In the UK, a mobile provider can change contract terms, but a change that disadvantages you will usually require at least one month’s notice and a penalty-free opportunity to leave. That protection is not automatic for every price or data change. The result depends on the contract wording, when you signed it, what exactly changed, and whether the change was already disclosed, beneficial, administrative or required by law.
Price-rise rules are stricter for contracts entered from 17 January 2025. New agreements cannot use inflation-linked or percentage-based mid-contract increases; any planned increase must be stated in pounds and pence with its effective date. Older agreements may still contain CPI-, RPI- or other percentage-linked clauses.

Start with the contract, not the notification
Before deciding whether you can cancel, find the contract summary and full terms you accepted. Ofcom says providers should give a written summary of key information before you agree and fuller contract information before you become bound. Check five details:
Do these 3 things before closing this tab:
1Repair Windows errors before they cause bigger problems2Scan for outdated or missing drivers - takes under a minute3Clear out junk files and repair common Windows errors- the date the contract started;
- the monthly charge and whether it excludes handset repayments or other add-ons;
- the data allowance, speed limits and any fair-use conditions;
- any scheduled price or allowance changes written into the agreement; and
- the cancellation process and charges for leaving early.
A provider relying on a clearly written, agreed adjustment is in a different position from one introducing a new increase or exceeding the amount stated at sign-up. Keep the original documents and the message announcing the change; the wording and dates can determine your rights.

Which situation are you in?
| Question | Why it matters |
|---|---|
| Was the contract signed before or from 17 January 2025? | From 17 January 2025, new contracts cannot contain inflation-linked or percentage-based mid-contract rises. Older contracts are not changed retroactively. |
| Was the change stated at sign-up? | A clearly specified amount and date may be enforceable under the existing agreement. An unstated increase, or one larger than promised, can trigger notice and exit protections. |
| Is it a price change, a non-price term change or an allowance change? | Ofcom’s price guidance deals specifically with increases. A data reduction must be assessed under the general terms-change framework; there is no universal automatic cancellation rule for every allowance adjustment. |
| Does the change help you, have no negative effect, or result from legislation? | Ofcom identifies exceptions for changes exclusively benefiting the customer, harmless administrative changes and changes directly imposed by law. |
| Did the provider give adequate notice and explain an exit route? | Missing or inadequate notice can support a complaint and, where the rules apply, a penalty-free exit. |
How price increases work
When the increase was specified
If your agreement clearly states the amount of an increase and when it will take effect, the provider may apply that adjustment according to the clause. Read the exact unit: a fixed pound amount, a percentage, an inflation index and a change to a recurring charge do not mean the same thing. A clause that says only “prices may change” may not provide the same certainty as a specific amount and date.
When the increase is new or larger than agreed
Ofcom’s consumer guidance says that if the contract does not set out the increase, or the provider raises the price by more than it specified, the provider must give at least 30 days’ notice and a 30-day opportunity to leave without an early-termination penalty. Its broader contracts guidance describes this as at least one month’s notice and a penalty-free right to exit when a change does not benefit the customer.
The notice period is not the same as permission to backdate a charge. Check the effective date against the date you received the communication and ask the provider to correct any bill that applies the increase early. If the provider says the rise was already agreed, request the precise clause and calculation in writing.

Why the contract date matters
Contracts from 17 January 2025
For new contracts entered from 17 January 2025, providers cannot include inflation-linked or percentage-based mid-contract price rises. If an increase is planned, the agreement must state it clearly in pounds and pence, show when it will happen and present the information prominently and transparently. The rule is about new contracts from that date, not every plan currently in service.

Contracts signed before 17 January 2025
An older plan may still contain a valid inflation-linked or percentage-based mechanism. Do not assume that the 2025 rule converts an existing clause into a fixed-pound amount. Instead, check the index, reference month, calculation method and timing stated in your original terms. If the provider departs from that formula or adds a separate increase, treat the extra amount as a potentially new change.
Ofcom introduced the newer rule after finding that many customers did not understand inflation measures. In survey results from 4,213 UK adults aged 16 and over in January 2023 and 4,232 in October 2023, 55% of broadband customers and 58% of pay-monthly mobile customers said they did not know what CPI and RPI measure.
What if the data allowance changes?
A reduction in gigabytes, removal of rollover data, lower hotspot access or a new speed threshold can materially change the value of a mobile plan. Treat it as a possible change to a contract term, then read the actual plan language and notice. Ofcom’s cited consumer guidance sets a general test rather than a separate automatic rule for every allowance variation.
When an allowance change may be protected
If the provider is changing a term to your disadvantage and the change is not already permitted by the agreement, the general framework points toward at least one month’s notice and a penalty-free exit opportunity. The provider should explain the effective date and how to leave. A reduction that applies only after a promotional period may instead be the end of a benefit that was time-limited from the start.

When you should not assume an automatic exit
Do not promise yourself a free cancellation solely because the allowance changed. The outcome can depend on whether the contract reserved a right to vary allowances, whether the change is genuinely adverse, and whether another term offsets it. A speed upgrade or extra data is generally beneficial; a purely administrative change with no negative effect is treated differently. A legal requirement, such as a tax-rate change, is another stated exception.
Questions to put to the provider
- Which clause authorises the allowance change?
- What was the old allowance and what is the new allowance, including any speed or tethering limits?
- On what date does the change begin?
- Does the provider consider it beneficial, administrative, legally required or subject to a right to exit?
- If it is adverse, how can you cancel without an early-termination charge?
What a proper notice should let you understand
A useful notification should identify the affected service, old and new recurring charges or allowances, the effective date and the contractual basis. For a price rise, it should show the amount in pounds and pence where the 2025 rules apply. It should also explain any cancellation deadline, method and consequences. A message that gives only a new total without the date or an explanation is a reason to ask for clarification, not a reason to ignore the change.
What to do when you receive a change notice
- Save the evidence. Download the email, text, account message and the original contract summary. Note when you received the notice and the date the change is due to start.
- Build a before-and-after comparison. Record the monthly service charge separately from handset finance, insurance, roaming passes and other optional services. Record the allowance in gigabytes and any speed, tethering or rollover conditions.
- Locate the exact clause. Search the full terms for words such as “price change”, “annual increase”, “allowance”, “variation” and “termination”. Compare the provider’s calculation with the wording you accepted.
- Ask for a written explanation. Request the clause, calculation, effective date and the provider’s view of whether the change is beneficial, administrative, legally required or subject to an exit right.
- Decide before the deadline. If a penalty-free exit is offered, follow the stated process within the 30-day or other stated window. Keep the reference number and confirmation. If you remain, check the first bill after the effective date.
- Escalate if necessary. Complain formally if notice was late, the amount exceeds the agreed rise, the allowance was reduced without a clear basis or the exit route is missing.
Complaints and alternative dispute resolution
Ofcom says to complain to the provider first. Explain the problem in one chronology: contract date, original term, notice date, effective date, amount or allowance changed, and the remedy you want. Ask for a final response and keep copies of bills and correspondence.

If the complaint remains unresolved after six weeks, or the provider sends a deadlock letter sooner, Ofcom says you can take it to the provider’s alternative dispute resolution scheme. The scheme can review whether the provider followed its process and contractual obligations. Ofcom itself does not decide individual compensation claims in the same way a dispute-resolution body does.

Should you switch?
If the change makes the plan poor value, compare alternatives before cancelling. Include the complete monthly cost, remaining handset balance, data allowance, network coverage where you use the phone, contract length, roaming terms and cancellation conditions. A cheaper headline tariff may cost more once a device payment or required add-on is included.
Ofcom advises shopping around when a contract ends. If you are still within a minimum term, verify whether the provider has granted a penalty-free exit; otherwise an ordinary cancellation can leave you liable for remaining service or device payments. Do not stop a direct debit until the final bill and cancellation are confirmed.
Why allowance and price changes matter more than they used to
Ofcom’s UK telecoms market data reported average monthly mobile data use rising from 3.4 GB in 2018 to 9.8 GB in 2023. Over the same period, average monthly mobile price excluding handset costs fell from £17.12 in 2018 to £11.51 in 2023, with the figures stated in 2023 prices. A reduction in data can therefore affect a much heavier everyday usage pattern than it would have several years ago, even when the monthly charge appears unchanged.

Worked examples
Fixed increase clearly stated in an older contract
Your pre-17 January 2025 contract says the monthly charge will rise by £3 on a named date. The provider applies exactly £3 and gives the notice required by the agreement. The 2025 ban on inflation-linked rises does not rewrite this older contract; check the clause and ordinary notice requirements.
Provider adds more than the stated amount
Your contract specifies a £2 increase, but the bill rises by £4. Ask for the calculation and challenge the extra £2. Ofcom’s guidance says an increase beyond the stated amount requires at least 30 days’ notice and a 30-day opportunity to exit without penalty.
Data falls from 30 GB to 20 GB
The provider announces a lower allowance but points to no clear term. This is potentially an adverse terms change, yet the cited Ofcom material does not create a universal automatic cancellation right for every allowance reduction. Request the contractual basis, notice details and any penalty-free exit route, then complain if the response is inadequate.

A change directly imposed by law, such as a VAT-rate change, is one of Ofcom’s listed exceptions. The provider should still explain what changed and when, but the ordinary adverse-change exit framework may not apply in the same way.
Common mistakes to avoid
- Applying the 17 January 2025 rule to a contract signed earlier.
- Assuming every annual increase is unlawful without reading the signed clause.
- Treating a data reduction as an automatic free-cancellation event.
- Counting handset finance as if it were the mobile-service price.
- Missing the stated exit deadline while negotiating informally.
- Leaving by cancelling payment before the account is closed and the final bill is settled.
Ofcom’s Director of Telecoms Consumer Protection, Cristina Luna-Esteban, said the newer rules are intended to give customers “key information about the contract they’re signing up to, in a short and simple way.” The practical lesson is to preserve that information, compare it with the notice you receive and challenge any difference promptly.
