Businesses facing central GST action in India are not without safeguards. The CGST Act sets conditions and time limits for searches, seizures, provisional attachment and transit detention. CBIC instructions add controls on investigations, summons, voluntary payments and arrest. These protections do not make every notice invalid or guarantee that a challenge will succeed, but they give a business concrete questions to ask, records to demand and deadlines to track.
This guide focuses on central GST (CGST) law and CBIC instructions. State GST authorities may apply parallel provisions and state-specific procedures. For an active investigation, arrest risk, bank-account attachment or detained goods, obtain prompt advice from a GST lawyer or tax professional.

Which GST actions have different safeguards?
A summons, a search, a request to pay through DRC-03, a bank-account attachment, detention of goods and an arrest are separate legal actions. Each has a different source of power, approval standard and response route. Treating all of them as one generic “GST raid” can cause a business to miss a deadline or concede more than it intended.

Protections when an investigation or summons begins
The inquiry should identify its subject
CBIC Instruction No. 01/2023-24-GST (Inv.), dated 30 March 2024, says an investigation should begin only after the Commissioner’s approval, subject to the instruction’s higher-level approval categories. A letter or summons to a regular taxpayer should disclose the specific nature of the inquiry. Expressions such as “GST enquiry” or “GST evasion” without a defined subject are expressly disallowed. The instruction also rejects fishing inquiries.
Information already available digitally on the GST portal should generally not be requested again from a regular taxpayer. An officer should not use a letter or summons to force the taxpayer to complete an investigation-created pro forma. If a request is broad, ask in writing which tax period, transaction, registration, document or statutory provision is being examined, while observing any valid deadline.
Duplicate or overlapping investigations should be checked
Before proceeding, the instruction requires the department to ascertain whether another central or state tax office is examining the same subject and taxpayer or GSTIN. If two record-based investigations concern different subjects, the Commissioner is expected to consider whether one office can handle them and to record reasons if consolidation is not feasible. A business should therefore disclose existing notices accurately and keep a chronology of every authority and subject matter.
Summons require approval and relevance
The 2024 instruction says a summons should normally have prior, reasoned approval from an officer not below Deputy or Assistant Commissioner, including approval of what is sought and a reasonable compliance period. The issuing officer should record why the information or documents are relevant and proper, avoid repeated summons and avoid piecemeal requests. Statements, search results and inspection outcomes are to be placed on the relevant electronic file.
A separate CBIC summons instruction dated 17 August 2022 says a Superintendent should generally obtain prior written permission from a Deputy or Assistant Commissioner, with reasons recorded. If an operational exception requires immediate action, permission should be reduced to writing at the earliest opportunity. The summons should normally identify the alleged offender unless doing so would harm the investigation. Statutory documents available online should generally not be summoned.

Senior officers are not automatically the first witnesses
The 17 August 2022 instruction says senior company officials should not generally be summoned first unless there are indications that they were involved in decisions leading to revenue loss. That does not give a director immunity from questioning. It does mean the department’s choice of witness should have a connection to the facts being investigated.
Use the investigation grievance channel
For an ongoing investigation, the Additional or Joint Commissioner in charge of investigation is identified as the grievance officer. A taxpayer may approach that official by letter, email or appointment. If a reasonable grievance persists, the Commissioner may consider meeting the taxpayer. This is an administrative channel, not a substitute for a statutory appeal, bail application or court proceeding.

Payments demanded during a search or investigation
DRC-03 is described as voluntary
CBIC Instruction No. 01/2022-23 (GST-Investigation), dated 25 May 2022, addresses complaints that taxpayers were pressured to make “recovery” payments during search, inspection or investigation. It states that a DRC-03 voluntary payment is initiated by the taxpayer through the GST portal using the taxpayer’s own credentials. The instruction refers to sections 73(5) and 74(5), which permit voluntary payment before a notice in the circumstances covered by those provisions.
That description does not decide whether a particular payment was actually voluntary or whether the underlying tax is due. A business should distinguish an amount it has self-ascertained and accepted from an amount it disputes but paid while under pressure. Do not sign a statement saying an amount is admitted unless the authorised representative understands the legal and accounting consequences.
Preserve evidence if pressure is alleged
Keep the written notice or request, officer names and designations, emails, messages, call details, the DRC-03 and challan, internal approval records, a minute-by-minute timeline and witness accounts. Ask counsel whether a representation, refund claim, adjudication response or judicial remedy is appropriate. An allegation of coercion does not automatically cancel a liability or guarantee a refund; the circumstances and documentary record matter.

Search and seizure under section 67
There must be statutory grounds
Section 67 of the CGST Act authorises inspection, search and seizure when the proper officer, not below Joint Commissioner rank, has the statutory reasons to believe specified conditions exist, such as suppression of transactions or wrongful input tax credit connected with evasion. The power is not a general licence to inspect anything for any reason. Obtain a copy of the authorisation and note the premises, GSTIN, date, officers and stated grounds.

Make the record complete
During or immediately after a search, preserve copies of the inventory, seizure documents, statements and panchnama where available. Record which rooms, devices, books and goods were accessed, what was taken and who witnessed each step. Keep an untouched duplicate or forensic image of business records when lawful and practical, and avoid obstructing officers or altering evidence.
Release and return rules have deadlines
Seized goods may be released provisionally on bond and security, or on payment of applicable tax, interest and penalty, as section 67 specifies. If no notice concerning seized goods is issued within six months, the goods are to be returned. The period may be extended by up to a further six months for sufficient cause. A missed deadline should be raised promptly with the officer and, where necessary, through the appropriate legal remedy. A procedural defect does not automatically invalidate every search, so the authorisation and facts must be reviewed.
Provisional attachment of property or a bank account
Section 83 allows the Commissioner, by written order, to provisionally attach property, including a bank account, after proceedings under the specified chapters have been initiated, when attachment is considered necessary to protect government revenue. The attachment ceases after one year.
Request and preserve the written order. Identify the proceeding on which it relies, the property or account covered, the date of attachment and the operational impact on payroll, suppliers and taxes. Ask the bank for the exact restriction communicated to it. Whether an order is proportionate, within jurisdiction or vulnerable to challenge depends on its wording, the underlying proceedings and applicable precedent. Do not assume that a business must accept an informal freeze with no written order, but do not move assets to defeat a lawful attachment either.

Detention of goods in transit under section 129
Section 129 applies when goods are transported or stored in transit in contravention of the Act or rules. The officer must serve an order of detention or seizure. A notice specifying the penalty must be issued within seven days, and the order must be passed within seven days of serving that notice. The person concerned must receive an opportunity to be heard before the penalty is determined.
The section provides release routes, including payment of the specified penalty or furnishing security. Collect the invoice, e-way bill, transport documents, vehicle details, tax records and any explanation for a documentation or classification problem. Check the dates on the detention order and penalty notice, attend the hearing, and obtain a written order. If the vehicle or goods remain held after the statutory steps or payment or security required for release, obtain urgent professional advice on the available remedy.
Arrest and prosecution safeguards
Arrest is not an automatic consequence of investigation
CBIC Instruction No. 02/2022-23 (GST-Investigation), dated 17 August 2022, requires statutory preconditions and an unambiguous “reasons to believe” decision based on credible material. The competent authority should consider whether arrest is necessary to ensure the investigation, prevent evidence tampering, stop interference with witnesses or ensure the person’s presence. The instruction says arrest should not be routine or mechanical and should not be used for a technical dispute involving a difference of opinion on legal interpretation.
The instruction reproduces the Supreme Court’s statement in Siddharth v. State of Uttar Pradesh, Criminal Appeal No. 838 of 2021, identified there as decided on 16 August 2021: “Merely because an arrest can be made because it is lawful does not mandate that arrest must be made.” This is a principle against automatic arrest, not immunity where the statutory test is met.

Check the arrest memo
An arrest memo consistent with Supreme Court directions should specify the applicable provisions, explain the grounds to the arrested person, record that a nominated or authorised person was informed, and state the date and time of arrest. The arrested person should receive the memo against acknowledgement. Preserve it and seek advice immediately about production before the magistrate, bail and the investigation strategy.

October 2026 proposals are not yet a legal change
A Press Information Bureau FAQ published on 9 October 2026 reported GST Council recommendations to remove GST arrest provisions, raise the prosecution threshold and alter offences and penalties. The material describes recommendations and proposed amendments; it does not establish enactment or commencement. Until an enacted amendment and its effective date are verified, businesses must rely on the law currently in force rather than announce that GST arrest has been abolished.
A practical response plan for a business
- Identify the action. Classify the communication as a letter, summons, search authorisation, seizure document, DRC-03 request, attachment order, transit detention notice or arrest record.
- Verify authority and dates. Note the issuing office, officer rank, GSTIN, tax periods, statutory provisions, service date and every response or hearing deadline.
- Preserve records. Create a secure chronology and retain notices, portal screenshots, ledgers, invoices, e-way bills, emails, messages, payment records, statements and witness details.
- Respond within scope. Provide relevant records, ask focused clarification questions where the request is vague, and avoid creating an unofficial format or volunteering unrelated material.
- Control communications. Nominate authorised representatives, brief employees not to speculate, and ensure statements are read and corrected before signature where procedure permits.
- Escalate proportionately. Use the investigation grievance officer for an ongoing administrative complaint, while taking separate advice on adjudication, statutory appeal, writ relief, release, attachment challenge, bail or other court remedies.
- Obtain specialist advice early. A GST lawyer or tax professional can assess jurisdiction, limitation, privilege, accounting treatment and the safest response to an active coercion allegation.
What these protections do—and do not—promise
CBIC instructions bind departmental administration but do not replace the CGST Act, the rules or judicial orders. A summons that lacks detail may still require a timely response while the taxpayer seeks clarification. A defective-looking attachment may need to be challenged through the correct forum rather than ignored. A voluntary-payment instruction does not decide the merits of a demand, and an arrest safeguard does not prevent arrest when the statutory conditions and necessity assessment are satisfied.
Businesses should also separate central GST from State GST action. The same commercial transaction can generate parallel central and state communications, but the responsible authority, instruction and remedy may differ. Check the issuer and governing enactment on every document.
The practical protection is disciplined process: insist on a defined subject, document every request and deadline, keep payment and seizure records, use the available grievance channel and obtain prompt legal advice before a disputed payment, asset freeze or arrest risk becomes irreversible.
