When a legal issue is urgent, that role can determine how quickly a matter is placed before an appropriate bench and which judges hear it. The CJI does not, however, act as a one-person emergency administrator, replace the Supreme Court as an institution, or direct the police and civil administration.
An urgent matter still has to reach the Court through a legally available procedure. Court administration then handles listing and bench constitution, while the bench—not the CJI acting alone—decides the legal dispute and any relief within the Court’s jurisdiction.

What the CJI’s role means in an urgent matter
Three separate functions are often compressed into the phrase “the Chief Justice will hear an urgent case.” They should be kept distinct:
- Access through procedure: A party must bring the matter before the Supreme Court using an available legal route and the filing process that applies to that type of case.
- Administration: The Registry and the CJI’s roster function determine how the matter is listed and which bench is constituted.
- Adjudication: The constituted bench examines the facts, law and jurisdiction, then decides whether any order or remedy is justified.
Urgency can affect the second stage, but it does not bypass the first or predetermine the third. The CJI can organize the Court so that an urgent issue is considered promptly; the resulting bench remains bound by law, procedure and the limits of judicial power.

“Master of the Roster”: the administrative power that matters most
Constituting benches
The Supreme Court has recognized a convention under which the CJI constitutes benches. In Campaign for Judicial Accountability and Reforms v Union of India (6 July 2018), the Court stated: “Once the Chief Justice is stated to be the Master of the Roster, he alone has the prerogative to constitute Benches.” The sentence describes the CJI’s role in deciding which judges sit together for a matter; it is not a grant of personal control over every judicial or governmental function. The judgment is available from the Supreme Court of India.
Directing listing and hearing
Bench constitution is linked to the practical question of when a case is placed before judges. The same 2018 judgment explained: “The power to frame Rules under Article 145 is, therefore, conferred upon the entire Court, which power includes power to frame the Roster and direct hearing/ listing of matters.” This distinction is important. The CJI exercises the roster convention, while Article 145 rule-making authority belongs to the Supreme Court as a whole. The CJI’s administrative position therefore operates within an institutional framework rather than as unchecked personal authority.
How an urgent concern reaches a bench
The exact filing route depends on the legal nature of the dispute. The available official records illustrate the handling of urgency but do not establish a single, current checklist for every petition, appeal or application. A realistic sequence is:

- Use the applicable legal procedure. The person or organization seeking relief must file or otherwise bring the matter before the Supreme Court in a form the Court can lawfully consider. A letter or public request to the CJI is not, by itself, a guarantee that a case has been instituted.
- Identify and explain the urgency. The filing must present the facts and legal basis for asking that the matter be considered urgently. Whether urgency is accepted is a matter for the Court’s process, not an automatic entitlement.
- Registry processing and administrative direction. Once the matter is before the Court, the Registry handles it under the applicable rules and directions. If an appropriate bench must be constituted, the matter may be placed before the CJI for that purpose.
- Bench hearing and decision. The bench constituted for the case decides whether to hear it, what interim or final orders are legally available, and what further information or submissions are required.
This sequence explains why “urgent” does not necessarily mean “same day.” A matter may require scrutiny, service or notice, a suitable bench, time for the opposing side to respond, or a hearing long enough to address the legal issues. The official material supports the possibility of prompt administrative action, not a universal promise of immediate listing.
What an official urgent-listing direction shows
An office report in Tej Prakash Pathak and Others v Rajasthan High Court and Others records a direction to the Registry to place matters before the CJI for constitution of an appropriate bench at the earliest. The direction referred to the urgency of the matter and the time required for hearing. It is a concrete example of the roster process being used to organize an urgent hearing, not a rule that every urgent request automatically receives priority. The record, dated March 2023, is published by the Supreme Court of India.
The example also shows why administrative coordination matters. If the ordinary roster does not provide a suitable combination of judges, or if a matter raises issues requiring a particular bench, placing it before the CJI allows the Court to address that institutional question. The eventual hearing remains a proceeding of the Supreme Court, not a private determination by the CJI.

What happens after a bench is constituted
Judicial power belongs to the bench in the proceeding
Constituting a bench answers “which judges will hear this matter?” It does not answer “what is the result?” The judges on that bench apply the relevant law and procedure, assess the record and arguments, and decide whether the Court has jurisdiction and whether relief should issue. The CJI may be one of the judges on a particular bench, but the decision is made through the judicial proceeding and the bench’s order.

Proceedings concerning Manipur illustrate the Court’s judicial capacity when an urgent public crisis raises legal claims. In the official record dated 1 August 2023, the Court took up the matter, required information from the government, and directed remedial, rehabilitative and preventive steps. Those actions show how judicial review can seek information and require legally justified measures when serious events are before the Court. The boundary between the CJI, the Court and the executive
The Manipur record also states that law and order and state security are essentially matters within the executive domain. That boundary prevents a common misunderstanding: the CJI is not the administrator of government departments, a police commander or a substitute for elected and executive authorities.

The Court can require explanations, seek records and order remedial, rehabilitative or preventive measures when those steps are part of a case within its jurisdiction. Such orders are judicial directions; they do not turn the CJI into the operational head of the government.

Speed and judicial capacity
An urgent issue can lose practical value if it is heard only after the threatened harm has occurred. The CJI’s ability to constitute a suitable bench and direct listing gives the Court a way to match judicial capacity to time-sensitive disputes. It also allows the Court to account for the complexity of a matter: some cases need several judges, specialized constitutional consideration or enough hearing time to address competing submissions.

Fairness to all parties
Urgency does not erase the need for a fair hearing. A bench may need to notify affected parties, obtain a government response or limit interim relief until the record is clearer. Administrative speed is therefore a means of getting a lawful hearing sooner, not a promise that the requesting side will win or that normal safeguards disappear.
What applicants and observers should—and should not—assume
Reasonable expectations
- An urgent filing can ask the Court to consider the time-sensitive consequences and to place the matter before an appropriate bench.
- The Registry may be directed to place a matter before the CJI for bench constitution when urgency and hearing requirements warrant that step.
- The constituted bench may seek information and issue directions within the case, including remedial or preventive orders where legally justified.
- The final result depends on the bench’s assessment of jurisdiction, facts, law and procedure.
Assumptions to avoid
- Writing directly to the CJI guarantees registration, listing or a particular order.
- Calling a matter urgent guarantees a same-day hearing.
- “Master of the Roster” means the CJI alone makes all Supreme Court rules or can decide every case personally.
- A judicial direction transfers responsibility for policing, public administration or state security to the CJI.
- Constitution of a bench signals the outcome of the case.
Checking the current procedure
Procedural requirements can change, and they vary with the type of matter. Anyone preparing an urgent filing should check the current Supreme Court Rules, Registry notices and filing guidance in force at the time, and obtain qualified legal advice about the correct legal route. The official examples discussed here explain the constitutional and administrative roles; they are not a substitute for the current procedural instructions governing a particular case.
The practical answer
The CJI addresses urgent legal-system concerns primarily by making the Supreme Court capable of hearing them: assigning an appropriate bench and organizing listing through the roster framework. The Court as an institution retains Article 145 rule-making authority, and the bench that hears the matter exercises the judicial power to decide claims and grant lawful relief. In crises such as those reflected in the Manipur proceedings, the Court can demand information and direct remedial, rehabilitative or preventive action, while executive authorities remain responsible for administration, law and order and security. Understanding those boundaries explains both the importance and the limits of the CJI’s role.
