If a U.S. importer uses the wrong tariff classification or reports too little dutiable value, CBP can demand the unpaid duties and, depending on the facts, assess civil penalties under 19 U.S.C. § 1592. The result is not automatic or uniform: CBP looks at the revenue loss, the importer’s level of care or intent, the entry’s liquidation status, the records available, and whether the importer disclosed the problem before learning of a formal investigation. A customs broker can prepare filings, but the importer remains ultimately responsible for compliance.
What happens if I classified my imports incorrectly?
CBP generally starts with the entry itself. If the classification produced a duty rate that was too low, the importer may owe the difference between the duty that should have been paid and the amount deposited. CBP can also examine whether the error resulted from negligence, gross negligence, or fraud. Those findings determine whether a civil penalty is added under 19 U.S.C. § 1592.

An incorrect code is not automatically fraud. A good-faith mistake supported by a reasonable classification analysis is materially different from knowingly using a false description or ignoring information showing that a higher-duty provision applies. The same tariff mistake can therefore produce very different outcomes for two importers with different records and conduct.
CBP may address an error while an entry is still being processed, during an audit or investigation, or after liquidation. Liquidation is the agency’s final computation of duties for an entry unless a lawful correction, protest, reliquidation, or other procedure changes it. Because the available remedies and deadlines depend on that procedural posture, an importer should determine the status of every affected entry immediately.

Can CBP make me pay back duties?
Yes. If CBP determines that the correct classification, value, origin, or other entry element required more duty, it can collect the shortfall. The amount can include the unpaid duty and applicable interest. A demand for money is separate from a civil penalty; an importer may owe both.
CBP can also review entries that were not identified by the importer. A notice, audit request, focused assessment, or other inquiry may ask for invoices, product specifications, purchase orders, classification work, broker communications, and entry records. Failing to produce reliable records can make it harder to show that the importer exercised reasonable care.
Will I get fined if I underpaid customs duties?
A penalty is possible, but the amount depends on culpability and the circumstances. CBP’s Customs Administrative Enforcement Process Informed Compliance Publication, issued in February 2004, describes historical ranges for section 1592 violations. Those figures are useful for understanding the framework, not for predicting a current case or calculating a settlement.

| CBP’s historical category | Revenue-loss case: multiple of total duty loss | Non-revenue-loss case: percentage of dutiable value | Important qualification |
|---|---|---|---|
| Fraud | 5 to 8 times the duty loss | 50% to 80% | Ranges published by CBP in 2004 and subject to the publication’s stated cap. |
| Gross negligence | 2.5 to 4 times the duty loss | 25% to 40% | Historical guidance only; the facts and current law control. |
| Negligence | 0.5 to 2 times the duty loss | 5% to 20% | Historical guidance only; not an individualized estimate. |
“Duty loss” means the revenue CBP says it should have collected. In a non-revenue-loss matter, the historical guide used dutiable value as the reference point. The publication also describes a statutory cap and different treatment for prior disclosures, interest, and fraud. Because the guide is dated, an importer should not present these multipliers as the current amount CBP must impose.

How CBP decides whether an error was negligent, grossly negligent, or fraudulent
Negligence
Negligence generally involves failing to use the reasonable care expected in importing. Examples could include relying on an old classification after a product was redesigned, failing to review a broker’s entry data, or using a vague description that did not support the selected tariff provision. A documented, reasonable process can be important even when the final classification proves wrong.
Gross negligence
Gross negligence reflects a more serious departure from reasonable care. Repeated errors after warnings, ignoring clear product information, or failing to maintain basic import controls can move a matter beyond an ordinary mistake. CBP evaluates the complete record rather than applying a simple “number of errors” test.
Fraud
Fraud involves intentional deception or a deliberate act designed to evade the lawful duties or requirements. A false commercial description, manipulated invoice, or intentional use of a known incorrect code can create substantially greater exposure than an accidental coding error. The government must establish the facts supporting its allegation; an importer should obtain legal advice before making statements about intent.

What factors change the outcome?
- Whether duty was actually lost: A classification error that changes the duty rate is different from an error that does not affect revenue.
- Quality of the product record: Specifications, drawings, composition data, photographs, purchase orders, and prior rulings can show what the goods were and why a code was selected.
- Reasonable-care process: Written classification instructions, review sign-offs, periodic audits, and escalation of uncertain products help demonstrate care.
- Entry status: An unliquidated entry may have different correction options from an entry that CBP has already liquidated.
- Timing: A disclosure made before, or without knowledge of, the commencement of a formal investigation may receive more favorable treatment than a disclosure after an investigation is known.
- Notice or investigation: A request for records, summons, audit, or other CBP action can affect what disclosure mechanisms remain available.
Does using a customs broker protect me?
No. CBP states that an importer is not legally required to hire a customs broker. A broker may prepare entry paperwork and transmit data, but CBP’s February 13, 2026 guidance says: “The importer is always ultimately responsible for knowing CBP requirements and for ensuring their importation complies with all federal rules and regulations.”

That responsibility means the importer should give the broker complete and accurate product information, review the classifications used for important products, approve power-of-attorney arrangements, and investigate discrepancies. A broker’s involvement can support a reasonable-care program, but it does not transfer the importer’s legal duties or guarantee that CBP will accept a classification.
What should I do after finding a possible underpayment?
Acting quickly preserves options, but do not send an improvised admission or file a one-size-fits-all form before understanding the entries and the procedural posture. A practical first response is:
- Preserve the record. Collect entry summaries, commercial invoices, purchase orders, packing lists, product specifications, laboratory or composition information, catalogs, classification analyses, broker emails, duty calculations, and all CBP notices. Preserve the versions that were available when each entry was filed.
- Define the affected population. List the products, tariff numbers, import dates, ports, manufacturers, and entries that may share the error. Separate a one-off shipment from a classification used across many entries.
- Check liquidation status. Identify whether each entry is unliquidated, liquidated, protested, under review, or covered by a CBP inquiry. Record the relevant dates; a correction mechanism that applies to one status may not apply to another.
- Recalculate cautiously. Estimate the possible duty difference by entry and product, but label assumptions such as value, origin, exchange rate, exclusions, and trade-program eligibility. A preliminary estimate is not the penalty amount.
- Notify the broker and obtain independent advice. Ask the broker to secure entry data and stop repeating a suspect code. Consult qualified customs counsel or an experienced customs professional about disclosure, protest, reliquidation, and penalty exposure.
- Choose a procedure based on the facts. Depending on timing and what CBP knows, the appropriate action might involve an entry correction, a protest, a request concerning liquidation, a prior disclosure, or a response to an existing investigation. The sources do not establish one universal remedy or deadline.
Can I correct an import entry after discovering a mistake?
Sometimes, but the answer depends on the entry’s status and the specific error. An unliquidated entry may have correction avenues that are unavailable after liquidation. A liquidated entry can raise protest and reliquidation issues, each with technical requirements and deadlines. Do not assume that paying an additional amount informally fixes every legal or recordkeeping issue.
CBP CROSS Ruling 962007 discusses voluntary reliquidation within 90 days in its particular procedural context. That example shows why liquidation timing matters; it is not a universal 90-day cure for classification or duty errors. A professional reviewing the actual entry history must determine whether that or another mechanism applies.

What is a prior disclosure?
CBP’s historical enforcement guidance says a prior disclosure made before, or without knowledge of, the commencement of a formal investigation can substantially reduce penalties in qualifying circumstances. The guide describes separate historical treatment for negligence, gross negligence, and fraud, including interest or reduced-penalty provisions under conditions it specifies.
Eligibility and effect are fact-specific. The importer must consider what it knew, what CBP had already done, the completeness and timing of the disclosure, the entries covered, and whether the submission accurately explains the conduct and revenue impact. A disclosure made after an investigation is known may not receive the same treatment. Do not promise that a disclosure will be accepted or that it will eliminate duties, interest, or penalties.
How can an importer prevent a repeat error?
Build a product classification file
For each recurring product, keep a plain-language description, materials and composition, function, technical specifications, photographs, dimensions, manufacturing process, country of origin, supplier information, and the reasoning for the selected tariff provision. Update the file when the design, materials, packaging, or use changes.

CBP’s Binding Ruling Program lets an importer or another interested party request a classification decision before importing and filing entries. CBP describes classification rulings as binding, while stating that duty rates are not binding. The request must present complete and accurate facts; a ruling applies to the facts submitted, so an incomplete description can undermine its usefulness.

Review broker data
Set a review schedule for high-volume or high-duty products. Compare broker entry data with purchase orders and specifications, investigate changes in tariff numbers, and document who approved the classification. Escalate products that combine materials, have multiple functions, or could fit more than one heading.
Improve cargo descriptions
In guidance published February 13, 2026, CBP said cargo descriptions should be clear, use plain language, and provide enough detail to identify the commodity’s size, shape, and characteristics. CBP described a precise commodity description as “clear and concise.” A better description supports classification review, but a description alone does not determine the legally correct tariff provision.
Three practical examples
| Situation | Likely issues to analyze |
|---|---|
| A new product is entered under a code copied from an older model, and the importer discovers the material changed. | Whether the change altered classification or duty, what the importer knew when entries were filed, the number and status of affected entries, and whether the control process showed reasonable care. |
| A broker selected a code after receiving only a generic description such as “parts,” while the importer had detailed specifications. | The importer’s ultimate responsibility, the information supplied to the broker, the adequacy of the description, and whether the omission caused a duty loss. |
| CBP sends an inquiry before the importer reports a suspected error. | Whether a formal investigation has commenced or is known, whether a prior disclosure remains available, and how to respond without creating inconsistent or incomplete statements. |
Questions to ask before contacting CBP
- Which exact products and entries may be affected?
- What classification, value, origin, or other data element was wrong?
- Was duty actually underpaid, and how was the estimate calculated?
- Which entries are liquidated, and on what dates?
- Has CBP sent a notice, requested records, audited the company, or otherwise indicated an investigation?
- What documents show the importer’s classification process and communications with its broker?
- Has the same issue appeared in prior rulings, internal reviews, or supplier documents?
Bottom line
An importer that misclassifies goods or underpays customs duties may owe the shortfall, interest, and a civil penalty whose severity turns on negligence, gross negligence, or fraud. Historical CBP ranges illustrate the possible scale but are not a current case quote. The safest response is to preserve records, map affected entries and liquidation dates, stop repeating the error, and obtain prompt advice on the correction or disclosure route that fits the facts. Using a broker helps with execution; it does not remove the importer’s responsibility.
