What Happens When an Air Permit Expires? Renewal, Enforcement, and Public Records

For a U.S. Clean Air Act Title V operating permit, a facility can generally keep operating under its existing permit while a timely, complete renewal application is pending with the permitting authority. Without that qualifying application, expiration ends the right to operate under that permit. The answer can differ for late or incomplete filings and for permits outside Title V, so the permit’s category, terms, jurisdiction, and renewal record matter.

First, identify what kind of air permit it is

“Air permit” can mean several different authorizations. The rules below describe the federal Clean Air Act Title V baseline: most Title V permits are administered by state or local permitting authorities under Part 70, while EPA issues a smaller number under Part 71. Construction permits, state-only operating permits, registrations, and other authorizations can have different expiration and renewal rules.

Start with the permit itself. Find its issuing authority, permit number, category, expiration date, renewal instructions, and any terms governing continued operation. Then check the applicable state, local, tribal, or federal rule. A general Title V explanation is not enough to decide whether a particular facility may operate.

What happens when a Title V air permit expires?

Title V permits generally have terms of no more than five years. Under the federal baseline, a timely and complete renewal application can keep the existing permit effective while the permitting authority processes the renewal. EPA describes the permit as continuing until the authority issues or denies the renewal, provided the required application conditions are met.

If no qualifying renewal application is in place, expiration terminates the permittee’s right to operate under that permit. A renewal application merely being under review does not, by itself, establish that continued operation is authorized: timeliness and completeness are central to the continuation rule.

When must a facility file its renewal?

Use the deadline in the permit and the rule governing that facility, not a generic calendar estimate. EPA’s 2024 Title V FAQ describes a renewal filed at least six months, but no more than 18 months, before expiration. EPA’s April 2026 renewal guidance says applicants must apply at least six months before expiration. The applicable approved state rule or permit may set an earlier deadline.

For example, Oklahoma’s EPA-hosted Part 70 rule requires a timely and complete renewal application at least 180 days before expiration. That is a jurisdiction-specific example, not a universal deadline.

Check these dates and status points

  • Expiration date: Use the date printed in the current permit, and verify whether an amended permit or other agency action changed it.
  • Filing date: Compare the submission date with the actual renewal window and any earlier deadline in the governing rule.
  • Completeness: Determine whether the authority found the application complete, or whether required material remains outstanding.
  • Information requests: Check for written agency requests and meet the stated response deadline. Missing that deadline can affect continuation protection.
  • Agency action: Establish whether the authority has issued or denied the renewal, or is still processing it.

What makes a renewal application complete?

A renewal must contain enough information for the authority to process it and determine compliance with applicable requirements. EPA’s April 2026 guidance identifies application information such as regulated-pollutant emissions, emission points, emission rates, and limits. The authority may request supplemental information needed to determine which requirements apply or to assure compliance.

If permit terms and underlying requirements have not changed, an authority may allow the applicant to reuse or incorporate unchanged information from the prior application. That does not remove the authority’s ability to request updates or supporting material. Any documents incorporated by reference must also be available for public review.

Can a plant keep operating after its permit expires?

The key distinction is whether a qualifying renewal was filed and remains pending. EPA’s Part 71 permit example states that a timely and complete renewal application keeps the permit effective until EPA issues or denies the renewal. It also says that, under the cited Part 71 provisions, failure to have a Part 71 permit is not a violation of that part until EPA takes final action—unless the permittee fails to provide information EPA requested in writing by its deadline.

Those specific terms concern Part 71 and should not be assumed to govern a Part 70, state-only, construction, or other authorization. If a facility has no applicable continuation protection, operating after expiration may amount to operating without the required authorization. The specific legal and enforcement consequences depend on the permit type, governing statute and rules, and facts.

EPA materials establish that permit noncompliance can be grounds for enforcement, but they do not establish one penalty amount or outcome for every expired permit. Do not infer a particular fine, shutdown, or enforcement result from the expiration date alone. When operation is at stake, confirm the status directly with the issuing authority and seek qualified permitting or legal advice.

How do I find an air permit or renewal application?

EPA’s public participation materials identify permit records for participating jurisdictions and actions, including applications, draft permits, final permits, and related documents. Online availability is not uniform across every agency or older file. If a record is not posted, ask the issuing authority about its public-records process.

  1. Identify the facility name, location, and permit number, if known.
  2. Find the issuing state, local, tribal, or EPA permitting authority and confirm the permit category.
  3. Search the authority’s permit records or request the current permit, prior permit, renewal application, completeness correspondence, draft permit, public comments, final action, and compliance certifications or reports.
  4. Compare the permit expiration date with the renewal filing date and the authority’s completeness and action records.

How can the public participate or report a concern?

Title V renewals follow the same procedural requirements as initial permit issuance, including public participation. Depending on the authority and action, the public may be able to comment on a draft permit, request a public hearing, appeal a Part 70 permit in state court, or petition EPA to object to a state-issued permit.

For a Title V petition, EPA generally requires the petitioner to have raised the issue with the permitting authority during the public notice-and-comment period, unless doing so was impracticable. EPA’s Title V Petitions page describes a 45-day EPA review of a proposed state permit, followed—if EPA does not object during that review—by a 60-day period for public petitions. These are permit-review and petition periods, not renewal deadlines. Check the current action-specific deadline and submission instructions; EPA says the CDX timestamp is used to determine timeliness.

Choose the channel based on the concern:

  • Concern about permit legality or terms: Use the applicable comment, appeal, or petition process and follow its deadlines.
  • Suspected failure to comply with permit terms: EPA directs the public to report the concern through ECHO. A compliance report is not a substitute for a permit-content petition.
