The exact approvals depend on the parcel, local government, acreage disturbed, wetlands and floodways, cooling system, wastewater route, combustion equipment and utility design.
The safest approach is to treat permitting as a site-and-design exercise. Confirm local land-use rules before buying or designing the site, then work through stormwater, wetlands, water withdrawals, wastewater, air emissions, floodway and utility triggers in parallel.

Why Indiana data centers have no single permit
Indiana agencies publish trigger-based requirements rather than a universal data-center license. Two facilities with identical server halls can face different approvals because one site may disturb a protected wetland, draw water from private wells, discharge process water to a stream, install large diesel generators or sit in a county with a special data-center ordinance.

Jurisdiction is divided. Cities, towns and counties control land-use compatibility and many development conditions. IDEM administers environmental programs such as construction stormwater, wastewater and air permitting. DNR handles significant water-withdrawal registration and several floodway, lake, navigable-waterway and related construction approvals. Building officials and fire authorities enforce adopted construction and life-safety codes. Utilities control the practical availability and terms of electric, gas, water and sewer service, subject to the Indiana Utility Regulatory Commission (IURC) where applicable.

Local zoning and development approvals
Confirm the parcel’s land-use status
Start with the county or municipal planning department. Determine whether a data center is a permitted use in the existing zoning district, requires rezoning, or needs a special exception or conditional-use hearing. A project may also need an improvement-location permit, site-development approval, subdivision action, grading approval or similar local authorization.
Local ordinances can regulate setbacks, building height, noise, lighting, water and utility infrastructure, landscaping, traffic, emergency access, generator placement and operating conditions. Some jurisdictions require annual operating reports or disclosure of generator inventories and testing schedules. Public hearings can add schedule risk even when state environmental permits are straightforward.
Check for changing ordinances and moratoria
Indiana University’s Environmental Resilience Institute reports that counties have been adopting data-center ordinances, moratoria and bans. Spencer County’s 2026 ordinance, for example, states that county review is limited to land-use compatibility, infrastructure capacity, and public health and safety; it leaves federal and state environmental jurisdiction with IDEM, DNR and the U.S. Environmental Protection Agency. Miami County has publicly noticed a proposed ordinance covering applications and permits for data-center developments. These examples are not substitutes for checking the current rules in the host jurisdiction, including pending applications and recently introduced amendments.
Building, electrical, mechanical and fire-code approvals
Indiana’s engineering standards framework includes the Indiana Building Code, Mechanical Code, Electrical Code (the National Electrical Code), Fire Prevention Code, Energy Conservation rules, Plumbing Code, structural engineering standards, IOSHA requirements and environmental approvals. A data-center owner should expect plan review, trade permits, inspections and fire-protection review by the authority having jurisdiction.

What the review normally covers
- Structural design for the building, equipment loads, roof systems and seismic or wind requirements adopted in the applicable code edition.
- Electrical distribution, substations, emergency power, grounding, battery systems and the required National Electrical Code provisions.
- Mechanical systems, cooling equipment, refrigerants, ventilation and energy-code compliance.
- Fire detection, suppression, water supplies, rated construction, egress, hazardous-material controls and fire-department access.
- Plumbing, sanitary connections, testing and any certificate or approval required before occupancy.
Indiana’s code edition and the local administrative process should be confirmed with the building official before finalizing construction documents. A state-level environmental approval does not replace local building or fire approval.
Environmental permits: the design triggers
| Project feature | Likely agency or approval | Key obligation |
|---|---|---|
| Clearing, grading, roads, substations or buildings that disturb at least one acre | IDEM Construction Stormwater General Permit | File a Notice of Intent and prepare a Construction/Stormwater Pollution Prevention Plan before construction. |
| Protected wetland impacts | IDEM isolated-wetland review or permit; other state or federal wetland jurisdiction may also apply | Obtain the applicable authorization; mitigation may be proposed for functional impacts to wetlands and streams. |
| Construction in a regulated floodway, at or lakeward of a public freshwater lake shoreline, or in a navigable waterway | Indiana DNR water-program approval, where triggered | Check maps and exemptions before fixing the site layout. |
| Process-water discharge to a stream, lake or other water body | IDEM National Pollutant Discharge Elimination System (NPDES) permit | Describe wastewater composition and treatment in the application. |
| Capability to withdraw more than 100,000 gallons per day in aggregate | DNR significant-water-withdrawal-facility registration | Register after completion and submit annual-use reports. |
| New or modified combustion equipment emitting regulated quantities | IDEM air-permit applicability review and, if required, construction and operating permits | Evaluate generators, fire pumps and other engines before installation. |
Construction stormwater
IDEM’s data-center guidance requires a Construction Stormwater General Permit for construction activity that disturbs one (1) acre or more of total land area. The trigger includes the entire construction footprint, not merely the server-building pad: clearing, grading, access roads, parking, drainage work, substations and related improvements can all count.
The applicant files a Notice of Intent and prepares a Construction/Stormwater Pollution Prevention Plan. The plan should identify drainage patterns, erosion and sediment controls, stabilized entrances, inspection responsibilities, discharge points and corrective actions. Because earthwork often begins before the building permit is complete, stormwater authorization is a critical-path item for site mobilization.
Wetlands, streams and floodways
Map constraints before selecting the final footprint
Have wetlands delineated and obtain a jurisdictional review early enough to move roads, ponds, transmission corridors or cooling infrastructure if necessary. IDEM may require an isolated-wetland permit when construction affects a protected wetland. Mitigation can be proposed for functional impacts to wetlands and streams, but mitigation does not eliminate the need to avoid and minimize impacts in the first place.

Screen DNR waterway approvals
DNR water programs require approval for regulated construction in floodways, development at or lakeward of a public freshwater lake shoreline, and specified structures, withdrawals or material extraction in navigable waterways. DNR advises applicants to check floodway maps and permit exemptions before construction. A parcel that appears buildable on a zoning map may still need redesign if its access road, outfall or utility crossing enters a regulated area.
Cooling water, wastewater and NPDES permits
Cooling architecture determines much of a data center’s environmental profile. IDEM states that a direct discharge of process water to a stream, lake or other water body requires an NPDES permit from its Office of Water Quality. The application must explain the wastewater’s composition and proposed treatment.
Discharge to a publicly owned treatment works
If noncontact cooling water is sent to a publicly owned treatment works (POTW), the receiving plant must notify IDEM’s permits branch. IDEM then decides whether the plant’s NPDES permit needs modification. The data-center owner should provide the plant with flow, temperature, chemistry, treatment and peak-discharge information early; sewer acceptance alone does not settle the state permit question.

Closed-loop or air-cooled designs can reduce or change process-water discharges, but they do not remove the need to verify stormwater, sanitary wastewater, cooling-tower blowdown, maintenance liquids and any other discharge. The water balance should identify every source, use, loss, storage volume and discharge route.

Water-withdrawal registration
DNR defines a “significant water withdrawal facility” as facilities that, in aggregate from all sources and by all methods, have the capability of withdrawing more than 100,000 gallons of groundwater, surface water or both in one day.
The owner must register within three months after the facility is completed and report annual water use within three months after each calendar year. This is a registration and reporting obligation, not a statement that every withdrawal is otherwise exempt from permits. Wells, surface-water intakes, utility-supplied backup sources and multiple cooling systems should be evaluated together against the capability threshold. Separate utility approvals, construction permits or discharge authorizations may still be required.
Air permits for generators and other combustion equipment
Indiana’s business guidance explains that federal rules require permits to construct and operate new facilities, or modify existing facilities, that emit specified quantities of pollutants. Sources emitting listed toxic pollutants may require additional permitting. The applicable permit class depends on equipment size, fuel, operating hours, controls and the facility’s potential to emit; it cannot be determined from the word “backup” alone.
Do these 3 things before closing this tab:
1Repair Windows errors before they cause bigger problems2Scan for outdated or missing drivers - takes under a minute3Clear out junk files and repair common Windows errorsEquipment to include in the review
- Diesel or natural-gas emergency generators.
- Fire pumps and engine-driven life-safety equipment.
- Boilers, heaters, emergency engines and other stationary combustion units.
- Fuel-storage and transfer systems whose emissions may be regulated.
Obtain an IDEM applicability determination before ordering or installing major equipment. Local zoning may separately require generator locations, acoustic controls, testing schedules, operating-hour limits or annual disclosures. Demolition or renovation involving asbestos requires an appropriate permit and certified workers, even when the work is part of a larger data-center project.
Best Value
Electric, gas, water and sewer infrastructure
Large-load projects should engage serving utilities before land-use filings. The IURC regulates electric, natural-gas, steam, water and wastewater utilities and oversees rates, financing, environmental-compliance plans, service territories and certain construction or acquisition of utility plant and equipment. IURC jurisdiction differs for municipal and other utilities, so identify the provider and its regulatory status early.
Confirm available electric capacity, substation or feeder work, tariffs, interconnection milestones, gas pressure, water volume and pressure, sewer capacity, fire-flow requirements, backup-generation arrangements and ownership of extensions. A utility letter describing future capacity is not necessarily a construction authorization; the project may still need local rights-of-way, easements, building permits or environmental approvals for the extension itself.
Tax incentives and compliance conditions
State data-center sales and use tax exemption
The Indiana Economic Development Corporation (IEDC) describes a Data Center Gross Retail and Use Tax Exemption for qualifying data-center equipment and energy. The exemption can last up to 25 years for investments below $750 million and up to 50 years when investment exceeds $750 million. Eligibility, covered purchases, transaction-award certificates and statutory conditions must be confirmed with IEDC before representing a savings amount or duration.

Local personal-property-tax exemption
IEDC also notes that local governments may provide a personal-property-tax exemption for qualified enterprise information-technology equipment when the owner invests at least $25 million in real and personal property. This is not automatic statewide relief: the host locality must offer the exemption and the project must satisfy the applicable agreement and statutory requirements.
House Bill 1043: proposed water-consumption permit
Indiana House Bill 1043, introduced during the 2026 session, proposed prohibiting operation of a data center without a DNR consumption permit and described application and transfer procedures. The official legislative record shows introduction and referral actions; it does not establish that the proposal became law. Treat the bill as proposed legislation unless an enacted statute and effective date are verified. Recheck its status immediately before filing applications, closing a transaction or publishing a compliance representation.
A practical permitting sequence
- Screen the parcel. Identify zoning, pending ordinances, moratoria, floodways, wetlands, public-lake shorelines and navigable waterways.
- Meet local authorities and utilities. Speak with planning, building and fire officials and the serving electric, gas, water and sewer providers.
- Develop the technical baseline. Complete wetland delineation, civil-grading concepts, a water balance, cooling-system description and wastewater characterization.
- Obtain IDEM determinations. Address construction stormwater, wetland, wastewater/NPDES and air applicability; file required applications before the related work begins.
- Screen DNR programs. Check floodway, lake, navigable-waterway and significant-withdrawal obligations, including registration deadlines.
- Lock code and emergency requirements. Confirm code editions, fire protection, generator testing, hazardous-material controls and emergency-response procedures.
- Validate incentives. Confirm IEDC eligibility, investment thresholds, transaction-award certificates and any local tax agreement in writing.
- Recheck before filing. Verify every local ordinance and the status of relevant legislation immediately before submitting plans or making public claims.
How to compare sites and cooling designs
| Decision factor | Questions to answer |
|---|---|
| Local approval certainty | Is the use permitted, discretionary or subject to a moratorium, hearing or new ordinance? |
| Earthwork and stormwater | How much land will be disturbed, and can grading and outfalls be kept simple? |
| Wetland and floodway exposure | Will buildings, roads, utilities or discharge points affect regulated areas? |
| Water supply | What sources are available, and does combined withdrawal capability exceed the DNR threshold? |
| Wastewater route | Will process water reach a stream, lake, POTW or no discharge point? |
| Air permitting | What generator, fire-pump and boiler capacity and operating profile will be installed? |
| Utility capacity | Can the provider deliver the required electric, gas, water, sewer and fire-flow capacity on schedule? |
| Code and fire complexity | Are unusual battery, fuel, suppression, structural or emergency-response features involved? |
| Incentive eligibility | Do the investment amount, equipment and local agreement meet current requirements? |
| Schedule risk | Could hearings, public notice, utility construction or changing legislation delay mobilization? |
Common permitting mistakes
- Assuming zoning approval covers environmental work: local land-use approval does not replace IDEM, DNR or federal authorization.
- Waiting until final design to map wetlands: late delineation can force expensive relocation of buildings, roads and utilities.
- Counting only the building pad: stormwater disturbance includes associated infrastructure and access work.
- Calling generators “exempt” because they are for emergencies: emissions applicability depends on the equipment and potential to emit.
- Using only normal daily water use: DNR’s threshold is based on capability in aggregate from all sources and methods.
- Assuming a sewer connection resolves discharge permitting: a POTW must involve IDEM when noncontact cooling water is accepted.
- Quoting tax savings before the award is secured: confirm statutory eligibility, certificates and local agreements first.
- Relying on an old ordinance or bill summary: check the current local code and legislative status immediately before filing.
The Bottom Line
Indiana data-center permitting is a coordinated screening process, not a single application. Establish local land-use authority and utility capacity first, then document stormwater, wetlands, waterways, cooling water, withdrawals, wastewater, air emissions, construction codes and incentive eligibility before committing to the final site and design.
