There is no single U.S. rule for AI-generated campaign ads or deepfakes. A campaign should check the law in every place it will distribute the content, then assess what the media depicts, when it will run, who sponsors it, and which communication rules apply. A required AI disclosure and an ordinary “paid for by” disclaimer are separate obligations; one does not automatically replace the other.
Do AI-generated political ads need a disclaimer?
Sometimes—and campaigns should ask two separate questions. First, does a law in a relevant state or territory require a disclosure about synthetic or manipulated media, or restrict its publication? Second, does the communication require an ordinary sponsor-identification disclaimer under federal or state campaign-finance rules?

The National Conference of State Legislatures (NCSL) reported on June 23, 2026, that 31 states had enacted laws regulating deepfakes in political messaging. Its summary describes two broad approaches: disclosure requirements and prohibitions. That is an enactment count as of the update date, not confirmation that every law remains in effect or is currently enforceable. The actual requirements depend on the controlling law and its current status.

|---|---|---|
| AI or deepfake disclosure | Whether specified synthetic or manipulated political media must carry a notice, or whether particular deceptive content is restricted. | Covered content, definitions, timing, exceptions, remedies, effective date, and any relevant court orders. |
| Sponsor disclaimer | Who paid for or authorized a covered political communication. | Whether the sponsor and communication meet the applicable federal or state requirements, including medium-specific presentation rules. |
The Federal Election Commission (FEC) says covered public communications by political committees must display a disclaimer, and the disclaimer must be clear and conspicuous. Its guidance says: “A disclaimer is not clear and conspicuous if it is difficult to read or hear, or if its placement is easily overlooked.” A notice that an image or voice was AI-generated does not, by itself, identify the sponsor.

Can a campaign use a deepfake in an ad?
There is no nationwide yes-or-no answer established by the materials summarized here. Some state laws require disclosures for certain synthetic or manipulated political content; others prohibit specified deceptive content, sometimes during a defined period before an election. A disclosure requirement is not the same as permission to publish content that another rule prohibits.
NCSL’s summary identifies Minnesota and Texas as examples of time-limited prohibitions and Maryland as prohibiting deceptive election-related deepfakes without a time limit in that summary. Those descriptions are a starting point, not a substitute for checking the exact statutory text, definitions, exceptions, effective dates, and current court status in the jurisdiction where the communication will appear.

What may make the content legally relevant
Do not limit review to video labeled “deepfake.” Depending on the law, relevant content could include AI-generated imagery or audio, a cloned voice, or an altered depiction of a real person. The statutory definitions and exceptions differ, so the campaign should not assume that a disclosure rule covers every AI-assisted edit—or that an edit falls outside a rule merely because it is not a fully generated video.

Map the audience and distribution before choosing a disclosure or deciding whether to publish. The campaign’s home state is not necessarily the only jurisdiction that matters. NCSL’s September 11, 2026 report says nearly every state regulates political-ad disclaimers, with requirements varying by sponsor, medium, and communication type. The applicable analysis may therefore involve both a deepfake-specific law and ordinary disclaimer rules, and the answer can change with the platform or format.

- Where will people receive it? Identify each state or territory where the content will be distributed, rather than relying only on the campaign’s location.
- When will it run? Record the relevant election date and planned distribution dates; some prohibitions are tied to an election-period window.
- What is the medium? Review whether the content is a broadcast, printed piece, internet communication, or another format, because disclaimer requirements can vary by medium.
- Who is the sponsor? Determine who paid for the communication and whether a candidate authorized it. Rules can depend on the sponsor and the type of communication.
For electioneering communications, FEC guidance also describes timing and distribution thresholds and requirements for certain communications not paid for by a candidate to identify the payer and whether a candidate authorized them. The definitions and thresholds are technical; use the current FEC guidance and governing rules for the specific communication rather than applying a simplified rule of thumb.
How should a campaign check an AI political ad before release?
- Map distribution and timing. List the states or territories targeted by the ad and the dates it will run. Note the relevant election date for each jurisdiction.
- Describe the media accurately. Identify what was generated or altered, whether it depicts or imitates a real person, and whether it uses a synthetic voice. Preserve the version being reviewed so staff can assess the actual content rather than a description of it.
- Check the specific jurisdiction’s rule. For each distribution location, determine whether the controlling law requires an AI or deepfake disclosure, restricts publication, or does neither for this particular content. Verify definitions, exceptions, effective dates, enforcement and remedies, and current court orders against primary legal materials.
- Check sponsor disclaimers separately. Determine whether the communication is covered by federal or state disclaimer rules and what the relevant medium requires. For FEC-covered communications, make sure the disclaimer is clear and conspicuous as presented—not merely included in a file or caption where it may be overlooked.
- Approve the exact release version. Keep an internal record of the content version, distribution locations and dates, proposed disclosure text, and reviewer. This is a practical editorial control, not a recordkeeping requirement asserted for every law.
- Recheck before launch. Confirm that the law, effective date, court status, and agency guidance have not changed since review. A change in the edit, sponsor, audience, medium, or launch date can also require a fresh check.
What do the 2026 state examples show?
NCSL’s 2026 enactment tracker lists examples that take different approaches and cover different communications. The list is useful for spotting issues, but it does not establish the precise text, effective date, or current enforceability of any enactment.

| Enactment listed by NCSL | General subject described in the tracker |
|---|---|
| Louisiana HB 459 | Disclosures for AI-generated electioneering communications. |
| Louisiana HB 639 | Disclosures for deepfake audio calls of public figures. |
| Maryland SB 141 | Prohibition on deceptive election-related deepfakes. |
| Puerto Rico SB 101 | Disclosures on political communications generated or altered by AI. |
These examples are not interchangeable rules: a disclosure tied to a particular communication is different from a restriction on deceptive content, and an audio-call provision may not apply to a video ad. Check each enacted law’s text and effective date before relying on the summary.
What should campaigns know about the federal guidance?
The FEC’s advertising and disclaimer guidance covers requirements for political committee public communications and notes that printed, broadcast, and internet communications can have additional requirements. Its page also says it has not yet incorporated the Supreme Court’s June 30, 2026 decision concerning coordinated expenditure limits; the Commission says revision is pending once it regains a quorum. That notice identifies an issue with the guidance. It should not be read as saying that the decision removed all disclaimer requirements.

Because the FEC page itself flags this update limitation, campaigns should check current governing rules and seek qualified election-law advice where the decision affects their circumstances. Federal guidance does not resolve state deepfake restrictions or state disclaimer requirements.
When should a campaign get a jurisdiction-specific legal review?
Consider review by election-law counsel or a campaign compliance professional when the media depicts or imitates a real person, the planned distribution crosses state lines, publication is close to an election, or the content may fall within a statutory prohibition. The same is true when sponsor authorization or the communication’s classification under federal rules is uncertain. A landscape summary can help locate the questions; it cannot decide how a current statute or court order applies to a particular ad.
