What permits and environmental clearances are needed to build a data center in India?

Short answer: A data centre does not automatically need prior environmental clearance (EC) merely because it is a data centre. The Ministry of Environment, Forest and Climate Change (MoEFCC) stated in a Rajya Sabha answer dated 6 August 2026 that AI data centres do not, “per se,” require EC under the Environmental Impact Assessment (EIA) Notification, 2006, as amended. EC becomes necessary when the proposal falls within a scheduled category—most commonly a building/construction project above 20,000 m² of built-up area, or a township/area-development project meeting its larger thresholds.

That answer settles only the national EIA trigger. Before construction or operation, the project must also be screened for local planning and building permission, water-source rights, pollution-control consents or exemptions, fire safety, fuel storage, power infrastructure, waste rules, and site-specific forest, wildlife or coastal restrictions. The exact list depends on the parcel, design, water system, backup generation and whether the data centre is part of a wider development.

When does a data centre need prior environmental clearance?

The data-centre label is not itself an EC category. The applicable trigger comes from the project form and scale listed in the EIA Schedule. The MoEFCC’s 6 August 2026 parliamentary answer specifically addressed AI data centres and said they do not, by themselves, require prior EC. A project can still require EC if its buildings or wider development fit Item 8(a) or Item 8(b) of the Schedule.

EIA schedule route Published threshold How it can affect a data-centre proposal Authority identified in the MoEFCC answer
Item 8(a): building and construction Built-up area exceeding 20,000 m² A qualifying data-centre building or building project above this threshold requires prior EC. State Environment Impact Assessment Authority (SEIAA) at state or Union-territory level
Item 8(b): township and area development Project area of at least 50 hectares and/or built-up area of at least 150,000 m² A data centre within a qualifying township or area-development proposal can require prior EC even if the data-centre building is assessed as part of a wider scheme. Confirm the categorisation and current procedure with the competent authority.
Below the listed thresholds No threshold-based Item 8(a) or 8(b) trigger established by the facts alone The ministry’s statement supports the conclusion that the data-centre label alone is not an EC trigger. Other approvals may still apply, and a larger integrated development may change the analysis. Confirm in writing with the relevant state or Union-territory authority.

“Exceeding 20,000 m²” is not the same as “20,000 m² or more”: the Item 8(a) figure is stated as above 20,000 m². Item 8(b) uses “at least” 50 hectares and/or 150,000 m² of built-up area. Measure the project against the applicable schedule using the authority’s current interpretation and the approved development plan; do not rely on a marketing description such as “hyperscale,” “AI,” or “edge.”

Standalone campus versus integrated development

A standalone facility may be assessed as a building/construction project. A campus that includes housing, offices, roads, utilities or other buildings may instead be part of a township or area-development proposal. The total project area and built-up area can therefore matter even when the data hall itself is smaller. The MoEFCC answer does not provide a universal method for allocating area among linked phases, so obtain a project-specific applicability view before construction contracts are released.

Approvals that remain relevant even when no EC is triggered

An EC, where required, is not a substitute for construction permission, utility approvals or operating consents. Official environmental-clearance conditions routinely state these obligations as conditional requirements. Treat the following as a screening list rather than a blanket checklist for every Indian site.

Land use, zoning and building sanction

Check the parcel’s master plan, zoning, development-control regulations, floor-area rules, setbacks, height limits, access roads and allowable industrial or commercial use. Obtain the applicable town-planning and local-authority building sanction before construction. The authority may be a municipal corporation, development authority, industrial-area authority or another state-designated body, depending on the location. A land purchase or lease does not itself establish that a data-centre use is permitted.

Water and air pollution controls

Cooling towers, humidification, domestic sewage, treatment systems, diesel generators and construction activity can bring the Water (Prevention and Control of Pollution) Act and Air (Prevention and Control of Pollution) Act into play. The State Pollution Control Board (SPCB) or Pollution Control Committee (PCC) can impose monitoring and discharge conditions. Determine whether the project needs Consent to Establish (CTE), Consent to Operate (CTO), or falls within a current exemption before work starts; the consent position for EC projects is addressed separately below.

Groundwater and surface-water abstraction

If the design proposes a borewell, groundwater intake or another regulated abstraction, identify the competent authority and obtain permission where required. The MoEFCC’s 2026 answer refers to the groundwater-abstraction framework in Notification S.O. 3289(E) dated 24 September 2020, as amended on 29 March 2023. The authority, conditions and feasibility depend on the source, aquifer status, location and intended volume. A municipal-water connection does not automatically authorise a backup borewell.

Forest, wildlife and coastal restrictions

Screen the parcel before final site selection. Forest diversion, protected-area or wildlife permissions, and Coastal Regulation Zone (CRZ) clearance are conditional on the land and ecological setting. A coastal location, access road, transmission line or water pipeline can create a separate trigger even if the data-centre plot itself appears outside a sensitive boundary. Use the MoEFCC’s PARIVESH process and the relevant forest, wildlife or coastal authorities where the site facts require it. Do not assume that a private industrial estate removes these obligations.

Fire safety, fuel storage and civil aviation

Obtain the applicable fire-department approval for the building, electrical rooms, battery areas, fuel systems, suppression equipment and emergency access. Diesel generators can require storage approval under petroleum and explosives controls, with the applicable requirement depending on quantity, tank type and layout. Civil-aviation approval may be relevant where the structure’s height, cranes, lighting or location could affect an aerodrome or flight path. These are design- and site-specific approvals, not automatic consequences of every generator installation.

Power connection and electrical infrastructure

Plan for a certificate of available power or load from the supplying agency, as required by official clearance conditions. Separately confirm the utility connection, substation or transmission works, right-of-way, transformer yard and any state-specific electrical inspectorate requirements. A letter showing that power is theoretically available is different from an executed connection agreement and energisation approval.

Construction and operational waste

Classify construction debris, packaging, used oils, batteries, electronic equipment, sewage-treatment residue and general solid waste. Official project conditions commonly refer to solid-waste and e-waste rules, but the correct authorisations depend on the actual waste streams and contractors. Put collection, storage, manifests, authorised recyclers and emergency-spill arrangements into the construction and operations plans rather than treating waste as a post-commissioning issue.

Water, cooling and the environmental case for the site

Cooling design can change both the project’s environmental profile and its approval workload. For qualifying building projects, MoEFCC says EC appraisal considers freshwater availability, especially in water-stressed regions, the project water balance, greywater generation, recycling and reuse. The SPCB or PCC monitors compliance with water-use and wastewater-discharge conditions.

Build a water balance before choosing the plant

Quantify source-by-source demand for cooling-tower make-up, humidification, domestic use, cleaning, fire-water replenishment and testing. Show seasonal demand, blowdown, evaporation, reject water, sewage, treatment capacity and the proposed destination for every discharge. Identify what is potable-quality, what can use treated wastewater, and what can be met with rainwater or another alternative source. This calculation should match the mechanical design and the abstraction or supply permission; an optimistic annual average can hide a summer shortfall.

Use water-stress information in site selection

A site with abundant electrical capacity can still be unsuitable if its approved water source is unreliable or groundwater abstraction is restricted. Compare municipal supply reliability, permitted abstraction, tanker dependence, drought conditions, wastewater-reuse options and the capacity of the receiving sewer or treatment system. Where a project falls in a water-stressed region, expect closer scrutiny of freshwater demand and reuse assumptions during EC appraisal.

Treated water and cooling-tower make-up

The Bureau of Energy Efficiency’s District Cooling Guidelines 2023 recommend treated water for cooling-tower make-up wherever feasible and emphasise efficient cooling, alternative water sources and conservation. These are recommendations, not a standalone permit for a particular data centre. The project still must satisfy the applicable water-source, discharge and SPCB/PCC requirements. Specify treatment quality, storage, disinfection, reliability and failover so that reuse is operationally credible rather than only a design promise.

How the 2024 consent change affects an EC-required project

A February 2025 MoEFCC parliamentary answer reports that notifications G.S.R. 702(E) and G.S.R. 703(E), both dated 12 November 2024, exempt projects requiring prior EC from obtaining a separate previous CTE, provided the project obtains EC and the required establishment safeguards are incorporated into the EC conditions. The answer says SPCBs may comment on the site, project feasibility and safeguards, and that the existing CTO mechanism continues.

This is not a universal waiver for every data centre. It is an official summary of the notifications and related standard operating procedure. Before relying on it, confirm with the relevant SPCB or PCC that the project is within the exemption, identify any state implementation instructions and budget for applicable fees or submissions. Do not begin construction on the assumption that CTE is unnecessary until that applicability is documented. The reported change does not eliminate CTO before operation where CTO remains required.

A practical approval sequence for a project team

  1. Fix the project definition. Record the state, municipality, parcel boundaries, land-use designation, planned phases, built-up area, total development area, cooling technology, water sources, generators, fuel volumes and connection route. State clearly whether the data centre is standalone or part of a township or area-development scheme.
  2. Test the EIA thresholds. Compare the design with Item 8(a) and Item 8(b), retaining the calculation drawings and area schedule. Ask the relevant SEIAA or an appropriately qualified environmental consultant for a written applicability view before site mobilisation. Do not treat an internal spreadsheet as an official EC determination.
  3. Screen ecological constraints. Check forest status, protected areas, wildlife sensitivities, CRZ mapping, wetlands or other applicable restrictions, plus groundwater status. Start PARIVESH-linked applications where the site facts require them and identify dependencies for roads, pipelines and transmission corridors.
  4. Lock the water strategy. Prepare the water balance, cooling-water specification, sewage and greywater treatment design, reuse targets, discharge route and source permissions. Verify whether groundwater abstraction is allowed and whether the local utility can provide the design flow during peak conditions.
  5. Confirm the consent route. If prior EC is required, ask the SPCB/PCC how the 12 November 2024 notifications and SOP are implemented locally, what comments or submissions are expected, and when CTO must be filed. If EC is not required, determine the ordinary CTE/CTO position rather than assuming an exemption.
  6. Obtain local and safety approvals. Secure planning and building sanction, fire approval, available-power/load confirmation, and any triggered diesel-storage, electrical-inspectorate or civil-aviation permissions before the relevant construction or operation stage.
  7. Align contracts and conditions. Put EC conditions, water monitoring, waste handling, noise and emissions controls, emergency response and reporting duties into contractor and operator scopes. Make commissioning dependent on evidence of the approvals that must precede energisation or operation.
  8. Maintain a change-control file. Re-screen approvals if the built-up area, phase boundary, generator capacity, fuel storage, cooling system, water source, building height or access infrastructure changes. A design revision can move a project into a different EIA or local-approval category.

This sequence is a planning aid, not a statutory filing order. States and sites use different portals, forms, fees and dependencies, so the local authority’s current procedure controls.

How the answer changes by project scenario

Scenario Likely regulatory question What the team should verify
Standalone building below 20,000 m² The data-centre label alone does not establish a prior EC requirement. Confirm the area calculation and screen local building, water, pollution, fire, power, waste and site-specific ecological approvals.
Standalone building above 20,000 m² Item 8(a) is the potential EC route. Confirm applicability with the SEIAA, prepare the required appraisal material and coordinate SPCB/PCC requirements, including the current CTE position.
Large campus or mixed-use development The wider proposal may be assessed under Item 8(b), even if the data hall is below the building threshold. Calculate total project area and built-up area, define phases and establish whether linked infrastructure forms one development.
Coastal, forest-adjacent or wildlife-sensitive site Additional ecological clearances may be triggered independently of the data-centre building’s EC status. Map the parcel and every associated road, cable, pipeline and transmission work before land commitment.
Groundwater-dependent or water-stressed site Water-source permission, abstraction limits and reuse expectations can determine feasibility. Obtain a source-specific view, complete the water balance and design treated-water reuse where feasible.

Common mistakes that delay Indian data-centre projects

Using “no EC” as a blanket conclusion

The ministry’s statement means the data-centre label is not an automatic trigger. It does not waive building sanction, pollution controls, water permissions, fire approval or ecological clearances.

Counting only the data hall

Support buildings, offices, utilities and linked phases can affect Item 8(a) or Item 8(b) analysis. Keep the area schedule consistent across planning, EC and building filings.

Designing water systems after the site is fixed

Cooling demand, seasonal supply, groundwater restrictions and wastewater capacity can make an apparently viable parcel impractical. Complete the water balance during site comparison.

Assuming the 2024 CTE exemption is automatic

The reported exemption concerns projects requiring prior EC and does not remove CTO. Obtain the SPCB/PCC’s current implementation position before relying on it.

Ignoring off-site infrastructure

Transmission lines, substations, access roads, fuel deliveries, water pipelines and discharge routes may have their own permissions or ecological constraints.

Relying on an old approval after a material redesign

More generators, a taller building, a different cooling technology, a new water source or an expanded phase can change the approval analysis. Re-screen the project after every material design change.

What a defensible permitting decision looks like

For a proposed data centre in India, the defensible conclusion is a written, site-specific matrix: the EIA category and area calculation; the SEIAA position if Item 8(a) or 8(b) is implicated; local planning and building permissions; water-source and discharge requirements; the SPCB/PCC consent route; ecological screening; fire, fuel, power and aviation approvals; and waste obligations. Keep the assumptions, drawings and authority correspondence together so that a later design change can be tested against the same record.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

The national position is therefore conditional rather than simply “yes” or “no”: data centres do not automatically require prior EC, but scale, integrated development and site conditions can make EC and several other approvals mandatory before construction or operation.
