What Is a Social Security Contribution Arrears Notice, and How Should Employers Respond?

A social security contribution arrears notice says that an authority or plan administrator believes an employer has unpaid or underpaid contributions for specified periods. It is not one universal type of document: the issuer, country, and notice stage determine what the employer must do, the applicable deadlines, and whether the matter may move toward collection or enforcement.

What an arrears notice means—and what it does not tell you

The notice may be a statement of an outstanding balance, a demand to regularize an account, a formal notice before enforcement, or a plan-specific form for reporting missing contributions. The label alone does not establish whether the amount is correct or what legal rights apply. Start with the notice itself: identify the issuing body, its legal basis, the periods and workers covered, and any separate dates for payment, correction, or challenge.

Do not borrow a deadline or penalty from another country—or assume that a challenge pauses collection. The rules differ by jurisdiction and can depend on how the contribution was assessed and what stage the notice represents.

How to respond to a contribution arrears notice

  1. Authenticate it and calendar every deadline

Confirm the notice through the authority’s official portal or contact details found independently on its website. Record the issue date, delivery date, amount, covered periods, payment deadline, response or review deadline, and any stated next step if you miss a date. Keep the notice and its envelope or electronic delivery record.

  2. Reconcile the claim period by period

Compare the notice with payroll registers, worker start and end dates, earnings or contribution bases, filed returns and amendments, remittance confirmations, bank debits, and the authority’s account ledger. Check whether a payment was credited to a different period or employer account. A Saskatchewan plan form from SHEPP, for example, asks for the arrears period, pensionable earnings, employee and employer contributions, and payroll-period information; it illustrates why a total balance alone may not reveal the discrepancy. SHEPP’s Current Year Contribution Arrears Notice is a plan-specific form, not a general government notice.

  3. Separate agreed amounts from disputed items

Make a reconciliation table for your own records with the period, amount claimed, amount in payroll records, payment or filing evidence, difference, and proposed correction. Classify each difference—for example, a missing filing, payment, calculation, worker record, duplicate assessment, or allocation issue. Avoid simply asserting that the notice is invalid; identify the evidence supporting each correction.

  4. Use the notice’s official payment or review route

If the amount is correct, follow the payment instructions and keep proof. If it is wrong, send the requested evidence and correction or review request through the stated official channel before the applicable deadline. Ask the authority whether it expects undisputed sums to be paid while the rest is reviewed, and whether collection continues during a challenge; neither outcome is universal. If cash flow is an issue, ask whether the authority offers a payment arrangement rather than assuming one is available.

  5. Preserve the record and address the cause

Keep the notice, payroll calculations, filings, bank confirmations, account extracts, correspondence, and any corrected submissions together. If the discrepancy came from a payroll or reporting process, correct that process for future periods as well as addressing the arrears.

How deadlines, surcharges, and enforcement vary

These official examples show why the exact notice and jurisdiction matter. The figures below describe the cited provisions or guidance only; they are not interchangeable rules or a penalty schedule for employers generally.

Jurisdiction or issuer What the source says Scope and qualification
Spain Government guidance describes a 10% surcharge for payment in the first calendar month after the deadline and 20% from the second month when the employer requested the contribution assessment and supplied the required information. Where no assessment was requested, it describes 20% if the debt is paid within the payment period stated in the debt notice, or 35% afterward. Unpaid debt may proceed to an electronically notified enforcement notice. These are Spain-specific cases and depend on the conditions described in the Spanish government guidance on paying social security contributions.
France Article L133-9-2 provides for a 6% surcharge on covered amounts not paid by the due date, increased by 1% per month or fraction after three months. In the specified process, if a formal notice to regularize within 15 days has no effect, the authorized director may issue a payment constraint. The article is in force from 1 July 2026 and applies to the collection context it defines, not every French contribution debt. See Article L133-9-2 of the French Social Security Code.
Saudi Arabia GOSI says it may seek a court order for attachment and compulsory execution if contributions and delay fines remain unpaid after notifying the employer and giving a 15-day grace period. This is the process described in GOSI’s employer FAQ; it should not be treated as a deadline in another system.
Poland ZUS says interest on late or underpaid amounts runs from the day after the payment deadline through the payment date. It also describes proportional allocation of a short payment, which can leave a contribution balance and interest due. The cited ZUS underpayment and delayed-payment guidance is dated 2017; check current official rules for any rate.
Malaysia PERKESO lists collection of arrears and short payments, late-payment interest, and assistance for employers facing contribution difficulties among its enforcement functions. See PERKESO’s enforcement information for its jurisdiction and current processes.
United Kingdom HMRC says employers generally send a Full Payment Submission on or before payday and may send an Employer Payment Summary by the 19th of the following tax month to report applicable reductions. These reporting records can help reconcile a disputed payroll liability; reporting rules are UK-specific. See HMRC’s payroll reporting guidance.

  • Payment deadline versus deadline to correct or challenge.
  • Whether collection continues during review, and what official channel is required for payment or a response.

These distinctions matter: the cited systems use different notice stages, calculation conditions, and consequences. A plan-specific arrears form, such as SHEPP’s, should not be mistaken for a government enforcement notice.

Records that help resolve a disputed liability

Build the response from records that connect each claimed amount to a payroll period and a remittance or filing. Depending on the notice, useful evidence may include payroll registers, worker dates and earnings, contribution calculations, filed returns and amendments, bank confirmations, payment references, and the authority’s account history. In the UK, for example, HMRC’s Full Payment Submission and applicable Employer Payment Summary are recurring records that can help check reported payroll liability; other jurisdictions use different filings and schedules.

Submit only through the channel identified by the issuing authority, and retain a dated copy of what you send and any receipt or case reference. If the notice does not make the review route, deadline, payment allocation, or effect of a dispute clear, ask the authority or a qualified local payroll or tax adviser before the date passes.
