Activate the incident-response plan, isolate affected systems when ransomware is suspected, preserve evidence, and establish a controlled downtime process for claims and other critical work. Then restore systems through tested, security-aware recovery procedures while separately determining whether protected health information (PHI) was exposed and whether HIPAA breach notifications are required.
HHS Office for Civil Rights (OCR) guidance provides the response framework, but it does not prescribe one claims-submission method for every provider, health plan, clearinghouse, or payer. Your privacy officer, legal counsel, incident-response lead, revenue-cycle leaders, business associates, and affected payers must adapt the workflow to your contracts, technology, and state obligations.

1. Activate incident response and contain the attack
A ransomware event or other malware intrusion is a HIPAA Security Rule security incident. Start your documented security-incident procedures immediately; do not wait for a complete diagnosis before assigning authority and protecting systems.
Establish one response structure
Name the technical incident commander and the people responsible for privacy, legal, clinical operations, revenue cycle, communications, executive decisions, and business-associate coordination. Set a single decision log and an approved communications channel that is not dependent on potentially compromised systems. Staff should know who can authorize isolation, downtime procedures, restoration, external notifications, and return to production.

Determine what is affected
Build an initial picture of the attack without assuming that the claims application is the only target. Identify affected networks, servers, endpoints, identity systems, interfaces, file shares, backups, and third-party connections. Record when unusual activity began, whether it is continuing, whether it has propagated, how the attacker entered, and which accounts or privileges were used. Preserve logs, alerts, forensic images, ransom notes, and other information needed for investigation according to your response plan.
OCR advises organizations that believe a ransomware attack is underway to activate their response plan and isolate infected systems to stop propagation. Isolation can include taking systems or network segments offline, disabling compromised accounts, or blocking connections, but the exact technical action must fit the incident and environment. Do not let pressure to submit claims cause staff to bypass the incident-response lead or destroy evidence.
2. Keep critical work moving while claims systems are unavailable
Once the response team has stabilized the immediate threat, activate contingency and emergency-operations plans. HIPAA contingency planning covers data backup, disaster recovery, emergency-mode operations, application and data criticality analysis, and periodic testing. The objective is to maintain essential processes while protecting ePHI, not to recreate every normal workflow at any cost.
Prioritize by patient-care and business criticality
Rank applications and information before assigning scarce staff or replacement technology. Patient-safety functions, access to current clinical information, medication and referral processes, identity and access management, and revenue-cycle activities may have different priorities in your organization. Use the criticality analysis already approved in your contingency plan; if it is incomplete, document the interim decisions and the assumptions behind them.
Design a controlled claims downtime workflow
There is no universal OCR form or sequence for preparing and sending claims during a cyber outage. Define a workflow that matches your payer contracts, clearinghouse arrangements, security controls, and ability to reconcile work later.

| Downtime function | Decisions to make | Control to document |
|---|---|---|
| Intake | How encounters, eligibility details, authorizations, and charge information are captured when the normal system is unavailable | Use approved forms or alternate systems; restrict access and track every record created |
| Claim preparation | Who validates coding, identifiers, provider information, and supporting documentation | Apply segregation of duties and a versioned queue so records cannot be silently changed |
| Submission | Which payer or clearinghouse channels remain available and what authentication they require | Confirm the channel is authorized, encrypted where required, and not connected to compromised infrastructure |
| Reconciliation | How downtime claims are matched to restored records and how duplicates or omissions are detected | Maintain a numbered inventory, submission status, acknowledgments, denials, and corrective actions |
| Backlog handling | How work is prioritized after service returns and how contractual or regulatory timing questions are escalated | Have legal, payer-relations, and revenue-cycle owners approve exceptions and retain correspondence |
Paper forms, spreadsheets, or alternate applications may be appropriate in one environment and unsafe or contractually unacceptable in another. Before using any substitute, confirm where it will be stored, who can access it, how it will be transmitted, and how it will be destroyed or migrated after recovery.
Protect ePHI in emergency mode
Downtime does not suspend HIPAA safeguards. Apply minimum-necessary access, verify identities, use approved secure communications, and keep physical records under controlled custody. Log disclosures and transfers where your procedures require it. If a business associate operates a claims interface, coding service, hosting environment, or clearinghouse connection, notify and coordinate with that organization under the business-associate agreement and incident plan.

3. Recover systems and data deliberately
Recovery begins after containment and remediation have reduced the risk of reinfection. OCR describes recovery as restoring lost data and returning affected operations to normal. A backup that has never been restored and checked is not a dependable recovery capability.
Confirm that backups are usable and safe
Assume that attackers may have reached backup systems or credentials until evidence shows otherwise. Select recovery points based on known-good status, isolate restoration environments, and involve the security team before reconnecting restored systems. Address the vulnerability, stolen credentials, exposed remote access, or other attack path that enabled the incident.
Test restoration and validate integrity
Restore representative data and applications in a controlled environment. Check that records are complete, readable, correctly linked, and usable by the people who need them. Test interfaces, authentication, audit logging, and role-based access, not just whether a database starts. Record the date, scope, test method, results, defects, and corrective actions. Retain those results as part of the contingency and security records.

Return claims processing in stages
Bring services back according to the approved recovery priority rather than switching everything on at once. Monitor for renewed malicious activity, unexpected changes, failed interfaces, and access anomalies. Obtain sign-off from technical, privacy, operational, and revenue-cycle owners before declaring a system operational.
Reconcile downtime work
Compare every claim, encounter, attachment, and payment-related record created during downtime with the restored system. Use the inventory and submission acknowledgments to identify duplicates, missing records, rejected transactions, and claims that require resubmission. Reconciliation is operational guidance rather than a single OCR-prescribed step, but it is essential for preventing lost revenue and inaccurate patient or payer records.
4. Decide whether PHI exposure is a reportable breach
Do not treat the outage itself as proof of a breach. Ransomware or malware presence is a security incident; a breach determination is a separate, fact-specific analysis of whether PHI was impermissibly acquired, accessed, used, or disclosed.
Build the fact pattern
Determine what PHI was in the affected systems, whose information it was, whether files were opened or exfiltrated, what evidence exists about attacker activity, and whether access was limited to encrypted data or unusable copies. Consider the nature and extent of the PHI, who received or accessed it, whether it was actually acquired or viewed, and the extent to which the risk was mitigated. Encryption can be important, but it does not automatically answer every question about the incident.
Document the conclusion
Write down the evidence reviewed, assumptions, risk analysis, mitigation, decision, and approving officials. If the facts change, update the assessment rather than treating the first conclusion as final. Coordinate with business associates when their systems or services are involved; agreements may require rapid notice even while the legal analysis continues.

5. Handle notifications and external communications
If the analysis establishes a HIPAA breach, follow the applicable HIPAA notification requirements and any stricter state, contractual, or sector-specific rules. The federal OCR materials do not establish Medicare or Medicaid claim deadlines, payer-specific outage procedures, or a single state reporting timetable. Counsel and the privacy officer should map each obligation to the facts and jurisdiction.
Coordinate the message
Use one approved set of facts for patients, workforce members, payers, regulators, business associates, and the media. Explain what is known, what remains under investigation, what protective steps people should take, and where questions can be directed. Avoid promising that no information was accessed unless the evidence supports that statement. Communications staff should receive updates from the incident commander and privacy or legal leads, not from informal technical speculation.
Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone.6. Document decisions, evidence, and lessons learned
Maintain a complete incident file from activation through closure. OCR audit materials indicate that reviewers may examine incident roles, timeliness of response and reporting, documentation, application criticality, contingency-plan testing, restore-test results, and coordination with business associates.
- Incident timeline, scope, affected assets, attack path, containment actions, and evidence-preservation steps
- Names and responsibilities of technical, privacy, legal, clinical, revenue-cycle, communications, and executive participants
- Downtime decisions, approved alternate workflows, access controls, inventories, submissions, acknowledgments, and reconciliation results
- Backup sources, restoration tests, integrity checks, vulnerabilities corrected, and approvals for staged return to service
- PHI risk assessment, breach conclusion, notifications, contractual reports, and correspondence with payers or business associates
- Post-incident findings, owners, deadlines, and verification of corrective actions
Conduct a formal after-action review while the sequence is still clear. Ask whether criticality rankings reflected real patient and revenue impact, whether staff could find the downtime procedures, whether alternate channels were secure, whether contacts were current, and whether restore tests reflected production conditions.
7. Strengthen the program before the next outage
Test the whole chain, not just backups
Schedule exercises that begin with a claims-system compromise and continue through isolation, emergency operations, payer communication, restoration, reconciliation, and breach assessment. Include business associates and key clearinghouse or payer contacts where agreements permit. Capture measurable findings, such as an unassigned decision, an inaccessible record, or an interface that cannot be rebuilt, and track remediation to completion.
Best Value
Review contracts and contact lists
Confirm business-associate agreements describe security-incident cooperation, notification routes, evidence preservation, and recovery responsibilities. Keep payer, clearinghouse, regulator, law-enforcement, insurer, and executive contacts current. A technically successful recovery can still fail if no one knows who may authorize submissions or notify a counterparty.
Make secure alternatives realistic
Downtime materials should be available when normal identity, printing, email, or file-sharing tools are unavailable. Store them with access controls, retention rules, and a process for reconciling and securely disposing of temporary records. Review whether staff can perform the workflow without creating uncontrolled copies of ePHI.
What the HHS guidance does—and does not—tell you
OCR guidance establishes duties and planning principles: respond to security incidents, contain and investigate them, maintain critical operations in emergency mode, protect ePHI, back up and restore data, test contingency capabilities, assess breach risk, document decisions, and improve the program after an event. It does not prescribe a particular claims form, clearinghouse, submission channel, payer deadline, recovery-time objective, or commercial product. Those choices depend on your systems, agreements, risk analysis, and applicable law.
OCR Director Paula M. Stannard summarized the preventive emphasis in a June 18, 2026 HHS announcement: “Effective cybersecurity starts with Security Rule compliance, ensuring that Security Rule provisions are implemented before a cyberattack occurs.” The statement is a reminder that an incident plan is useful only when roles, backups, downtime procedures, and tests exist before the outage.
Practical decision checklist
- Activate the security-incident plan and appoint accountable technical, privacy, legal, operational, revenue-cycle, communications, and executive leads.
- Isolate suspected infected systems, preserve evidence, and determine scope, timing, propagation, and attack path.
- Activate contingency operations, rank critical applications, and select a secure claims downtime workflow that fits payer and clearinghouse arrangements.
- Protect ePHI in every alternate process and coordinate with affected business associates.
- Restore from validated recovery points only after containment and remediation; test integrity, access, interfaces, and audit logging.
- Reconcile downtime claims and other records against restored systems, documenting duplicates, omissions, and resubmissions.
- Perform and document a separate PHI breach-risk assessment; issue required notifications under applicable federal, state, and contractual rules.
- Complete an after-action review, assign corrective actions, and retest the capabilities that failed or proved uncertain.
A claims outage becomes manageable when the organization separates urgent containment from continuity decisions, treats recovery as a tested process, and documents the facts behind every privacy and notification conclusion. The federal framework is consistent, but the operational details must be built and exercised around the organization’s own patients, payers, systems, and business associates.
