“Made in USA” is not a synonym for an American brand, a U.S. factory address, or final assembly in the United States. For an unqualified claim, the Federal Trade Commission (FTC) expects a product to be “all or virtually all” made in the United States: final assembly or processing must occur here, all significant processing must occur here, and all or virtually all components must be made and sourced domestically. A product containing imported parts may qualify for a carefully worded “Assembled in USA” claim only when the U.S. assembly is principal and substantial and the product was last substantially transformed in the United States.
Customs marking is a separate issue. U.S. Customs and Border Protection (CBP) decides whether imported goods need a foreign-country marking under its case-by-case substantial-transformation analysis. A CBP result does not automatically authorize an FTC-compliant “Made in USA” marketing claim.

The three origin claims consumers should distinguish
Read the exact wording, not just the flag, map or factory photograph. These claims make materially different promises:
| Claim wording | What it generally requires | What it does not prove |
|---|---|---|
| Made in USA (unqualified) | U.S. final assembly or processing; all significant processing in the United States; and all or virtually all components made and sourced in the United States. | There is no universal percentage threshold that makes a product qualify. A U.S. company, U.S. design team or U.S. warehouse is not enough. |
| Made in USA with imported parts (qualified) | A truthful qualification that explains the imported content and does not imply more domestic content than exists. The marketer still needs a reasonable basis. | The word “USA” by itself does not make the qualification clear. Placement, type size and surrounding graphics can create an overall misleading impression. |
| Assembled in USA | Principal assembly occurs in the United States, the assembly is substantial rather than a minor finishing operation, and the product was last substantially transformed here. | Simply tightening screws, loading software or packaging imported major components does not automatically meet the standard. |
| Foreign country-of-origin mark | CBP may require a marking identifying the country where the imported article was made or last substantially transformed. | A determination that a foreign mark is unnecessary is not a blanket permission to advertise the product as Made in USA. |
The FTC’s consumer-facing standard applies to claims such as “Made in America” and “Made in USA” when they communicate U.S. origin. The precise wording and the overall presentation matter; a small disclaimer cannot cure a prominent, contradictory message.

What an unqualified “Made in USA” claim means
The FTC describes an unqualified claim this way: “For a product to be called Made in USA, or claimed to be of domestic origin without qualifications or limits on the claim, the product must be ‘all or virtually all’ made in the U.S.” The phrase is deliberately demanding. It is a qualitative standard, not a safe harbor based on a particular domestic-cost percentage.
U.S. final assembly or processing
The product must finish in a U.S. operation that is more than storage, inspection or a token finishing step. In electronics, that could involve building and testing a device, but the significance of the operation depends on the product and its production sequence. The location of the last workstation alone does not settle the question.
All significant processing in the United States
Significant processing includes the manufacturing work that gives the article its essential form, function or capability. A company must analyze the whole production chain, not only the final line. Imported circuit boards, displays, power modules or other major assemblies can be highly significant even when technicians perform meaningful work in a U.S. plant.
All or virtually all components made and sourced domestically
Components must also be considered. “Virtually all” does not mean that a product can contain any convenient mix of foreign and domestic parts. The significance, value and role of each component matter, particularly for major electronic assemblies. The FTC materials do not establish a single percentage applicable to every product, so marketers should not invent one.

Why U.S. assembly alone is not enough
The FTC’s computer example illustrates the problem. A computer whose motherboard, hard drive and other major components are imported, then joined in a simple screwdriver operation in the United States, does not qualify for an unqualified assembled-in-U.S. claim and must carry a foreign country-of-origin mark. This is an illustration, not a universal ruling about every computer: actual origin depends on the specific parts, processes and production facts.
The same reasoning can affect routers, servers, cameras, laboratory instruments, smart-home equipment and other technology. Installing firmware, attaching a case, inserting a battery or running a final test may be important quality steps, but those steps do not automatically make imported major assemblies U.S.-origin products.
When “Assembled in USA” can be accurate
An assembly claim can accommodate foreign components, but it has two connected requirements.

The principal assembly must take place in the United States and must be substantial. Consider the number and complexity of operations, how much of the product is put together domestically, and whether the U.S. work creates the finished article rather than merely preparing it for sale. A brief packaging or screwdriver operation is unlikely to be enough when the important assemblies arrived complete from abroad.

Last substantial transformation in the United States
The product should have been last substantially transformed in the United States. In the general test summarized by the FTC, a process is transformative when it creates a new and different product with a new name, character and use. CBP applies this analysis case by case. A manufacturing step that changes an imported item into a new commercial article may support U.S. origin for a particular purpose, while a minor operation may not.
“Assembled in USA” therefore describes a manufacturing fact, not a way to avoid explaining imported content. A qualified statement such as “Assembled in USA with imported components” still needs substantiation and must not exaggerate the domestic contribution.

The FTC polices deceptive origin representations under Section 5 of the FTC Act. Its Made in USA Labeling Rule addresses labeling claims; in a July 2021 announcement, the agency stated, “The rule applies only to labeling claims.” That statement describes the rule’s scope, not a limitation on the FTC’s broader authority to challenge deceptive advertising or other representations under the FTC Act. Marketers need a reasonable basis for the claim they present to consumers.

CBP: whether an imported article needs a foreign mark
CBP administers country-of-origin marking for imported goods. Its substantial-transformation inquiry is fact-specific and asks whether processing produced a new and different article with a new name, character and use. A product can be exempt from a particular foreign marking requirement yet still be unable to support an unqualified Made in USA advertisement. Conversely, a foreign-origin marking question does not by itself answer every FTC advertising question.
For a technology company, this means a customs ruling, tariff treatment or import document should not be treated as a complete marketing substantiation file. Keep the two analyses separate.
How to evaluate an electronics product’s origin claim
Before printing a label, publishing a product page or approving a trade-show display, document the following items for the exact model and production version:
- Capture the exact claim. Record whether it says “Made in USA,” “Made in America,” “Assembled in USA,” or uses a qualification such as “with imported components.” Include flags, maps, stars and nearby copy because the overall presentation can change the message.
- Map every production location. List where fabrication, board population, machining, molding, firmware loading, calibration, testing and final assembly occur. Identify which steps are performed by suppliers and which are performed by the marketer.
- Identify significant processing. Explain which operations create the product’s essential function and which are routine finishing, packaging or inspection. Do not assume the last operation is the most important one.
- Inventory components by role and origin. For major assemblies such as motherboards, processors, displays, storage, radio modules, batteries and power systems, record the manufacturing country and whether the item arrived as a finished subassembly.
- Assess substantial transformation. For the relevant production step, ask whether it creates a new and different product with a new name, character and use. Because CBP makes determinations case by case, preserve engineering descriptions and bills of materials rather than relying on a slogan.
- Choose the narrowest accurate wording. If imported content is significant, an unqualified claim is generally inappropriate. Use a precise qualification that consumers can see and understand, and verify that the qualification does not imply that only trivial parts are imported when major assemblies are foreign.
- Retain evidence. Keep supplier certifications, bills of materials, manufacturing records, invoices and process descriptions tied to a model, revision and production date. A claim that was accurate for one revision may not remain accurate after a supplier change.
Common technology scenarios
A U.S.-branded laptop with imported core parts
The brand’s headquarters, design staff and customer support may all be in the United States. If the motherboard, display, storage and other major parts are imported and the U.S. operation mainly screws them together, those facts do not support an unqualified Made in USA claim. The FTC computer example warns against treating simple final assembly as decisive.
Best Value
A device built from imported chips on a U.S. production line
Semiconductors are globally sourced in many products. Their presence does not automatically disqualify every possible U.S.-origin claim, but the marketer must analyze whether the imported chips and other parts are significant and whether all significant processing and virtually all components are domestic. There is no general rule that a U.S. printed-circuit-board line makes the completed device American-made.
A U.S. battery pack containing imported cells
In April 2022, the FTC described its first case under the Made in USA Labeling Rule. The complaint alleged that a battery maker marketed batteries as Made in USA while using lithium-ion cells made in China. This was an allegation in that case at that time, not a finding about every battery or a current survey of products. It demonstrates why cell origin, pack assembly and the exact advertising language must be documented separately.
Software, firmware and cloud services
Writing code in the United States or operating a U.S. cloud service does not, by itself, establish the origin of a physical device. For hardware claims, the relevant analysis remains tied to physical processing and components. A company should describe domestic software development separately rather than allowing it to imply that imported hardware is Made in USA.

- “American company.” Ownership, incorporation or a U.S. mailing address says nothing conclusive about where the product was manufactured.
- “Designed in the USA.” This can describe design work if true, but it is not the same as a manufacturing-origin claim.
- “Built in our U.S. facility.” The statement may be accurate yet incomplete if the facility performs only a minor operation on imported major assemblies.
- Flags and maps without words. Visual cues can communicate a domestic-origin message even when no explicit sentence says Made in USA.
- Small-print qualifications. A qualification that is hard to notice or contradicts the dominant headline may not prevent a misleading overall impression.
What consumers can check
Consumers who care about domestic production should look for the exact claim and its qualification, then ask what the manufacturer means by “made” or “assembled.” Useful questions include:
- Does the package identify imported components?
- Which major assemblies are manufactured in the United States?
- Is the statement about the physical product, its design, its packaging or its software?
- Does the claim apply to every model and revision, or only a specified configuration?
- Can the manufacturer explain where final assembly and significant processing occur?
A U.S. origin label is not a guarantee of a particular quality level, security posture, labor standard or supply-chain resilience. It communicates a manufacturing-origin claim, and that claim should be evaluated on its own terms.
Bottom line for buyers and marketers
For electronics, an unqualified “Made in USA” claim sets a high bar: U.S. final assembly or processing, U.S. significant processing, and all or virtually all components made and sourced domestically. “Assembled in USA” is narrower and can include foreign parts only when the U.S. assembly is principal and substantial and the product was last substantially transformed here. FTC advertising standards and CBP import-marking determinations overlap in their attention to production facts but answer different legal questions. Treat the exact model, bill of materials, process sequence and wording as the evidence—not the company address, a flag or the location of the last screwdriver.
