What Healthcare Marketers Should Know About HIPAA and AI

The key point: HIPAA does not create a special legal category for “AI.” Your obligations depend on whether your organization is a covered entity or business associate, whether the system handles protected health information (PHI) on your behalf, and what the communication or campaign does with that information. An AI vendor that receives or maintains PHI for a provider may be a business associate and require a written business associate agreement (BAA). Marketing uses and disclosures can require a separate patient authorization; signing a BAA does not replace that permission.

Start with the HIPAA questions, not the AI label

Healthcare teams often ask whether a chatbot, generative model, personalization engine, analytics platform or advertising tool is “HIPAA-compliant.” That wording skips the legal tests that matter. HIPAA’s Privacy, Security and Breach Notification Rules apply to covered entities and business associates in workflows involving PHI. The fact that a product uses machine learning neither brings it under HIPAA automatically nor exempts it.

First identify your organization’s role. Under the Department of Health and Human Services (HHS) definition, covered entities include health plans, health-care clearinghouses and certain health-care providers. A provider is not covered merely because it treats patients; the provider must transmit health information electronically in connection with a transaction for which HHS has adopted a standard. A marketing agency, software company or data processor may instead be a business associate when it performs services for a covered entity and handles PHI for that work.

Next identify the data and the relationship. Ask what information enters the system, who can see it, where prompts and outputs are stored, whether logs or telemetry are retained, which subprocessors receive it, and whether the vendor can access PHI to deliver the service. Those facts determine the HIPAA analysis more reliably than a product description such as “AI-powered.”

When a marketing communication is “marketing”

HHS describes marketing as a communication about a product or service that encourages the recipient to purchase or use it. The Privacy Rule generally requires the individual’s authorization before PHI is used or disclosed for marketing, subject to limited exceptions. The sponsor, purpose, data used and recipient all matter.

Communication pattern HIPAA issue to resolve Practical action
A provider tells its own patients about a service the provider offers HHS identifies some communications about the covered entity’s own health-related products or services as outside the marketing definition, but other Privacy Rule duties still apply. Document the sponsor, purpose, audience and PHI used; confirm the exception fits the exact message.
A health organization sends general disease-prevention or health-promotion information Certain general health-promotion communications may not be marketing. Describe the educational purpose and avoid assuming that every “wellness” message qualifies.
A provider discloses a patient list so another company can promote that company’s product HHS says the disclosure for the other entity’s independent marketing requires authorization. Do not sell, rent or disclose the list for that purpose without a valid authorization.
An AI system selects recipients or personalizes copy using PHI The targeting or personalization can itself be a use of PHI for marketing. Classify the campaign before enabling the model, audience export or automated send.

A privacy notice, cookie banner or general consent checkbox is not a substitute for a HIPAA authorization when the Privacy Rule requires one. The authorization analysis is separate from the question of whether a technology vendor needs a BAA.

Decide whether an AI provider is a business associate

HHS gives a direct example: a third-party AI chatbot embedded in a provider’s patient portal that uses PHI for symptom assessment, reminders or appointment scheduling can be a business associate. The same conclusion may not apply to a vendor that merely supplies software and cannot access PHI. You must examine the actual configuration and contract.

  1. Confirm the organizational role. Record whether the customer is a covered entity, an existing business associate, or neither. A campaign run by an unrelated consumer business may fall outside HIPAA, although other federal or state laws can still apply.
  2. Map the complete data flow. List prompts, uploads, generated responses, account identifiers, appointment events, logs, analytics, backups, retention periods, support access and every subprocessor. Include data sent from browsers and mobile SDKs, not just the main application database.
  3. Test vendor access. Determine whether the provider can view, decrypt, store or otherwise access PHI while delivering the service. A vendor that does not access PHI is not a business associate on that basis alone; a vendor that needs access to perform the service may be.
  4. Execute a written BAA before the PHI workflow. HHS says the agreement must establish permitted and required uses and disclosures, safeguards and other required terms. Make sure the operating configuration matches the BAA; a contract cannot make an impermissible use lawful.
  5. Handle marketing permission separately. A BAA governs the covered-entity–vendor relationship and safeguards. It does not give patients the authorization needed for a marketing use or for disclosure to another company’s independent marketing.

Do not assume that sending information to a vendor and asking it to remove names later eliminates the disclosure. Assess what the vendor received, when it received it, the context of the information and the vendor’s ability to access or retain it.

Pixels, cookies and analytics need a PHI data-flow review

HHS’s Office for Civil Rights (OCR) states: “The HIPAA Rules apply when the information that regulated entities collect through tracking technologies or disclose to tracking technology vendors includes protected health information (PHI).” OCR lists pixels, cookies, session-replay scripts, fingerprinting and mobile identifiers as examples of tracking mechanisms.

For marketers, the question is not simply whether a tag is on a public page. Inventory exactly what leaves the site or app: URL paths, form fields, search terms, account or appointment events, device identifiers, IP addresses, user-entered text and inferred interests. Then identify each recipient and decide whether the information is PHI in context. A tracker attached to an authenticated patient portal, registration flow, appointment workflow or app that handles patient information deserves especially close review.

On June 20, 2024, the U.S. District Court for the Northern District of Texas vacated OCR’s tracking-technology guidance insofar as it treated a connection between an IP address and a visit to certain unauthenticated condition- or provider-related pages as sufficient by itself to trigger HIPAA. HHS says it is evaluating next steps. The order narrowed that specific proposition; it did not declare that tracking tools are outside HIPAA. Because the guidance is legally volatile, check the current OCR page and obtain counsel’s assessment of the particular data flow.

A campaign review workflow for healthcare marketing teams

Use a documented review before an AI-assisted campaign goes live. The record should be understandable to marketing, privacy, security and procurement teams.

  1. Describe the campaign. State the sponsor, objective, audience, channel, message, call to action and whether the communication promotes the organization’s own service or another party’s product.
  2. Classify every data element. Mark direct identifiers, account data, appointment details, free-text inputs, device identifiers and model-derived segments. Explain why each field is needed.
  3. Identify recipients. Include the AI model host, analytics and advertising endpoints, support personnel, cloud storage and subprocessors. Record countries or regions involved when relevant to your broader privacy review.
  4. Check permissions. Determine whether an exception removes the communication from the marketing definition. If not, verify a valid HIPAA authorization before using or disclosing PHI.
  5. Check the contract. If a recipient is a business associate, confirm that a BAA is signed before transmitting PHI and that its permitted-use language matches the implementation.
  6. Minimize and secure. Remove unnecessary fields, restrict role-based access, set retention and deletion rules, disable vendor training or secondary use unless expressly permitted, and protect keys, logs and exports.
  7. Monitor after launch. Review tag changes, model-provider updates, new subprocessors, audience exports, prompt histories and incident alerts. A campaign can change its HIPAA profile when a new integration is enabled.

Common mistakes and how to correct them

“The vendor advertises a HIPAA-ready product, so we are covered.”

Marketing language is not a legal determination. Obtain the vendor’s data-flow description, access controls, retention terms and BAA, then compare them with your configured use. If the vendor cannot access PHI, document why; if it can, treat the relationship accordingly.

“A BAA means we can use patient data for any campaign.”

A BAA permits and governs specified activities; it does not authorize a use that would violate the Privacy Rule. Review the communication’s purpose and any required patient authorization independently.

“We removed names, so the upload is no longer PHI.”

De-identification is a fact-specific process. Removing a name after transmission does not undo the disclosure or answer whether the original dataset was PHI. Design the workflow so unnecessary information never leaves the covered environment.

“The website is public, so tracking is outside HIPAA.”

Public availability alone does not settle the question. Context, the page or event, the identifiers collected and the recipient’s ability to connect information can matter. Apply the OCR bulletin’s data-flow approach and account for the June 2024 court order’s limited scope.

“One consent checkbox handles cookies, email and HIPAA.”

Cookie choices, general privacy consent and HIPAA authorization serve different purposes. Keep records that show which permission covers which activity, and do not rely on a banner to cure a PHI disclosure.

Examples of the decision in practice

Patient-portal symptom assistant

A provider places an AI assistant inside its authenticated portal. Patients enter symptoms, and the assistant proposes reminders and appointment options. The provider is a covered entity if it meets HHS’s electronic-transaction test; the assistant’s operator may be a business associate because it handles PHI on the provider’s behalf. A BAA and safeguards are required for that workflow. If the provider later uses those symptom entries to promote an unrelated company’s product, analyze marketing authorization separately.

Public educational chatbot

A health system offers a general, unauthenticated chatbot that answers broad questions without collecting accounts, appointment details or user-entered health information. The absence of PHI may mean the chatbot provider is not a business associate for that feature. Document the data limits, monitor prompts and integrations, and reassess if the system begins storing conversations or linking them to patient records.

Appointment retargeting campaign

A marketing team sends appointment-page events to an advertising platform to build a retargeting audience. Review the URL, event parameters, identifiers and recipient. If the information is PHI in context, the disclosure may require HIPAA permissions and an appropriate vendor relationship; a cookie banner alone is insufficient. If the data is demonstrably outside PHI, HIPAA may not govern that event, but other privacy and advertising rules still deserve review.

HIPAA is only one part of the compliance analysis

The federal HIPAA framework discussed here does not establish that HIPAA is the only law governing an AI campaign. State consumer-health and privacy statutes, breach-notification requirements, communications laws, professional rules and platform policies may impose additional limits. Their scope varies by jurisdiction and by the type of data and message. Have counsel map those requirements instead of treating a BAA or HIPAA authorization as a universal permission.

For current federal guidance, consult HHS and OCR materials, including the marketing FAQ reviewed January 9, 2023, and the online-tracking bulletin that records the June 20, 2024 court order. Because OCR has said it is evaluating next steps on the tracking guidance, preserve the date of your review and revisit high-risk implementations when the agency updates its position.

Decision checklist

  • Is the organization a covered entity or business associate for this workflow?
  • What exact fields, identifiers, prompts, outputs and logs are transmitted?
  • Can the AI or analytics vendor access, maintain or disclose PHI?
  • Is the communication about the organization’s own service, general health promotion or another party’s product?
  • Does an exception apply, or is an individual authorization required?
  • Is a written BAA in place before the vendor receives PHI?
  • Do tracking tags, SDKs and subprocessors match the approved data flow?
  • Have state and other federal requirements been reviewed separately?
