It depends on what the employer withdrew and which 180-day deadline your case has reached. For an approved employment-based Form I-140, withdrawal during the first 180 days after approval generally causes automatic revocation unless the related Form I-485 has already been pending for at least 180 days. After the I-140 has been approved for 180 days, or after the I-485 has been pending for 180 days in the circumstances covered by the rule, withdrawal alone generally does not revoke the approved petition.
That protection does not keep the original job offer alive. The offer is treated as withdrawn. If your I-485 has been pending at least 180 days, you may be able to use AC21 portability for a new job in the same or similar occupational classification. These are general U.S. employment-based immigration rules; your category, notices, exact dates and any separate revocation issue can change the result.

First identify what “sponsorship” was withdrawn
People use “employer sponsorship” to describe several different parts of the employment-based green-card process. They do not have identical consequences.

- Pending Form I-140: the employer can withdraw the petition before USCIS approves it. A petition that is never approved normally does not provide an approved I-140 priority date or an independent basis for adjustment.
- Approved Form I-140: this is where the federal 180-day revocation rule and the related I-485 exception matter.
- The job offer only: an employer may stop offering the position even when the approved I-140 is protected from withdrawal-based revocation. The petition and the job offer are separate issues.
The rules described below concern employment-based preference petitions and adjustment of status. They do not establish the result for family-based, diversity-visa, humanitarian or every other green-card category.

The two 180-day clocks you must track
There are two separate dates. Confusing them is a common source of mistakes.
| Clock | What it measures | Why it matters |
|---|---|---|
| I-140 approval clock | 180 days from the date USCIS approved the employment-based I-140 | Withdrawal during this period generally triggers automatic revocation, subject to the I-485 exception. |
| I-485 pendency clock | 180 days since USCIS received the related adjustment-of-status application | It can protect an approved I-140 from withdrawal-based revocation in the specified circumstance and can make AC21 portability available. |
Use the approval notice for the I-140 date and the I-485 receipt notice for the filing date. Do not substitute the date the employer signed a withdrawal letter, the date you received a notice, or the date your visa priority date became current. Have an immigration professional calculate the deadlines from the actual records.
What happens to an approved I-140?
Withdrawal before the applicable 180-day protection
Under 8 CFR § 205.1, written withdrawal of an approved employment-based preference petition within 180 days of approval generally results in automatic revocation, unless an associated I-485 has been pending for 180 days or more. USCIS summarizes the rule in its Employment-Based Adjustment of Status FAQs.

If you have not filed an I-485, or it has been pending for less than 180 days, USCIS generally says you need a different Form I-140 filed and approved to continue adjustment in the covered employment-based first, second or third preference categories. Keeping a priority date from an earlier approved petition does not, by itself, preserve the withdrawn employer’s job offer or qualify you for adjustment.
Withdrawal after the I-140 has been approved for 180 days
Once the applicable approval-duration threshold has been reached, USCIS says the petitioner may request withdrawal, but withdrawal alone generally does not revoke the approved I-140. The beneficiary retains the petition’s priority date. USCIS states that “The petitioner may request to withdraw a Form I-140 at any time,” while explaining that the timing determines whether withdrawal causes automatic revocation.
Retaining the approved petition and priority date is not the same as retaining employment. The original employer’s offer is considered withdrawn. You still need a qualifying employment basis, an available immigrant visa and satisfaction of the other adjustment requirements. A retained priority date also does not guarantee that a visa number is immediately available under the Department of State Visa Bulletin.

Withdrawal when the I-485 has been pending at least 180 days
An associated I-485 that has been pending for at least 180 days can provide the exception to withdrawal-based automatic revocation described in the regulation and USCIS guidance. The I-140 may remain approved, with its priority date, even though the sponsoring employer has withdrawn the offer.
This does not automatically approve the I-485. USCIS can still examine admissibility, visa availability, the validity of the original petition and any other statutory or regulatory requirement. Separate grounds such as fraud, willful misrepresentation, ineligibility for the classification or other revocation bases are not erased by the passage of 180 days.
Case outcomes at a glance
| Case posture when the employer withdraws | General consequence |
|---|---|
| Approved I-140 withdrawn before 180 days; no I-485 or I-485 pending less than 180 days | Automatic revocation generally applies. A different approved I-140 is generally needed to continue in the covered employment-based categories. |
| Approved I-140 has reached 180 days, or the associated I-485 has been pending at least 180 days in the covered circumstance | Withdrawal alone generally does not revoke the I-140. The priority date is retained, but the job offer is treated as withdrawn. |
| I-485 pending at least 180 days and a new offer is in the same or similar occupational classification | An eligible applicant may request AC21 portability with Form I-485 Supplement J. Category and other eligibility limits apply. |
| Labor certification or a pending I-140 withdrawn before approval | The underlying filing generally cannot support the green-card case as an approved petition; a new labor-certification and/or I-140 strategy may be required. |
Can you change employers and keep the pending I-485?
Possibly, through AC21 portability. The portability provisions allow certain employment-based adjustment applicants to move to a new employer or job after the I-485 has been pending for at least 180 days, provided the new position is in the same or a similar occupational classification. The applicant and prospective employer generally submit Form I-485 Supplement J to confirm the continuing job offer or portability request.

What “same or similar” means in practice
USCIS compares the occupational classification of the original and new positions. Relevant evidence can include duties, required skills, education, experience, wages, industry and occupational codes. The new position does not have to be identical, but a substantially different occupation can defeat portability. Preserve job descriptions, offer letters, pay information and any evidence that explains the relationship between the roles.
Categories with portability limits
USCIS guidance in the Policy Manual chapter on transfer of underlying basis explains that portability is not available to applicants whose approved petitions are for extraordinary ability or a national interest waiver. Do not treat 180 days as a universal right to change jobs in every employment-based category.

What Supplement J does and does not do
Supplement J documents the qualifying job offer or a portability request; it is not an automatic approval of the I-485. USCIS can request evidence or determine that the new position is not sufficiently similar. Submit the form when required by the filing posture and keep copies of the receipt and supporting evidence.

Timeline examples
Example 1: early withdrawal with no 180-day protection
Suppose USCIS approves an I-140 on January 10 and the employer withdraws it on April 20. If the I-485 was not filed, or has been pending fewer than 180 days, the withdrawal generally falls inside the revocation period. The approved petition may be automatically revoked, and a new approved I-140 is generally needed for the covered employment-based adjustment path.
Example 2: I-140 approval has passed 180 days
If the same I-140 was approved more than 180 days before the withdrawal, withdrawal alone generally does not revoke the petition. The priority date remains with the beneficiary, but the original job offer no longer supports the case. You may need a qualifying new offer, a new petition or another lawful basis to complete adjustment.
Example 3: I-485 has passed 180 days
If the I-485 receipt date is at least 180 days before the employer’s withdrawal and the new position is in the same or similar occupational classification, an eligible applicant may request AC21 portability through Supplement J. The I-140, category and all other adjustment requirements still matter.
What the withdrawal does not guarantee
- No guaranteed green card: retention of an I-140 or priority date does not promise adjustment approval.
- No automatic lawful status: an approved I-140 is not, by itself, nonimmigrant status or permission to remain in the United States.
- No automatic work authorization or travel permission: an EAD or advance-parole document and its underlying I-485 have their own requirements. Do not assume they remain usable without checking your notices and current eligibility.
- No immunity from other revocation grounds: the 180-day protections address withdrawal-based revocation, not fraud, misrepresentation, invalid labor certification, ineligibility or other statutory grounds.
- No universal rule for every green-card category: the cited provisions concern employment-based preference cases and adjustment of status.
What to do after learning of the withdrawal
- Obtain the written record. Ask for the employer’s withdrawal notice, any USCIS notice, the I-140 approval notice and the I-485 receipt notice. Determine whether the withdrawal concerned PERM, a pending I-140, an approved I-140 or only the job offer.
- Build a date worksheet. Record the I-140 approval date, I-485 receipt date, withdrawal date, priority date and visa-bulletin availability. Calculate the I-140 and I-485 180-day clocks separately.
- Confirm the classification. Identify whether the case is EB-1, EB-2, EB-3 or another employment-based category, and whether the petition was based on extraordinary ability or a national interest waiver. Portability rules differ.
- Protect evidence about the new job. Keep the offer letter, duties, salary, location, organizational information and documentation showing why the new position is the same as or similar to the original occupation.
- Evaluate Supplement J and a new petition. An attorney can determine whether AC21 portability is available, whether Supplement J should be filed, and whether a new employer must file an I-140.
- Respond to USCIS notices on time. A notice of intent to revoke, request for evidence or denial has its own deadline. Missing it can cause a result independent of the employer’s withdrawal.
- Get individualized legal advice. Have a qualified U.S. immigration attorney review the actual notices and receipt dates before changing jobs, withdrawing a filing or relying on an EAD, advance parole or pending adjustment application.
How to think about your priority date
When USCIS allows an approved I-140 to remain valid after a withdrawal-based event, the beneficiary generally keeps the petition’s priority date. That date can be valuable for visa-number availability, but it is not a substitute for a valid job offer, a qualifying portability filing or an approved petition where one is required. Check the visa bulletin and the category-specific rules rather than treating the priority date as a standalone green-card entitlement.
Bottom line for the three common questions
- What happens if my employer withdraws my I-140? If the approved petition is withdrawn before the applicable 180-day protection, automatic revocation generally follows. After the threshold, withdrawal alone generally does not revoke it, but the job offer is gone.
- Do I keep my priority date? USCIS says a beneficiary generally retains the priority date when the approved I-140 has reached the applicable protection. A withdrawn or never-approved petition does not provide the same protection.
- Can I change jobs after my I-485 has been pending 180 days? An eligible applicant may use AC21 portability for a same-or-similar occupation through Supplement J, subject to category limits and every other adjustment requirement.
Because a single day, petition category or notice can change the analysis, base any decision on the exact USCIS record rather than on the word “sponsorship” alone.
