Usually, nothing happens automatically. An exchange cannot sell crypto merely because you hold it at a different platform or because you defaulted on a separate loan. The result depends on the contracts you signed, whether you granted a pledge or security interest, who controls the account and private keys, whether the outside custodian agreed to honor a lender’s instructions, and which jurisdiction’s law governs.
If those arrangements give the lender enforceable rights and a practical way to reach the assets, the collateral may be frozen, transferred or sold after a defined default. If the lender has only a claim against you and no control agreement with the other platform, it may need that custodian’s cooperation or a court or insolvency process. Rehypothecation and custodian failure can add further claims and delays.

The short answer: a balance on another exchange is not automatically available
Crypto collateral is controlled through legal rights and operational access, not through a universal industry rule. A lender may have a contractual right to assets that are recorded at another platform, but that right does not by itself give the lender login credentials, transaction authority or the ability to compel the custodian to act immediately.
Three separate questions must be answered in any real case:

- [Deep Bass with Clear Vocals] High-performance drivers produce punchy bass while keeping vocals clean and detailed for everyday listening.
- Did you grant an enforceable interest? The margin, credit or pledge agreement may cover particular coins, a value amount, a margin account, affiliated accounts or property held by an agent.
- Who can issue instructions? A separate exchange or custodian may have agreed to follow a secured party’s directions after a default, or it may recognize only the customer’s instructions and its own legal process.
- Can the assets actually be realized? On-chain coins require control of keys or an authorized transaction process. An off-chain exchange balance depends on the platform’s records, withdrawal controls and contractual duties.
A lender that cannot establish both legal authority and a workable route to control may have to seek cooperation from the other platform or pursue litigation, arbitration or an insolvency claim. The answer cannot be determined from the on-screen balance alone.
Four contract and custody features decide the outcome
Read the lending agreement, the outside platform’s custody terms and any tri-party or account-control document together. Compare them on these four axes:
| Issue | What to look for | Why it matters after default |
|---|---|---|
| Collateral grant and scope | Definitions of collateral, security interest, pledge, lien, set-off, margin account and property held by agents or affiliates | A broad grant may cover more than the assets originally deposited, while a narrow grant may be limited to a named account or asset type. |
| Control and instruction rights | Who may freeze, transfer, sell or withdraw; whether an account-control agreement becomes effective on a specified default; notice and authorization requirements | A lender may hold a valid claim but still lack an operational path to move assets held by an independent custodian. |
| Segregation and reuse | Whether assets are held for the customer, pooled, lent onward, staked, rehypothecated or commingled | Reuse can create borrowers and secured creditors between you and the coins, making a specific-asset recovery more difficult. |
| Governing law and insolvency treatment | Choice of law, venue, enforcement rules, customer-property provisions and treatment if a custodian fails | Liquidation rights and ownership priorities differ across jurisdictions, and a foreign custodian can create conflicts-of-law issues. |
None of these provisions should be inferred from a product name such as “cross margin.” Cross margin can describe only the balances inside one venue’s own risk engine.

How a cross-platform liquidation would work
A conventional margin liquidation follows an agreed trigger and remedy. A cross-platform case adds a second institution whose records and controls must be reconciled. The usual sequence is:

- A trigger occurs. The account falls below a maintenance-margin level, a payment is missed, another default occurs or the agreement’s insolvency clause is activated. The exact trigger and cure period come from the credit agreement.
- The lender calculates the secured amount. It applies the contract’s valuation, haircuts, interest, fees and permitted set-off. A lender may be entitled to sell only enough collateral to cover the secured obligation, unless the agreement allows broader action.
- The lender asserts control rights. If an account-control or tri-party agreement exists, the lender sends the specified notice or instruction to the outside custodian. The custodian may require proof of default, a waiting period, dual authorization or a court order.
- The custodian freezes or transfers the position. For an exchange balance, this may mean disabling withdrawals, moving coins to a controlled account or placing a sell order. For self-custodied assets, the party controlling the private keys must sign the transaction.
- The assets are sold or applied. Sale price, trading liquidity, fees and timing affect the amount recovered. A volatile market can leave a deficiency even when the lender acted within the agreement.
- Any surplus or deficiency is reconciled. The contract and local law determine whether excess proceeds return to the customer and whether the customer remains liable for a shortfall.
Without a pre-agreed instruction mechanism, the lender may be unable to progress beyond step two without legal process. A court order may still be ineffective if the custodian is in another country, the assets were already transferred or the relevant keys cannot be identified.
Legal entitlement and technical ability are different
A contract can say that a lender has a security interest in assets held by an agent or affiliate, yet the lender may not have direct access to an unrelated exchange. Conversely, a custodian might technically be able to transfer coins but lack legal authority to do so without the customer’s instruction, a valid control agreement or an order from a competent authority.
On-chain ownership is represented by control of a blockchain address, but an exchange customer commonly owns a contractual claim to a balance in the platform’s ledger rather than a separately identifiable coin. The platform’s terms, internal records and applicable property law determine whether that claim is treated as custody property, a debt, a trust interest or collateral. A hardware wallet does not cancel a pledge, change governing law or give a lender access to keys it does not control.
New York State Department of Financial Services guidance issued on 30 September 2025 addresses sub-custody disclosure and recommends that covered customer assets not be used for a custodian’s proprietary obligations. Such guidance is relevant to providers within its scope; it is not a universal rule for every exchange or country.

What named platform rules demonstrate—and what they do not
Individual terms illustrate why the exact product and version matter. They cannot be turned into a rule for all exchanges.
Coinbase User Margin Trading Agreement
That agreement describes the customer granting a security interest over the margin account and other accounts maintained by its agent or affiliates. It also describes possible sale or transfer of assets held by those parties or pledged as collateral. Those are the remedies in that named agreement; they do not establish that an unrelated platform must surrender a customer’s assets.
BitMEX exchange rules
BitMEX describes cross margin using the available balance in the corresponding margin currency and liquidation by its trading-platform liquidation engine. This is a venue-local margin pool. It is not evidence that the engine can reach coins held at another exchange.

Coinbase International Exchange leverage policy
Its policy describes cross collateral and portfolio liquidation under that exchange’s own risk framework. “Cross collateral” in this context concerns the assets recognized by that platform’s policy, not every asset a customer holds elsewhere.
Rehypothecation can create a chain of competing claims
Rehypothecation is the reuse of collateral that was already provided—for example, lending it onward or pledging it to another secured party. UNIDROIT’s 2021 study describes rehypothecation as an established industry practice and examines crypto-backed loans and liquidation mechanisms. That establishes a structural risk, not a claim that every account permits reuse.
If reuse is authorized, the original customer may sit behind several borrowers, custodians and creditors. An exchange could have lent the coins to another institution, placed them in an omnibus wallet or mixed them with other customers’ assets. Oxford Business Law and Finance’s June 2023 analysis notes that omnibus custody, commingling and a third party’s right to reuse cryptoassets can complicate whether a customer can claim particular coins if a custodian enters bankruptcy. That analysis is not a court ruling and cannot predict the result in every jurisdiction.

Practical consequences include delayed withdrawals, substitution of equivalent value rather than return of the same units, competing secured claims and a recovery measured as an unsecured debt. The governing documents and local insolvency law decide which of those outcomes applies.

Liquidation is not the same as custodian insolvency
Liquidation asks whether a lender may use an agreed or legally available remedy after a default. Insolvency asks whether a failed custodian’s customers can recover assets outside the custodian’s estate. The two events can occur together but require different analysis.
For covered providers and services, Article 75 of Regulation (EU) 2023/1114 (MiCA) requires a custody agreement, position records, safeguarding procedures, segregation and return procedures. It also provides for legal segregation from the provider’s estate in accordance with applicable law. MiCA applies within its defined scope; it does not resolve every conflict-of-laws question or govern platforms outside that scope.
FINMA’s 12 January 2026 announcement on risks associated with custody of crypto-based assets similarly highlights cross-border custody and custodian insolvency. It emphasizes that customer assets should not become part of a custodian’s bankruptcy assets, but the actual result still depends on the custody structure and law governing the account.

A ledger entry labeled “your balance” does not conclusively establish priority, and a contractual promise to segregate may be tested against local property and insolvency rules.
Possible outcomes in common arrangements
| Arrangement | Likely practical result after a default | Main uncertainty |
|---|---|---|
| One exchange holds collateral in its own margin account and controls the keys | The platform’s liquidation engine may freeze and sell according to its terms. | Whether the trigger, valuation and sale complied with the agreement and law. |
| A separate custodian signed an account-control agreement | The lender may instruct the custodian after satisfying the stated default conditions. | Notice, cure periods, authentication and the custodian’s jurisdiction. |
| The lender has only a pledge against the customer, with no custodian agreement | The lender may demand payment or seek a court or arbitral order rather than directly sell the outside balance. | Recognition and enforcement where the custodian and assets are located. |
| Collateral was rehypothecated or commingled | Recovery may involve tracing, substitution or an insolvency claim instead of immediate return of specific coins. | Records, segregation, competing claims and applicable insolvency law. |
| The outside platform itself becomes insolvent | Customer assets may be returned outside the estate if legally segregated, or the customer may receive a claim in the proceeding. | Custody characterization, governing law and the platform’s actual records. |
Documents to collect before disputing a liquidation
Download the versions that applied when the collateral was posted, not only the current website terms. Preserve notices, account statements, transaction IDs and communications showing who gave instructions.
- Exchange margin or credit agreement: collateral definition, default triggers, valuation, sale rights, set-off, liability for a shortfall and language covering other accounts or affiliate-held property.
- Outside platform custody terms: whether the platform holds assets for you, can freeze or transfer them, recognizes third-party instructions and describes segregation or reuse.
- Account-control, pledge or tri-party agreement: the controlling party after default, required notices, authentication, cure periods and permitted transactions.
- Reuse provisions: permission for lending, staking, rehypothecation, omnibus holding or commingling, plus any right to substitute equivalent assets.
- Legal provisions: governing law, forum, arbitration, service-of-process clauses and insolvency treatment for each entity and account.
This checklist identifies the issues to investigate; it does not establish that a particular liquidation was lawful or that assets are recoverable.
What to do when a liquidation notice arrives
- Do not assume the notice proves control. Ask which agreement, account and default trigger the exchange relies on.
- Request an itemized calculation. Obtain the collateral valuation time, prices, haircuts, fees, interest, quantity sold and any remaining deficiency.
- Notify the outside custodian promptly. Ask whether it received an instruction, freeze request, court order or competing claim, and request the contractual basis for any restriction.
- Preserve evidence. Export ledgers, wallet addresses, order history, margin notices, terms versions and support tickets before an account is closed or data becomes unavailable.
- Check jurisdiction and deadlines. A contract may impose a short objection period, arbitration requirement or forum that differs from the place where you live.
- Get advice from a lawyer experienced in secured transactions and digital-asset custody. Cross-border enforcement and insolvency priorities are fact-specific; a general trading dispute analysis may miss control and property issues.
Common misconceptions
- “Default lets an exchange take crypto anywhere.” No. The lender needs an enforceable right and a lawful, practical route to the assets.
- “Cross margin means cross-platform collateral.” Usually no. Venue rules commonly refer to balances inside that venue’s own margin system.
- “The app shows my coins, so I own specific coins.” Not necessarily. The legal characterization may be a custody interest or contractual claim, especially in an omnibus structure.
- “Segregation guarantees immediate recovery.” Segregation improves the customer’s position, but the governing law and records determine whether it keeps assets outside an insolvency estate.
- “Rehypothecation is always illegal.” No. It may be permitted, restricted or prohibited by the account terms and applicable regulation; the risk is that reuse adds parties and competing claims.
Bottom line
An exchange can liquidate collateral held on another platform only when the documents and law give it that right and provide a workable enforcement path. A pledge without custodian control may lead to a demand or court process rather than an instant sale. Account-control agreements, segregation, reuse permissions, governing law and insolvency rules determine whether the lender can freeze, transfer or sell the assets—and whether any surplus or recovery reaches the customer.
