An H-1B visa is a temporary U.S. employment classification that allows an employer to hire a foreign worker for a qualifying specialty occupation. The employer—not the worker—drives the process by filing a Labor Condition Application (LCA) with the Department of Labor and an H-1B petition with U.S. Citizenship and Immigration Services (USCIS). A visa stamp, an approved petition and lawful H-1B status are related but separate parts of the process.
Eligibility depends on the job and the worker’s qualifications, not simply the job title. The position generally must require specialized knowledge and at least a bachelor’s degree, or equivalent, in a specific specialty. The program is numerically limited each year, imposes wage and workplace obligations on employers, and is affected by a September 2025 entry restriction for certain later-filed petitions.

What an H-1B visa is—and what it is not
The Department of Labor describes H-1B as a program allowing employers to temporarily employ foreign workers in the United States on a nonimmigrant basis in specialty occupations, as well as fashion models of distinguished merit and ability. See the Department of Labor H-1B program page.
It is an employer-sponsored classification, not an open work permit that a person obtains independently and then uses for any job. The petition is tied to the employer, the offered position and the terms represented to the government. If the worker moves to a different employer, the new employer normally must file its own petition and satisfy the portability rules described below.
Three documents or decisions are often confused:
- The LCA: the employer’s filing with the Department of Labor containing wage and working-condition attestations.
- The H-1B petition: the employer’s request to USCIS to classify and employ the named worker in the described role.
- The visa or status: a consular visa stamp permits an eligible traveler to seek admission at a port of entry, while H-1B status governs a person already in the United States. An approved petition does not by itself equal a visa stamp, and a visa stamp is not the same thing as an approval to remain indefinitely.
The Department of Labor handles the LCA and labor protections, USCIS adjudicates the employer’s petition, and the Department of State issues visas to eligible applicants applying from outside the United States. The agencies’ roles are summarized on the H-1B Labor Condition Application page and the State Department’s H-1B entry-restriction notice.

Who can qualify for H-1B classification?
The job must be a specialty occupation
A specialty occupation requires the theoretical and practical application of specialized knowledge and, generally, at least a bachelor’s degree or equivalent in the specific specialty. A title such as “engineer,” “analyst” or “developer” does not decide the issue. The employer must show that the actual duties, complexity and normal requirements of the position call for the specified specialized education.
The degree requirement must relate to the specialty. A general degree that does not match the occupation’s required knowledge may not establish eligibility. The petition also has to connect the beneficiary’s education or equivalent preparation to the duties the employer has described.

A narrow additional category
The H-1B program also covers fashion models of distinguished merit and ability. That is a separate statutory category from the ordinary specialty-occupation analysis and should not be treated as a general exception for other jobs that do not require specialized education.
Employer and worker evidence
The employer identifies the position, work location, wage and proposed period of employment. The worker supplies evidence of identity, education and experience, and—where relevant—proof that a foreign degree or other preparation is equivalent to the required U.S. specialty degree. USCIS decides whether the filing establishes both that the position qualifies and that the beneficiary is qualified for it.
How the H-1B process works
1. The employer defines the role and checks eligibility
Before filing, the employer should document the job’s detailed duties, minimum educational requirements, work locations and compensation. It must determine whether the case is subject to the annual numerical limit or falls within an applicable cap-exempt category. The general rules do not establish every cap exemption or current fiscal-year procedure, so an employer should verify the classification in the current USCIS instructions.

2. The employer files a Labor Condition Application
The employer submits an LCA to the Department of Labor. By signing it, the employer makes attestations about the wage, working conditions, notice and other obligations. The LCA is not an H-1B visa and does not grant H-1B status; it is a required labor-condition filing supporting the later petition.

3. The employer files the H-1B petition with USCIS
After obtaining the required LCA, the employer files the petition with USCIS, including evidence about the company, the position, the beneficiary’s qualifications and the requested classification. USCIS—not the Department of Labor—adjudicates whether the petition meets the immigration requirements.
4. The case follows either a U.S.-based status route or a consular route
For a worker already in the United States in an eligible status, the employer may request a change to H-1B status or an extension, subject to the case-specific rules. A worker applying from abroad generally uses the approved petition to seek an H-1B visa from a U.S. consulate and then requests admission at the border or airport. The Department of State’s visa decision and USCIS’s petition decision are distinct; approval of one does not automatically guarantee the other.
5. The worker starts only under the applicable authorization
The worker must follow the start-date, status and worksite conditions authorized for the case. Starting work for an employer before the relevant authorization exists can create immigration and payroll problems. A worker considering a start date, extension, change of status or travel should check the current USCIS and State Department instructions for that exact case.

How the annual H-1B cap affects selection
The Department of Labor states a statutory annual limit of 65,000 H-1B numbers, plus a 20,000-place exemption for qualifying beneficiaries with advanced degrees from U.S. institutions. These figures describe the statutory framework; they are not a promise that every registration or petition will be selected or approved. The figures appear on the Department of Labor’s H-1B program page.
Cap treatment depends on the petition. An initial cap-subject case is different from an extension, a qualifying employer-change filing or a cap-exempt case. The complete current registration calendar, selection mechanics, all cap exemptions and every fiscal-year-specific procedure are not established by the statutory framework. Employers and workers should therefore use the current USCIS cap-season instructions rather than rely on a prior year’s dates or workflow.
| Situation | What can be said from the established rules | What must be checked for the case |
|---|---|---|
| Initial cap-subject petition | Falls within the statutory numerical framework unless an exemption applies. | Current registration dates, selection process, filing window and evidence requirements. |
| Qualifying advanced-degree beneficiary | There is a statutory 20,000 advanced-degree exemption in addition to the 65,000 limit. | Whether the degree and beneficiary meet the current exemption rules. |
| Extension or employer change | Not automatically treated like a brand-new cap allocation in every case. | Current USCIS rules for the worker’s prior H-1B history and petition type. |
| Cap-exempt situation | Some petitions may be outside the numerical limit. | Whether the employer and position actually meet a current cap-exemption category. |
Wages, benefits and workplace protections
The required wage is the higher applicable figure
An H-1B employer generally must pay at least the higher of two amounts: the actual wage it pays similarly qualified workers, or the prevailing wage for the occupation in the area of intended employment. The Department of Labor states this rule in its worker guidance: “You must be paid the actual wage, which is the same wage rate your employer pays other workers with similar experience and qualifications, or the local prevailing wage for the occupation in the area of intended employment, whichever is higher.” See H-1B Workers.
The comparison is not limited to a national salary average. The employer’s similarly qualified workforce and the local occupation-and-area standard matter. The wage obligation should therefore be assessed against the actual work location and the role described in the LCA.
Comparable benefits and working conditions
Worker-facing Department of Labor guidance says an employer must provide qualifying benefits and working conditions on the same basis as comparable U.S. workers. The employer also makes attestations concerning working conditions and gives notice under the LCA framework. These obligations continue to matter after approval; they are not merely paperwork for the filing date.

Who pays petition-related costs?
The Department of Labor says an employer may not require the H-1B worker to pay certain petition fees or employer business expenses. The exact treatment of a particular expense can depend on what the expense is and how the law applies to the case. Current USCIS filing-fee amounts are not stated, so this article does not quote a fee schedule. An employer should use the current USCIS fee information and obtain case-specific advice before shifting any cost to a worker.
Protection from retaliation
An employer may not retaliate against a worker for protected reporting or cooperation concerning H-1B violations. A worker who believes wages, conditions, notice or payment obligations have been breached can review the Department of Labor’s worker guidance and consider professional legal advice.

Often, yes—but not as an unrestricted job change. The portability rule is conditional and requires a new employer’s filing.

1Repair Windows errors before they cause bigger problems2Scan for outdated or missing drivers - takes under a minute3Clear out junk files and repair common Windows errorsThe Department of Labor’s Fact Sheet #62W on H-1B portability says a worker already employed under a valid LCA may accept new employment when the prospective employer files a nonfrivolous H-1B petition before the worker’s authorized stay expires and submits an unexpired approved LCA covering the work. The worker may begin qualifying employment when that petition is filed, while it is still pending, if the portability requirements are met.
The fact sheet was revised in November 2016. Because the rule is fact-dependent and immigration guidance can change, a worker should confirm the current USCIS instructions before resigning, starting the new job or relying on a filing receipt. Important questions include:
Best Value
- Is the worker still in a period of authorized H-1B stay?
- Did the new employer file a nonfrivolous petition before that stay expires?
- Does the new employer have an unexpired approved LCA covering the offered work?
- Does the new role and worksite match what the petition and LCA describe?
- What happens if USCIS later denies, rejects or revokes the petition?
The September 2025 H-1B entry restriction and $100,000 payment condition
The Department of State’s notice, last updated September 21, 2025, describes a Presidential Proclamation issued September 19, 2025. It says the restriction applies to visa issuance and entry for certain H-1B cases based on petitions filed with USCIS after September 21, 2025, at 12:01 a.m. Eastern Daylight Time, unless the petition is accompanied or supplemented by a $100,000 payment. The notice says the Department of Homeland Security determines exceptions under the Proclamation. Read the notice at Restriction on Entry of Certain Nonimmigrant Workers.
This is a payment condition attached to the covered entry restriction described in that notice—not a universal H-1B filing fee for every employer or worker. It should not be generalized to petitions filed before the stated cutoff, and an exception should not be assumed without checking the current official text.

The policy is consequential and may be affected by later guidance, litigation or amendment. Before a worker travels or an employer files a covered petition, check current State Department, DHS and White House materials and confirm the petition’s filing date and whether an exception applies.
Important distinctions that prevent common mistakes
Petition approval versus visa issuance
USCIS approval concerns the employer’s petition. A person outside the United States generally still needs the consular visa process before seeking admission. A person already in the United States may instead be dealing with a change-of-status or extension request. Treating a petition approval as a travel document can lead to an avoidable border or consular problem.
LCA versus H-1B status
An approved LCA supports the petition but does not authorize employment by itself. It records the employer’s labor attestations; USCIS must still adjudicate the petition, and the worker must have the appropriate status or visa authorization.
Cap number versus approval
The 65,000 cap and 20,000 advanced-degree exemption are numerical limits, not approval standards. Selection, where applicable, does not remove the need to prove that the job and worker qualify.
Recommended Free Tools
Employer sponsorship versus personal eligibility
A worker can have excellent credentials and still lack a route to H-1B classification without an employer willing and able to file the required paperwork. Conversely, an employer’s willingness to sponsor does not cure a position that fails the specialty-occupation test.
A practical checklist before relying on an H-1B filing
- Confirm the job analysis: write the actual duties, minimum degree specialty, worksite and wage rather than relying on a title.
- Match the worker’s evidence: collect degree records, equivalency evidence when needed, experience documentation and identity documents.
- Check the wage: compare the actual wage for similarly qualified employees with the applicable local prevailing wage and use the higher amount.
- Classify the filing: determine whether it is cap-subject, cap-exempt, an extension, an employer change or another petition type under current USCIS rules.
- Separate the agencies: track the Department of Labor LCA, USCIS petition and, when relevant, State Department visa process as separate decisions.
- Review the travel date: for a covered post-September 21, 2025 petition, verify the entry restriction, payment condition and any DHS-determined exception before making travel plans.
- Protect the worker: keep copies of the LCA-related notices, wage information, petition receipts and approval documents, and seek qualified immigration advice when the facts are unusual or disputed.
What the available official guidance does not establish
H-1B rules are time-sensitive. Current official guidance does not establish a current filing-fee table, the complete registration timetable and selection mechanics, exact maximum-stay or extension rules, consular appointment procedures or every exception to the September 2025 Proclamation. Those details should be confirmed in current USCIS, Department of Labor, DHS and State Department instructions for the relevant filing date and case type.
