A host country can seek to change basing terms, limit or refuse permission for a particular U.S. military activity, or end a basing arrangement if the applicable agreement and law provide a route to do so. These are different measures: barring one operation does not necessarily end all U.S. access, and terminating an agreement is not automatically available on demand. The controlling documents, domestic decision-making rules, and circumstances determine the procedure and legal effect.
What determines a host country’s authority?
The starting point is the host state’s sovereignty. The Congressional Research Service (CRS) explains that nearly all U.S. overseas bases remain subject to foreign sovereignty and that political developments can affect U.S. access. A particular U.S. presence or activity therefore needs to be assessed against the host state’s consent and the instruments governing it.

There may not be one document called “the basing agreement.” Relevant instruments can include a status of forces agreement (SOFA), a visiting forces agreement, a defense cooperation or access agreement, a memorandum of understanding, an alliance treaty or compact, and related exchanges of notes or implementing arrangements. Their scope varies, some terms may not be public, and different documents may govern presence, facilities, personnel, or particular activities. A country-specific answer requires the current operative texts, not an assumption that every U.S. base follows the same rules.
What options can a host government use?
The options below can have different legal bases and operational reach. Whether a government can act unilaterally, what process it must follow, and when a restriction takes effect depend on the applicable instruments and law.

Negotiate different terms
If both governments agree, they can amend an arrangement or adopt a related implementing measure. The Federated States of Micronesia (FSM)–U.S. Military Use and Operating Rights Agreement, for example, expressly permits amendment at any time by mutual consent. That clause is specific to that agreement, not a universal amendment rule. Japan’s Ministry of Foreign Affairs publishes its SOFA alongside related agreements and Joint Committee materials, illustrating that operational rules can be distributed across a framework agreement and accompanying arrangements.
Set conditions or limit consent
A host government may seek to define consent more narrowly—for example, by specifying permitted locations, activities, duration, or force size and composition. In a U.S. statement on the Conventional Armed Forces in Europe (CFE) Treaty dated March 9, 1999, Ambassador Greg Govan said: “We believe that consent is conditional, as determined by the host.” He then identified such matters as force size or composition, duration, locations, treaty obligations, costs associated with treaty inspections, and environmental protection. This was the U.S. government’s stated view in the historical CFE context, not a court ruling or a universal clause governing all basing arrangements.

Refuse a particular operation
A host may be able to deny a requested use of its territory or a facility for a specific operation even while other basing rights remain in place. CRS reports that Turkey blocked U.S. use of Incirlik Air Base for combat operations against Iraq in 2003. It also notes that an ally may restrict use during a conflict out of concern about being attacked or drawn into the war. Whether such a refusal is legally available in another case depends on that case’s governing instruments.

A host government may invoke an applicable termination or withdrawal clause, allow an arrangement to expire, or decline to renew it if the instrument and governing law permit. The text may set notice periods, consultation requirements, or other steps; there is no single notice period or general rule that every agreement can be ended unilaterally at will. A political announcement can change the practical situation, but the legal validity and timing of the change still depend on the agreement and relevant law.

Act through domestic processes
A government’s public position, access permissions, or administrative implementation can have immediate operational significance. That does not by itself settle whether the state has complied with its treaty or agreement obligations. The host country’s constitutional and statutory rules determine which officials or institutions can make the decision and whether legislative or other approval is required.
What do past cases show—and not show?
- Turkey, 2003: CRS reports that Turkey blocked use of Incirlik for U.S. combat operations against Iraq. This is an example of a mission-specific restriction, not evidence that all basing rights were terminated.
- France, mid-1960s: CRS reports that Charles de Gaulle informed the United States that existing basing agreements no longer obtained, ending two decades of U.S. military presence. This illustrates a major change in the basing relationship; it should not be reduced to a simple example of a standard notice clause, given the broader France–NATO context.
- Niger, 2023–2024: After the 2023 coup, Niger’s junta cancelled the existing SOFA, according to CRS. The cancellation compelled U.S. force withdrawal and abandonment of two bases. The episode shows how a changed political setting can alter access, but does not establish a universal right of unilateral termination.
These cases involved different instruments and circumstances. They demonstrate that restrictions and withdrawals can occur in practice; they do not supply a substitute for examining the legal terms that applied in any particular country.

What do specific agreements illustrate?
Japan’s published SOFA materials
Japan’s Ministry of Foreign Affairs makes the bilateral SOFA and related materials available, including Joint Committee records. Those materials are a starting point for Japan-specific questions about how the framework is implemented. They should not be treated as evidence that another host country has identical rules.
The FSM–U.S. operating-rights agreement
The 2003 FSM–U.S. Military Use and Operating Rights Agreement defines defense sites and U.S. rights, provides for unresolved disputes to go to a Joint Committee, and allows amendment by mutual consent. Its duration is tied to the Compact’s period of effectiveness, with an exception for Annex A. It also provides that a site or portion reverts to FSM control when the United States no longer needs it. These are negotiated terms in one agreement, not a template that applies to other bases.

What happens when rights end?
Termination does not necessarily resolve every practical issue at the moment access ends. CRS explains that continued use is prohibited after relevant agreements are terminated and that financial settlement is negotiated. Capital investment, the return or handover of sites, and possible environmental cleanup costs can matter. The particular agreement may also address personnel, disputes, and transition arrangements; those details need to be checked rather than assumed.
How should a country-specific question be analyzed?
For a named country, facility, or proposed operation, identify the relevant texts and decision-makers before concluding that a restriction is legally available:
- Map the instruments. Locate the applicable alliance treaty or compact; SOFA or visiting-forces agreement; basing, access, or defense-cooperation agreement; and any side letters, exchanges of notes, or joint-committee arrangements.
- Define the requested restriction. Establish whether it concerns one operation, activity, facility, location, period, force level, or the entire presence. The legal route may differ with the scope.
- Read the operative procedures. Check consent, amendment, consultation, dispute, notice, termination, withdrawal, expiration, and renewal terms in each relevant instrument.
- Check who may act. Review host-country constitutional and statutory rules for the decision, including any required government, legislative, or administrative steps.
- Assess consequences and disputes. Consider the legal effect of the proposed measure, applicable international law, site handover, personnel, investment settlement, and possible environmental obligations.
CRS identifies 10 U.S.C. §§ 2675 and 2687a among U.S. statutory provisions concerning acquisition, use, and disposal of overseas real property, including congressional reporting or oversight. Those U.S. provisions do not, by themselves, state a host country’s termination rights under a bilateral agreement.
