Being able to read or download a research paper does not automatically let you train an AI model, build a retrieval-augmented generation (RAG) system, store embeddings, or expose the text through a commercial service. Those uses depend on the paper’s article-level licence, the publisher’s current text-and-data-mining (TDM) policy, your institutional or subscription agreement, the purpose of the project, and any separate written permission.
Access and reuse are separate permissions
A subscription usually answers one question: may an authorised user read the content? AI projects ask additional questions: may software extract the text at scale, retain copies, transform it into training data, index it for retrieval, or show outputs to people outside the subscribing institution?

There is no universal “AI permission” attached to a paywall or to a download button. A publisher may allow non-commercial TDM for researchers with lawful access while prohibiting commercial model training. Another may require a licence for every generative-AI use of its website, even where non-commercial TDM is otherwise allowed. An open-access article may permit broad AI use under one Creative Commons licence and restrict it under another.
Publisher policies are contractual and operational evidence, not a complete statement of copyright law. Whether a particular use is lawful can also depend on jurisdiction-specific exceptions, contract enforceability, database rights, privacy, confidentiality, funder terms, and third-party material in the article.

What publisher licensing controls in an AI project
Read the governing documents as a package. The relevant terms can include:
- Article licence: the copyright-transfer, exclusive-licence, or Creative Commons terms shown on the paper’s landing page.
- Publisher TDM or AI policy: rules for APIs, automated downloads, rate limits, authentication, storage, and permitted purposes.
- Institutional agreement: subscription, data, or text-mining terms negotiated by a university, company, or library.
- Written permission: a project-specific licence covering commercial use, model training, RAG, external users, or other restricted activities.
- Output and retention controls: attribution, deletion at termination, limits on verbatim display, redistribution, resale, and competing services.
“AI use” is too broad to put in a permission request. Describe the exact operation, corpus, users, geography, duration, model, outputs, and safeguards.
Can AI use paywalled research papers?
Sometimes, but lawful subscription access alone is not enough to answer. A publisher may permit an authorised institution to run non-commercial TDM through an API, while requiring a separate licence for training a production model or serving external customers. The same paper can therefore be usable for a library research project but not for a commercial assistant.

Confirm whether the agreement allows local storage, derived data, embeddings, model weights, and access by contractors or cloud services. A licence that permits “research” may define that term narrowly or exclude revenue-generating services.
Non-commercial research and teaching
Non-commercial status can open a pathway, but it does not remove technical or contractual conditions. Policies may require an approved API, attribution, security controls, limits on systematic extraction, or deletion when access ends. Teaching use may be limited to an institution’s students and staff rather than the public.

Commercial products and external access
Commercial restrictions commonly cover model training, fine-tuning, paid search products, customer-facing RAG, dataset resale, and services that compete with the publisher. External access can be restricted even when the underlying research was performed by a subscribing institution. Obtain written permission before incorporating the corpus into a product, and preserve the signed scope and termination terms.
Does open access mean AI can use the paper?
No. “Open access” describes how readers obtain the article; the specific licence determines reuse. Gold open access commonly uses a Creative Commons licence, but CC BY, CC BY-NC, CC BY-ND, and other variants impose different conditions. The article page may also identify images, datasets, or quotations that are excluded from the article licence.
CC BY generally permits commercial and non-commercial adaptation with attribution, subject to the licence terms. A non-commercial licence does not authorise a commercial model or service. A no-derivatives licence can restrict transformed versions or adaptations. Always inspect the exact licence icon or text and every third-party credit line.
AI activities are not interchangeable

A policy that permits one row does not automatically permit another. State each activity separately in a permission request.
What major publisher policies say
Elsevier
Elsevier says researchers at subscribing academic institutions can use its ScienceDirect full-text API for TDM in non-commercial research, including XML full text. Non-subscriber requests are considered case by case. Its click-through licence terms restrict substantial or systematic reproduction and redistribution, direct or indirect commercial activity, and outputs that could compete with or substitute for Elsevier offerings. API availability should not be read as permission for commercial AI training. See the TDM policy and copyright guidance for the applicable route.

IOP Publishing
Under its Text and Data Mining policy, researchers with valid subscription access may use subscription articles for non-commercial AI or TDM, subject to the policy and any superior institutional or written agreement. Commercial AI or TDM requires IOP’s written agreement. For gold open access, IOP states that CC BY permits commercial and non-commercial AI or TDM in accordance with the licence; other listed Creative Commons licences permit non-commercial use. The policy also addresses systematic extraction, third-party exposure, competing services, and machine-accessible resources that lack express authorisation.
Sage Publishing
Sage says non-commercial TDM does not need a licence when a user has lawful access, and it directs non-commercial journal TDM users toward Crossref API access. Commercial TDM requires a Sage licence even when access is lawful. Separately, Sage states that any AI use of its website or content, including generative AI, requires both lawful access and a licence. Do not collapse its non-commercial TDM exception into a blanket permission for generative-AI systems; the policy distinguishes those activities at Sage’s TDM and AI policy.
Wiley
Wiley distinguishes subscription articles published under a Copyright Transfer Agreement or Exclusive License Agreement from open-access articles governed by a Creative Commons licence under an Open Access Agreement. For content under a CTA, ELA, CC BY-NC, or CC BY-ND, its licensing guidance says authors and third parties must seek permission for AI uses such as training or RAG. Wiley also cautions that a signed article agreement may differ from a standard form, so inspect the agreement tied to the specific paper.
Springer Nature
Springer Nature says authors retain copyright in submitted and published work while it receives an exclusive License to Publish for subscription articles. Its AI guidance says AI training and third-party access are not allowed unless explicitly licensed. It describes internal institutional AI use in a teaching context, limited licensing for some third-party uses, attribution for external summaries, and a prohibition on verbatim distribution. Licensing for a standalone large language model may be considered only in limited cases.
Edward Elgar Publishing
Edward Elgar’s AI Licensing Programme covers two broad categories: model training or fine-tuning, and RAG or discovery tools. Its stated restrictions include substantial verbatim output, redistribution of underlying text, dataset resale, and competing derivative works. The programme describes attribution and technical safeguards. Edward Elgar also notes that declining its authorised programme does not prevent third parties from attempting unauthorised scraping. Its guidance states: “Technically, a model cannot be untrained on specific inputs.” That is a description of a technical limitation, not a legal conclusion about every model or mitigation method.

How to check a paper before using it
- Identify the exact work. Record the title, DOI, version, journal, publication date, article page, and any supplementary files. A manuscript, accepted version, and version of record can have different rights.
- Read the article-level licence. Capture the Creative Commons name or the relevant CTA, ELA, or other notice. Review image, table, dataset, and quotation credit lines for exclusions.
- Classify access. Note whether the copy is subscription-only, gold open access, repository-hosted, author-posted, or supplied under a separate agreement. Record which institution or account provides access.
- Name the activity. Specify TDM, training, fine-tuning, embeddings, RAG, evaluation, internal teaching, or external service delivery. Include whether the use is commercial.
- Read current policy and contract terms. Check API requirements, authentication, rate limits, storage duration, geographic restrictions, permitted users, attribution, and competing-service clauses.
- Map the data flow. List download locations, cloud processors, contractors, vector databases, model providers, logs, backups, and every person who can retrieve text or outputs.
- Request written permission where required. Ask for explicit coverage of the corpus, activities, model or index, users, territory, term, fees, outputs, attribution, security, deletion, audit rights, and termination.
- Keep an evidence file. Retain the licence page, policy version and access date, institutional agreement, correspondence, approval records, and a paper-by-paper exception list.
Output, storage, and termination controls
Permission to process text may still limit what the system returns. A licence can prohibit substantial quotations, verbatim article delivery, redistribution of the underlying corpus, or outputs that substitute for the publisher’s service. Configure retrieval limits, citation links, passage-length caps, and access controls to match the written terms.
Decide what happens when a subscription or licence ends. Some agreements require deletion of full text, caches, indexes, embeddings, evaluation sets, and backups; others may allow narrowly defined derived results. Model weights are difficult to reverse. Edward Elgar’s warning that a model cannot technically be “untrained” from specific inputs illustrates why deletion and retention promises must be addressed before training, not after a dispute.
Legal limits and unresolved questions
Publisher policies do not decide every copyright question. A jurisdiction may recognise a text-and-data-mining exception, research exception, fair-use defence, or other limitation, but the scope can vary by country and by contract. A subscription contract may impose terms even where an exception might otherwise apply, and enforceability is fact-specific.
Authors may retain rights, funders may require repository deposit, and a paper may contain private information, confidential material, database rights, patient data, or third-party images. Verify those layers separately. If the project is high-risk, obtain advice from qualified counsel in the relevant jurisdictions rather than treating a publisher FAQ as a legal opinion.

University literature-mining study
Start with the library’s subscription and API terms. If the publisher permits non-commercial TDM for authorised researchers, use the required access method, limit the corpus and retention to the study, and prevent public redistribution of full text. Document whether cloud processing or collaborators fall within the agreement.
Internal teaching assistant
Confirm that the policy covers instructional AI, the institution’s users, and the chosen model provider. Restrict access to eligible students and staff, provide attribution, and avoid exposing article text to a public chatbot or external customer.
Commercial research assistant
Assume a separate licence is needed unless the exact policy says otherwise. Describe training, RAG, embeddings, customer access, output formats, retention, and competing-service risk in the request. Do not rely on a personal subscription or an employee’s university access.
Open-access corpus
Collect each article’s exact Creative Commons licence and third-party exclusions. A mixed corpus must follow the most restrictive applicable terms for each item or be partitioned so that incompatible permissions are not combined.
The reliable answer is therefore paper-specific and activity-specific: identify the licence, identify the intended AI operation, check the publisher and institutional terms, and obtain written permission whenever those documents require it.
