Neither law is a blanket right to see every communication or veto every school activity. The result in a particular case can also depend on the student’s age and enrollment, state law, district policy, and any applicable custody order.
Which laws cover student privacy?
The federal baseline comes from the Family Educational Rights and Privacy Act (FERPA) and the Protection of Pupil Rights Amendment (PPRA). They address different situations, so identifying whether a concern involves an existing record, a disclosure, a survey, or another school activity is a useful first step.

| Law | What it generally covers | Key distinction |
|---|---|---|
| FERPA | Parents’ rights to inspect and review covered education records, seek amendments to records they believe are inaccurate, and consent to many disclosures of personally identifiable information. | It concerns covered records and identifiable information, subject to legal exceptions; it does not mean every school-held item must be disclosed in every circumstance. |
| PPRA | Specified surveys and information-gathering practices, certain instructional materials, certain physical examinations or screenings, and personal information collected for marketing or sale. | Its notice, access, and opt-out procedures depend on the activity and circumstances; it is not a general veto over instruction or all student questions. |
The U.S. Department of Education’s Student Privacy Policy Office explains the federal FERPA baseline in its Legal Basics materials and discusses PPRA in its FAQ and notices. State law and local policy may add requirements or affect how a dispute is handled.
Can a parent see a child’s school records?
For an educational entity covered by FERPA, the Department of Education says a parent must be allowed to inspect and review the student’s education records within 45 days of a request. Parents may also seek amendment of records they believe are inaccurate and generally must consent before personally identifiable information from covered records is disclosed, unless an exception permits disclosure without consent.

That access right applies to covered education records maintained by the school. It is not a promise that every message, conversation, or item of information will be treated as an education record or released without redaction. If a response is denied or limited, ask the school to identify the records or information at issue, explain its reason, and point to the applicable review process.
Make the request specific
- Identify the student and the records you want to inspect. Describe the relevant time period or record category when you can.
- Send the request to the school or district office that handles student records, in writing, and keep a copy. This is practical recordkeeping advice, not a special federal form requirement.
- Note when the school receives the request. The Department’s summary gives a 45-day period for access to covered records.
- If the school withholds or redacts something, ask which records were considered and what process is available to challenge the response.
Access is different from an amendment request
Inspecting a record lets a parent review what the school maintains. Seeking an amendment is a separate FERPA right for a record the parent believes is inaccurate. The school’s amendment process is distinct from the access deadline; do not assume that asking to correct a record is the same as requesting to see it.

When do rights transfer from a parent to a student?
The transfer rules are different under FERPA and PPRA. A student’s age and enrollment or legal status can therefore change who exercises the federal rights.
| Law | When the federal rights transfer | Practical significance |
|---|---|---|
| FERPA | When the student turns 18, or when the student attends a postsecondary institution at any age. | A parent’s continuing financial or personal support does not, by itself, change the transfer trigger described by the Department. |
| PPRA | When the student turns 18, or when the student is emancipated under applicable state law. | Postsecondary enrollment alone is not the PPRA transfer trigger described in the Department’s materials. |
These are federal rules; state law may matter to questions such as emancipation, and individual situations can involve other relevant facts or orders.

What does PPRA let parents review or opt out of?
PPRA requires local educational agencies to develop policies, in consultation with parents, in several specified areas. The Department describes parental access, on request, to certain third-party surveys before administration; privacy protections for surveys that ask about protected areas; access to instructional materials used as part of the curriculum; certain physical examinations and screenings; and restrictions involving personal information collected or used for marketing or sale.
Notice and an opportunity to opt a child out apply in specified circumstances, not automatically to every questionnaire or school activity. The Department’s March 2025 annual notice describes circumstances involving surveys about protected areas, including cases where participation is required or specified Department-administered programs are involved. Requirements can depend on the survey’s content, program or funding context, and whether participation is mandatory. Parents should check the district’s annual PPRA notice and the policy for the particular activity.

What do the recent federal announcements say about student gender identity information?
Student names, pronouns, and gender identity have become a prominent point of dispute involving parental access, student privacy, and state or district policies. On March 28, 2025, the Department of Education announced a compliance direction concerning FERPA and PPRA and stated its view that records related to gender identity fall within parents’ inspection rights.

These are Department announcements and agency findings, not a final court judgment that resolves every dispute nationwide. Whether a particular item exists, is maintained by a school, qualifies as a covered education record, or is subject to an exception depends on the circumstances. State and local rules may also affect the answer.
Quick Recap
How should families approach a records or privacy dispute?
- Pin down the setting: identify the state, school type, student’s age, and whether the student attends a postsecondary institution.
- Name the request: distinguish a request to inspect existing records from a request for a new explanation, notice of an event, or a correction to a record.
- Identify the activity: determine whether the concern involves record access, disclosure to another party, an amendment, a survey, instructional material, marketing data, or a physical examination.
- Check the applicable notices: review the district’s current FERPA and PPRA notices and the policy in force when the event occurred.
- Get jurisdiction-specific help when needed: state law, local policy, and custody arrangements can matter. For a live dispute, consult the relevant state education agency, official federal guidance, or a qualified lawyer.
