What Happens to Your Crypto If a Custodian or Crypto Bank Fails?

Your crypto is not automatically protected if the company holding it fails. FDIC insurance covers eligible deposits at insured banks, not cryptocurrency. If a custodian becomes insolvent, access and recovery depend on the custody agreement, asset records, how the assets were held, applicable law, and decisions by a court or receiver. Even customers who ultimately have a valid claim to assets may face delays.

Is crypto FDIC insured?

No. FDIC insurance applies to eligible deposits at insured banks; it does not insure crypto assets or reimburse customers when a nonbank exchange, custodian, broker, wallet provider, or neobank fails. The FDIC states that deposit insurance does not protect against the default, insolvency, or bankruptcy of a nonbank crypto company: FDIC fact sheet.

The FDIC has described coverage of up to at least $250,000 per depositor at an insured bank, subject to ownership categories and other rules. That figure is a deposit-insurance limit, not a crypto-insurance amount: FDIC press release.

Cash held through a crypto service

A crypto company may say it works with a bank or that customer cash is held at a bank. That alone does not establish that your particular balance is an eligible insured deposit. Identify the bank, the legal depositor, the account type, and whether the funds are actually held as an eligible deposit at the insured institution. Do not assume that deposit coverage follows cryptocurrency through an exchange or custodian.

What happens if a crypto custodian goes bankrupt?

There is no single outcome. In a U.S. bankruptcy, the estate generally includes the debtor’s legal or equitable interests in property, but that general rule does not by itself decide who owns specific crypto held under a custody arrangement. The customer’s agreement, the custodian’s records and practices, the legal entities involved, and applicable law all matter.

A 2026 SEC-filed disclosure warns that contractual protections and customer rights to digital assets held by a custodian remain relatively untested in bankruptcy or receivership, so outcomes can be fact-specific. A court might treat customer assets as estate property, potentially leaving customers as general unsecured creditors exposed to a total loss or markdown. Even if assets are excluded from the estate, an automatic stay and related proceedings may delay or prevent their return: SEC-filed disclosure.

Does a crypto bank or bank custodian change the answer?

The word “bank” does not make crypto an insured deposit. A deposit account and cryptocurrency held in a safekeeping arrangement are different kinds of assets. If an insured bank fails, eligible deposits may receive FDIC protection under applicable rules; crypto held in custody is not covered by that protection.

U.S. banking agencies describe risk-management considerations for banks that hold crypto on customers’ behalf. The agencies’ July 14, 2025 statement says it does not create new supervisory expectations: joint agency statement. The OCC has also said national banks and federal savings associations may conduct certain crypto custody and execution activities, including through outsourcing, subject to applicable law, safe-and-sound operation, and appropriate third-party risk management: OCC announcement. Bank regulation and risk controls do not convert custodial crypto into an insured deposit.

What determines whether customers can recover crypto?

These details can shape a legal analysis, but none guarantees a particular bankruptcy result:

  • Legal entity and jurisdiction: Find the entity named in your agreement and where it is organized. A service’s brand name may not identify the entity that holds the assets or owes you an obligation.
  • Ownership and account structure: Read whether the agreement describes the assets as customer property, a security entitlement, or a claim against the intermediary. The legal characterization and applicable law matter.
  • Segregation and records: Check whether customer assets are kept separately, how balances are reconciled, and what records document your holdings. Segregation can help establish what belongs to customers, but is not a promise of return.
  • Lending, liens, and setoff: Look for permission to lend, pledge, rehypothecate, or otherwise use assets, and for rights to liens or setoff. These terms can affect what assets remain available and what claims may arise.
  • Sub-custodians and operational control: Determine whether another provider holds the keys or assets, who can authorize withdrawals, and what happens if access is suspended.
  • Proof and recovery process: Check what evidence may be needed to assert ownership or a claim and how account access or keys are handled after an operational failure.

How to check your exposure before a failure

  1. Identify the actual provider. Find the full legal entity in your account agreement, not just the app or brand name. Check whether it is an insured bank or a nonbank service provider.
  2. Separate cash from crypto. Review where cash balances are held and what kind of account they represent. A bank logo, partnership, or “bank-backed” claim does not by itself prove FDIC coverage.
  3. Read the custody terms. Look for ownership, segregation, commingling, lending, liens, setoff, rehypothecation, and sub-custody provisions.
  4. Keep evidence of your holdings. Save account statements, transaction records, and copies of the agreement so you can document balances and the terms that applied.
  5. Assess who controls the keys. Determine whether you can withdraw directly or rely on the provider or another custodian to authorize transactions.

Would self-custody avoid the risk?

Self-custody changes who controls the private keys; it does not insure crypto against loss. A hardware wallet is a physical key-management device: the crypto remains recorded on-chain, while the keys enable access and transactions. Recovery depends on keeping keys and backups secure. Losing or exposing recovery information creates separate risks, and moving to self-custody cannot resolve a claim already caught up in a custodian’s insolvency. See this hardware wallet explanation for the basic distinction.

Before moving assets, understand how the wallet and recovery phrase work and make a backup plan you can safely maintain. Self-custody replaces reliance on a custodian with responsibility for key security and recovery.
