The key question is whether the service or access is authorized—and what conduct is involved. IPTV technology, an app, or a streaming device is not illegal by itself.
What “illegal pay TV” means under U.S. law
The phrase can describe several different situations: receiving cable service without authorization, providing certain commercial digital-transmission services that distribute copyrighted works without authorization, or bypassing technological controls that restrict access. Each is governed by a different legal test.

Unauthorized cable reception
Federal law says a person may not intercept or receive, or assist in intercepting or receiving, communications service offered over a cable system unless specifically authorized by the cable operator or by law. The statute also includes manufacturing or distributing equipment intended for unauthorized reception as a form of assistance. This is a cable-specific rule; its wording should not be treated as a general rule for every internet video service. 47 U.S.C. § 553.

Commercial digital-transmission services
A separate federal statute applies to a person who willfully offers or provides the public a digital-transmission service for commercial advantage or private financial gain, when the service meets at least one specified criterion: it is primarily designed or provided for unauthorized public performances of protected works; it has no commercially significant purpose or use other than that; or it is intentionally marketed to promote that unauthorized use. The statute addresses offering or providing a service and has specific elements; the label “IPTV” alone does not satisfy them. 18 U.S.C. § 2319C.
Bypassing access controls
Section 1201 of the Copyright Act concerns circumvention of technological measures used to control access to copyrighted works. The statute defines circumvention to include decrypting, avoiding, bypassing, removing, deactivating, or impairing a measure without the copyright owner’s authority. The Copyright Office gives bypassing a password control to access a subscription video-streaming service as an example. U.S. Copyright Office, Section 1201 FAQs and 17 U.S.C. § 1201.

How to assess an IPTV subscription
IPTV means television delivered using internet protocol. That describes a delivery method, not whether a service has permission to carry its programming. A legitimate service can use IPTV, and an unauthorized service can use the same technology. Government hearing material describes illicit services as carrying channels or video-on-demand content without authorization, sometimes through paid subscriptions, but those examples are descriptive rather than a substitute for applying the law. - Authorization: Is the service authorized to provide the channels or other content where you are?
- Conduct: Is the issue unauthorized cable reception, helping others obtain it, public retransmission, or bypassing an access control?
- Purpose and statutory criteria: For § 2319C, willfulness, commercial advantage or private financial gain, and at least one of the service criteria matter.
- Jurisdiction: The statutes discussed here are U.S. federal authorities; another country requires a separate legal analysis.
A low price, unfamiliar brand, or streaming device may prompt questions about authorization, but none by itself proves that a service or user violates one of these provisions. The legal conclusion depends on the facts and the relevant statute.

Why the distinction matters
“Illegal pay TV” can refer to different conduct by a service operator, a person assisting unauthorized reception, or someone bypassing an access control. Those situations should not be collapsed into a claim that every IPTV provider, app, device, or subscriber is treated alike. The cited digital-transmission statute, in particular, specifies elements concerning a person offering or providing a service.
A 2012 Copyright Office statement in a House hearing record said the Office was not aware at that time of studies focused solely on illegal streaming’s overall impact on the internet ecosystem.
