Mortgage lenders should treat an AI agent as part of the lending operation—not as an experiment outside normal controls. Before an agent reads borrower files, contacts applicants, recommends a decision, or supports servicing, the lender should define its permitted task, accountable owner, data boundaries, vendor duties, monitoring, human escalation, and records. If the system influences a credit decision, the lender must be able to reconstruct the actual decision factors and provide specific, accurate adverse-action reasons when required.
This is a U.S.-focused operational guide. The applicable obligations depend on the lender, loan product, jurisdiction, data flow, and whether loans are sold to or serviced for a particular investor. A general AI policy or a government-sponsored enterprise framework does not answer every legal question.
Start with the agent’s authority and the decision it can affect
“AI agent” can describe anything from a document-classification assistant to a system that retrieves records, calls external tools, recommends underwriting actions, or communicates with borrowers. Compliance risk rises with the agent’s authority, the sensitivity of the data it handles, and the consequence of an error.

| Operations recommendation | Flags missing information, prioritizes work, suggests conditions | Validation, override logging, bias testing, monitoring for drift |
| Credit-decision influence | Supplies or ranks factors used in approval, pricing, or denial | Decision traceability, explainability, adverse-action accuracy, qualified human oversight |
| Servicing action | Recommends or initiates payment, loss-mitigation, or account actions | Authorization controls, borrower protections, audit trails, rollback and complaint handling |
Classify the use case before selecting a model. An agent that drafts a checklist is not governed the same way as one that changes a borrower’s approval odds. The classification should be recorded in the lender’s inventory and revisited when the prompt, connected data, model, or workflow changes.
What Fannie Mae’s 2026 framework means for covered lenders
Fannie Mae Lender Letter LL-2026-04, dated April 8, 2026, establishes a specific AI and machine-learning framework for seller/servicers. It applies to AI/ML used in the origination of loans sold to or guaranteed by Fannie Mae and to servicing loans on Fannie Mae’s behalf. The letter says it becomes effective 120 days after publication.
#1 Best Overall
- [Ultra-Lightweight Ear Buds Designed for Small Ears] Each earbud weighs only 3.7g and features a compact, ergonomic in-ear design made especially for small ears. Secure, low-profile, and comfortable for workouts, all-day wear or overnight sleeping. The ultra-slim profile sits flush in your ear with no hard edges poking or rubbing, so you can even sleep on your side without discomfort.
- [Immersive Stereo Sound with TOZO OrigX Technology] TOZO OrigX tuning delivers clear vocals, balanced mids, and natural stereo sound for music, podcasts, and videos.
- [Long Battery Life for Daily Use] Get up to 7 hours of playtime on a single charge, with up to 32 hours total using the charging case—ideal for workdays, commuting, and extended listening sessions.
- [Bluetooth 5.3 & Stable Connection] Bluetooth 5.3 provides fast pairing, stable wireless performance, and reduced dropouts as you move around home or office.
- [Deep Bass with Clear Vocals] High-performance drivers produce punchy bass while keeping vocals clean and detailed for everyday listening.
This is a seller/servicer expectation with a defined scope, not a universal AI statute. A lender should first determine whether it sells loans to, or services loans for, Fannie Mae. The letter also states that applicable law and the Lender Contract continue to apply. Covered organizations should build policies and procedures for:
- Development, implementation, use, maintenance, and risk management of AI/ML.
- Transparent communication to personnel who need to understand the system’s use and controls.
- Trustworthy and ethical AI characteristics, including awareness of legal and regulatory requirements.
- Risk management tied to the organization’s risk tolerance.
- Named ownership and review at least annually.
- Information-security protections and governance over vendors and subcontractors.
Fannie Mae may request information about the types of AI used, their purpose and manner of use, safeguards, and other details. Vendor and subcontractor governance for covered use must be no less protective than the seller/servicer’s own controls. Keep evidence—approvals, inventories, testing, incidents, overrides, and reviews—in a form that can be produced without reconstructing the history from scattered systems.
Map borrower data before an agent can access it
Make a data-flow diagram for each use case. Identify what the agent can retrieve, infer, retain, transform, or send to an outside model or tool. Mortgage files can contain identity information, income, employment, assets, debts, tax records, credit data, property details, communications, and information about household members. The agent should receive only what is necessary for the defined task.

Questions for the data map
- Which systems are connected, and can the agent query them directly?
- Can prompts, outputs, uploaded documents, or logs be used to train an external provider’s model?
- Where are data and backups stored, for how long, and who can retrieve them?
- Are sensitive fields masked, tokenized, or excluded when they are not needed?
- Can an employee or borrower ask the agent to reveal information from another applicant?
- What happens when the agent receives conflicting, incomplete, or obviously corrupted data?
Fannie Mae’s Selling Guide identifies borrower privacy and consumer-credit/equal-credit requirements among the laws applicable to covered sellers and servicers, including subservicers, third-party originators, and technology licensees. A privacy impact assessment is a practical way to document how personally identifiable information is handled, test whether collection and use meet requirements, and record mitigations. It does not replace legal review, security testing, or contractual controls.
Build governance with a named owner and a stop button
Every agent needs one accountable business owner, a technical owner, and a compliance or risk reviewer. The business owner defines the permitted outcome; the technical owner controls configuration and access; the reviewer checks legal, privacy, fair-lending, and operational risks. For Fannie Mae-covered use, align the program with LL-2026-04’s ownership and annual-review expectations.
Minimum governance record
- Use-case name, purpose, affected products, jurisdictions, and responsible executives.
- Model, agent version, prompts or policies, connected tools, and change history.
- Permitted inputs and outputs, prohibited actions, retention period, and access roles.
- Validation results, known limitations, performance thresholds, and fairness testing.
- Human-review points, escalation contacts, rollback procedure, and incident severity levels.
- Vendor, subcontractor, hosting, security, breach-notification, and deletion obligations.
- Review date, approval status, and conditions for suspension.
The agent should fail safely. If confidence is low, records conflict, a request falls outside the approved purpose, or an explanation cannot be generated, it should stop and route the matter to a trained employee. A pause or rollback must be technically possible without waiting for a model provider to change its service.

Preserve a reconstructable path to every credit decision
If an agent materially influences approval, pricing, counteroffer, or denial, retain the information needed to reproduce its role. That includes the data version, relevant fields, model and agent version, instructions, tool results, timestamps, human overrides, and the final decision. “The model said so” is not an adequate record.
CFPB guidance issued September 19, 2023 says creditors using complex algorithms must provide specific and accurate reasons for adverse action. A checklist of possible reasons is not sufficient if the selected reasons do not reflect the actual reasons for the decision. CFPB Director Rohit Chopra stated: “Creditors must be able to specifically explain their reasons for denial. There is no special exemption for artificial intelligence.” The statement is from 2023; apply it alongside the current statute, regulation, official interpretations, and later agency materials.
Design the explanation before deployment
- List the factors the workflow is legally and operationally allowed to use.
- Record which factors actually affected the outcome, not merely which factors were available.
- Test explanations against edge cases, overrides, missing data, and multiple simultaneous reasons.
- Have compliance review the notice language for specificity and accuracy.
- Re-test after any model, data, prompt, threshold, or vendor change.
Do not promise that a human review cures an untraceable model. The reviewer needs enough evidence to understand the recommendation, challenge it, and document the final rationale.

Apply fair-lending, privacy, and mortgage rules together
AI oversight is not a separate silo from mortgage compliance. A use case can raise fair-lending, privacy, disclosure, servicing, appraisal, and information-security issues at the same time. GAO’s September 2025 report on property technology in homebuying and mortgage evaluation identifies potential fair-lending, privacy, and oversight concerns. Those concerns can arise from the data used to train or prompt a system, proxy variables, disparate error rates, inaccessible interfaces, or automated steering.

CFPB’s ECOA resource records a final Regulation B rule issued April 22, 2026 addressing provisions concerning disparate impact, discouragement, and special purpose credit programs. Because legal text and interpretations can change, confirm the current rule before relying on a test, policy, or conclusion. Regulation Z is also among the mortgage rules to check: CFPB materials identify mortgage loans, disclosures, servicing, and appraisal requirements within its coverage, while noting that an interactive resource is not the official legal edition.
Fairness review questions
- Does the agent use, infer, or proxy for protected characteristics?
- Do approval, pricing, document-request, servicing, or escalation rates differ across relevant groups?
- Are errors concentrated among applicants with limited English proficiency, disabilities, thin credit files, or nontraditional income?
- Could the agent discourage an applicant or steer a borrower toward a product or channel?
- Can a human correct an erroneous inference without penalizing the borrower for challenging it?
Document the population, outcome definition, test period, data limitations, thresholds, remediation, and decision to proceed. A favorable aggregate result does not prove that every segment is treated fairly.

Control vendors, models, and subcontractors
Outsourcing the model does not outsource the lender’s responsibilities. Before sharing borrower data or allowing an agent to act, evaluate the provider’s access, security, retention, training use, incident response, geographic processing, subcontractors, change notifications, audit rights, and deletion process. Contracts should identify who owns logs and outputs, how quickly incidents are reported, and whether the provider can support a specific adverse-action explanation.
For Fannie Mae-covered activity, vendor and subcontractor AI risk governance must be no less protective than the seller/servicer’s governance. Require the provider to notify the lender before material model or data-flow changes, and maintain a tested exit plan. A provider that cannot return usable records or explain a version change is an operational dependency, not merely a software supplier.
Monitor the agent after launch
Pre-deployment validation is only a baseline. Monitor accuracy, false positives and negatives, override rates, complaint patterns, response latency, data leakage indicators, access anomalies, and outcome differences across relevant populations. Set thresholds that trigger investigation, human review, suspension, or rollback. Review monitoring results on a schedule proportionate to the decision’s consequence and at least annually where the covered Fannie Mae framework requires that cadence.
Incident and escalation path
- Contain the event: disable the affected action, revoke access, or switch to a manual process.
- Preserve prompts, inputs, outputs, logs, versions, and communications.
- Assess affected borrowers, decisions, disclosures, privacy, and reporting duties.
- Correct or re-run decisions where appropriate, with documented human review.
- Notify required internal stakeholders, vendors, regulators, investors, and borrowers according to applicable rules and contracts.
- Record root cause, corrective action, owner, deadline, and evidence of closure.
A practical implementation sequence
- Inventory. List every current and proposed agent in origination, underwriting support, closing, servicing, collections, and borrower communications.
- Tier. Rate each use by decision authority, borrower-data sensitivity, external sharing, explainability, reversibility, and applicable loan-program or jurisdiction obligations.
- Map. Document data sources, transfers, storage, retention, users, tools, and subcontractors; complete a privacy impact assessment where appropriate.
- Approve. Assign owners, define prohibited actions, set human-review points, and obtain legal, compliance, security, and business sign-off.
- Validate. Test accuracy, robustness, fairness, security, explanations, accessibility, and failure handling using representative and difficult cases.
- Pilot safely. Begin with a restricted population or shadow mode, compare outputs with qualified employees, and block automatic decisions until acceptance criteria are met.
- Operate. Monitor, log, review overrides and complaints, manage vendor changes, and keep the stop-and-rollback process tested.
- Reassess. Reapprove after material changes and conduct the required periodic review; for Fannie Mae-covered use, include at least the annual review described in LL-2026-04.
Common mistakes to avoid
- Calling a system “assistive” while allowing its score or recommendation to determine the next credit action.
- Sending complete loan files to a general-purpose external model when a redacted, task-specific input would work.
- Relying on generic adverse-action reason codes that were not the actual drivers.
- Assuming a vendor’s security certification proves compliance with the lender’s privacy, fair-lending, or investor duties.
- Testing only average accuracy and ignoring subgroup error rates, unusual income, conflicting records, or language and accessibility needs.
- Keeping no versioned record of prompts, model changes, tool calls, or human overrides.
- Treating a broad AI policy as a substitute for product-specific, jurisdiction-specific legal analysis.
What lenders should verify before relying on this guidance
This article addresses a U.S. governance framework, not every state privacy or AI law, regulator interpretation, security control, or facts-specific legal obligation. Recheck official federal and state text before deployment or operational reliance. Pay particular attention to changes in Fannie Mae implementation guidance, CFPB rule status, and state requirements. The lender’s own counsel and compliance team should determine how the rules apply to its products, contracts, data flows, and decisions.
