What Local Governments Can Regulate When Approving Data Centres

A local government can usually decide whether a data centre fits a proposed location, which planning route it must follow, and what site and operating conditions apply. It may review land use, traffic, noise, design, water and power capacity, stormwater, environmental effects and emergency access—but its authority is defined by local enabling law and shared with state, national, utility and environmental regulators.

That means there is no universal checklist. The answer depends on the jurisdiction, the zoning district, the facility’s size and impacts, and whether the rule is already adopted or merely recommended. The framework below shows what councils and planning departments commonly control, where their authority ends, and how to test a specific proposal.

Start with the approval route: what decision is the council actually making?

Before debating cooling systems or generators, identify the legal path for the project. A comprehensive plan, zoning map and development code normally determine whether a data centre is an allowed use, a conditional or special use, or prohibited at the proposed site. The code may also define “data centre,” “server farm,” or related campus uses and set floor-area, power or site-size thresholds.

By-right approval

A by-right project can proceed when it satisfies the adopted zoning and development standards. Staff may check plans, building details and technical reports, but the council may have little discretion to reject a compliant application. Public participation, if any, follows the local code and may not include a legislative hearing.

Conditional, special-exception or planned-development approval

A conditional-use, special-exception, planned-area-development or similar route gives the authority a defined decision point. It commonly requires findings about compatibility, infrastructure and impacts, and can trigger public notice, a hearing and enforceable conditions. Conditions must have a lawful basis in the code and be connected to project effects; a hearing does not give officials unlimited power to impose unrelated demands.

Site-plan and development review

Even an allowed use may require site-plan review. This is where officials apply setbacks, access, landscaping, drainage, lighting, building placement and other adopted standards. Pennsylvania’s Department of Community and Economic Development toolkit describes review from the initial inquiry through zoning, permitting and long-term planning, including land use, infrastructure, fiscal effects and legal issues. The toolkit is guidance, not a grant of authority; the municipality’s statute and code control.

Location, zoning and geographic fit

Local plans can identify suitable areas, reserve industrial capacity and steer large facilities away from incompatible or constrained locations. Berks County Planning Commission guidance recommends identifying locations in municipal or multi-municipal plans, using overlay zoning where appropriate, defining data centres and campus uses clearly, and placing them in districts capable of accommodating their utility and water requirements. Those recommendations become binding only if enacted through the proper local process.

Reviewers can examine proximity to homes, schools, hospitals, offices, transit, agricultural soils, protected land, flood-prone areas and other sensitive receptors. They may also assess whether the parcel has enough room for setbacks, substations, cooling equipment, backup generation, fire access, stormwater facilities and landscaping. A council cannot assume that a data centre belongs in every industrial district: the applicable use table, overlay and development standards determine the answer.

Physical design and neighbourhood effects

Where the code authorizes it, local review can address the effects neighbours experience even when the computing equipment is indoors.

Setbacks, height and massing

Setbacks can separate large buildings, generators and cooling equipment from property lines or sensitive uses. Height, lot coverage and building-placement rules control visual mass and protect corridors, homes or aviation constraints. A local code may impose special distances from residential areas, commercial districts, offices or transit stations, but the measurement method and exceptions are jurisdiction-specific.

Appearance, screening and landscaping

Design standards can regulate façades, blank walls, roof equipment, fencing, tree preservation, buffers and open space. Screening may conceal transformers, diesel tanks, chillers and loading areas. Tucson’s adopted 2026 framework, for example, includes expanded landscaping and open-space provisions as part of its large-scale data-centre rules. That framework applies in Tucson, not automatically elsewhere.

Lighting, vibration and construction disturbance

Codes may limit spill light, require shielded fixtures and set hours for construction activity. They can require vibration controls, dust management, erosion protection and restoration of disturbed areas. Berks County guidance recommends standards for lighting, buffering, noise, vibration, stormwater and landscaping, along with minimizing land disturbance and impervious surfaces and protecting sensitive lands and agricultural soils.

Noise: what can be measured and conditioned?

Noise review can cover construction, cooling fans, pumps, transformers, generators and low-frequency tones. A municipality may require an applicant’s acoustic study, specify measurement locations and operating scenarios, require barriers or equipment orientation, and set limits at property lines or sensitive receptors if its code authorizes those measures.

Berks County’s April 2026 advice gives 55 dB at property lines as an example a municipality might consider and suggests a low-frequency noise analysis. That figure is illustrative guidance, not a general legal limit. The enforceable number, frequency weighting, averaging period, nighttime rule and compliance method must come from the applicable ordinance or permit.

Tucson’s adopted rules illustrate a more detailed approach: enhanced separation distances, applicant sound-impact studies, noise barriers and operational noise limits. Fairfax County reports that its zoning rules include noise studies, visual screening, building-design standards and minimum distances from homes or Metro stations. These examples show possible tools, not a model ordinance that every council can copy without checking enabling law.

Water, wastewater and power infrastructure

A planning authority can ask whether existing infrastructure can serve the proposal and whether the project would create unacceptable cumulative demand. Evidence may include water-availability letters, wastewater-treatment capacity, electric-service studies, substation or transmission plans, fire-flow analysis and construction schedules.

Water supply and cooling

Officials may evaluate the source, reliability and seasonal limits of cooling water, along with wastewater or discharge arrangements, when those matters fall within the planning criteria. The Local Government Association says UK policy frameworks address data-centre effects on water, nature and the environment only partially and indirectly, and that water supply and wastewater capacity can constrain development. Its position is policy advocacy, not a universal legal rule.

Maryland’s 2026 executive order directs the state Department of the Environment, within its permitting authority and to the extent permitted by law, to address water availability, evaluate closed-loop, air-cooled and reclaimed-water cooling, require disclosure of withdrawal and consumption, protect stormwater and discharges, and consider air monitoring, environmental justice and greenhouse-gas requirements. Those are state actions; a municipality does not automatically acquire the same powers.

Electricity and energy mix

Local review can consider whether power infrastructure is physically available, whether construction would require new utility facilities, and whether emergency generation creates site impacts. Tucson’s rules require adequate water and power access and disclosure of the facility’s energy mix, including renewable sources. A council generally cannot set electricity rates or approve transmission in place of the utility regulator.

Berks guidance recommends baseline infrastructure assessments, identification of energy and water sources and written confirmation from providers about available capacity. Treat provider letters as evidence for the planning record, not as a guarantee that a separate utility or environmental permit will be issued.

Stormwater, land disturbance and environmental evidence

Large buildings and parking areas can increase runoff, erosion and flood risk. Local development standards may require stormwater calculations, detention or infiltration facilities, stream buffers, construction-phase erosion controls and protection of wetlands or other sensitive resources where local law covers them.

Environmental assessment is divided among jurisdictions. Scotland’s Chief Planner reported that a Scottish Government Direction requires an environmental impact assessment for new data-centre development exceeding 50 MW of power capacity, effective September 17, 2026. Projects at or below 50 MW remain subject to case-by-case consideration under existing EIA regulations. The letter identifies possible effects on landscape, biodiversity, soils, water resources, noise and air quality from backup generators. The 50 MW threshold is specific to Scotland; it is not a general planning threshold.

Hearings, public input and enforceable conditions

Whether residents get a hearing depends on the approval route and local notice rules. Fairfax County says large projects in some districts require special-exception approval and hearings before the Planning Commission and Board of Supervisors, while qualifying projects in the heaviest industrial districts may proceed by right if they meet the standards. Thus, a large facility is not necessarily entitled to—or automatically subject to—a hearing everywhere.

Written comments and oral testimony can identify missing studies, unusual noise paths, traffic conflicts or service concerns. Decision-makers should connect any condition to an adopted standard, a documented impact or a lawful approval criterion. Common conditions include specified setbacks, sound barriers, landscape plans, construction hours, stormwater measures, emergency access, monitoring reports and limits on equipment operation.

Emergency planning and accountability after approval

Data centres can remain on a site for decades, change owners or operate through utility disruptions. Berks County guidance recommends pre-application meetings, emergency plans coordinated with local responders, continuity planning for utility interruptions and decommissioning plans covering equipment removal, recycling, site restoration and potentially financial assurance.

These are recommended planning tools, not guaranteed municipal powers. A condition requiring a financial guarantee, ownership-change notice, monitoring or removal must be authorized by local law and drafted so it can be administered and enforced. Councils should distinguish a one-time construction obligation from an ongoing operating requirement and specify who receives reports and what happens after non-compliance.

Where local authority ends

A planning approval is only one part of a data-centre project. Local government usually cannot replace the agencies responsible for grid regulation, air permits, water withdrawals, wastewater discharges or nationally controlled environmental reviews.

Fairfax County states that Virginia’s State Corporation Commission controls electricity rates and related matters, including demand and transmission lines, while Virginia’s Department of Environmental Quality regulates air pollution and permits certain cooling-water discharges. Maryland’s executive order likewise assigns specified water, discharge, stormwater and air-quality actions to the state environmental department. The division differs by jurisdiction, so every case needs an agency-by-agency map.

How to compare two proposed sites or approval regimes

Question What to verify
Permission route Is the use by right, conditional or special? Which size, power or location threshold triggers a hearing?
Geographic fit Is the parcel in an eligible district, with adequate setbacks and distance from sensitive receptors, agricultural land and environmental constraints?
Evidence required Are sound studies, water and power capacity letters, environmental assessments, cumulative-impact analysis and fiscal or service studies required?
Standards Which noise, separation, height, design, landscape, stormwater and operating rules are legally enforceable?
Agency boundary Which decisions belong to the municipality, and which belong to utility, environmental or higher-level authorities?
Long-term accountability Are monitoring, public reporting, emergency planning, ownership changes and decommissioning safeguards authorized?

A practical checklist for a proposed project

  1. Identify the jurisdiction and code version. Confirm the municipality, planning authority, adopted zoning text, overlays and effective dates.
  2. Classify the use. Check the definition of data centre and related uses, plus floor-area, power, parcel-size or campus thresholds.
  3. Map the approval path. Determine whether the proposal is by right or needs conditional, special-exception, planned-development or site-plan approval.
  4. List required studies. Ask for acoustic, traffic, stormwater, environmental, water-supply, wastewater, power-capacity and emergency-access evidence required by the code.
  5. Separate local and external permits. Identify utility, air, water, discharge, grid and environmental approvals controlled by other agencies.
  6. Check hearing and notice rules. Confirm who must be notified, deadlines for comments and which body makes the final decision.
  7. Test proposed conditions. Tie each condition to an adopted standard or documented impact, and confirm the municipality has authority to enforce it.
  8. Plan for operation and closure. Where authorized, address monitoring, emergency coordination, ownership changes, equipment removal and site restoration.

What this means for residents and applicants

Residents should ask which rule governs the site, which studies are mandatory, who controls each permit and whether the project is by right. Applicants should engage planning staff and utilities early, provide capacity and impact evidence in the format the code requires, and avoid treating advisory guidance from another jurisdiction as a binding local standard.

The Local Government Association summarizes the policy challenge this way: “Existing policy frameworks only partially address the impacts of data centres on water use, nature and the environment, and largely do so indirectly.” That observation explains why a single planning approval rarely resolves every concern. The legally decisive questions are always local: what the adopted code says, what the enabling statute permits, what evidence the decision-maker may consider and which other agencies must approve the project.
