What It Takes to Certify a Supersonic Passenger Jet for Commercial Flights

In the United States, a supersonic passenger jet needs more than permission to fly faster than sound. Its design must earn an FAA type certificate; its manufacturer must separately show it can build conforming aircraft repeatedly; and the aircraft must meet applicable noise and engine-emissions requirements. Operating it supersonically over land raises a separate issue: as of October 4, 2026, the FAA’s proposed overland standard is not yet an effective commercial-flight permission.

What does “certification” mean?

For a new airplane, certification is a set of distinct regulatory decisions, not one blanket approval. The FAA type certificate approves a particular design after the applicant demonstrates compliance with that design’s certification basis—the applicable requirements established for the project. Production approval addresses whether the manufacturer can consistently build aircraft that match the approved design. Flight-test authorization, noise certification, emissions compliance and permission to conduct particular operations answer different questions.

Decision or authorization What it addresses
Type certification Whether the aircraft’s defined design meets its FAA certification basis.
Production approval Whether the manufacturer’s facilities and quality systems can repeatedly produce aircraft conforming to the approved design.
Special flight authorization Whether specified testing may be conducted under the authorization’s terms; it is not approval for passenger service.
Noise and emissions compliance Whether the aircraft and covered engines satisfy applicable noise and emissions requirements.
Operational permission Whether a particular kind of flight, such as civil supersonic flight over land, is allowed under the applicable operating rules.

This article describes the U.S. FAA pathway. An FAA certificate should not be read as automatic approval to operate in every other country; international service may require acceptance or approvals from other authorities.

How does the FAA type-certification process work?

The FAA’s April 23, 2026 aircraft-certification overview describes seven shared phases. They are a general process, not a universal checklist or the approved certification basis for any particular supersonic design.

1. Standards and project initiation

The applicant briefs the FAA and applies for design and production approval. The FAA and applicant establish the project’s certification basis: the rules the design must satisfy. Depending on the design, the FAA may also need to address special conditions, exemptions or equivalent-safety findings.

2. Airplane definition

The applicant defines the airplane and works with the FAA to identify how each applicable requirement will be met. The parties agree on means of compliance and plans describing what evidence will be used, such as testing, analysis, inspection or simulation.

3. Detail definition

The applicant develops the detailed design and compliance evidence. The exact airworthiness requirements and accepted methods depend on the project; the general process overview does not establish which specific provisions will apply to a future supersonic passenger jet.

4. Build

As the applicant builds test articles and prepares manufacturing operations, the FAA assesses the quality system and facility readiness. Conformity inspections help establish that test articles and components match the design and configuration represented in the compliance data.

5. Test

The applicant supplies engineering data and safety assessments and conducts ground and flight tests under the agreed plans. The FAA oversees certification activity, including conformity inspections and type-inspection flight testing. A successful supersonic flight by itself does not establish compliance with the full certification basis.

6. Certification

The applicant closes compliance findings and finalizes documents such as the Airplane Flight Manual. The FAA issues a type certificate only after the applicable requirements have been met and findings are closed.

Why is supersonic operation over land a separate hurdle?

Type certification addresses the aircraft design; it does not by itself authorize every flight profile. The FAA’s June 2026 operational notice of proposed rulemaking says the general U.S. prohibition on civil flight above Mach 1 over land dates to 1973. As of October 4, 2026, the FAA’s proposed alternative remains a proposal, not an effective permission for scheduled passenger flights.

The proposal would allow civil supersonic flight without an operation-specific special flight authorization only if all three proposed conditions were satisfied:

  • Surface sonic-boom overpressure stays at or below 0.11 pounds per square foot.
  • The FAA finds, following an operator demonstration using an accepted method, that primary and secondary boom overpressure at the surface comply with the proposed standard.
  • The operator follows conditions and limitations imposed by the FAA.

The demonstration method—potentially involving measurement equipment and procedures or modeling—would itself require FAA approval. This is a proposed performance standard for operations, not a prescribed aircraft design or a final rule. The FAA’s overview says it aims to finalize the operational rule and a separate takeoff-and-landing noise rule by mid-2027; that target is not a guarantee of finalization.

How do noise rules differ from the sonic-boom proposal?

Noise certification and en-route sonic-boom exposure are related environmental concerns, but they cover different conditions. Noise certification concerns aircraft noise at specified operating points, including takeoff and landing. The proposed overland standard concerns sonic-boom exposure at the surface during supersonic operation en route.

The FAA’s 2020 noise notice of proposed rulemaking proposed extending the Part 36 noise-certification framework to new supersonic airplanes and adding takeoff-and-landing standards for the specified SSL1 class: designs with maximum takeoff weight no greater than 150,000 pounds and maximum operating cruise speed up to Mach 1.8. Those were proposed provisions, not limits to treat as current law. The 2020 proposal also said it would not change the then-existing overland sonic-boom restriction. The applicable current noise requirements for a particular aircraft must be established from current FAA rules and project records.

What does special flight authorization allow?

The FAA says civil supersonic testing above Mach 1 over U.S. land requires a special flight authorization under 14 CFR 91.818, with FAA environmental review under the National Environmental Policy Act as part of issuance. The FAA’s page, updated September 21, 2026, lists authorizations for test aircraft including Boom Technology’s XB-1 and Hermeus Quarterhorse Mark 2.1 and Mark 2.2.

Those examples concern flight testing. An authorization for a test aircraft is not a type certificate, production approval or permission to carry passengers on scheduled commercial flights.

What about engine emissions?

Emissions are another certification stream, separate from airworthiness, noise and operating permission. The FAA states that 14 CFR Part 34 fuel-venting and exhaust-emissions requirements apply to civil airplanes with covered classes of gas-turbine engines. The EPA establishes aircraft emissions standards, while the FAA administers certification requirements; the FAA identifies standards under 40 CFR Part 87 and Part 34 procedures. The exact requirements for a proposed supersonic airplane depend on its engine classification and the rules applicable to it.

What must be established before passenger service?

For a U.S. commercial supersonic passenger operation, the manufacturer and operator need to address several separate questions rather than rely on a single milestone:

  • Has the FAA issued a type certificate for the aircraft design after compliance findings are closed?
  • Does the manufacturer hold the separate production approval needed to build conforming aircraft repeatedly?
  • Are the aircraft’s applicable noise and engine-emissions requirements satisfied?
  • Is the planned flight profile permitted under effective operating rules, including rules governing supersonic flight over land?
  • Are any required approvals in place for the countries where the aircraft will be operated?

The FAA’s seven-phase overview explains the general certification sequence, but a particular aircraft’s requirements depend on its FAA-established certification basis and accepted compliance plans. Proposed operating or noise rules should not be treated as effective until finalized and applicable.
