A Stingray is a cell-site simulator: a device that impersonates a cellular tower. Nearby phones can select its signal and transmit identifying or signaling information, allowing an operator to determine which device is present and narrow its location. The process can initially involve phones belonging to people who are not targets.
That description covers the technology, not the legal authority to use it. Rules depend on the agency and jurisdiction. The U.S. Department of Justice (DOJ), for example, has a policy for its own domestic criminal investigations that generally requires a probable-cause warrant and sets limits on collection and retention; it is not a universal rule for every government body.

What a Stingray cell-site simulator is
“Stingray” is a commonly used name for a cell-site simulator, also called an IMSI catcher in some discussions. It is radio equipment operated directly by investigators rather than a record held by a mobile carrier. DOJ testimony by Deputy Assistant Attorney General Richard Downing on March 2, 2016, defined the distinction plainly: “A cell site simulator is equipment operated directly by law enforcement officers.”

Phones are designed to select an attractive or apparently suitable tower and exchange signaling information needed to identify and manage the connection. A simulator exploits that normal behavior. The phone may send an identifier such as a device or subscriber number even though the apparent tower is not part of the carrier’s ordinary network.

The simulator is therefore not simply reading a carrier’s historical database. It creates a targeted, real-time radio interaction in the area where it is deployed. A recent Seventh Circuit opinion dated February 5, 2026, described the same basic sequence: the equipment mimics a tower, nearby phones connect, and the system obtains signaling information, including identifying information such as a phone or subscriber number.
How the tracking operation works
1. The equipment advertises a tower-like signal
Investigators position or move the simulator so phones in the vicinity can detect it. The DOJ policy issued September 3, 2015, describes simulators governed by that policy as functioning “by transmitting as a cell tower.” A phone does not need to be deliberately handed to the operator; its ordinary network-selection behavior can cause the exchange.
2. Nearby phones answer with signaling information
Phones that respond can provide identifiers and other signaling information used to distinguish devices. The exchange is not the same as obtaining a person’s entire phone. It is a radio-level interaction intended to identify and locate a device.

3. Investigators separate a target from other devices
When investigators already know the identifier they are seeking, the simulator may initially receive identifiers from several nearby phones and then determine which one matches the known target. If the target’s identifier is unknown, the DOJ policy describes limited collection from non-target devices to distinguish the target. That is why people who are merely near an operation can be involved in the initial collection even when they are not subjects of the investigation.
4. The operator narrows the location
Signal range and direction information can indicate whether the target phone is within a particular area. Operators can move the equipment, take additional readings, and repeat the process from different positions. Each pass can reduce the search area. A 2015 New York court described a progression from an approximate location to a more precise one as the equipment and phone came closer together. That is the court’s description of the device and record in that case, not a guaranteed accuracy specification for every simulator model or deployment.

5. The phone’s state affects what can be found
The same New York opinion said, based on its understanding of the equipment before it, that the phone had to be powered on with battery remaining but did not have to be on a call. Those details should not be treated as universal specifications: hardware, cellular generations, configuration, and operating procedures can differ.
What information can be collected
A simulator’s central purpose is to collect identifying and signaling information from phones in radio range. That can include an identifier used to recognize the device or subscriber and information useful for determining proximity or direction. The collection is associated with a particular deployment, rather than being a carrier’s ongoing business record.
DOJ policy places an explicit limit on its criminal-investigation use: a cell-site simulator may not be used to collect communication contents. The policy gives emails, text messages, contacts, and images on the phone as examples of content it may not collect. This is a rule governing DOJ use, not proof that every product in existence has identical technical capabilities.
The New York court separately said the record before it was not definitive on whether simulators generally, or products associated with a particular manufacturer, could monitor calls or texts. The accurate conclusion is therefore two-part: DOJ policy prohibits content collection in the investigations it covers, while the technical capabilities of all simulator products should not be generalized from that policy.
Why bystander phones can be involved
A simulator cannot initially know which nearby radio device is the target. Phones respond because they are in the coverage area, not because their owners consented or were individually selected. The first collection can consequently contain identifiers from multiple devices.

The DOJ policy addresses this situation in two ways. For a known target, the simulator can use the gathered identifiers to recognize that device and then obtain signaling information relating to it. For an unknown target, the policy permits limited signaling information from non-target phones for the purpose of distinguishing the target. The policy also requires handling controls for data gathered during the operation.
DOJ’s public announcement about the 2015 policy says that, when locating a known cellular device, collected data must be deleted once that device is located and at least daily. Those deletion requirements are part of that department’s policy framework; another agency may operate under different rules.
Stingray tracking versus carrier cell-site records
Both sources can provide location clues, but they are created and controlled differently. Carrier records arise from a provider’s ordinary service. A simulator is deployed by law enforcement to collect signaling information from phones nearby at a particular time.

Neither category should be described as automatically giving a continuous, exact map of a person. The available detail depends on the equipment or records, the timing, the network environment, and the legal process used to obtain it.
What the DOJ policy does—and does not—require
Scope
The DOJ policy was issued on September 3, 2015; the department’s policy page was updated February 5, 2025. It governs DOJ use inside the United States in furtherance of criminal investigations. The document expressly says it does not apply to other federal agencies. State and local agencies can have different statutes, court decisions, policies, and warrant practices.

General warrant rule
For the DOJ activities covered by the policy, use generally requires a search warrant supported by probable cause. The policy lists limited exceptions. It also requires exceptions to the warrant rule to be tracked and reported, along with supervision and data-management practices.
Retention and deletion
The policy and its public announcement describe controls for information collected from non-target devices and require deletion in the circumstances specified there. In the known-device example, data must be deleted once the device is located and at least daily. These are DOJ policy requirements, not a nationwide statute that automatically governs every deployment.

“It is just the same as asking a carrier for location history.”
No. A carrier produces records created in the course of network service. A simulator is a separate piece of equipment that creates a local radio interaction and can collect nearby-device signaling in real time.
“The simulator automatically reads every message and photograph.”
That is not established by the evidence described here. DOJ policy prohibits collection of communication contents in the criminal investigations it covers, including emails, texts, contacts, and images. A 2015 court record also said it was not definitive about the general content-monitoring capabilities of simulator products. Technical capability and permitted use must be analyzed separately.

Nearby phones can respond before the system distinguishes the target. The policy’s special handling rules exist because non-target devices may be part of that initial process.
“Every simulator gives the same accuracy.”
No universal accuracy figure is established here. The New York court described increasing precision as the device moved closer in the case before it. Results can depend on model, antenna setup, terrain, buildings, network conditions, and operator technique.
“A consumer accessory is proven to defeat it.”
The cited evidence does not establish that an app, airplane mode, a Faraday pouch, or a detector defeats every simulator. Avoid treating any of those as a guaranteed countermeasure without model-specific, independently verified evidence.
How to evaluate a claim about Stingray tracking
- Identify the collector. Ask whether the information came from a law-enforcement simulator or from a carrier’s ordinary records.
- Establish the time frame. Simulator data is tied to a deployment; carrier records may cover historical communications events.
- Separate identifiers from content. A device or subscriber identifier and signaling data do not by themselves prove that calls, texts, emails, contacts, or images were obtained.
- Check the jurisdiction. Determine which agency acted and which warrant, statute, court order, or internal policy governed it.
- Ask how non-target data was handled. Look for collection limits, access controls, retention periods, deletion, auditing, and reporting.
- Qualify precision claims. “Narrowed to an area” is not the same as a guaranteed street address or room-level result; demand the equipment and deployment facts behind any accuracy statement.
Why the technology matters
The important privacy issue is not only what a simulator can do to a target phone. It is also the unavoidable possibility of collecting information from other phones that happen to be nearby. That makes authorization, minimization, access controls, deletion, and auditability central to any responsible use.

The technology also changes the evidentiary question. A carrier record is generated as part of a provider’s business; a simulator reading is generated by an investigative operation designed to find a device. Courts and agencies therefore have to address both the method of collection and the rules that permitted it.
Bottom line
A Stingray cell-site simulator tracks phones by pretending to be a cellular tower, prompting nearby devices to transmit identifying or signaling information, and using repeated signal and direction readings to narrow a target’s location. Bystander phones may be caught in the initial collection. DOJ policy limits how its covered investigators may use and retain the information, but that policy is not a universal rule, and technical capability should not be confused with legally permitted collection of communication content.
