California has no single “robot law.” The rules depend on what the machine does, where it operates, whether it travels on public roads, what information it collects, whether it makes consequential decisions about people, and whether it is used at work or sold as a product. A humanoid working in a warehouse, a delivery vehicle using public streets, and a camera-equipped home robot can fall under very different legal frameworks. This is general orientation, not legal advice for a particular machine or deployment.
Start with the machine’s use, not its label
“Humanoid robot” and “autonomous machine” are descriptions, not legal classifications. California agencies generally regulate the underlying activity. A machine that drives on a public road raises Department of Motor Vehicles (DMV) questions. A robot that records identifiable people raises privacy questions. Software that helps decide whether someone receives employment, housing, credit, education, insurance, health care or another significant service may trigger automated-decision rules. A robot operating around employees introduces workplace-safety issues, while a company selling the hardware can face product and consumer-protection obligations.

For an initial legal map, document these facts:
- Location: public road, private industrial site, sidewalk, retail space, home, school or another setting.
- Mobility: wheeled or tracked vehicle, walking machine, fixed industrial equipment, or a device moved only by a person.
- Autonomy: remote-controlled, supervised automation, or able to perceive and act without immediate human control.
- Data: cameras, microphones, biometric information, precise location, account data, employee records or other personal information.
- Decision role: navigation and physical control only, or recommendations and decisions about identifiable people.
- Business context: internal workplace use, a service offered to consumers, or a product sold or leased to another business.
Those answers identify which agencies and statutes to investigate; they do not replace checking the definitions and exemptions in the current law.
California autonomous-vehicle rules for public roads
If the machine is a motor vehicle operating on California public roads, the DMV’s autonomous-vehicle program is the clearest specialized regime. A walking humanoid inside a warehouse is not automatically an autonomous vehicle merely because it navigates independently. Conversely, a conventional-looking delivery vehicle can be subject to the DMV program even if its autonomy software is supplied by a separate company.

Three DMV permit categories
The DMV identifies separate permit categories for:
| Activity | What it covers | Important qualification |
|---|---|---|
| Testing with a safety driver | Development or evaluation while a qualified human safety driver is present as required by the permit. | Approved locations, operating conditions and speed limits apply. |
| Driverless testing | Testing without a human safety driver in the vehicle. | This is a distinct permit category, not an automatic extension of a safety-driver permit. |
| Deployment | Commercial operation of an autonomous vehicle service on California roads. | Deployment has its own approval requirements and operating limits. |
Manufacturers must apply for the category that matches the proposed activity. The DMV says each category has specific approved locations, operating conditions and speed limits. A permit therefore is not a blanket authorization to operate everywhere in California or to change a vehicle’s use without further approval.
Collision reporting
The DMV says testing manufacturers must report collisions that cause property damage, bodily injury or death. A compliance plan should assign responsibility for preserving event data, determining whether a reportable threshold was met, and submitting the report within the applicable DMV process. Do not assume that a minor contact is outside the rule without checking the current reporting requirements and definitions.
2026 light- and heavy-duty updates
On April 28, 2026, the DMV announced adoption of updated regulations for light- and heavy-duty autonomous vehicles. The agency said manufacturers may apply for permits to test and deploy heavy-duty autonomous-vehicle technology on California roads. That announcement concerns road vehicles. It does not create a general permit for humanoid robots in warehouses, homes, sidewalks or other off-road environments.

When California privacy law reaches a robot
A robot can create privacy obligations because of the information system attached to it, not because it has a human-like body. Cameras, microphones, geolocation, facial or other biometric signals, voice recordings, household profiles and employee identifiers may all be relevant personal information. Whether the California Consumer Privacy Act (CCPA) and related rules apply depends on the business, the information, the purpose of processing and statutory thresholds or exemptions.
CCPA and regulations in force in 2026
The California Privacy Protection Agency’s laws-and-regulations index lists the CCPA and related regulations effective January 1, 2026. For a robot deployment, the responsible business should identify what the device collects, where data is stored, who receives it, how long it is retained, and whether the business is covered by the CCPA. Notices, access or deletion handling, contracts with service providers, security practices and limits on secondary uses may all need review when the law applies.
Do not describe every camera-equipped robot as automatically covered. A consumer’s device, a small business below statutory thresholds, exempt information, or a particular service-provider arrangement may change the analysis. The fact that a device can collect data is a reason to perform a coverage assessment, not proof of an obligation.

The agency’s September 23, 2025 announcement said its 2025 regulations took effect January 1, 2026, while requirements for businesses using automated decision-making technology (ADMT) to make significant decisions begin January 1, 2027. The announcement also provides staged dates for particular cybersecurity-audit and risk-assessment obligations.

These dates do not mean every autonomous machine is subject to ADMT requirements. The business, system, information and decision must fit the applicable statutory definitions. A robot that chooses a route or avoids an obstacle is different from software that evaluates a person for employment, housing, credit, education, insurance, health care or another significant opportunity. If the machine’s sensors feed a model that ranks or rejects people, preserve documentation showing the data used, the human role, the decision purpose, testing and the process for handling any required consumer request or review.
Existing California laws still apply to AI-enabled machines
California’s Attorney General has issued advisories explaining how existing law applies to artificial-intelligence-related conduct. The advisories address consumer protection, civil rights, competition and data privacy. They are important because a company cannot avoid an established rule simply by describing its product as a robot or its software as AI.
Consumer protection
Marketing, disclosures, pricing, safety representations and performance claims must be accurate. A seller that promises a robot can perform tasks safely or autonomously should be able to substantiate the claim and explain material limits. Misleading demonstrations, hidden human intervention or omitted operating restrictions can create risk even when no robot-specific statute applies.
Civil rights
If a robot or its software is used in a process affecting people, evaluate whether the design, data or deployment produces unlawful discrimination. Physical assistance, surveillance and access-control functions can have civil-rights implications when they are used in housing, employment, public accommodations, education or other covered settings. The legal question turns on the activity and impact, not on whether the final action was taken by a machine.

Competition
Autonomous systems can affect competition through data access, exclusive arrangements, pricing, marketplaces or control of essential interfaces. A business should not assume that an algorithmic feature is exempt from competition law. Contracts and product design need review where the system limits rivals’ access or coordinates conduct in a way that could raise antitrust concerns.
Workplace use: a separate safety analysis
The DMV and privacy frameworks are not a complete safety code for a humanoid robot at work. A machine sharing space with employees may require a fact-specific review of workplace-safety requirements, hazard controls, training, supervision, emergency stops, maintenance, lockout procedures and incident reporting. The correct requirements can depend on the worksite, machine design, task, operator and employer.
Before deployment, document the robot’s energy sources and moving parts, foreseeable failure modes, proximity to people, guarding and interlocks, remote-control capabilities, maintenance access, and the procedure for stopping it when perception or communications fail. Then obtain advice on the California workplace-safety rules that fit that equipment and industry. The exact requirements cannot be inferred from the robot’s humanoid appearance or from an autonomous-vehicle permit.

Product sales, leases and services
A business that manufactures, imports, sells or leases a robot faces different questions from a business that merely operates one. Product-liability, warranty, consumer-protection, labeling, instructions, software-update and contract issues can depend on the design, sales channel, customer, injury and alleged defect. A service provider may also have obligations tied to the data it processes for a customer.
Best Value
California law does not provide one universal product-certification checklist for all humanoid robots. The specific machine, intended use, purchaser, location and industry determine which state, federal or local rules may apply. Do not treat a DMV permit as product approval, or a privacy assessment as proof that the machine is safe to operate around people.
Use-case decision framework
Use the following sequence to decide where to begin. Several tracks can apply at the same time.
- Is it a motor vehicle on a California public road? Start with the DMV’s testing or deployment permit categories, operating conditions, speed limits and collision-reporting rules.
- Is it tested without a safety driver or offered commercially? Determine whether driverless testing or deployment approval is required rather than relying on a safety-driver authorization.
- Does it collect or use personal information? Analyze CCPA coverage, notices, data handling, contracts and security obligations using the current California Privacy Protection Agency materials.
- Does software make or materially support a significant decision about a person? Assess whether ADMT definitions and the January 1, 2027 significant-decision requirements apply.
- Does the deployment affect consumers, civil rights or competition? Apply the Attorney General’s AI advisories to the underlying conduct.
- Will employees work near or maintain it? Conduct a separate California workplace-safety review for the site, task and machine.
- Is the device sold, leased or supplied as a service? Review product, warranty, advertising, data-processing and liability issues, plus any federal or local requirements.
| Scenario | Primary starting point | What cannot be assumed |
|---|---|---|
| Autonomous passenger or freight vehicle on a public road | California DMV AV testing or deployment program. | A permit for one category authorizes every other category or location. |
| Humanoid robot in a warehouse | Workplace-safety and machine-specific review. | DMV AV rules automatically apply. |
| Home robot with cameras and microphones | Privacy, consumer-protection and contract analysis. | Data collection alone proves CCPA coverage. |
| Robot-assisted hiring or access decision | Privacy and ADMT analysis, plus civil-rights review. | Calling the system “assistive” removes responsibility for the decision. |
| Robot sold to another business | Product, warranty, advertising, data-processing and liability review. | A safety or privacy review substitutes for product-law analysis. |
Common mistakes and how to avoid them
- Using “robot” as the legal answer: describe the function, location and decision role instead.
- Confusing a road vehicle with an off-road machine: the 2026 heavy-duty AV update is about California roads, not every autonomous device.
- Treating privacy as an on/off switch: map the data, business, purpose and statutory definitions before concluding that the CCPA applies or does not apply.
- Assuming AI has its own exemption: existing consumer-protection, civil-rights, competition and privacy laws can reach AI-enabled conduct.
- Ignoring human impacts: workplace hazards, discrimination and consumer injury require separate analysis even when the machine is technically autonomous.
- Relying on an old deadline: verify current DMV rules and California Privacy Protection Agency materials, especially around the January 1, 2027 ADMT start date and staged audit or risk-assessment obligations.
What to prepare before asking for legal advice
A focused review is faster when the operator can provide a complete factual record:
- Machine model, software version, autonomy functions and intended task.
- Every operating location, including public roads, private property and customer sites.
- Whether a safety driver, remote supervisor or other human is present.
- Sensor inventory, categories of personal information, retention, cloud vendors and data-sharing recipients.
- Whether the system ranks, recommends or decides anything about an identifiable person.
- Worksite layout, employee exposure, guarding, emergency controls and maintenance procedures.
- Sales, lease or service contracts, user instructions, marketing claims and update commitments.
- Known incidents, collision records, injuries, complaints and data-security events.
That record lets counsel separate DMV permitting, privacy, ADMT, civil-rights, workplace, product and local-law questions instead of searching for a nonexistent all-purpose robot statute.
Bottom line
California regulates autonomous machines through a patchwork of use-based rules. Public-road vehicles belong first in the DMV testing and deployment framework; data-intensive robots may fall under the CCPA and related privacy rules; systems making significant decisions require an ADMT and civil-rights analysis; and workplace or product deployments need separate, machine-specific safety and liability reviews. The legally relevant question is not “Is this a humanoid robot?” but “What does this system do, where, for whom, with what data, and with what consequences?”
