You may keep fish in a marine protected area (MPA) only when the exact site and zone allow recreational take and you follow every applicable species, season, size, bag, possession, gear, license, permit and reporting rule. A no-take marine reserve generally prohibits removing marine life, while a multiple-use MPA may allow hook-and-line fishing.
The words “marine protected area” do not answer the question by themselves. Identify the boundary, determine the zone’s protection level, and check the managing agency’s current rules immediately before your trip. Transit with fish already onboard can be legal in some closed areas, but fishing-gear deployment may still be prohibited.

What a marine protected area actually means
NOAA’s National MPA Center defines an MPA as “any area of the marine environment that has been reserved by federal, state, territorial, tribal, or local laws or regulations to provide lasting protection for part or all of the natural and cultural resources therein.” That definition covers a wide range of places: multiple-use areas, national marine sanctuaries, wildlife refuges, fishery closures, state parks, cultural-resource sites and fully protected reserves.
Because the designation can protect different resources in different ways, two MPAs with similar names may have completely different fishing rules. One may allow recreational angling but prohibit anchoring on a reef. Another may permit fishing for selected species with specified gear. A marine reserve or no-take zone generally bans extractive activities, including catching, retaining or removing fish and other marine life.

NOAA’s National MPA Center says, “There are many types of Marine Protected Areas in the United States, and most do not prohibit fishing and recreational uses throughout their boundaries.” NOAA Ocean Service likewise reports that nearly all U.S. MPAs allow multiple uses, including fishing, although restrictions can apply to particular activities or zones.
How common are no-take areas?
NOAA Ocean Service reported on a 2026 page that the United States has more than 1,600 MPAs, with about 41% of U.S. marine waters protected in some way and about 3% in highly protected no-take MPAs. A NOAA National MPA Center summary from 2011 found that 86% of U.S. MPAs were multiple-use, accounting for 97% of MPA area; no-take MPAs occupied less than 3% of MPA area and about 1% of U.S. waters. These figures describe national patterns, not the rule at any particular site.
Why the MPA name is not enough
A named MPA can contain several zones. A boundary shown on a chart may include a seasonal closure, a gear-restricted conservation area and a no-take reserve side by side. The same species may be legal in one zone and prohibited a short distance away. State, federal, tribal and local authorities can also impose overlapping requirements.

For an unspecified MPA, there is no universal list of fish that anglers may keep. The legally correct answer is always site-and-species specific: retain only species identified as allowed for take in that zone under the regulations in force on the date of fishing.
The rule hierarchy to follow before you fish
Use this sequence every time. It prevents a common mistake—finding a species’ open season but missing an area closure, gear ban or special permit.

Find the exact boundary and zone
Use the managing agency’s official MPA map, chart or regulation page. NOAA’s MPA Inventory can help identify the site, but the agency that manages the specific area controls the operative rules. Confirm your position with the chart datum and coordinates used by the regulation; a line on a general-purpose mapping app may not be authoritative.
-
Classify the protection level
Determine whether you are in a multiple-use zone, a gear-restricted zone, a seasonal closure or a no-take/marine-reserve zone. “Protected” does not automatically mean closed, and “multiple use” does not mean every method is allowed. A zone can allow trolling while banning bottom-contact gear or spearfishing.

Check the target species
Read the current rule for each species you intend to catch. Regional fishery regulations can prohibit retention entirely, establish an open season, set a minimum or maximum size, or impose a daily bag and possession limit. Do not assume that a fish caught legally outside the MPA may be retained inside it if possession rules differ.
-
Verify season, size, bag and possession limits
These are separate requirements. An open season does not override a size limit; a legal size does not create an allowance when the season is closed. Possession limits can apply across the vessel, cooler or trip, not only to the individual holding the rod. NOAA Fisheries states that the eight regional fishery management councils establish measures such as seasons, size limits and bag limits, which NOAA Fisheries then implements.
-
Confirm legal gear and method
Read the MPA rule and the fishery rule together. Restrictions may cover hook-and-line, bottom-contact equipment, traps, nets, spearfishing, bait collection or the number of hooks. A species may be open under regional fishery rules while the MPA bans the gear needed to target it.

Check licenses, permits and reporting
For state waters—generally from shore to 0–3 nautical miles offshore, depending on the state and coastline—NOAA directs anglers to the relevant state fish-and-wildlife agency. Federal-water fisheries can require additional permits, including permits for highly migratory species or Hawaii bottomfish. Some fisheries also require electronic or paper catch reporting, vessel registration or a for-hire license.

Recheck immediately before departure
Regulations can change during a season, and state rules can be more restrictive than federal rules. Check the official notice, regulation booklet or emergency closure issued for your location and date. Save the current page or download the applicable document so you can reference the rule offshore when connectivity is poor.
What fish can you keep? Use a site-and-species answer
There is no national MPA catch list. The following examples from NOAA’s Greater Atlantic materials show why a broad answer is unsafe: Atlantic cod has a limited open season and minimum-size requirements in some stock areas but “NO RETENTION ALLOWED” in Southern New England. Atlantic salmon, sea scallop, ocean pout, red drum, several skate species, striped bass in federal waters, sturgeon, windowpane flounder and wolffish are listed as having no recreational fishing allowed in the stated contexts. Those are regional fishery examples, not rules for every MPA or every state.
Before keeping a fish, match all of the variables in this table to your trip:
| Question | What must be established | Why it matters |
|---|---|---|
| Where exactly? | MPA name, coordinates, boundary and zone | Different zones can have different permissions. |
| What protection level? | Multiple-use, gear-restricted, seasonal closure or no-take | A no-take zone generally prohibits removing marine life. |
| Which species? | Species identification and any stock-area rule | Some species are closed or non-retainable even when fishing is allowed. |
| When? | Open season and the regulation’s effective date | Closures can be seasonal or emergency-based. |
| How large? | Minimum or maximum size, measured exactly as specified | A legal species can still be undersized or oversized. |
| How many? | Daily bag and vessel or possession limits | Limits may apply to the angler, vessel, cooler or trip. |
| With what gear? | Permitted hooks, lines, lures, traps, nets or spear equipment | MPA rules can be stricter than the general fishery rule. |
| Which authorization? | State license, federal permit, vessel registration and reporting | Location and species can trigger additional requirements. |
Can you transit an MPA with fish onboard?
Transit rules are distinct from fishing rules. An area may allow a vessel to pass through with legally caught fish onboard while prohibiting fishing, anchoring or possession of certain gear. Whether transit is lawful depends on the site’s written rule, the vessel’s activity and the gear being carried or deployed.

California’s 2026 example
California’s 2026 Ocean Sport Fishing Regulations illustrate the distinction. Vessels may transit state marine reserves with catch onboard, but fishing gear may not be deployed while transiting a state marine reserve. In state marine parks, conservation areas and recreational management areas, only gear used for species identified as allowed for take may be deployed.
Spearfishing equipment has an additional handling requirement: when transiting an area that prohibits spearfishing, or where the species onboard is not allowed, spearfishing gear must be unloaded and not carried in hand. Anchoring is generally allowed with catch onboard unless an area-specific rule says otherwise, and gear deployment while anchored is restricted according to the area’s classification.
Do not generalize California’s rule to another state or sanctuary. Treat it as an example of how a regulation can distinguish moving through an area from fishing inside it. Read the exact transit, anchoring, possession and gear clauses for your destination.
Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone.Licenses, permits and reporting
An MPA designation usually does not replace the ordinary fishing license. In state waters, obtain the license required by the state fish-and-wildlife agency for the location and fishing method. License boundaries do not always match an MPA boundary: a state-managed MPA can lie near federal waters, and a trip can cross both jurisdictions.

Federal fisheries may add species-specific or vessel-specific permits. NOAA identifies highly migratory species and Hawaii bottomfish as examples of fisheries that can require federal authorization. For-hire operators may face different rules from private anglers, including passenger-license, logbook or reporting requirements. Carry proof of every required authorization and follow the specified reporting deadline; a legal catch can become a violation if required reporting is omitted.

How local MPAs can support fishing while protecting resources
Protection and recreational fishing are not mutually exclusive. The Florida Keys National Marine Sanctuary illustrates the economic scale of a multiple-use approach: NOAA reported that fishing was allowed in 98% of the sanctuary. In 2007–08, more than 400,000 visitors and residents made over 2 million recreational-sport-fishing person-days and spent $262 million in Monroe County, including roughly $103 million on fishing items, bait, lines and charter fees. Those historical figures do not establish current access rules, but they show why managers may permit carefully controlled fishing outside fully protected zones.
A printable pre-trip compliance checklist
- Mark the MPA’s official boundary and the exact zone where you will fish.
- Identify whether the zone is multiple-use, gear-restricted, seasonal or no-take.
- Write down each target species and confirm that retention is allowed there.
- Record the current season dates, size measurement method, bag limit and possession limit.
- Confirm that your line, hooks, bait, traps, nets or spear equipment are legal.
- Verify state licenses, federal permits, vessel registrations and reporting duties.
- Read separate rules for transit, anchoring, gear deployment and fish already onboard.
- Check for emergency or seasonal changes on the day of departure.
- Keep the current regulation page or booklet available onboard.
Common mistakes and how to avoid them
Assuming every MPA is a no-fishing zone
Most U.S. MPAs are multiple-use, but that does not authorize every activity. Identify the zone instead of relying on the label.
Assuming every MPA allows fishing
A marine reserve or no-take zone generally prohibits extractive fishing. A seasonal closure can make a normally open area temporarily closed.

Bottom line for recreational anglers
You can keep fish in an MPA only when the exact zone permits recreational take and your catch satisfies every current species, season, size, bag, possession, gear, license, permit and reporting requirement. Most U.S. MPAs allow some fishing, while no-take marine reserves prohibit removing marine life. Transit with fish onboard may be legal even where fishing is closed, but only under the site’s specific transit and gear rules. If you cannot identify the boundary, zone and current regulation, do not fish or retain the catch until you have verified them with the managing agency.
