenas. Those competing positions show why a landlord or tenant should not assume that a particular demand is valid or invalid without reviewing the actual document.

Questions to ask about a subpoena or other demand
- Who issued and signed it?
- Is it a subpoena, a judicial warrant, an administrative request, or another document?
- Which records and people does it cover?
- What is the response deadline?
- Does it provide a procedure to object, seek court review, or narrow the request?
- Could disclosure violate a state privacy rule, confidentiality promise, or housing regulation?
Do not tell a landlord categorically to ignore or comply with a demand based only on its title. A lawyer can evaluate its scope, enforceability, and any objection deadline.

| Document or situation | Who issues or controls it | What it may concern | What it does not automatically establish |
|---|---|---|---|
| Judicial warrant | A court, signed by a judge or magistrate | Authority specified in the warrant, such as an arrest or search | That every room, person, or item may be searched; read the scope |
| Administrative immigration warrant | An immigration agency, signed by an officer | Immigration arrest or enforcement action under agency authority | Permission to enter a private home without consent, under NILC’s February 2026 guidance |
| Landlord-entry notice | Landlord or property manager under the lease and local law | Repair, inspection, showing, or another housing purpose | Government authority to enter or search a tenant’s home |
| Subpoena for tenant records | An agency, court, or other authorized issuer | Production of specified documents or information | Authority to walk into a unit or conduct a physical search |
State and local rules can change the practical answer
There is no single nationwide landlord-notice period or universal remedy for an unlawful entry. The federal guidance about home entry should therefore be paired with current state and local information.
New York example
The New York State Office of the Attorney General’s “Immigrant Tenants’ Rights” guide, published in March 2026, addresses agents appearing at a home or speaking with a landlord. It states that ICE cannot enter a home without permission or a judge-signed warrant. New York renters should still check the current state and municipal rules for landlord notice, privacy, retaliation, and documentation of an entry.

Minnesota example
The Minnesota Attorney General’s 2026 “Tenant Rights if ICE” brochure discusses immigration encounters, unit entry, notice, records, and threats. Its details are Minnesota-specific and should not be generalized to renters elsewhere. A Minnesota tenant should use the current brochure and Minnesota law when deciding whether a landlord’s notice or conduct violated a local requirement.

What to document after an encounter
Once everyone is safe, write down the date, time, location, names or badge numbers, agency, exact words used, whether a document was shown, and whether anyone entered or searched. Save doorbell-camera footage, texts, emails, notices, and photographs of any paper left behind. Do not alter or delete recordings. If witnesses saw the encounter, ask them to preserve their own notes rather than coordinating a single story.
Documentation helps a lawyer evaluate consent, the warrant’s scope, landlord-notice compliance, possible retaliation, and any records demand. It does not replace legal advice and should not be posted publicly if doing so could expose sensitive personal information.
Where to get advice during or after the visit
When an encounter is happening, ask for a lawyer and avoid substantive questioning. Afterward, contact a local immigration attorney, tenant-rights attorney, or reputable legal-aid organization that serves your area. Tell the adviser the city and state, your immigration and housing situation only as much as necessary, what officers said, and what document they displayed. Bring the lease and copies or photographs of all papers.
The national sources discussed here do not establish one guaranteed nationwide hotline or response service. Availability, language access, and eligibility vary by location. If there is an immediate threat of violence or a medical emergency, call emergency services; do not use an emergency call to argue about warrant validity.
Quick Recap
Common mistakes to avoid
- Opening the door to “just talk.” Speak through the closed door and ask for the document first.
- Assuming an ICE form is a court warrant. Check the issuing authority and judicial signature.
- Assuming a landlord can authorize any government entry. Landlord access and officer authority are separate.
- Assuming a subpoena permits a search. A records demand and a physical-entry warrant serve different purposes.
- Arguing or touching officers. State non-consent, do not obstruct, and seek counsel.
- Treating another state’s rule as your own. Notice periods and tenant remedies are local questions.
- Relying on an old checklist. NILC’s guidance and litigation can change; verify current information when the issue is urgent.
