For the seven EDF-owned Advanced Gas-cooled Reactor (AGR) stations, transfer for decommissioning happens only after electricity generation has ended, spent fuel has been removed, and the site has passed fuel-free verification. Ownership then moves into the Nuclear Decommissioning Authority (NDA) group. Its subsidiary, Nuclear Restoration Services (NRS), becomes the licensed site operator and leads the long programme of safe management, dismantling and remediation.
The change is not an overnight shutdown and it is not simply a change of company name. The outgoing operator remains responsible while the station is defueled and prepared; the Office for Nuclear Regulation (ONR) must separately approve the new corporate licensee; and maintenance, environmental controls and regulatory oversight continue for years after the handover.

Which UK stations does this process describe?
This sequence is the current arrangement for seven EDF-owned AGR stations. It should not be treated as a universal template for every UK nuclear site. Historic Magnox stations and other facilities have different histories, ownership arrangements, fuel conditions, regulators and end-state plans.

What happens before the handover?
Generation ends, but the station remains an operating nuclear site
Stopping electricity generation is the starting point, not the transfer itself. After a reactor closes, the outgoing operator still has responsibility for the site, its safety systems, its workforce and the spent fuel remaining in the reactors and storage ponds. Under the revised AGR arrangement, EDF remains the site licensee, controlling mind and strategic authority until the formal transfer.
That period allows the operator to complete the specialist work needed to make the site ready for a different phase of its life. The regulator continues to apply the nuclear site licence and its conditions while this preparation takes place.
Spent fuel is removed and cooled
EDF describes the AGR defueling sequence as removing fuel from reactor channels, placing it in ponds for cooling, packaging it in transport flasks and sending it to Sellafield for further cooling and storage. Government planning describes transfer as following both defueling and verification that the station is fuel-free.
The fuel operation is substantial. EDF says each reactor has around 300 fuel channels, that fuel is cooled in a pond for a minimum of 90 days before it is packaged for transport, and that around 400 spent-fuel flasks are shipped from each EDF site. EDF also gives three to five years as the expected defueling period per site. These are fleet-level explanatory figures from EDF; they are not independently verified measurements for every station, and the source does not state a publication year.

Fuel-free verification establishes readiness
Fuel-free verification is a formal readiness condition rather than a casual visual check. It provides the basis for confirming that the transfer arrangement is being applied to a site whose spent reactor fuel has been removed. Until that preparation is complete, the outgoing operator remains responsible under the existing arrangements.
How ownership and the nuclear licence change
Ownership transfer and licensing are separate legal steps
A central point is that ownership does not equal a nuclear site licence. Section 38 of the Energy Act 2004 makes clear that a nuclear transfer scheme does not itself transfer a nuclear site licence. The corporate body that is legally responsible for operating the licensed site must be approved separately by ONR.
In the AGR programme, the government arrangement provides for the station to transfer to the NDA. NRS, an NDA subsidiary, then becomes the site licensee and permit holder. The transfer therefore changes both the organisation that owns the site and the organisation that holds the permissions needed to control it, but those changes take effect through the required legal and regulatory process.

ONR assesses the incoming licensee
ONR grants nuclear site licences to corporate bodies and attaches conditions that apply across the site’s lifecycle, including decommissioning. Before a licensee change, ONR assesses whether the proposed organisation has the capability and competence to take responsibility.

For Hinkley Point B, ONR’s assessment supported NRS becoming the licensee on 1 October 2026. In its announcement that day, ONR said: It is vital for the continued safety of the workforce and the public that nuclear facilities no longer generating energy are adequately maintained and that decommissioning and dismantling is progressed in a timely manner.
The announcement also reported ONR’s conclusion that NRS demonstrated the necessary capability and competence to hold the licence.
Who is responsible at each stage?
| Organisation | Responsibility in the AGR transfer |
|---|---|
| EDF Energy | Remains site licensee and strategic authority before transfer; completes defueling and prepares the station for handover. |
| Nuclear Decommissioning Authority (NDA) | Takes ownership and responsibility for decommissioning once the station transfers under the AGR arrangements. |
| Nuclear Restoration Services (NRS) | NDA subsidiary that becomes site licensee and permit holder and leads post-transfer decommissioning. |
| Office for Nuclear Regulation (ONR) | Assesses and grants nuclear site licences and approves the incoming licensee’s competence and capability. |
| Environmental regulator | Controls environmental permitting for the relevant nation and site; NRS is identified as permit holder after transfer under the NDA strategy. |
| Nuclear Liabilities Fund (NLF) | Under the revised AGR arrangements, meets qualifying EDF decommissioning costs on a cost-pass-through basis. |
The exact environmental regulator and permit conditions depend on the nation and site. They should be checked for the particular station rather than assumed from the Hinkley Point B arrangement.
What NRS does after transfer
Safe management continues
The handover marks a change in responsible organisations, not the end of nuclear work. ONR states that facilities which no longer generate electricity still need adequate maintenance and timely decommissioning and dismantling. NRS therefore takes over the licensed responsibility for keeping the site safe while the decommissioning programme proceeds.
Licence conditions continue to cover lifecycle safety controls. That means the transferred station remains subject to regulatory requirements for maintaining relevant systems, managing hazards, controlling work and demonstrating that activities can be carried out safely. The station may no longer be producing power, but it has not become an unregulated industrial site.

Decommissioning is a programme, not a single event
After the licence change, NRS leads the work programme associated with decommissioning. In practical terms, that includes continued care of the facilities, dismantling work and eventual remediation under the applicable nuclear and environmental permissions. The handover does not establish one universal timetable or one identical sequence for all seven AGR stations; their conditions and readiness dates differ.
Work is planned around the hazards and assets that remain at each site. Fuel status is a major dividing line: the transfer arrangement assumes defueling and fuel-free verification first, while later work is carried out under NRS’s licence and the conditions imposed by ONR and the environmental regulator.

A transfer has to account for more than the reactor buildings. Land, facilities, infrastructure, equipment and other assets need defined responsibilities before, during and after decommissioning. NDA interface agreements set out how those responsibilities are managed across the transition and through remediation.

That does not amount to a single final land-use promise for every station. Whether a particular parcel remains under controls, is released for another purpose or follows a different end state depends on the site’s plans, regulatory decisions and the condition of its assets.

How is the work funded?
The revised AGR arrangement provides a specific funding mechanism: the Nuclear Liabilities Fund meets qualifying EDF decommissioning costs on a cost-pass-through basis. This description applies to the qualifying costs covered by that AGR agreement. It should not be extended automatically to every UK nuclear decommissioning project, whose funding terms may be different.
When will the other AGR stations transfer?
The seven stations are intended to move on a rolling programme rather than on one national handover date. The NDA’s current strategy says it is preparing to take on the seven AGR stations, while the 2025–28 business plan describes transfers over the next decade after defueling and fuel-free verification.
Hinkley Point B’s completed handover on 1 October 2026 is the established date in the current regulator announcement. Dates for the remaining stations should be checked individually. A station’s closure date alone does not prove that its fuel has been removed, that fuel-free verification has passed or that ONR has approved a new licensee.
What the transfer does not mean
- It does not mean the site is immediately dismantled. Decommissioning and dismantling continue under NRS after the licence change.
- It does not mean regulation ends. ONR licence conditions and environmental permits continue to govern the site.
- It does not mean ownership automatically changes the licence. The Energy Act 2004 requires the licence position to be dealt with separately.
- It does not mean spent fuel remains at the station by default. For the AGR transfer arrangement, EDF is responsible for removing the fuel and the transfer follows fuel-free verification.
- It does not establish one final land use. The NDA strategy provides for institutional controls, but not a universal end state for every station.
- It does not prove that other nuclear sites follow the same funding or organisational model. The NLF cost-pass-through description is specific to the revised AGR arrangements.
How to understand a transfer at another UK station
When a future announcement concerns a different station, six questions reveal what has actually changed:
- Which reactor and site programme is involved? Identify whether it is an AGR, a historic Magnox site or another type of facility.
- What is the fuel status? Check whether defueling is complete and whether fuel-free verification has been reported.
- Who owns the site after the transaction? Ownership may move to the NDA or another body under a different arrangement.
- Who holds the nuclear site licence? Look for a separate ONR decision naming the incoming corporate licensee.
- Who holds environmental permits? The relevant regulator and permit holder can vary by nation and site.
- What funding agreement applies? Do not infer NLF coverage or cost terms from the AGR programme unless the announcement says so.
Using those questions prevents a common mistake: treating a commercial or governmental ownership announcement as proof that regulatory control, fuel removal and decommissioning responsibility have all moved on the same day.
The clearest example so far: Hinkley Point B
Hinkley Point B illustrates the complete logic of the arrangement. The station stopped generating in 2022. Both reactors were defueled. EDF remained responsible while the site was prepared. ONR then assessed the proposed incoming licensee, and NRS assumed site-licensee responsibility on 1 October 2026. From that point, NRS leads decommissioning within the NDA group while ONR and the environmental regulator continue their oversight.
That example shows why “transferred for decommissioning” describes a controlled change of responsibility rather than a finished project. The physical site, its remaining assets and its regulatory obligations continue into the next phase.
