In the United States, the permits and monitoring for industrial wastewater depend first on where the water goes: directly to surface water, into a municipal sewer, or off the site as stormwater. Direct surface-water discharges may require an NPDES permit; sewer discharges are subject to pretreatment standards and local control-authority requirements; and certain industrial stormwater discharges require separate NPDES coverage. The applicable permit, standards, or local control mechanism—not the treatment equipment alone—sets the actual limits, sampling, and reporting duties.
This is a federal Clean Water Act overview for the United States, not a determination for a particular facility. State, tribal, territorial, and local requirements may be more specific or stringent. A site may have more than one discharge route and therefore more than one set of obligations.

Start with the discharge route
| Where the water goes | Potential regulatory pathway | What determines the details |
|---|---|---|
| Directly to surface water through a point source | NPDES permit coverage, where required; the permit may be individual or general. | The applicable permitting authority and permit conditions, including limits, monitoring, reporting, and special conditions. |
| To a publicly owned treatment works (POTW) through a sewer | Federal, state, and local pretreatment requirements; the facility may also need an industrial-user permit or other control mechanism. | Applicable categorical standards, the control authority’s requirements, and the facility’s industrial-user status. |
| From industrial activity as stormwater runoff | Separate industrial stormwater NPDES coverage for certain facilities, with a Stormwater Pollution Prevention Plan (SWPPP) or equivalent where required. | The facility classification and the applicable EPA or state stormwater permit. |
EPA’s Industrial Wastewater overview explains that NPDES conditions are based on the facility or activity and are intended to protect receiving waters or prevent interference with POTWs. A site should assess each wastewater stream and outfall separately rather than assume that one permit covers every discharge.

For a direct point-source discharge to surface waters, determine whether the discharge requires NPDES coverage and identify the permitting authority. Depending on the site and applicable program, coverage may be under an individual permit or a general permit. EPA or an authorized state, tribal, or territorial authority may administer permitting.

The permit is the controlling document for the facility’s obligations. Use its conditions and monitoring tables to identify applicable pollutant limits, sampling locations and types, analytical methods, sampling frequency, reporting schedule, and any additional requirements. Do not use another facility’s permit or a generic description of treatment equipment to infer those terms.
What applies when wastewater goes to a municipal sewer?
A sewer discharge is not automatically unregulated. Industrial users must comply with applicable federal, state, and local pretreatment requirements. The control authority is often the POTW, but it may be another designated authority. EPA or an authorized approval authority oversees local pretreatment programs; requirements may also be placed in the POTW’s NPDES permit or another applicable control mechanism.
Check categorical standards and industrial-user status
Federal categorical pretreatment standards apply to specified industrial processes. EPA describes these as technology-based standards, listed in 40 CFR Parts 405–471. Identify the facility’s industrial category and applicable standards before deciding what to sample or report.

EPA’s Pretreatment Roles and Responsibilities—Industrial Users page, accessed in 2026, describes significant industrial users (SIUs) as including categorical users, subject to the regulatory exception it notes, and users that meet specified additional criteria. Those criteria include discharging an average of 25,000 gallons per day or more of process wastewater; contributing a process wastestream equal to at least five percent of the POTW’s average dry-weather hydraulic or organic capacity; or being designated by the control authority because of a reasonable potential to affect POTW operations or violate a requirement. These are regulatory criteria, not general estimates; the applicable definition and exclusions matter.
A categorical user or SIU may have additional control and reporting duties. A control authority may require an industrial-user permit or another control mechanism, but core pretreatment obligations can apply even when the facility has not received a specific permit or mechanism.
Does industrial stormwater need a separate permit?
Potentially. Stormwater runoff from industrial activity is a separate discharge to assess, even if process wastewater is sent to a POTW or covered by another permit. EPA says certain industrial facilities must obtain industrial stormwater NPDES coverage, prepare a SWPPP or equivalent plan, and implement measures to prevent pollutant discharges in runoff.

Confirm the facility’s industrial classification and the provisions of the applicable EPA or state stormwater permit. That permit determines whether inspections, monitoring, or reports are required and how they must be performed; requirements cannot be inferred from the process-wastewater permit.

What monitoring, reporting, and records are required?
There is no single sampling schedule for all industrial facilities. Requirements vary by discharge route and are set by the applicable permit, categorical standard, or control mechanism.
For a POTW discharge
- Perform required self-monitoring and submit required reports and notifications to the control authority.
- Maintain required records. EPA’s compliance-monitoring information identifies notifications that can concern changed discharge practices, potential slug discharges, noncompliance, hazardous-waste discharges, and bypasses.
- Meet the applicable reporting schedule and requirements for forms, signatories, sample collection, and analysis. Categorical industrial users may need to submit baseline monitoring reports, compliance-schedule progress reports, 90-day compliance reports, and periodic compliance reports.
- For SIUs, EPA describes periodic reporting at least every six months under the relevant requirements. The applicable regulation and control mechanism govern exact timing and any facility-specific terms.
EPA’s industrial-user permitting guidance says sampling frequency should produce representative compliance data while taking account of the burden on the user. Relevant factors include the nature and volume of the discharge, the historical information available to characterize it (less information may support more frequent sampling), and actual or potential effects on the POTW. The control authority sets the requirements; this guidance does not create one universal interval.

For direct discharge and stormwater
Use the applicable NPDES permit’s monitoring tables and conditions to determine which pollutants to monitor, where and how to sample, the required frequency and methods, and when to report. Stormwater coverage and its plan may impose separate requirements from those for process wastewater.
How to determine the requirements for a specific facility
- Map the discharge routes. Identify every process-wastewater stream, sewer connection, surface-water outfall, and stormwater outfall. Note which streams are combined and where treatment occurs.
- Characterize the operation. Gather the facility’s location, industrial process and category, wastewater sources, average and peak flows, pollutants, treatment chemicals, and available historical sampling results.
- Identify the responsible authorities and existing instruments. Locate current NPDES permits or stormwater coverage and identify the POTW or other control authority for sewer discharges. Confirm the applicable state, tribal, territorial, and local requirements.
- Read the controlling requirements. Check the permit, categorical standards, and local control mechanism for limits, sampling points, sample types, approved analytical methods, frequency, reporting deadlines, notification duties, and record retention.
- Resolve site-specific questions with the issuing authority. Where the facility’s classification, discharge route, or applicable conditions are unclear, confirm them with the permitting or control authority before setting a compliance schedule.
Without those facility and permit details, the exact pollutant list, numeric limits, sampling frequency, analytical method, and reporting dates cannot be determined from a general overview.
