What Is an OCC National Trust Bank Charter, and What Can It Do?

An OCC national trust bank is a national bank whose charter limits it to trust-company operations and activities related to them. That scope is not necessarily fiduciary-only: an OCC rule effective April 1, 2026, clarifies that such a bank may also conduct permissible non-fiduciary activities. The charter does not, by itself, show that a particular institution can offer every service of a full-service bank, accept ordinary deposits, or provide FDIC-insured accounts.

What is an OCC national trust bank charter?

It is a federal national-bank charter issued by the Office of the Comptroller of the Currency (OCC), with a defined limitation: the bank’s operations are restricted to those of a trust company and activities related to those operations. The OCC’s Charters booklet describes this limited-purpose framework.

“National” identifies the federal charter; “trust” describes the charter’s limited scope. It does not mean every institution has identical powers. The individual charter, OCC approval and conditions, approved business plan, and applicable law determine what a particular bank may do.

What changed under the OCC’s 2026 rule?

On February 27, 2026, the OCC announced a final rule amending 12 C.F.R. § 5.20, effective April 1, 2026. It clarifies that a national bank limited to trust-company operations and related activities may conduct non-fiduciary activities as well as fiduciary activities. The OCC said the rule aligns its chartering regulation with its statutory authority and changes the regulatory language from “fiduciary activities” to “operations of a trust company and activities related thereto.” The agency also said the rule “would neither expand nor contract” its authority to charter a national bank. OCC Bulletin 2026-5.

The distinction between chartering and ongoing supervision matters. In 2021, OCC Interpretive Letter 1176 addressed the agency’s treatment of applications under 12 U.S.C. § 27(a), reasoning that a trust-company-limited national bank is not necessarily confined to fiduciary activities as defined in Part 9. Letter 1179 clarified that Letter 1176 did not change the continuing Part 9 obligations of existing national banks. Interpretive Letter 1176; Interpretive Letter 1179.

What can a national trust bank do?

It may exercise fiduciary powers granted to it and conduct other activities permissible as trust-company operations or related activities, subject to its charter and applicable requirements. Fiduciary work can involve legal roles beyond serving as trustee. OCC licensing guidance, for example, identifies executor and guardian among fiduciary capacities. Those examples describe possible powers, not a guarantee that every trust bank has them. See the OCC’s Fiduciary Powers booklet.

For a specific institution, check its charter and the OCC decision approving it, including any conditions, rather than assuming that the general charter category grants a particular service. A trust bank’s authorized activities should be assessed institution by institution.

Can it take deposits, and is it a full-service bank?

The charter category alone does not establish whether a particular institution may take deposits or offer a specific consumer or business product. Nor does it establish that the bank has the unrestricted powers associated with a full-service national bank. Verify the institution’s charter, OCC decision and conditions, and current product disclosures before relying on a claimed service.

Does the charter mean the bank is FDIC-insured?

No conclusion about a specific institution’s deposit-insurance status follows from the words “national trust bank” alone. Check the institution’s current disclosures and regulatory status directly, especially before placing funds with it. Do not treat a trust relationship, a bank charter, or a product name as proof that a particular account is insured.

How does an organization obtain the charter?

Organizers apply to the OCC. The agency reviews the charter application and requested fiduciary powers together when the proposed national bank is limited to trust activities; a separate fiduciary-powers application is not required in that case. The OCC generally conditions approval on articles limiting the bank to trust-company operations and related activities. Organizers should consult both the OCC’s Charters booklet and Fiduciary Powers booklet, and address requested powers in their charter materials.

  1. Submit a charter application. Organizers apply to the OCC and describe the proposed business and requested powers.
  2. Undergo OCC review. The OCC evaluates the proposal, including fiduciary powers where relevant, and may issue a decision subject to conditions.
  3. Satisfy the conditions before operations begin. Conditional approval is not evidence that conditions have been met or that the bank has begun operating. Read the applicant’s individual OCC decision for the precise scope and requirements.

What capital and supervision apply?

The OCC’s Charters booklet says trust banks must meet statutory capital requirements tied to state-law requirements for comparable service providers, as well as minimum leverage and risk-based capital ratios under 12 C.F.R. Part 3. It cautions that balance-sheet capital ratios are not optimal stand-alone measures of a trust bank’s financial position because they do not capture off-balance-sheet asset-management activity. This is a measurement consideration, not a basis for concluding that a particular institution is safer or riskier.

Recent charter approvals and how to interpret them

On December 12, 2025, the OCC announced conditional approval of five applications: new-charter applications for First National Digital Currency Bank and Ripple National Trust Bank, and conversion applications for BitGo Bank & Trust, Fidelity Digital Assets, and Paxos Trust Company. The OCC said that, if they met the conditions, they would join approximately 60 other national trust banks then supervised by the agency. Both the applicant list and the approximate count are specific to that December 2025 announcement, not a verified current count or proof of later operating status. OCC release.

The OCC’s decisions on financial institution applications index lists later trust-bank applications and decisions, including entries for Bridge National Trust Bank, National Digital Trust Company, and Foris DAX National Trust Bank. An index entry is a starting point, not enough to establish an applicant’s current status: consult the individual decision for its date, outcome, scope, and conditions.
