What Happens to Your Job if Your Employer’s Green Card Sponsorship Is Suspended?

A paused or withdrawn green-card case does not automatically terminate your job, cancel your immigration status, or end your work authorization. Those are separate questions. The practical result depends on whether your case is still in PERM labor certification, has an I-140 petition, or includes a pending I-485 adjustment application; how long each filing has been pending or approved; what your current work-authorized status permits; and what your employer actually did.

The safest first step is to identify the case stage and preserve every notice before resigning, changing jobs, or assuming you must stop working. The rules below are general information, not a case-specific legal opinion.

Start with the three issues that are often confused

“Green-card sponsorship suspended” is not a single legal event. An employer may pause recruitment, stop a PERM filing, decline to file an I-140, withdraw an already filed petition, terminate the business, or receive a USCIS revocation notice. Each event can affect the immigration case differently, while your employment relationship and your permission to work follow their own rules.

1. The immigration case

The employer’s action may stop or change the permanent-residence process. A pending PERM application, an I-140 immigrant petition, and an I-485 adjustment application are separate filings with different consequences.

2. The job relationship

Immigration guidance does not guarantee continued employment. Whether an employer can end your job, reduce hours, or change duties is generally governed by your employment agreement and applicable federal, state, and local law. The cited immigration sources do not decide wrongful-termination, contract, discrimination, severance, or unemployment questions.

3. Independent work authorization and status

Your ability to work comes from a current status, an employment authorization document (EAD), or another legal basis—not simply from the fact that an employer once sponsored a green card. A sponsorship pause therefore does not by itself tell you whether you may keep working or start with another employer.

Find your case stage before deciding what to do

Stage What exists What an employer’s pause usually means Key timing or job-change issue
PERM pending or not yet certified A Department of Labor permanent labor-certification application The employer may stop pursuing that application. The cited DOL material does not establish that an employee can transfer a pending PERM application to another employer. If certification is approved, DOL says it must be submitted to USCIS with Form I-140 within 180 days or it expires.
I-140 filed or approved, with no qualifying pending I-485 portability An employment-based immigrant petition, either pending or approved Withdrawal, business termination, denial, or revocation can affect the petition. Approval alone does not satisfy the full AC21 job-portability test. For certain withdrawal or termination situations, USCIS describes protection after 180 days since I-140 approval or after the related I-485 has been pending 180 days, subject to other revocation grounds.
I-485 pending at least 180 days An adjustment-of-status application tied to an employment-based petition Eligible applicants may be able to change employers or jobs under AC21 portability, but only if all conditions are met. The new position must be in the same or a similar occupational classification, and category-specific exclusions and filing requirements apply.

Check the receipt notices, approval notices, online case history, and any written withdrawal or revocation notice to determine which row describes you. Do not infer the stage from an email saying “sponsorship is on hold.”

If the case is still in PERM

PERM is the Department of Labor process normally used to obtain certified permanent labor certification before an employer submits an employment-based immigrant petition. DOL describes the ordinary sequence: the employer obtains certification and then submits it to USCIS with Form I-140. A certified labor certification is valid for 180 days for that submission; DOL says it expires if it is not filed with USCIS within that period. See the Department of Labor’s Permanent Labor Certification page.

If the employer pauses a PERM case before certification, there is no approved labor certification for you to carry to a new employer. The official material does not say that a worker can transfer the employer’s pending PERM application. A different employer generally would need to evaluate and pursue its own case, with its own job, recruitment, and filing decisions.

What to preserve at this stage

  • The PERM case number and copies of recruitment and prevailing-wage records that the employer gave you.
  • Any written notice that recruitment, filing, or sponsorship has been paused or withdrawn.
  • Your current nonimmigrant approval notice, passport, I-94 record, and expiration dates.
  • Pay statements and job-duty descriptions, in case your work-authorized status has employer-specific conditions.

A PERM pause may leave your current job unchanged for employment purposes, but it can remove the expected path to permanent residence through that employer. Whether you may remain and work depends on your separate status or authorization.

If an I-140 was filed or approved but your I-485 is not yet portable

An I-140 is the employer’s immigrant petition to USCIS. A pending or approved I-140 is important, but it is not, by itself, a general right to change employers. The portability language in USCIS guidance addresses certain adjustment applicants with an approved employment-based petition whose I-485 has been pending at least 180 days and who meet the same-or-similar job requirement.

USCIS also describes circumstances in which an approved I-140 remains valid after an employer withdraws it or the business terminates. In the beneficiary guidance issued November 11, 2017, USCIS states that the petition remains valid when at least 180 days have passed since approval or the associated I-485 has been pending at least 180 days, unless another revocation ground applies. Read the USCIS AC21 beneficiary guidance for the stated conditions.

That retention rule concerns petition validity. It does not itself grant current work authorization, authorize a new employer, or guarantee approval of an adjustment application. A petition can remain valid while you still need an independent status or EAD to work.

Events that should not be treated as identical

  • Pause: the employer temporarily stops a filing or declines to continue.
  • Written withdrawal: the employer asks USCIS or DOL to withdraw a filing.
  • Business termination: the sponsoring company stops operating or ends the relevant job.
  • Denial: USCIS or DOL refuses a filing.
  • Revocation: USCIS takes action against an approved petition, potentially on grounds other than withdrawal.

The date, document, and stated basis matter. Ask for a copy of any withdrawal or revocation notice rather than relying on an informal description.

If your I-485 has been pending at least 180 days

For qualifying employment-based preference categories, AC21 portability can allow a worker to change employers or jobs after the I-485 has been pending for 180 days or more, provided the new job is in the same or a similar occupational classification and the other requirements are satisfied. USCIS states:

“The portability provisions of the American Competitiveness in the Twenty-First Century Act (AC21) allow certain adjustment applicants with approved employment-based immigrant visa petitions in the 1st, 2nd, and 3rd preference categories to change jobs and employers if the adjustment application has been pending for 180 days or more, provided that the applicant’s new job offer is in the same or similar occupational classification as the job for which the petition was initially filed.”

This is USCIS Policy Manual guidance, not blanket permission to accept any position. The relevant policy is in USCIS Policy Manual, Volume 7, Part A, Chapter 8.

Conditions to check before relying on portability

  • Your employment-based preference category must be one covered by the rule (the cited guidance addresses first, second, and third preference categories).
  • The I-140 must be approved as required by the portability provision.
  • The I-485 must have been pending for at least 180 days; count from the relevant USCIS receipt date and confirm the record.
  • The new permanent job offer must be in the same or a similar occupational classification.
  • You must satisfy any filing and evidentiary steps USCIS requires. USCIS materials identify Form I-485 Supplement J as the mechanism used in the cases addressed by the beneficiary guidance; check the current form instructions.

The USCIS Policy Manual identifies exclusions for extraordinary-ability and national-interest-waiver petitions. Do not assume that an approved petition in one of those categories can use this employer-portability route.

Work authorization is a separate analysis

Determine what currently authorizes you to work: for example, an employer-specific nonimmigrant status, an EAD based on a pending I-485, or another authorization. Review the expiration date and any employer, position, location, or hours limitations. A green-card sponsorship pause does not automatically extend an expiring status or EAD.

H-1B workers

H-1B portability is a different rule from green-card portability. The Department of Labor explains that a qualifying H-1B worker may begin employment with a prospective employer after that employer files a nonfrivolous H-1B petition, subject to the fact sheet’s requirements. Read DOL Fact Sheet #62W, “What is ‘Portability’ and to whom does it apply?”.

That rule does not replace the AC21 analysis for a pending I-485. It also does not apply automatically to every worker or every proposed job. Confirm eligibility, filing timing, maintenance of status, and the duties of the new position with counsel.

Other statuses and EADs

If your authorization is tied to the sponsoring employer, stopping sponsorship may matter only when the underlying status ends or changes; if you hold an EAD with an unexpired validity period, the EAD’s terms and renewal rules control. The documents—not the employer’s phrase “sponsorship suspended”—determine the answer.

A practical response plan

  1. Request the action in writing. Ask whether the employer paused PERM, withdrew a petition, ended the position, or received a USCIS notice. Request copies and effective dates.
  2. Build a timeline. Record PERM filing and certification dates, I-140 filing and approval dates, the I-485 receipt date, any withdrawal or revocation date, and your status and EAD expiration dates.
  3. Separate the three tracks. Note what the employer says about your job, what USCIS or DOL says about the immigration case, and what document currently authorizes your work.
  4. Check portability only after verifying the 180-day facts. Confirm I-485 pendency, I-140 approval, category, and the proposed job’s occupational classification before accepting a new offer.
  5. Do not stop working or resign solely because of a rumor. Verify authorization and employment consequences first. Conversely, do not continue work after an authorization expires without confirming a lawful basis.
  6. Obtain case-specific advice. Take the complete file to a U.S. employment-based immigration attorney before responding to a revocation, changing employers, or signing a withdrawal-related agreement.

Documents an attorney will need

  • All PERM, I-140, and I-485 receipt, approval, request-for-evidence, denial, withdrawal, and revocation notices.
  • Your passport biographic page, visa, I-94, current approval notices, and EAD front and back.
  • Employment agreement, recent pay records, job description, work location, and any termination or leave notice.
  • The proposed new employer’s offer, duties, requirements, location, salary, and occupational classification.
  • Any USCIS online account history and correspondence with the employer’s immigration representative.

Questions readers commonly ask

Can my employer fire me if it stops sponsoring my green card?

The immigration sources do not guarantee continued employment or decide whether a termination is lawful. Your job rights depend on the employment relationship and other applicable law. Separately, determine whether your immigration status or work authorization continues.

Can I change jobs after my I-140 is approved?

Approval alone is not the complete AC21 portability test described by USCIS. The relevant rule generally requires an eligible category, an approved petition, an I-485 pending at least 180 days, and a same-or-similar occupational classification, along with other conditions.

What if my employer withdraws my I-140?

USCIS describes retention after 180 days from I-140 approval or 180 days of related I-485 pendency in the stated circumstances, unless another revocation ground applies. Obtain the actual notice and have counsel assess its basis.

Can I keep working while the green-card case is paused?

There is no categorical answer. Check the status, EAD, expiration date, and employer-specific conditions that independently authorize your work. H-1B portability is available only to qualifying workers meeting its separate requirements.

Can another employer take over my green-card case?

Do not assume a pending PERM transfers. The narrower AC21 adjustment portability rule may apply after the required I-485 pendency and job-match conditions are met. Case documents and category determine whether it is available.

When to obtain legal help immediately

Contact a U.S. employment-based immigration attorney promptly if you receive an I-140 withdrawal or revocation notice, your I-485 has been pending near or beyond 180 days, your employer is terminating your position, your status or EAD is near expiration, or you are considering a new job. Bring the timeline and documents listed above. A consultation cannot guarantee eligibility or an outcome, but it can prevent an irreversible filing or work-authorization mistake.

The central point is narrow but important: suspension of sponsorship is an event in an immigration process, not an automatic order ending your job or work authorization. Your result turns on the exact filing stage, statutory timing, job comparison, employer action, and independent authorization shown in your records.
