What It Means to Own a Digital Game Instead of Licensing It

Buying a digital game usually gives you a personal license to access and use software, not ownership of its copyright or an unrestricted copy that you can transfer. Steam’s EULA states: “Your license confers no title or ownership in the Content and Services.” Your account, the store’s rules, digital-rights management (DRM), authentication servers, updates and local consumer law determine how long and where that access works. A disc or cartridge gives you possession of physical media and generally makes lending, resale and preservation easier, but it still does not transfer copyright and may require patches, an account or online services.

Four different meanings of “owning” a game

Arguments about game ownership often mix together rights that are legally and technically separate. Ask which of these four things you mean.

Copyright ownership

The developer or publisher normally retains copyright and the exclusive rights to reproduce, adapt, distribute and commercially exploit the game. Purchasing access does not make you the copyright holder, even when you pay the full retail price or receive a permanent download.

Possession of a copy

A disc or cartridge is a tangible object you can physically possess. You may be able to lend or sell that object under applicable law, although the recipient can still be bound by an end-user license agreement (EULA), activation requirements and online-service rules. Possessing the media is not the same as owning the game’s copyright.

Contractual access

A digital storefront records a license against your account. The EULA defines permitted devices, household use, account sharing, copying, modifications and termination. Losing access to the account can therefore prevent access to every game attached to it, even if the files remain on your drive.

Service-dependent use

DRM, activation checks, updates, multiplayer servers and platform accounts can all affect playability. The U.S. Federal Trade Commission (FTC) has explained that DRM can prevent a game from working on another console brand and that terms may change. A purchase is therefore a bundle of software permission and service conditions, not an unconditional promise that the program will run forever.

What a digital purchase normally grants

Most major stores describe the transaction as a non-transferable, personal license. You may download the game, install it on permitted hardware and play under the store’s current rules. The license can prohibit selling or transferring the account, sharing credentials, making unauthorized copies or using the software outside supported platforms.

Steam provides a clear example. Its EULA says, “Your license confers no title or ownership in the Content and Services.” Valve’s Subscriber Agreement also says the agreement does not entitle users to future updates or enhancements unless the law requires them. Those clauses do not automatically answer every dispute, because mandatory consumer protections can override contract terms, but they show why the word “buy” does not by itself create property ownership.

The license can cover more than the base game. Downloadable content, season passes, virtual currency, cosmetic items and community-created content may each have separate terms. A game that remains in your library can still lose a particular expansion, item or online feature if its associated service ends.

Digital license versus physical copy

The practical difference is not simply “online” versus “offline.” It is how much control you have over the medium, the account and the services needed to use it.

Resident Evil 4 - PS5
  • Reawaken a Classic – Resident Evil 4 preserves the essence of the original game, now reconstructed using Capcom’s proprietary RE Engine to deliver realistic visuals and additional narrative depth to the iconic story that was not possible at the time of the original release.
  • Modernized Gameplay – The team from 2019’s Resident Evil 2 returns to build upon the series’ modern approach to survival horror. Engage in frenzied combat with the Ganados villagers, explore a European village gripped by madness, and solve puzzles to access new areas and collect useful items for Leon and Ashley’s constant struggle to survive.
  • Overwhelming Hordes – Face hordes of rabid enemies that threaten to overwhelm Leon with even more diverse methods of attack than in the original release.
  • Survive on a Knife’s Edge – Years of intense training have taught Leon new ways to use his knife, helping to even the odds against the unrelenting onslaught of enemies. By parrying enemy attacks, you can avoid debilitating damage and evade lunging enemies seeking to grab Leon and hold him in place. Make smart use of scavenged knives to deliver precise finishing moves on vulnerable enemies, and even use the element of surprise to quietly dispatch unsuspecting foes before they break.

Issue Digital license Physical disc or cartridge
Transfer and resale Usually personal, account-bound and non-transferable; store rules commonly prohibit account transfers and second-hand sales. The object can often be handed to another person or resold, subject to local law, platform rules and any activation or EULA requirements.
Offline play Depends on whether the store and game support an offline mode and whether a periodic authentication check is required. The media can improve offline prospects, but a day-one patch, account sign-in or server connection may still be necessary.
Revocation or delisting The license contract may reserve suspension or revocation rights; delisting can stop new downloads while existing access depends on the platform. You retain the physical object, but online services, activation servers or required patches can still become unavailable.
Portability Usually limited to the account and platform ecosystem where the license was issued; DRM can block use on another console brand. Limited by the disc or cartridge format and console compatibility; a different platform generally requires a separate version.
Refunds Controlled by store policy and mandatory local rights. In Steam’s EU/UK guidance, the statutory withdrawal period for digital content ends when downloading begins or after 14 days, whichever is sooner, once you consent to early supply. Often treated as a sale of goods, with local defective-goods and return rules; retailer policy and opened-packaging conditions still matter.
Preservation and backup Backups may be limited by DRM, encryption, account checks and the store’s terms; a local installer may not be enough to run the game later. You control the media and can preserve it, although disc damage, hardware failure, patches and server dependencies remain risks.
Ongoing cost The purchase can be followed by paid DLC, subscriptions, replacement hardware, storage and online-service charges. There may be second-hand savings and no download requirement, but patches, accessories, subscriptions or replacement hardware can still add cost.

Can a digital game be taken away?

Three events are easy to confuse: delisting, suspension and revocation.

Delisting

A store can stop selling a title. Delisting usually affects new purchases first; whether previous purchasers can redownload it depends on the platform’s policies and licensing arrangements. Keep installers, receipts and account details, but do not assume a backup bypasses DRM or remains legally usable after a license ends.

Account suspension

A platform may suspend an account for fraud, chargebacks, security violations or other EULA breaches. Because the license is recorded against the account, suspension can block multiple games at once. Protect the account with a unique password and multifactor authentication, and keep recovery information current.

Revocation

A contract can reserve a right to terminate or revoke access in specified circumstances. California AB 2426 legislative materials describe a digital license that “may be unilaterally revoked by the seller” and require disclosure of that possibility when a seller uses purchase language. A disclosure requirement does not turn the license into unrestricted ownership; it makes the limitation clearer to buyers.

Updates, patches and server shutdowns

A physical copy is not a time capsule. Modern games may ship incomplete, require a large day-one patch, use servers for authentication or put essential content behind an account. If the servers close, single-player functionality may survive, may require an official patch or may stop working, depending on the design.

Digital ownership is equally conditional. Valve’s Subscriber Agreement says customers are not entitled to future updates or enhancements unless required by law. A publisher can therefore end routine support while leaving the original licensed version available. Conversely, an update can change performance, compatibility or features without giving you a new ownership interest in the revised code.

  • Beautifully rearranged soundtrack in a faithful FINAL FANTASY style, overseen by original composer Nobuo Uematsu.

Before buying, look for an explicit offline mode, the frequency of required sign-ins and whether the campaign can be completed without multiplayer services. Treat “downloadable” as a delivery method, not proof of permanent offline play.

Transfer, lending and resale

Digital stores generally bind the license to the purchaser’s account. Selling the account can violate the EULA, expose the buyer to fraud and leave the original owner able to recover the credentials. Even where a platform permits family sharing, that feature is a limited permission rather than a transfer of title.

With a disc or cartridge, the physical handover is straightforward, but the recipient may not receive digital bonuses, season-pass content or promotional items tied to the original account. Some games require a one-time product code that becomes permanently associated with one account. Check those conditions before treating a physical copy as fully resalable.

Refunds and consumer protections

Refund rights depend on the platform, country, payment method and whether you began downloading or playing. Steam’s EU/UK guidance says the statutory 14-day withdrawal period for digital content ends when downloading starts or when 14 days pass, whichever comes first, after the consumer consents to early supply. Other regions may provide different cooling-off periods, remedies for faulty digital content or mandatory repair and replacement rights.

EU consumer law distinguishes digital-content contracts from sales of goods and imposes protections that cannot simply be waived by an EULA. National implementation and the facts of a dispute still matter. In the United States, state and federal rules can also supplement a store’s policy; California’s AB 2426 focuses on honest disclosure when sellers use ownership language.

Read the refund screen immediately before payment. Record the deadline, the amount of play or download permitted, and the procedure for submitting a request. A store’s voluntary policy can be more generous than the legal minimum, but it can also be narrower outside the region covered by its guidance.

What happens if a storefront shuts down?

A closure creates several separate questions: Can you redownload the installer? Can the account still authenticate? Will the game’s servers remain online? Can you install patches? Does your local copy start without checking in?

There is no universal answer. A DRM-free installer stored locally may remain usable, while an account-bound title can depend on the platform continuing to operate. A physical disc may preserve the launch version, but it cannot restore a closed multiplayer service or a required activation server. Preservation groups can archive software, yet an archive does not automatically grant a private buyer the right to bypass technical protection.

For games you care about long term, keep legally obtained installers where the terms allow, retain purchase records, document required accounts and check whether the publisher has published an end-of-service or offline patch. These steps improve resilience; they do not convert a license into ownership.

How to check a game before paying

  1. Read the current EULA and store terms. Search for “license,” “transfer,” “termination,” “account,” “DRM,” “offline” and “updates.” Save a copy or screenshot because terms can change.
  2. Confirm account binding. Identify which account receives the license and whether another person can legally use it.
  3. Check activation and DRM. Find out whether the first launch, every launch or occasional launches require internet access, a launcher or a product code.
  4. Test the offline path. Look for the platform’s documented offline mode and whether the game’s campaign works after an account sign-in has been completed.
  5. Identify service dependencies. Determine which features require publisher servers, matchmaking, cloud saves or a subscription, and look for an announced shutdown policy.
  6. Review refund timing. Note the regional deadline and whether downloading, launching or playing ends a withdrawal right.
  7. Separate included content. Check whether DLC, virtual currency, season passes and community items have separate licenses or expiration rules.
  8. Compare a compatible physical edition. If resale, lending and possession matter most, verify the exact console format, installation size, patch requirement and account obligations rather than assuming every disc is self-sufficient.

How the rules vary by location

European Union and United Kingdom

EU consumer law provides mandatory protections for digital content and distinguishes digital-content contracts from goods. The United Kingdom has its own statutory framework and platform guidance. The exact remedy can depend on conformity, duration, price and whether you accepted immediate digital delivery, so a store’s regional refund page should be read alongside local law.

California

AB 2426 materials address digital goods marketed with words such as “buy” or “purchase.” Unless the seller provides a conspicuous license disclosure or obtains affirmative acknowledgment listing restrictions and possible revocation, that wording can be restricted. The rule improves disclosure; it does not grant copyright, unrestricted copying or guaranteed lifetime access.

Australia

The Australian Competition and Consumer Commission reported in 2025 that 56% of surveyed game players were unaware that some digital-store purchases provide a license rather than ownership. Australian consumer guarantees may apply to digital products, but the practical remedy depends on the seller, platform and defect.

A practical definition of ownership

For a digital game, “owning it” usually means holding a contractual permission to access the software through a specified account and platform, for as long as the license and required services remain available. It does not normally mean owning the copyright, freely transferring the game, or guaranteeing every future update.

A physical copy gives you stronger control over a tangible object and often better prospects for lending, resale and preservation. It still does not promise permanent play: patches, accounts, DRM, replacement hardware and server shutdowns can impose limits. Choose digital when convenience, instant delivery and library integration outweigh those dependencies; choose a compatible disc or cartridge when possession and second-hand flexibility are higher priorities. In either case, the decisive evidence is the current license, the platform’s offline and refund rules, and the services the game actually requires.
