A retailer’s data breach does not automatically mean someone has used your card. It does mean you should review transactions closely and contact the card issuer immediately if you find anything you do not recognize. In the United States, the protection you receive depends mainly on whether the card is credit or debit, whether only an account number was exposed or the physical card was lost, how quickly you report the problem, and the terms of the card network and issuer.
Federal law generally limits unauthorized credit-card liability to $50 under specified conditions. Debit-card liability is more dependent on reporting deadlines. Network “zero liability” promises can provide broader protection, but they are contractual policies with exclusions—not replacements for federal law or the issuer’s dispute process.

A breach notice is a warning, not proof of fraud
A breach notification tells you that information may have been accessed. It does not establish that a fraudulent purchase or electronic transfer has occurred. Criminals may test stolen details with a small charge, use them months later, or never use them at all.
Start by checking recent activity on the affected card and the linked bank account. Look for small unfamiliar charges, recurring transactions, cash withdrawals, and merchant names that differ from the store’s familiar brand name. If you find a suspicious transaction, call the bank, credit union, or card issuer using the number on the card or an official statement—not a number in an unexpected email or text.

The CFPB’s consumer guidance, titled “Watch accounts closely when card data is hacked,” recommends close monitoring and prompt reporting. Keep monitoring even when the first review is clean because fraudulent activity can appear long after information was stolen.
Credit and debit protections at a glance
| Situation | General federal rule or deadline | What to do |
|---|---|---|
| Credit-card account number used without authorization | CFPB guidance distinguishes account-number theft from loss of the physical card; the consumer is generally not responsible for unauthorized charges made with the number alone. | Notify the issuer promptly and follow its dispute procedure. |
| Physical credit card lost or stolen | Federal law generally caps unauthorized-use liability at $50 when statutory conditions are met. | Report the loss immediately, block or replace the card, and dispute any charges. |
| Unauthorized debit transfers when only account information was misused | Report within 60 calendar days after the statement showing the transaction is sent, according to the FTC’s consumer summary of federal protections. | Contact the financial institution as soon as you notice the transfer and preserve the statement. |
| Physical debit card lost or stolen | Report within two business days after learning of the loss to limit liability to no more than $50, according to CFPB guidance. | Call immediately; do not wait for the next statement. |
| Credit-card billing error | Written notice generally must reach the issuer within 60 days after the first statement carrying the error is sent under the Fair Credit Billing Act process. | Send the notice to the billing-inquiries address or through the electronic method the issuer specifies. |
These are U.S. consumer-card rules. Issuer agreements, state law, card type, and the facts of the transaction can change the outcome.
Credit-card protection after a breach
When only the account number was exposed
Federal consumer guidance treats theft of a credit-card account number differently from theft of the physical card. If an unauthorized charge is made using the number alone, you generally do not bear responsibility for that charge under the federal framework described by the CFPB and FTC. You should still report it immediately so the issuer can investigate, close the compromised number, and issue a replacement.
Do not wait for several charges to accumulate. A prompt report limits further use and creates a clear record of when you notified the issuer. Ask whether the issuer wants a written statement, an online form, or a signed declaration after the initial call.

When the physical credit card is lost or stolen
Federal law generally limits liability for unauthorized credit-card use to $50 when the statutory conditions are satisfied. The statute’s conditions include requirements concerning notice, issuer disclosures, and whether the unauthorized use occurred before notice. Once you discover the card is missing, report it immediately rather than relying on the $50 ceiling.
The issuer can normally cancel the card number and send a replacement. A replacement card addresses future use of that number; it does not by itself resolve transactions that already posted. Review the account and dispute each unauthorized transaction through the issuer’s process.
Using the Fair Credit Billing Act dispute process
The Fair Credit Billing Act (FCBA) covers unauthorized transactions and other qualifying billing errors. The FTC says written notice should be sent within 60 days after the first statement containing the error is sent. A telephone call can alert the issuer, but a call alone may not preserve the formal written-notice process.
- Identify the account, the transaction date, merchant, amount, and why you believe it is unauthorized or otherwise a billing error.
- Send the notice to the billing-inquiries address shown on the statement, or use the issuer’s accepted electronic dispute channel if it expressly provides one.
- Keep a copy of the message, attachments, submission confirmation, statement, and every call reference number.
- Continue paying undisputed portions of the bill while the issuer investigates. Follow the issuer’s instructions about the disputed amount.
Credit-card investigations generally may take up to two billing cycles. That is an investigation expectation, not a promise that every claim will be credited immediately or decided in your favor.

Debit-card protection depends heavily on timing
When only the debit account number was misused
For unauthorized electronic transfers made with account information, the FTC’s consumer guidance says to notify the financial institution within 60 calendar days after the statement showing the problem is sent. The 60-day period is measured from the statement date, not from the date of the retailer’s breach notice.
Contact the institution as soon as you see the transaction anyway. Waiting can allow additional transfers and can weaken your position under the applicable rules. Ask the representative to block the card or account credentials, explain whether a new account number is needed, and tell you how to submit written confirmation.
When the physical debit card is lost or stolen
If the physical card is missing, CFPB guidance says to report the loss within two business days after learning of it to limit liability to no more than $50. This is a much shorter clock than the 60-day statement rule for account-number-only misuse.

Call immediately, even outside normal branch hours if the institution offers a 24-hour lost-card line. Record the exact time and date of the report and ask for a confirmation number. If the card is later found, do not assume it is safe to resume using it; follow the issuer’s instructions.

Investigation and provisional credit
CFPB guidance describes a general 10-business-day investigation period for debit-card disputes. In some circumstances, the institution may take up to 45 days, and sometimes 90 days, when the conditions for provisional credit are met. These are general investigation guidelines, not a universal reimbursement deadline.
Keep statements, transaction details, screenshots, receipts, and notes of every conversation. If provisional credit is issued, check whether it is temporary and what action is required to make it permanent.
Network zero-liability policies are separate from federal law
Card networks may promise zero liability for unauthorized transactions, but the promise is governed by network and issuer terms. It should not be confused with the statutory protections described above.

Visa says its zero-liability policy applies to most Visa credit and debit cards. The policy has exclusions, including certain commercial cards, anonymous prepaid transactions, and transactions that are not processed by Visa. Your issuer’s agreement determines how the policy is applied to your particular card.

Mastercard network terms
Mastercard states that cardholders are protected against fraud under its Zero Liability policy when they use Mastercard. The policy requires reasonable care and prompt reporting, and it excludes certain commercial cards and unregistered prepaid cards. Check the terms supplied by your issuer rather than assuming every Mastercard transaction qualifies.
In either case, report the transaction promptly and cooperate with the issuer’s investigation. A network policy cannot restore a missed legal deadline or override an issuer’s requirement for documentation.

- Read the notice carefully. Determine whether it says card numbers, expiration dates, security codes, bank-account details, names, addresses, passwords, or government identifiers were exposed. The type of information affects the next steps.
- Review transactions now. Check the card, the linked deposit account, digital-wallet activity, and recurring payments. Include tiny charges and unfamiliar merchant descriptors.
- Call the issuer for suspicious activity. Ask whether the card should be locked, canceled, replaced, or reissued with a new account number. Ask which disputes must be submitted in writing.
- Preserve evidence. Save the breach notice, statements, transaction records, emails, text messages, screenshots, and call-confirmation numbers. Write down the date, time, person, and instructions for each contact.
- Use the correct dispute route. Follow the FCBA written-notice process for a credit-card billing error. For an unauthorized debit transfer, notify the financial institution quickly and follow its electronic or written procedure.
- Watch for delayed activity. Continue checking statements and alerts for several months. A clean account immediately after the breach is not proof that the exposed data is harmless.
- Secure related accounts. If the breach involved login credentials, change reused passwords, enable multifactor authentication, and review account-recovery details. Do not reuse a password that was exposed.
- Address broader identity theft. If names, addresses, Social Security numbers, or other identity information were exposed and misuse is suspected, use the FTC’s free IdentityTheft.gov recovery resource. Paid monitoring is not required to invoke card-dispute rights and does not prevent card fraud.
Fraud is not the only kind of billing problem
A retailer breach can produce an unauthorized charge, but not every disagreement with a retailer is fraud. Classifying the problem correctly helps you use the right process.

| Unauthorized transaction | Did you or an authorized user make this purchase? | Notify the card issuer or bank immediately and use its fraud-dispute process. |
| Item not delivered or not delivered as agreed | Was the purchase authorized but the merchant failed to provide what was promised? | For eligible credit-card transactions, raise the issue as an FCBA billing error; debit protections are narrower. |
| Incorrect amount or duplicate charge | Does the posted amount differ from the receipt, or did the transaction post twice? | Contact the merchant and issuer, and use the applicable billing-error procedure. |
| Product-quality disagreement | Was the item delivered but defective or unlike the description? | Document the issue and follow the issuer’s rules; do not label it unauthorized unless you did not authorize the transaction. |
Credit-card dispute rights can cover some billing problems beyond fraud, including certain non-delivery errors. Debit-card protections primarily address unauthorized transfers and specified account errors, so the two systems should not be treated as interchangeable.
Common mistakes that can cost time or protection
- Assuming the breach itself creates a refund claim. A breach notice is evidence of possible exposure, not evidence that a charge is fraudulent.
- Waiting for the issuer to find the problem. Monitoring and prompt reporting are the consumer’s practical safeguards.
- Missing the debit-card deadlines. The two-business-day rule for a lost physical debit card and the 60-day statement rule for account-number misuse are different clocks.
- Using only a phone call for an FCBA dispute. Call first if needed, but send the written notice through the address or electronic method the issuer specifies.
- Assuming zero-liability language is unconditional. Network policies can exclude commercial, anonymous prepaid, or non-network-processed transactions and can require reasonable care and prompt notice.
- Confusing a merchant dispute with fraud. Incorrect amounts, non-delivery, and product-quality problems may follow different rules from an unauthorized purchase.
- Buying a product to obtain legal protection. Wallets, RFID sleeves, security software, and paid monitoring are not prerequisites for the federal protections described here.
What protection should you expect?
For a U.S. consumer credit card, an unauthorized-use claim generally has the strongest federal baseline: account-number-only misuse is generally not charged to the consumer, and unauthorized use of a lost or stolen physical card is generally capped at $50 when statutory conditions are met. For a debit card, reporting speed is central: a lost physical card should be reported within two business days, while account-number-only misuse should be reported within 60 days after the relevant statement is sent.
Your immediate priorities are therefore simple but time-sensitive: inspect the account, report suspicious activity, preserve records, and use the issuer’s formal dispute channel. Network zero-liability terms may improve the result, but only the issuer can apply those terms to your card and transaction.
