A credit-card surcharge is an extra amount added when a customer pays with a credit card instead of cash, check, or a similar method. A merchant may impose one only when the law governing that transaction allows it and the merchant follows the applicable card-network, acquirer, notice, receipt, and price-display rules. Visa and Mastercard impose different limits, debit and prepaid cards receive different treatment, and some states prohibit surcharges altogether. There is no single nationwide rule that makes every surcharge legal.
What a credit-card surcharge is
Federal law defines a surcharge by comparing the regular price charged to a cardholder with the price charged to customers paying by cash, check, or a similar means. The Truth in Lending Act describes it as any method of increasing the regular price to a cardholder that is not imposed on customers using those other payment methods. The Federal Reserve’s published statutory text uses this definition in sections 103 and 167.

In practical terms, a store might list an item at $100 and add a separate 3% charge only when the customer uses a credit card. The added $3 is a surcharge. A cash discount uses the opposite presentation: the merchant establishes a regular price and reduces it for customers who pay with cash or another qualifying method. The economic result can be similar, but the wording, signs, receipts, and legal treatment may differ.

Calling the fee a “convenience fee” or “service fee” does not automatically change its classification. Visa warns that a fee tied to paying by card may be treated as a surcharge under its rules, depending on the facts. The label must match the transaction and the disclosure; renaming a card fee is not a substitute for compliance.

The legal test: five checks before a merchant adds a fee
Merchants should treat surcharge permission as a sequence of checks rather than a yes-or-no assumption.
- Identify the governing location and transaction. Determine the state and, where relevant, local law for the outlet or online sales channel involved. Visa says each outlet must follow the law of the state where it is located. Mastercard likewise says its rules do not replace state or federal requirements.
- Check every card network accepted. Visa and Mastercard have different caps, notice processes, and disclosure requirements. If a merchant accepts multiple networks, the strictest applicable combination may control the checkout design.
- Identify the card product. A credit card is not treated the same as a debit or prepaid card. Visa’s U.S. guidance prohibits surcharging Visa debit and prepaid transactions, even when a customer selects “credit” at the terminal.
- Calculate the permitted amount. A surcharge generally cannot exceed the merchant’s applicable acceptance cost, and each network also sets a ceiling. A lower state-law limit or product-specific rule can reduce the amount further.
- Set up notice and disclosure before payment. Customers must see the fee and its amount before choosing to pay. Required signs, online notices, receipts, and advance network or acquirer notifications are separate compliance steps.
State law can prohibit a surcharge even when a network permits it
Network rules are not a nationwide authorization. State restrictions, exceptions, and court decisions can determine whether a merchant may charge anything at all. The following official examples illustrate why a state-by-state conclusion cannot be inferred from a general internet list.
| Jurisdiction | Official position described in the cited material | Practical implication |
|---|---|---|
| Maine | Title 9-A, section 8-509 bars a seller in a sales transaction from imposing a surcharge on a credit- or debit-cardholder instead of a cash, check, or similar payer. The statute separately allows specified governmental entities to impose certain surcharges under stated conditions. | A private seller covered by the prohibition cannot rely on a Visa or Mastercard permission rule. |
| Florida | The 2026 Florida Statutes, section 501.0117, says a seller or lessor accepting credit cards may not surcharge a buyer or lessee for choosing credit instead of cash, check, or similar means. The statute contains separate exceptions for specified tariff-related charges. | Review the current statutory text and any applicable exception before implementing a fee. |
| Connecticut | The Department of Consumer Protection says businesses may not add a surcharge for choosing one payment type over another, usually credit instead of cash. It notes that some public payments may carry a separate fee. | A network-compliant credit surcharge may still be unlawful for an ordinary business transaction. |
This is not a complete state survey. State statutes, regulations, litigation, injunctions, and agency interpretations can change the answer. For a real transaction, identify the outlet, customer type, sales channel, and payment method, then consult the current authority in that jurisdiction and legal counsel when appropriate.

Visa and Mastercard use different caps and procedures
The networks’ published requirements should be treated separately. A merchant that accepts both brands must configure the fee for each brand and card product instead of applying one universal percentage.
| Issue | Visa U.S. guidance | Mastercard merchant rules |
|---|---|---|
| Eligible transactions | Credit-card purchases only. Visa debit and prepaid transactions cannot be surcharged; selecting “credit” on a debit terminal does not change the transaction into a credit purchase. | Rules described for Mastercard credit cards, subject to the operative rule and legal restrictions. |
| Maximum | The lower of the applicable merchant discount rate or 3%. | A stated 4% maximum surcharge cap, with the actual amount also limited by the merchant’s cost of acceptance and product-level calculations. |
| Notice before launch | Notices are required at the point of entry and point of sale or transaction. | At least 30 days’ advance notice to Mastercard and the merchant’s acquirer before implementation. |
| Customer disclosure | The surcharge must be shown separately on the receipt, in addition to the required notices. | Clear point-of-interaction disclosure, including the surcharge amount, plus the dollar amount on the transaction receipt. |
| Legal reservation | Each outlet must follow the law of the state where it is located. | Network rules do not relieve a merchant of state or federal obligations, including laws against deceptive or misleading disclosures. |
Visa’s U.S. Merchant Surcharge Q&A is dated February 15, 2024. Mastercard’s merchant surcharge page was verified in 2026. The figures are network ceilings, not guarantees that a merchant may charge those percentages.
How to calculate the allowed surcharge
Start with the actual acceptance cost
Both networks tie the fee to payment acceptance economics. Gather the merchant discount rate or other applicable acceptance-cost figure for the card product and transaction. The fee should not be used to recover unrelated overhead, and the calculation should be documented so the amount can be explained to the customer and acquirer.

Apply the network ceiling
For Visa, compare the applicable merchant discount rate with 3% and use the lower number. For Mastercard, the page states a 4% maximum, but a cost-based limit may produce a lower result. A product-level Mastercard surcharge can also have different calculations from a brand-level surcharge applied to Mastercard credit cards generally.

A state or local rule can reduce the permissible amount to zero. An acquirer agreement or a particular network rule can impose additional operational conditions. The final rate is therefore the lowest applicable limit, not whichever headline percentage appears most convenient.
Notice, checkout display, and receipts
A legally permitted fee can still create a problem if the customer sees it too late or cannot identify how it was calculated. Build the customer-facing process before turning the fee on.

- Post an entry notice. For a physical location, place the required surcharge notice where customers can see it before entering or beginning the transaction. Visa specifically requires notice at the point of entry.
- Repeat the notice at payment. Show the fee and the card types to which it applies at the point of sale or transaction. For online checkout, place the information before the customer submits payment, not only in a buried terms page.
- State the amount or rate clearly. Explain whether the fee is a percentage or a fixed amount and identify the applicable card category. Do not imply that debit or prepaid cards incur a fee when they are exempt.
- Itemize the receipt. Visa requires a separate surcharge entry. Mastercard requires the dollar amount on the transaction receipt. The receipt should distinguish the merchandise price, surcharge, taxes, and final amount.
- Complete advance notifications. Mastercard requires notice to Mastercard and the acquirer at least 30 days before implementation. Confirm any comparable acquirer setup requirements for other networks before activation.
- Test every payment path. Run credit, debit, prepaid, refunds, split tenders, mobile wallets, online orders, and manually keyed transactions. A terminal setting that identifies every card as “credit” can apply an impermissible fee.
When the fee must appear in the advertised total price
The Federal Trade Commission’s May 2025 FAQ distinguishes a mandatory payment fee from an optional credit-card fee. Businesses may charge or pass through processing fees only if otherwise permitted by law.
| Checkout condition | FTC total-price treatment | What the customer must see |
|---|---|---|
| Credit card is required, or no viable fee-free payment method exists at the same location or platform | The fee is mandatory and must be included in the total price shown to the customer. | The advertised or displayed total must include the fee, with its nature and amount disclosed before payment. |
| The same transaction can be completed at the same location or platform using a viable fee-free method | The fee may be excluded from the initial total-price figure for the FTC analysis because the customer can avoid it. | The fee’s purpose, amount, and conditions must still be clear and conspicuous before payment, and the final amount must include it. |
The FTC’s online-ticket example involves a 3% charge where no other viable online payment method is offered; that charge is mandatory and belongs in the total price. Its contrasting in-person comedy-club example allows payment by app, debit, or cash without the fee, making the credit-card charge optional for total-price analysis.
Federal requirements do not erase stronger state or local protections. The FTC says a business must comply with the federal rule and applicable state or local law; where a state or local requirement gives consumers greater protection, that requirement applies. A direct conflict displaces another rule only to the extent necessary to resolve the conflict.

Multi-state merchants need location-specific configurations
A chain cannot assume that one national surcharge setting works everywhere. Visa directs merchants with multiple locations to follow the law governing each outlet. A merchant may therefore need to enable a credit-only fee in one state, disable it in another, and use different signs, online disclosures, or receipt formats by channel.
Online sales require a separate analysis. Identify where the transaction is considered to occur under applicable law, whether the platform offers a viable fee-free payment option, and whether the checkout displays the fee before submission. A policy written for a storefront may not satisfy an online transaction’s price-display requirements.
Common implementation failures and fixes
| Failure | Why it causes trouble | Fix |
|---|---|---|
| Adding the fee to every card transaction | Visa prohibits surcharges on Visa debit and prepaid cards. | Use reliable card-product identification and suppress the fee for exempt products. |
| Using one percentage for every network | Visa and Mastercard have different ceilings and cost calculations. | Calculate each network separately and apply the lowest binding limit. |
| Disclosing the fee only on the receipt | Customers must see the charge before payment; Visa and Mastercard require earlier disclosures. | Post entry and point-of-interaction notices, then itemize the receipt. |
| Calling the fee a service or convenience fee without analysis | A payment-linked fee may still be treated as a surcharge under network rules. | Classify the fee by how it operates, not by its label. |
| Including a mandatory fee only at the last screen | The FTC treats a required payment fee as part of the total price. | Include it in the displayed total and disclose the amount before payment. |
| Copying an old state-law list | Statutes, court orders, and agency guidance can change. | Verify the current authority for the specific outlet and transaction date. |
| Ignoring refunds or partial payments | A surcharge that is not reversed or allocated correctly can make the receipt and final amount inaccurate. | Test refund, void, split-tender, and adjustment workflows before launch. |
What customers should look for
Before paying, check whether the merchant disclosed a card fee at the entrance, checkout, or online payment screen. Confirm that the fee identifies the applicable card type and shows a dollar amount or understandable rate. On the receipt, look for a separate surcharge line and compare it with the amount disclosed before payment.
If a debit or prepaid transaction appears to have received a Visa surcharge, or if a fee appears without the required advance disclosure, ask the merchant for an itemized explanation and retain the receipt. Whether a charge is unlawful depends on the transaction’s location, card product, network, and available payment alternatives, so a generic internet statement cannot resolve every complaint.
Bottom line for merchants
A credit-card surcharge is lawful only when all applicable layers align: the state and local law for the transaction, the card network’s rules, the card product, the acceptance-cost and percentage caps, the acquirer’s requirements, and the federal price-disclosure standard. Visa’s U.S. guidance limits surcharging to credit cards and caps it at the lower of the merchant discount rate or 3%; Mastercard describes a 4% maximum while also applying acceptance-cost limits and requiring at least 30 days’ advance notice. State law can prohibit the fee entirely. Treat location, network, card type, calculation, notice, and receipt design as separate checks, and re-verify them before changing a live checkout.
