What Is Typosquatting, and How Is It Different From Cybersquatting?

Typosquatting is the registration or use of a domain that imitates a recognizable name through a likely typing or spelling variation, such as a missing, added, transposed or visually similar character. Cybersquatting is the broader concept: ICANN describes it as the bad-faith registration of another party’s trademark in a domain name. A typosquatted domain can therefore be one form of cybersquatting, but cybersquatting does not require a typo.

The distinction is descriptive, not a complete legal test. A near-match spelling may be evidence in a dispute, but liability usually depends on trademark rights, bad faith, confusing similarity and the policy or law that applies to the domain and jurisdiction.

What typosquatting means

Typosquatting anticipates a mistake a visitor might make while entering a web address. Someone registers a domain that is close enough to a legitimate name that a hurried or distracted user could reach it instead of the intended site. The variation may be one character or a more substantial change that still looks or sounds familiar.

For example, a hypothetical domain such as exampel.com could anticipate a transposed pair of letters in example.com. The example illustrates the pattern; it does not establish that any particular domain is abusive.

Common forms of the variation

WIPO’s overview of UDRP decisions discusses several recurring forms of “typo” or lookalike construction:

  • Adjacent-key substitutions: replacing a letter with a nearby key on a keyboard.
  • Omissions: leaving out a character.
  • Additions: inserting an extra character, word or punctuation-like element.
  • Transpositions: reversing the order of neighboring characters.
  • Visually similar characters: choosing a character that resembles another in a particular typeface or script.
  • Non-Latin or accented lookalikes: using characters from another writing system, or accented forms, to create a similar appearance.

These patterns help a rights holder or investigator recognize a possible imitation. They do not, by themselves, prove that the registrant acted unlawfully. WIPO’s discussion concerns the confusing-similarity analysis in UDRP cases; the other required elements and the surrounding facts still matter. Read the WIPO Overview of WIPO Panel Views on Selected UDRP Questions for the panel approach to these comparisons.

What cybersquatting means

Cybersquatting is the wider category. ICANN’s plain-language description says: “Cybersquatting is generally bad faith registration of another’s trademark in a domain name.” The statement appears on ICANN’s About Cybersquatting page.

Under that broad description, a domain can be cybersquatting even when it is not a simple typing error. A registrant might choose the exact trademark in a different extension, combine it with another term, or use a spelling that copies the mark without reflecting a likely keyboard mistake. The defining concern is the alleged bad-faith registration of another party’s trademark, not the mechanical way the domain was formed.

“Cybersquatting” is common explanatory language, while the applicable statute or dispute policy supplies the actual test. Popular usage can therefore be imprecise. A domain that resembles a mark may have an innocent explanation, may not involve a valid trademark right, or may fall under a policy different from the one a reader expects.

Typosquatting versus cybersquatting at a glance

Term What the label describes What it does not establish
Typosquatting A recognizable name is imitated through an intentional or obvious spelling, keyboard, character or script variation, often anticipating a typing mistake. The variation alone does not establish bad faith, trademark rights, confusing similarity under every policy, or liability.
Cybersquatting The broader allegation that a domain was registered in bad faith to exploit another party’s trademark. The label alone is not a substitute for the elements of a statute, the UDRP or a country-code policy.

The relationship is best expressed as “typosquatting can be a tactic within cybersquatting.” The first word describes the domain’s form. The second focuses on the alleged conduct and intent. A typo-like domain can be suspicious without satisfying every legal requirement, and a cybersquatting claim can involve a domain that contains no typo at all.

Is every typo domain illegal?

No. A near-miss spelling is a warning sign, not an automatic legal conclusion. A complainant generally needs to show the relevant trademark right, the required similarity, the registrant’s lack of a qualifying right or legitimate interest where the policy requires that showing, and bad-faith registration and use or the equivalent elements under the chosen route. The facts and the domain’s extension determine which test applies.

For a UDRP case, WIPO’s analysis treats a typo or lookalike as part of the confusing-similarity inquiry. A panel still considers the policy’s remaining elements and the evidence of the registration and use. A domain owner, registrar, court or panel may therefore reach a different result from the initial impression created by the spelling.

How U.S. law frames cybersquatting

In the United States, the Anti-cybersquatting Consumer Protection Act is codified in 15 U.S.C. § 1125(d). The statute provides a civil cause of action when a person has a bad-faith intent to profit from a protected mark and registers, traffics in or uses a qualifying domain name. Its requirements distinguish between distinctive marks and famous marks and include statutory treatment of confusing similarity or dilution.

This is a U.S.-specific summary, not a ruling on any particular domain. The exact facts, the mark’s status, the domain’s relationship to the mark and the registrant’s conduct all matter. Consult the current text of 15 U.S.C. § 1125 and qualified counsel for a live dispute.

How the UDRP fits in

The Uniform Domain-Name Dispute-Resolution Policy (UDRP) is an administrative process for covered domain disputes. ICANN explains that a trademark-rights holder can initiate an expedited proceeding alleging an abusive registration. The policy is not an automatic takedown mechanism and is not the only available remedy.

What a UDRP proceeding can address

A complainant must present the elements required by the policy and the provider’s rules. A typo pattern may support the similarity argument or the bad-faith evidence, but it does not replace the full case. If the decision supports a remedy, the registrar process can result in cancellation or transfer under the policy framework.

When another route is needed

ICANN notes that many trademark-based domain disputes must instead be resolved through agreement, court action or arbitration before a registrar cancels, suspends or transfers a domain. A UDRP decision also does not decide every possible trademark or consumer-protection claim. Review ICANN’s Uniform Domain-Name Dispute-Resolution Policy explanation before choosing a route.

Does the domain extension change the process?

Yes. WIPO states that the UDRP applies to generic top-level domains (gTLDs), while some country-code top-level domains (ccTLDs) adopt the UDRP or a local variation. Other ccTLDs use their own dispute policy, eligibility rules or procedure. You should not assume that a complaint for a .com domain follows the same process as one for a country-code extension.

Start by identifying the exact extension and its current policy. WIPO’s Domain Name Dispute Resolution guidance provides an overview and directs readers toward the relevant policy information. A qualified professional can confirm jurisdiction, deadlines, standing and available remedies.

What to do if you find a lookalike domain

The appropriate response depends on whether you are a visitor, a trademark owner or the registrant. The following sequence helps preserve options without assuming that the domain is already legally abusive.

  1. Record the exact domain and extension. Save the spelling, the date and time you observed it, and the page or message that led you there. Similar-looking domains can differ by one character, script or extension.
  2. Compare it with the legitimate address. Check every character and the top-level domain. Do not treat visual similarity as proof of ownership or authorization.
  3. Limit further interaction if the site appears deceptive. Do not submit credentials or payment details to a site you cannot verify. If you entered sensitive information, follow your organization’s incident-response process or contact the relevant service promptly.
  4. Check registration information through a current official channel. WIPO points to ICANN’s Registration Data Request Service (RDRS) or a registrar WHOIS service for registration data. Availability and disclosure of data can vary, so treat a missing record as inconclusive rather than as proof of concealment.
  5. Identify the governing policy. Confirm whether the extension is a gTLD, a ccTLD using the UDRP, or a domain governed by a different local procedure.
  6. Collect trademark and use evidence. A rights holder should assemble registration details, evidence of the mark, examples of the similarity, dates, screenshots and any facts bearing on intent or legitimate interest.
  7. Choose a proportionate route. Depending on the facts, options may include contacting the registrant, using a registrar’s abuse channel, filing a UDRP complaint where available, or pursuing court or arbitration remedies. A lawyer can assess which path fits the jurisdiction and objectives.

Practical controls for brand and domain owners

Register and monitor predictable variants

Organizations can inventory their important marks and identify likely omissions, additions, transpositions, adjacent-key substitutions and visually similar characters. Monitoring should cover the extensions that matter to the organization’s audience and the country-code domains in which it operates. A variant is not automatically abusive, but early awareness gives the owner time to investigate and communicate with users.

Make the canonical address easy to verify

Publish the official domain consistently in customer communications and support materials. Explain how users can verify the address before entering credentials. This reduces reliance on memory, which is exactly what a near-match domain attempts to exploit.

Keep evidence and registrations current

Maintain records of trademark rights, domain registration details, renewal dates and the person responsible for responding to reports. When a suspected imitation appears, preserve the evidence before the content changes. Confirm the extension’s policy at that time; procedures and registration-data access can change.

Common misunderstandings

“Any misspelling is cybersquatting.”

A misspelling may be a typosquatting indicator, but cybersquatting allegations require the applicable legal or policy elements. The existence, scope and ownership of trademark rights, the registrant’s intent and the domain’s use all remain relevant.

“Cybersquatting only means a typo.”

Cybersquatting is broader. It can involve a domain that reproduces or targets a trademark without relying on a typing mistake. The typo is one possible tactic, not the definition of the entire category.

“The UDRP covers every domain.”

The UDRP covers gTLDs and certain ccTLDs that adopt it or a variation. Other extensions may have different policies, forums and remedies. Always check the exact extension before relying on a UDRP timeline or filing strategy.

“A registrar will automatically remove a suspicious domain.”

ICANN’s materials explain that many disputes require a policy proceeding, court action, arbitration or agreement. A registrar’s role and the available action depend on the governing rules and the evidence presented.

The bottom line

Typosquatting describes how a domain imitates a name: through a likely spelling, keyboard or character variation. Cybersquatting describes the broader allegation that someone registered another party’s trademark in bad faith. The first can be evidence of the second, but neither label decides a case. For a real domain, identify the trademark rights, document the conduct, verify the extension’s policy and select the UDRP, national-law or other process that actually applies.
