Usually, your broadband contract does not end when another company buys your provider. Ofcom says the service will generally continue and the existing contract should normally transfer to the new owner. A separate change to your contract terms is different: if the change disadvantages you, your provider must normally give at least one month’s notice and let you leave without an early termination charge, subject to specific exceptions.
A network change also does not automatically mean you have switched provider or need a new contract. Ask whether your existing service is being migrated under the same arrangement, whether terms are changing, or whether you are being asked to place a new order.

Takeover, contract change and network migration are different events
Three situations are often confused:
- Ownership takeover: another company acquires the provider or its customer business. Ofcom’s guidance says the existing service usually continues and the contract should generally transfer.
- Contract-term change: the provider changes a price, minimum term, service feature, usage rule or another contractual provision. This can trigger notice and exit rights.
- Network migration: the service is supplied over a different wholesale network. That may happen behind the scenes under your existing contract, or it may involve a new order and new terms.
An acquisition announcement alone does not prove that your individual contract has changed. Read the notice sent to you and compare it with your contract before deciding whether you can leave without charges.
What normally happens when a broadband provider is bought?
Ofcom’s consumer guidance, “What to do if your broadband or landline provider goes out of business” (published 13 February 2026 and updated 15 September 2026), says that when another company takes over a provider’s service, customers will usually continue receiving service and their existing contract should generally transfer.

That normally means you do not need to sign a replacement agreement merely because the corporate owner changes. The practical details can change, however. The new owner may update branding, customer-service channels, billing systems or account terms later, provided it follows the rules that apply to those changes.
What a takeover does not automatically give you
- It does not automatically cancel your minimum term.
- It does not automatically create a penalty-free right to leave.
- It does not automatically require a new router, modem or engineer visit.
- It does not prove that your price or other terms have changed.
If you want to leave solely because ownership changed, check your minimum-term position and any early termination charge first. A charge-free exit generally depends on a qualifying change to your contract terms, not on the acquisition itself.
The October 2026 TalkTalk announcement: what Ofcom actually said
On 5 October 2026, Ofcom published advice after BT Group announced that it would acquire TalkTalk Group. Ofcom said TalkTalk customers remained TalkTalk customers and that there would be no immediate change to price, contract or access to billing. It said customers should be able to continue using their landline, broadband and pay-TV services during and after the transition, and that BT would contact affected customers if anything changed in future.

That was advice about the announced transaction at that date. It was not confirmation that every acquisition has identical terms, and an announcement should not be treated as proof that the acquisition has completed. Ofcom’s wording for this case was: “There will be no change to your price, contract or how you access billing.” Apply that statement only to the TalkTalk announcement and the circumstances Ofcom described.
When a contract change gives you a right to leave
Ofcom’s “Contracts” guidance (published 24 July 2023 and updated 1 May 2026) says phone and broadband providers can change contract terms, but must normally provide at least one month’s notice and a right to exit without penalty when the change does not benefit you.

The notice should identify what is changing and when it takes effect. Keep the message, the date it arrived and the relevant contract version. Those details matter if you later dispute an early termination charge.
Exceptions to the usual penalty-free exit rule
Ofcom identifies three main exceptions:
- The change is exclusively to your benefit.
- The change is purely administrative and has no negative effect on you.
- The change is directly imposed by law.
For example, a correction to an administrative record that does not affect your service is not the same as a price increase or a reduction in an included allowance. The exact wording and effect of the proposed change determine whether the exit right applies.
If the notice is unclear or missing
Ask the provider to state, in writing, whether it considers the message a contract variation, what clause permits it, the effective date and whether it will waive an early termination charge. If you believe the notice was late, incomplete or unfair, use the provider’s formal complaints process. Ofcom advises contacting the provider and making a complaint when terms appear unfair or unclear.
Does a change of network mean you have a new contract?
Not necessarily. A provider can migrate your line from one wholesale network to another while continuing to manage your account under the existing retail contract. In that case, the network operator has changed but your contracting provider, price and minimum term may remain the same.
In another situation, the provider may ask you to accept a new product, place a new order or move to a different company. That is a customer switch and should be assessed as such. Do not infer the answer from a new cable, street cabinet or router message; ask the provider what legal and commercial arrangement applies to your account.

Questions to ask before agreeing to a migration
- Is this migration covered by my current contract, or am I entering a new agreement?
- Will my price, speed, data allowance, phone service, television service or minimum term change?
- What is the effective date, and how much notice am I receiving?
- Will my existing router work, and who supplies replacement equipment if it does not?
- Will an engineer visit or an appointment be required?
- If I decline, will my current service continue, and for how long?
- If I leave, will the provider charge an early termination fee?
Request the answers by email or in a letter. A sales call summary is harder to rely on if there is a later disagreement.
Do these 3 things before closing this tab:
1Repair Windows errors before they cause bigger problems2Scan for outdated or missing drivers - takes under a minute3Clear out junk files and repair common Windows errorsWhat happens if you decide to switch provider or network?
Ofcom’s “Switching broadband provider” guidance (published 4 August 2010 and updated 25 August 2026) says to check whether you are in or out of contract. Switching before the minimum period ends may result in early termination charges.
For a move to a different network, the new provider should explain whether you need an engineer visit, new equipment or other setup work. Do not buy a replacement router in advance unless the new provider confirms compatibility and tells you to do so.
One Touch Switch
Under Ofcom’s One Touch Switch process, you contact the provider you want to join rather than arranging the cancellation separately first. The switching provider should obtain the information needed to progress the move, and Ofcom’s guide says customers using the process should be told about applicable charges before switching.
Read that charge information carefully. A penalty-free exit right caused by a qualifying contract change is different from a normal switch during a minimum term. The first may remove an early termination fee; the second may not.

Stay or leave: compare the two practical paths
| Question | Stay with the continuing service | Leave or switch |
|---|---|---|
| Contract basis | Confirm that the existing contract transfers and identify any later variation. | Confirm whether a qualifying disadvantageous change gives you a penalty-free exit. |
| Charges | Check whether the price or other recurring charges change. | Check early termination charges, outstanding equipment obligations and any destination-provider setup charges. |
| Continuity | Ask whether broadband, landline and any bundled services remain active during migration. | Confirm the installation or activation date and what happens if the new service is delayed. |
| Terms | Keep the current contract and all takeover notices. | Read the new provider’s minimum term, speed promise, usage rules and cancellation terms before ordering. |
| Equipment | Wait for instructions; a takeover alone does not establish that new hardware is needed. | Ask whether a compatible router, optical network terminal, modem or engineer appointment is supplied or required. |
A step-by-step checklist when you receive a takeover or migration notice
- Save the notice. Record the sender, date received, proposed effective date and every stated change.
- Identify the event. Decide whether the message describes ownership transfer, a contract variation, a network migration or a new customer order.
- Compare terms. Check price, minimum term, speed, allowances, phone and television elements, equipment obligations and cancellation wording against your contract.
- Check your minimum-term end date. If you are considering a normal switch, calculate whether the current term has ended and ask for the exact early termination amount if it has not.
- Ask targeted questions. Use the questions above and request written answers, especially about whether your existing agreement continues.
- Decide whether an Ofcom exit right applies. A disadvantageous term change with proper notice may qualify; ownership change alone does not establish that it does.
- Plan continuity. If moving network, confirm installation, equipment and the process for returning old equipment before cancelling anything.
- Keep evidence. Retain contracts, notices, chat transcripts, bills, complaint references and promised fee waivers.
Common mistakes and how to avoid them
Assuming the acquisition cancels the contract
Most takeovers are structured so customers continue receiving service. Cancelling on that assumption can leave you liable for charges or without a confirmed replacement service.
Treating every network change as a contract variation
A wholesale migration can occur without changing your retail agreement. Establish what has changed for you, not just which infrastructure carries the signal.
Buying hardware before receiving instructions
Equipment requirements depend on the destination network and service design. Wait for the provider’s compatibility and installation instructions.
Confusing a penalty-free exit with an ordinary switch
One Touch Switch makes changing provider easier, but it does not by itself erase a minimum-term charge. Confirm the contractual reason for leaving and the amount disclosed before the switch.
Relying on a general announcement
A company-wide statement may not describe your product, region or contract. Your individual notice and agreement control the practical answer.
Best Value
How to challenge an unexpected charge or disputed change
First, ask the provider to identify the contract clause, notice date and calculation behind the charge. Explain why you believe the change was not properly notified, had a negative effect or should qualify for penalty-free exit. Attach the notice and keep the complaint reference.
If the provider does not resolve the issue through its complaints process, follow the escalation route given in its complaints code, including any applicable alternative dispute-resolution scheme. Keep paying undisputed bills while the complaint is considered, unless the provider gives different written instructions; withholding unrelated payments can create a separate arrears problem.
What the evidence does—and does not—establish
Ofcom’s published guidance supports a general expectation that a takeover will not interrupt service and that the existing contract will generally transfer. It also sets out notice and exit protections for qualifying contract-term changes, plus practical switching guidance. It does not provide a market-wide statistic showing how often contracts transfer after acquisitions, and the TalkTalk example is an announcement-specific case rather than such a statistic.
