Hotel booking transparency depends on what is being paid for and where the customer is located. A paid advertisement, a hotel paying for a higher position, an affiliate commission earned after a referral, and a sponsored review are different arrangements. U.S., EU and UK rules address them through different laws and guidance, so no single worldwide disclosure formula applies.
Start by identifying what the payment buys
The same hotel-search page can contain several commercial relationships. Before judging whether a label is adequate, determine whether money buys visibility, ranking, a referral, or editorial influence.
| Commercial arrangement | What the payment buys | Who is paid | Transparency question |
|---|---|---|---|
| Paid advertisement | An ad impression or placement identified as advertising | The platform or publisher receives money from an advertiser | Can a visitor recognize the item as an ad and identify the advertiser and payer? |
| Paid ranking or placement | A better position, preferred ordering or enhanced visibility in results | The search or booking platform receives remuneration from a hotel or other business user | Does the service explain that payment can affect ranking, and is the commercial effect distinguishable from ordinary results? |
| Affiliate referral | A commission when a reader clicks a link and completes a qualifying action | A publisher, creator or media site receives commission from a retailer or booking service | Does the recommendation disclose the paid relationship before the reader relies on it or clicks? |
| Sponsored or incentivised review | Editorial coverage, a rating or review influenced by payment, free service or another benefit | The reviewer or publisher receives money or a non-cash benefit | Is the incentive or sponsorship stated separately from search-result advertising? |
These categories can overlap, but one label does not automatically explain all of them. A page may disclose an affiliate commission while failing to explain that some hotels paid for preferred positions, or may mark an advertisement without revealing that a review was incentivised.

United States: affiliate links need a clear, nearby explanation
For U.S.-facing editorial content, Federal Trade Commission staff guidance applies the general endorsement principles of the FTC Act to affiliate marketing. It is not a hotel-booking statute and does not create one mandatory phrase for every site. The central requirement is that readers understand the publisher’s financial relationship before deciding how much weight to give the recommendation.
“You should disclose your relationship to the retailer clearly and conspicuously on your site, so readers can decide how much weight to give your endorsement.”

FTC staff, FTC’s Endorsement Guides: What People Are Asking
What an effective disclosure says
The FTC gives this example: “I get commissions for purchases made through links in this post.” It identifies both the payment and the event that triggers it. A statement such as “affiliate link” may be too vague because many readers do not know that it means the publisher is paid.
What’s actually slowing this PC down?
Pick the symptom - the matching free tool is one click away.
A disclosure should also be understandable to the audience. Avoid euphemisms, unexplained abbreviations or wording that suggests the link is merely a technical tracking device. If the publisher may earn money when a reader books a room after clicking, say so in ordinary language.
Where the disclosure belongs
Place the explanation close to the recommendation or link, before the reader clicks or makes a booking decision. A disclosure hidden on a general policies page can be inadequate when the commercial link appears in a separate review, comparison or list. The closer the disclosure is to the claim that could be affected by payment, the less likely a reader is to miss it.
The FTC’s 2023 Endorsement Guides update added a definition of “clear and conspicuous.” The agency also cautioned that a platform’s built-in disclosure tool might not, by itself, communicate the relationship adequately. A publisher remains responsible for making the financial connection understandable in the presentation the audience actually sees, including mobile layouts and social posts that send readers to a booking page.

What this guidance does not decide
FTC staff guidance does not determine whether a hotel paid for a higher position in a booking service’s own results. That is a different relationship from a publisher’s affiliate commission. It also does not establish a universal rule for sites aimed exclusively at another country. The audience, claims, business model and facts of the placement matter.

European Union: advertisements must be identifiable in context
Article 26 of the Digital Services Act (DSA) addresses providers of online platforms that present advertisements. For an advertisement shown by a covered platform, recipients must be able to identify, in a clear, concise and unambiguous manner and in real time, that the information is an advertisement. The platform must also identify the person on whose behalf the ad is presented and, where different, the person who paid for it.
Information that must be accessible from the ad
The DSA also calls for meaningful information, directly and easily accessible from the advertisement, about the main parameters used to target it and, where applicable, how the recipient can change those parameters. The information has to work with the interface in which the ad appears; a buried explanation that a typical user cannot reach from the ad may not satisfy the practical transparency objective.
These obligations are not automatically attached to every hotel result or every booking website. Coverage depends on whether the service is a covered online platform presenting an advertisement and on the applicable DSA provision. A label should therefore be assessed together with the service’s legal role, the audience and the way the item was selected.
Labels should communicate advertising, not merely promotion
European Commission guidance on the Unfair Commercial Practices Directive recounts earlier consumer-authority action concerning paid ranking by major travel platforms. In that account, less informative “sponsored” wording was replaced with more direct labels such as “Ad,” “Advert” or “Advertisement,” or their local-language equivalents, and the labels were made more prominent. This is the Commission’s description of that action, not a blanket instruction that one label must appear on every current result in every EU country. National law and current guidance still need to be checked.

Regulation (EU) 2019/1150, commonly called the Platform-to-Business (P2B) Regulation, takes a different approach. Article 5 requires providers of online intermediation services to state in their terms and conditions the main parameters that determine ranking and the reasons those parameters matter relative to others.

When remuneration affects ordering
If ranking can be influenced by direct or indirect remuneration from business users or corporate website users, the provider must describe that possibility and its effects. Article 5(3) states:
“Where the main parameters include the possibility to influence ranking against any direct or indirect remuneration paid by business users or corporate website users to the respective provider, that provider shall also set out a description of those possibilities and of the effects of such remuneration on ranking in accordance with the requirements set out in paragraphs 1 and 2.”
Regulation (EU) 2019/1150, Article 5(3)
The European Commission identifies online travel agents as examples of online intermediation services. The P2B duty is principally information for business users, such as hotels listing rooms through the service. It is not the same as a consumer-facing “paid placement” badge on each hotel result. A platform can satisfy one obligation while still needing a clear consumer label under another applicable rule.
What ranking explanations should help a hotel understand
A useful terms-and-conditions explanation should identify the principal ranking factors, explain their relative importance and state whether payment can alter ordering or visibility. It does not require disclosure of every detail of a proprietary algorithm. It does require enough information for a business user to understand the commercial effect of paying for a ranking-related option.
United Kingdom: paid and unpaid accommodation listings should be distinguishable
The Competition and Markets Authority’s short guide for online accommodation-booking sites says services offered to UK consumers should “clearly differentiate ‘paid for’ listings with those that aren’t ‘paid for’.” The guidance arose from an investigation involving several large accommodation services and commitments to change practices. It says the principle applies broadly to online accommodation booking sites, including online travel agencies, search engines, hotel groups, short-stay rental services and smaller businesses.

The guide identifies 1 September 2019 as the implementation date for those historical changes. That date is context, not a new deadline. The practical lesson remains that a customer comparing results should not have to open a distant policy page to discover that some listings were paid for and others were not.
What “paid for” can mean on a UK results page
The phrase can cover a placement purchased directly by a hotel, a marketing arrangement that gives a listing additional prominence, or another commercial deal that changes how the result is presented. The exact legal analysis depends on the facts. A platform should not imply that all results are ordered solely by neutral relevance when payment has a material role.
Sponsored reviews are a separate disclosure problem
A sponsored or incentivised review is not the same as a paid search result. EU accommodation-review principles address practices such as reviews produced in exchange for a benefit or presented under sponsorship. Those principles do not replace an explanation that a hotel listing itself was paid for or that an affiliate commission may be earned after a click.
For readers, the useful distinction is simple: ask whether the money affected the existence or wording of the review, the position of the hotel in search results, or the publisher’s commission after a referral. Each answer points to a different commercial mechanism and potentially different disclosure duty.
How to tell whether a hotel listing is sponsored
No single visual design is used worldwide, but the following checks help a reader assess a results page before booking:
- Look beside the result, not only at the footer. Search for terms such as “Ad,” “Advert,” “Advertisement,” “paid placement” or an equivalent local-language label.
- Open the explanation attached to the label. It should identify who is advertising or paying and, where relevant, explain the main targeting information.
- Check the ranking explanation. Terms and conditions should describe the main ranking parameters and whether remuneration can influence ordering, particularly for services covered by the P2B Regulation.
- Compare similarly described results. If one group is marked as paid and another is not, the distinction should be visible before you choose a property.
- Read review notes separately. A statement about sponsored reviews does not tell you whether the listing position was purchased.
- For editorial articles, find the commission disclosure near the link. “I get commissions for purchases made through links in this post” is the FTC’s example of the type of plain-language explanation that tells readers what payment means.
If the only explanation appears after checkout, in an inaccessible policy page or behind wording that an ordinary reader would not understand, the disclosure may not be meaningful at the point of decision.

Do booking sites have to say when a hotel pays for a higher position?
There is no single worldwide answer. In the EU, the P2B Regulation requires covered intermediation services to explain to business users whether remuneration can influence ranking and what effect it has. The DSA separately addresses identification and targeting information for advertisements shown by covered online platforms. In the UK, CMA guidance calls for clear differentiation between paid-for and unpaid accommodation listings. In the U.S., the FTC affiliate guidance primarily concerns a publisher’s endorsement and commission relationship, not a universal hotel-search ranking label.
Whether a particular result must carry a consumer-facing label depends on the service’s role, the jurisdiction, the audience and the facts of the payment arrangement. A claim that every booking site must mark every commercially influenced result in the same way would overstate the evidence.
A practical disclosure checklist for publishers and booking services
For publishers earning referral commissions
- State that the publisher receives commissions when readers book through qualifying links.
- Put the statement next to the recommendation or link and ensure it is visible on mobile devices.
- Use plain language; do not rely on “affiliate link” alone.
- Keep the disclosure separate from claims about the hotel’s quality, price or availability.
- Do not assume a platform’s disclosure badge is sufficient without checking how readers see it.
For booking platforms displaying commercial results
- Make advertising identifiable in the result itself where the applicable law requires it.
- Identify the advertiser and, when different, the payer.
- Provide meaningful targeting information directly and easily from the ad when the DSA applies.
- Explain the main ranking parameters and their relative importance in terms provided to business users.
- Describe how direct or indirect remuneration can affect ranking when that possibility exists.
- Keep paid and unpaid accommodation listings visibly distinguishable for UK consumers in line with CMA guidance.
For review and content teams
- Label sponsored or incentivised reviews as such.
- Do not use a review-sponsorship label as a substitute for a paid-listing label.
- Record whether compensation affected the review, the ranking, the referral or more than one of these.
Why jurisdiction and platform role matter
The FTC materials are agency guidance on practices that may violate the FTC Act, not a special hotel-booking code. The DSA applies its ad-transparency rules to covered online platforms and specified advertisements. The P2B Regulation focuses on online intermediation services and information supplied to business users. CMA guidance is UK-specific and describes changes associated with a historical 2019 implementation date. These instruments should not be treated as interchangeable.
When assessing a real listing, document the country targeted, the identity of the operator, whether the item is an advertisement or an ordinary result, who paid, how ranking changed, and where the disclosure appeared. Those facts determine which rule or guidance is relevant and whether the disclosure was visible before the customer’s decision.
