What Questions to Ask Your Bank About AI, Data Use, and Automated Decisions

Ask your bank four things first: where automation is used, what information influenced an outcome, how to correct errors, and how to reach a person when an automated channel fails. If the issue is a credit denial or another adverse credit action, request the specific principal reasons and ask whether a consumer report or credit score contributed. These questions help you understand and challenge a decision without assuming that every bank uses the same systems or that a human review is always legally required.

Why ask your bank about AI now?

Banks use software for many different tasks, and “AI” can mean very different levels of influence. A system might sort incoming messages, detect unusual transactions, recommend an action to an employee, or make an automated decision. The same label does not tell you whether a person approved the result, what data was considered, or how an error can be fixed.

The Consumer Financial Protection Bureau (CFPB) and five other federal financial agencies identified customer service, operational functions, governance, risk controls, and consumer-protection compliance as relevant questions about financial-institution AI in a 2021 request for information. That request was not a current rule and did not establish that every bank uses every type of system.

Chatbots are one visible example. A CFPB report estimated that about 98 million people—approximately 37% of the U.S. population—used bank chatbots in 2022 and projected 110.9 million users by 2026. Those figures are the report’s estimate and projection, not a newly measured 2026 count. The report also said all ten largest commercial banks it reviewed had chatbots; that was a finding about its review, not a census of all banks.

“Does my bank use AI?” Questions to identify the system

Start with neutral questions that make the bank describe the technology’s role rather than forcing it to agree with a label.

  • “Do you use AI, machine learning, automated scoring, or decision rules for this product or service?”
  • “Which parts of this process are automated?”
  • “Does the system make the final decision, or does it provide a recommendation to an employee?”
  • “Do you use automated systems for fraud alerts, account access, customer-service routing, credit underwriting, credit-line changes, or other decisions affecting me?”
  • “If a system flags my account or application, what checks are performed to determine whether the result is accurate?”

Ask the question about the specific product or incident. A bank may automate fraud monitoring but use a person for a particular lending decision, or it may apply different controls to new applications and existing accounts. Ask the representative to identify the department responsible for the decision and the date or case number involved.

Ask what “automated” means in practice

Terms such as “algorithm,” “decision engine,” “rules,” and “AI” can describe overlapping tools. Follow up with: “What action did the system take, and what action did a person take afterward?” Also ask whether the result was generated from a fixed rule, a statistical score, a machine-learning model, or a combination. The bank may not disclose proprietary code, but it can often explain the process at a useful level.

  • “What information did you use in reaching this decision?”
  • “Did you use information from a consumer-reporting agency, another outside source, a data broker, or a service provider?”
  • “Was account activity, spending behavior, device information, location, or anything beyond my application and your own records considered?”
  • “Which specific item or items had the greatest effect on the outcome?”
  • “How can I see or correct information that is inaccurate?”

Ask where each important data item came from. The CFPB notes that Fair Credit Reporting Act (FCRA) disclosure duties can apply when a credit decision is based in whole or in part on information from a source other than the applicant or the creditor’s own files. If an outside consumer-reporting agency supplied information, ask for the agency’s name and the instructions for disputing an error.

Separate data used for the decision from data used for service

A bank may use information to authenticate you, route a service request, detect fraud, market a product, or evaluate credit. Those are different purposes. Ask: “Was this information used to decide my eligibility, or only to verify my identity or route my request?” Then ask whether the same information is used for another purpose. Do not assume that a bank has one universal retention, sharing, or secondary-use policy across all products.

If an automated credit decision is adverse

For a denial, reduction, cancellation, or other adverse credit action, ask for the specific principal reasons and whether an outside report or score contributed. A generic statement such as “you did not meet our standards” does not tell you which factors actually drove the result.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  • “What are the specific principal reasons for this adverse action?”
  • “Which factors actually considered in my application caused the decision?”
  • “Did you use a consumer report or credit score? If so, which reporting agency supplied it?”
  • “What information about the score or its key factors am I entitled to receive?”
  • “How do I dispute inaccurate information or request reconsideration?”

CFPB Circular 2022-03 states that the Equal Credit Opportunity Act (ECOA) and Regulation B adverse-action requirements apply regardless of the technology used. Reasons must accurately describe the factors considered. Referring only to an internal policy, a qualifying score, or a checklist that does not identify the actual reason is not enough under the guidance. Where applicable, FCRA notices can include the consumer-reporting agency and information about credit-score factors.

What to do with the notice you receive

  1. Save the complete notice. Keep the date, application or account number, stated reasons, score information, and any instructions for contacting the bank.
  2. Ask for clarification promptly. Request an explanation in plain language of each principal factor, especially if the notice uses broad terms.
  3. Check outside reports. If the bank names a consumer-reporting agency, obtain the relevant report and compare it with your records.
  4. Dispute factual errors through the stated channel. Ask whether the bank needs documents, a written dispute, or a separate request to the reporting agency.
  5. Ask what happens next. Confirm whether a corrected record will trigger a new review, whether a person will assess the dispute, and when you should expect a response. Do not assume that a human review is universally required; the available process depends on the product and applicable rules.

How to challenge incorrect information

Use precise, document-based questions. “Your data is wrong” is less useful than “The balance shown on the date of the decision was $X, but the statement dated [date] shows $Y.” Ask the bank to identify the record it relied on, the source of that record, and the method for submitting proof.

Keep copies of statements, notices, identity-verification records, and correspondence. Record the representative’s name or identification number, the time of the call, the case number, and every promised deadline. If the bank says a vendor supplied the information, ask whether your dispute must go to the vendor, the bank, or both.

Ask whether an incorrect fraud flag, identity match, or account-access score caused a fee, declined transaction, missed payment, or other harm. Request instructions for correcting the resulting consequence, not only the underlying data. A correction to a database may not automatically reverse a fee or restore access.

“Can I talk to a person instead of the bank chatbot?”

When an automated service cannot resolve the issue, ask directly for a person and for an alternate channel.

  • “Can you connect me to a representative now?”
  • “What phone number, secure-message channel, or complaint process can I use instead?”
  • “Can I receive a reference number or written record of this conversation?”
  • “If the automated system gave me incorrect information, how do I correct the resulting fee, missed payment, or account problem?”

The CFPB says chatbots can handle basic inquiries but may perform poorly with complex problems, leave people in repetitive loops, and raise privacy and security concerns. That describes risks, not proof that every chatbot is deficient or that every consumer has an unconditional right to a live agent in every circumstance.

Issue Chatbot or automated route Person-assisted route
Simple status or routine question Often quick for published information or basic status checks. May take longer but can clarify exceptions.
Account-specific problem May authenticate and route you, but can repeat scripted responses. Can examine the case and explain what action is available.
Correcting a mistake Ask for a case number and a documented escalation; the system may not handle unusual facts. Request written confirmation of the correction and its effective date.
Privacy and security Use only the bank’s verified channel; never enter a password, one-time code, or full account credentials into an unverified link. Verify the representative and avoid sharing more information than needed.
Creating a record Save the transcript or request a reference number; automated chats can disappear from view. Ask for a secure message or written summary after the call.

Recognize a chatbot loop

If the system repeats the same options, cannot understand the facts, or sends you back to the starting menu, stop rephrasing indefinitely. Say, “This automated channel has not resolved my issue. Please provide the human-agent option and the complaint or secure-message channel.” Capture screenshots or the transcript before leaving the session.

Ask about retention, sharing, and secondary uses

These questions help you understand what happens after a decision without presuming a single policy for every bank:

  • “How long do you retain the information used for this decision?”
  • “Which employees, affiliates, vendors, or service providers can receive it?”
  • “Is it used for fraud prevention, marketing, model training, eligibility decisions, or another purpose beyond this matter?”
  • “What choices do I have about optional uses, and where are those choices recorded?”
  • “How will a correction or deletion request affect records already used in a decision?”

Ask for the privacy notice or product-specific explanation that governs your account. A general privacy statement may not answer whether a particular vendor received a data element or whether a model retained it for a later purpose.

Prepare before contacting the bank

  1. Define the outcome. Decide whether you need an explanation, a correction, restored access, reversal of a fee, a new credit review, or a complaint record.
  2. Collect identifiers safely. Have the relevant date, product, notice, and case number available, but do not send full credentials through an unsolicited message.
  3. Use a written question list. Include the automation, data source, reason, correction path, human escalation, retention, and sharing questions that fit your issue.
  4. Request documentation. Ask for a notice, transcript, secure message, or reference number.
  5. Set a follow-up date. Confirm who owns the case, what response is promised, and how to escalate if the deadline passes.

What the bank may not tell you

A bank may decline to disclose source code, model weights, security rules, or information about other customers. That does not prevent you from asking for the outcome-relevant facts: the data categories used, the principal reasons for an adverse credit action, the identity of an outside reporting agency when applicable, and the available correction or complaint process.

If a representative gives only a generic answer, ask whether the explanation is the formal adverse-action reason or merely a customer-service summary. Ask for the department that can provide the formal notice. Keep the two issues separate: a request for more information is not itself proof that the bank violated a rule.

Current legal context to verify in 2026

The CFPB’s Regulation B resource says the regulation was most recently amended on July 21, 2026 and describes amendments issued in April 2026. The online resource also cautions that it is not the official legal edition. The CFPB’s ECOA resource records the 2026 final rule and says several guidance documents were withdrawn in May 2025. Because rules and agency guidance can change, consult the current regulation and final rule—or qualified legal advice—for a time-sensitive dispute.

For a practical bank conversation, the safest approach is to ask for the facts first: what system acted, what information it used, why the result occurred, how to correct an error, and how to reach a person. Then compare the bank’s response with the notice and the current rules that apply to your specific product and state.
